If you may recall, during the meeting it was found that the current location of your storage shed is illegal and could pose as a potential traffic hazard as the property owner to the west tries to pull out onto West 29`h Avenue. During the January 28`h meeting, the Board granted an approval to allow for the storage shed to remain in the front of the property, but at a location closer to the house. Therefore, based on the approval of your variance, you are required to remove the storage shed from it's existing location and relocate it to the location for which you submitted within your variance request. The City of Wheat Ridge will grant you another 30 days to comply with this request. However, if the shed is not relocated by April 2, 1999, the Planning and Development Department will have to undertake Code Enforcement action to rectify the situation. Case No. WA-98-32: An application by Curtis Krey for approval of a 5' variance from the 5' side yard setback requirement and an 8.5' variance from the 30' front yard setback requirement for the purpose of an 8' x 10' storage shed. Said property is zoned R-2 and located at 7110 West 29th Avenue. This case was presented by Barbara Delgadillo. She reviewed the staff report and stated that this is Mr. Krey's second request to locate a small shed on his property which he plans to use for storage of his bicycle trailer. (His first request for a 20' front yard setback variance and 4' side yard setback variance was denied on October 22, 1998 because the shed would be locates within the sight triangle.) Ms. Delgadillo referred to a letter submitted by Mr. Krey's physician which explained that Mr. Krey has severe arthritis which is managed through medication and an exercise program which includes bicycle riding. Ms. Delgadillo presented slides and overhead projections of the subject property, entered all pertinent documents into the record and advised that there was jurisdiction for the Board to hear the case. Curtis Krey 7110 West 29th Avenue Mr. Krey stated that, since his first request was denied, he determined that he could move the shed from the front yard to the side of his house and still accomplish the purpose of storing his bicycle trailer. Board Member ECHELMEYER suggested that Mr. Krey transport his bicycle with a bumper carrier for his automobile. Mr. Krey replied that, due to his arthritis, he was unable to maneuver his bicycle onto an automobile rack and that his wife was unable to do it by herself. In response to a question from Board Member ABBOTT, Mr. Krey stated that, if his request were approved, he planned to paint the shed to match his house and have some concrete poured to extend his driveway which would allow him to back his car up to the shed to attach the trailer. Mr. Krey also stated that his neighbor had no objection to his request. Board Member ECHELMEYER expressed concern about having a shed in the front of the property and suggested that the height of the shed be lowered. Board Member WALKER asked Mr. Krey if the shed contractor, who erroneously informed him that the shed could be placed in its present position, was going to move the shed to the new location without cost. Mr. Krey replied that his son would move the shed for him. Mr. Krey stated that when the time comes that he no longer has a need to ride his bicycle, he would be agreeable to selling the shed and having it removed from his property. Board of Adjustment Page 2 01/28/99 Board Member-HOWARD asked if this situation could be addressed by a temporary use permit (TUP). Mr. McCartney replied that this would necessitate annual hearings for renewal. Board Member THIESSEN asked Mr. Krey if he had considered parking the trailer in the garage and leaving his car in the driveway. Mr. Krey responded that this would not be satisfactory during the winter months. The applicant will agree that the fire department or the City shall not be deemed liable if the shed would impair access to the back yard. During discussion of the possibility of a temporary use permit, Mr. McCartney suggested using the City's electronic tracking system to alert the staff on a yearly basis to check the ownership of the property rather than going through the temporary use permit process every year. Board Member THIESSEN stated that she would not support the motion for any other reason than that this particular variance will accommodate a person with a disability and that it will not be a permanent situation. Board Member ABBOTT moved and Board Member JUNKER seconded to amend the motion to reword condition 1 as follows: This variance will no longer apply when the applicant loses title to the property or when the applicant no longer has use for the bicycle and that staff will monitor compliance with conditions of the variance on an annual basis by means of the electronic calendar and tracking system used to monitor temporary use permits. The motion passed, as amended, by a vote of 6-1, with Board Member ECHELMEYER voting no and Board Member HOVLAND absent. Chair MAURO advised the applicant that his request had been approved. B. I. REQUEST The applicant, Curtis Krey, is requesting approval of an 8-1/2' front yard setback variance from the 30' front yard setback requirement and a 5' side yard setback variance from the 5' side yard setback requirement to allow an 8' x 10' storage shed. If approved by the Board, the storage shed will be located 21-1/2' from the front property line and will be located on the west side property line leaving no side yard setback. This is the second request of Mr. Krey to locate a small shed on his property. On October 22, 1998, the Board denied his request for a 20' front yard setback variance and 4' side yard setback variance. The Board's reason for denial was based primarily on the fact that the requested front yard setback would cause the storage shed to be located within the sight-triangle for his property as well as the property to the west. Based on the Board's decision, Mr. Krey has resubmitted his application locating the shed on the west side of the property in lieu of the front of his property. As the Board is aware, Mr. Krey hired a contractor to build the shed on his property. The contractor and Mr. Krey were unaware that a building permit was required and that minimum setback requirements had to be preserved. Because of this misunderstanding, the shed was built and placed within the required setbacks. The applicant has rheumatoid arthritis and has been a patient in the rheumatology clinic for a number of years. The applicant's doctor submitted a letter (see attached) that explains that the applicant has severe ankle pain and manages his arthritis through medications and an exercise program which includes bicycle riding. In an attempt to park and lock up his bicycle trailer, Mr. Krey is desiring the use of a small storage shed. The shed allows not only the parking of the trailer, but also allows Mr. Krey to back up his vehicle to the bike trailer rather than trying to physically move the bike trailer (which he is unable to do without great pain). His single-car garage will not accommodate the bike trailer nor is there sufficient area to expand the size of the garage removing these as options for Mr. Krey. To date, staff has received no objections to the request or complaints from the surrounding neighbors II. SITE PLAN The property in question is a rectangular property located in a relatively flat section of Wheat Ridge. The property abuts West 291h Avenue (on the north side of the property) and is considered an interior lot (no other right-of-way abuts the side or rear lot lines). Therefore, there is no access to the rear property by a vehicle. The property in question, is a two-family (duplex) residential structure located approximately 30' from the front property line. Each unit has a single-car garage located on the sides of the structure leaving just over the required side yard setback. Board of Adjustment Page 2 WA-98-32/Krey d-0-~, III. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? Yes. If the request is denied, the applicant may continue to use his property for residential purposes. 2. Is the plight of the owner due to unique circumstances? Yes. The plight of the owner is due to his medical condition which has caused a need for him to access a bicycle trailer with his vehicle and the need to store the trailer to keep it safe from theft as well as environmental conditions. 3. If the variation were granted, would it alter the essential character of the locality? No. Although we are not aware of any other sheds with non-conforming setbacks in the neighborhood, this shed would not alter the essential character of the locality or diminish from the surrounding character either visually or through its use and location. 4. Would the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? Yes. The physical location of the residence on the property does not allow for a shed either in the front or the side of the residence without encroaching into the setbacks. Because of the uniqueness of the situation in relationship to the medical condition of the applicant, it is critical that the applicant be able to access his bicycle trailer with his vehicle from either the side or front yard. Therefore, a physical hardship is created by the current location of the residential structure. Most residential structures are physically located in a way in which a small shed of this nature could be located in the side yard without encroaching into the entire setback or into the front yard setback. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to other properties within the same zoning classification? Yes. The petition is primarily based upon a medical condition in conjunction with the physical layout of the residence. This is a very unique request in that encroachment into the front and side yard setbacks is necessary for the placement of a small shed due to medical reasons. In most instances, applicants would have the ability to place a shed within their back yard. In addition, all applications are reviewed on a case-by-case basis thereby changing the outcome for each request. Board of Adjustment Page 3 WA-98-32/Krey Iq 3 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property No. The purpose of this request is to allow for a small storage shed to safely lock up a bicycle trailer which is medically beneficial to the applicant and recommended by his doctor. 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? No. The hardship was created by the combination of the applicant's medical condition and the physical layout of the residence. A second difficulty was created by the shed contractor who misinformed the applicant regarding the need for a building permit and regarding setbacks. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? No. With the location of the shed on the side yard, no detrimental impact to the public welfare or neighborhood would occur. In addition, there would be no impact to the driveway sight-triangle for visibility to on-coming traffic. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood. No. Because of the size of this shed, approval of the request would not impair the adequate supply of light and air to the adjacent property to the west nor would it increase the danger of fire. The placement of the shed on the side yard would not negatively impact emergency access to the applicant's property or the property to the west. A minimum distance of 10 feet will remain between the applicant's shed and the closest structure to the west. 10. If it is found in criteria 8 and 9 above that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then would the granting of the variance result in a benefit or contribution to the neighborhood or the community as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? It has been found by staff that approval of this request would not be detrimental or injurious to other properties or the neighborhood and would not have a negative impact on the public health, safety, or public facilities and surrounding property values. STAFF CONCLUSIONS AND RECOMMENDATION Staff concludes that the request for the side yard and front yard setback variances is based on the fact that the applicant is in need of a storage shed to lock up his bicycle trailer. Bicycle exercise is medically required by his physician as part of a routine exercise program for rheumatoid arthritis. Unique to this request is the fact that the applicant must access the trailer with his vehicle from either the front or side yard. In order to avoid the sight-triangle area and meet the needs of the applicant, the only alternative is to locate the shed on the side yard. Therefore, approval of this request would not be detrimental to the health, safety and welfare of the surrounding area, nor would it alter the residential character of the neighborhood. V. RECOMMENDED MOTIONS Option A: "I move that Case No. WA-98-32, a request for a 5' side yard variance from the 5' side yard setback requirement and for an 8'-6" front yard variance from the 30' front yard setback requirement to allow an 8'x 10' storage shed on the west side of the property zoned Residential-Two and located at 7110 West 29' Avenue, be APPROVED for the following reasons: 1. The applicant has an existing medical condition requiring bicycle riding as part of the on- going exercise routine. 2. The requested front yard setback does not impact the driveway sight-triangle of the applicant or neighbors. 3. The side yard setback does not create a detrimental impact to the public's safety. 4. The granting of these variances would result in a reasonable accommodation of a person with disabilities." My address is 7110 W. 29th Ave,I am applying for a Variance as per your instructions. We would like to have a 10X8 shed on the Northwest corner of our property. This shed would house a small trailer that carries our bycicles. I have Rheumatoid Arthritis and am unable to walk very far but I am able to ride without pain to my ankles. My wife and I both participate in the Jeffco YMCA Arthritis Aquatic water clases. Having this small shed on a concrete slab enables us to easily wheel the trailer with the bikes already fastened to the trailer, out and hook it to the cars trailer hitch. The shed would enable us to have both security for our bikes as well as a measure of ease and convenience in getting the trailer hooked up to the car. This may seem like a small thing to many but when you are so handicaped it becomes a monumental chore to do some of the most simple tasks. He manages his arthritis with medications and an exercise program which includes riding a bicycle and aqua exercise classes. Because of severe ankle pain, he is unable to walk prolonged distances, but he is able to ride a bicycle. For that reason, I appreciate any efforts to assist Mr. Krey in continuing his bicycling activities.
