SUBJECT: Case No. WA-98-11 / FHP Construction
DATE: March 30, 1998
Case No. WA-98-11, an application by FHP Construction, for a 10% administrative variance to
the 30' side yard setback requirement, to allow the existence of a commercial structure. The
property is zone Planned Commercial Development and located at 3470 Wadsworth Boulevard.
Pursuant to Section 26-6(2)(a) of the Wheat Ridge Code of Laws, the zoning administrator is
empowered to decide upon applications for minor variances as long as:
1. The variance does not exceed 10% of the maximum standard;
2. The zoning administrator finds that the "findings of fact," as set forth in subsection (2)(c),
are substantially complied with and support the request;
3. No protests have been received during such ten-day period;
4. That no additional dwelling units would result from approval of such variance.
This case first surfaced after the applicant, who had a professional survey pin survey performed
for the development of the site, noticed that the proposed structure was too close to the southern
property line. Because the southern property line is a public right-of-way, any structure which
with a side yard abutting a public right-of-way must retain a 30' side yard setback from property
line. After finding the design flaw, the applicant applied for the administrative application in
hopes of rectifying the situation.
We have not received any letters or phone calls in opposition of this case.
Therefore, staff recommends approval of Case No. WA-98-11. All requirements of Section 26-
6(2)(a) of the Wheat Ridge Code of Laws have been met and the findings of fact support
approval.

This is to inform you that Case No. WA-98-11, a request for an 1' 8" sideyard
setback variance to the 30' sideyard setback requirements in a Planned
Commercial District for property located at 3470 Wadsworth Boulevard has been
submitted to the City for administrative approval.
The applicant is requesting an administrative variance review which allows no
more than a ten percent (10%) variance to be granted by the Zoning
Administrator without need for a public hearing. Prior to the rendering of a
decision, all adjacent property owners are required to be notified of the request by
certified mail.
All comments and concerns are to be submitted to the Planning Department no
later than Friday, March 27, 1998 (10 days after mail out of letters) in order to be
considered by the Zoning Administrator.
