DITCH COMPANY, and to their respective heirs, successors and assigns, a perpetual,
non-exclusive easement and right-of-way over, under and across, the documented
( see Plat ) main irrigation ditch (and lateral diversion to Carlson / Williams / Herzman),
for the construction, operation, maintenance and reconstruction, of a ditch or conduit,
measuring and division devices and other appurtenances, for the conveyance of water and
associated uses . It is understood and agreed that the ditches and the conduits shall
remain in approximately their present locations, and that no trees or shrubs shall be
