Gault, which is a request for an increase in lot coverage from 25% to 27.5% for the construction of a new home at 3231 Oak Street. Pursuant to Section 26-6 (D)(2)(a) of the Wheat Ridge Code of Laws, the Zoning Administrator is empowered to decide upon application for a waiver from the lot coverage since the following conditions apply: 1. The variance does not exceed ten (10) percent of the minimum or maximum standard. 2. That the Zoning Administrator finds that the "findings of fact," as set forth in subsection (2)(c), are substantially complied with and support the request. 3. The Zoning Administrator has not received objections to the project after noticing and posting of the site for ten days. 4. No additional dwelling units would result from this approval. The Gault's request for a ten percent variance from the lot coverage meets all applicable conditions as required by Section 26-6(D)(2)(a) of the City of Wheat Ridge Code of Laws. The home as proposed will be built with many ADA specifications which, in general, yields a larger home. The only response received by staff, was in favor of the variance. The lot size is 13,952 square feet. The house, as designed, will be 3,117 square feet on the main level with a 725 square foot garage, totaling 3,842 square feet which is approximately 27.5% of the lot. Due to the need for a handicap accessible house, the area required to accommodate a wheel chair has exceeded the allowance. The house provides wider than standard hallways (minimum of 4'-0" wide) explicitly to accommodate a wheelchair and ample space in the garage to accommodate a wheelchair ramp. To comply with requirements of the Department Veterans Affairs, the need for a separate handicap accessible bathroom and a larger second main floor bedroom have also increased the overall area of the house. In addition, all services (i.e. Laundry Room, Office and Storage) are located on the main level to allow for total access in the house by wheel chair. The above listed items do not impose on or cause detriment to the neighboring properties nor do they endanger public safety or affect the surrounding property values.
