This is a request for an administrative variance to allow a 10% increase in lot area coverage for a
structure to be built at 3869 Union Court. If approved, the proposed structure will cover 3,491.6
square feet of the property.
The applicant has proposed to build a 3,491.5 square foot single-story residence upon a 12,697
square foot property. It has been the applicant's intent to construct a single-story structure
mainly for convenience, and believes that the single-story structure will benefit the adjacent
property owners in that it will not obstruct any views of the nearby foothills.
Pursuant to Section 26-6 (2) of the Wheat Ridge Code of Laws, " the zoning administrator is
empowered to decide upon applications for minor variances or waivers from the strict application
of any of the `development and use regulations' of this zoning ordinance... under the following
conditions:
1. The variance or waiver does not exceed 10 percent of the minimum or maximum
standard.
2. That the zoning administrator finds that the `findings of facts' as set forth in subsection
(2)(c) hereof, are substantially complied with and support the request.
3. The zoning administrator has notified adjacent property owners by letter of notice and
posting of the site at least 10 days prior to rendering his decision, and that no protests
have been received during such ten-day period.
4. That no additional dwelling units would result from approval of such variance or waiver."
It is staffs conclusion that, through review of the "facts of findings" and the 10 day notification
of the property owner, that the above request complies with all of the administrative
requirements and that a recommendation for APPROVAL of Case No. WA-98-25 should be

This is to inform you that Case No. WA-98-25 a request for an administrative
variance to increase the lot coverage requirement from 25% to 27.5% for the
development of a new home at the property located at 3869 Union Court has been
received by the Department of Planning and Development.
The applicant is requesting an administrative variance review which allows no
more than a ten percent (10%) variance to be granted by the Zoning Administrator
without need for a public hearing. Prior to the rendering of a decision, all adjacent
property owners are required to be notified of the request by certified mail.
If you have any questions, or would like to submit comments concerning this
request, please contact the Planning Division at 235-2846 by 12:00 p.m. September
8, 1998.
