Case No. MS-02-04 (continued from April 17, 2003): An application filed by Daniel and Diane Brauer for approval of a two-lot minor subdivision plat including a 6-foot variance to the 75-foot lot width requirement in the R-2 zone district, resulting in a lot width of 69 feet on property zoned Commercial-One, Residential-Two and Residential- Three and located at 6375 West 44 h Avenue. The case was presented by Travis Crane. He advised the Commission there was jurisdiction to hear the case. He reviewed the staff report, digital presentation and entered all pertinent documents into the record which were accepted by Vice Chair WEISZ. He advised the Planning Commission that a lot width variance is not required in this application as indicated in the case title. Staff recommended approval of the application for reasons outlined in the staff report. In response to a question from Commissioner McMILLIN, Mr. Crane explained that the city is only interested in purchasing the residentially zoned portion of the property (lot 2) for use as a park. Commissioner BERRY asked if lot 2 was under contract with the city. Mr. Crane stated that negotiations with the applicant and Jefferson County Open Space have been in process for some time. He stated that he has been in contact with Joyce Manwaring of the Parks and Recreation Department as well as with Mr. Callahan of Jefferson County Open Space. He informed the Commission that an agreement has been reached for sale of the property to the city and would be finalized immediately if the subdivision plat is approved. Vice Chair WEISZ asked if there were others present who wished to address this matter. There was no response. It was moved by Commissioner DAVIS and seconded by Commissioner BERRY to approve Case No. MS-02-04, a request for a two-lot subdivision located at 6375 West 44ch Avenue, for the following reasons: 1. The existing structure adjacent to 441e Avenue is proposed to remain until the site is redeveloped. The property owners have indicated that future redevelopment is a possibility. However, there are no immediate plans to redevelop the site. Since this is a minor subdivision without dedication, Planning Commission will be the final deciding authority. It was indicated that a lot width variance was required for Lot 2, however, because of lot orientation, a lot width variance is not needed. For interior lots, lot width is measured for the portion of the lot that is considered the "front yard". The front yard for Lot 2 is considered the western property line, measuring in excess of 312 feet. Planning Commission MS-02-04/Brauer I. REQUEST The applicant is requesting approval of a two-lot subdivision. II. CASE ANALYSIS The property in question is located on the north side of 44`x' Avenue between Jay Street and Newland Street, and is approximately 34,440 square feet in area. Approximately the southern one-third of the property is zoned Commercial One. The remainder of the property is zoned Residential-Two and Residential-Three (Exhibit 1, Vicinity Map). There is an existing structure on the southern one-third of the property currently being used as on office. III. PLAT REVIEW This plat would subdivide the lot into two lots. Lot 1 would be approximately 12,832 square feet and Lot 2 would be approximately 21,608 square feet in size (Exhibit 2, Plat). The northern two-thirds of the lot is currently zoned R-2 and R-3. The minimum lot size for an R-2 lot is 9,000 square feet. The minimum lot size for an R-3 lot is 7,500 square feet. Lot 2 will be in excess of both lot area requirements. The proposed subdivision line will follow the current C-1 zoning line. There are no minimum lot requirements for the C-1 district, as long as all of the development standards can be met. The applicant has stated the existing structure on the southern one-third of the property will remain, and will continue to be used as an office. If any redevelopment occurs, any new structure must comply with the development standards of the C-1 zone district. Lot two will not be developed. The owner is currently negotiating with the City to sell Lot 2. Lot 2 would then become a part of the proposed park directly to the east. Since this is a request for a two-lot subdivision without dedication, Planning Commission will be the final deciding authority. IV. NEIGHBORHOOD MEETING The meeting for neighborhood input was held on October 9, 2001 in the Municipal Building located at 7500 West 29`h Avenue. One person attended the meeting, and was in favor of the proposal. A summary of the meeting and sign in sheet has been included as Exhibits 3 & 4. V. AGENCY REFERRALS All outside service agencies that currently serve the property will continue to serve the property, and have indicated that the property owner will incur any associated costs of improvement. The Final Plat has been reviewed by the City Surveyor, and has been approved in accordance with the subdivision regulations. Parks & Recreation Commission did review this proposed subdivision, and originally recommended that a fee in lieu of parkland dedication be required. The fee in lieu of parkland Planning Commission MS-02-04/Brauer dedication only applies to residential subdivisions. The request has since been altered from a four-lot subdivision to a two-lot subdivision. Currently, half of the property is zoned as Commercial One, and the remaining half of the land will be sold to the City for parkland. Therefore, parkland dedication cannot be required as a part of this request. VI. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff concludes that the final plat meets the subdivision requirements as described in Article IV of Chapter 26 of the Code of Laws. Therefore, staff recommends APPROVAL of Case No. MS- 02-04. VII. RECOMMENDED MOTIONS Option A: "I move to APPROVE Case No. MS-02-04, a request for two-lot subdivision located at 6375 W. 44`x' Avenue, for the following reasons: 1. The plat meets all requirements of a final plat. 2. All requirements of the zone districts will be met. It was moved by Commissioner BERRY and seconded by Commissioner DAVIS to move Case No. MS-02-04 to the Planning Commission meeting of May 1, 2003. The motion passed 7-0 with Commissioner PLUMMER absent. B. Case No. ZOA-03-05: An ordinance amending Section 26-123 of the Wheat Ridge Code of Laws concerning the definition of "Family Foster Home." Alan White presented this case. He stated that all notification requirements had been met and therefore the Commission had jurisdiction to hear the case. A recent Colorado Supreme Court ruling found that the number of children housed in a foster home cannot be limited. Therefore, it is necessary to amend the City Code to remove the limitation of four children not related to the caretaker in a family foster home. It was moved by Commissioner WEISZ and seconded by Commissioner DAVIS that Case No. ZOA-03-05, an ordinance amending Section 26-123 of the Wheat Ridge Code of Laws concerning the definition of "Family Foster Home", be forwarded to City Council with a recommendation for approval for the following reasons: 1. It will remove the limitation of four children not related to the caretaker in a family foster home. 2. The amendment is consistent with recent action by the Colorado Supreme Court. The City of Wheat Ridge made numerous comments and requirements that were in conflict with our original intent and purpose of the Brauer Subdivision. There are two major areas of requirements which are not acceptable to us. The first conflict is that we were willing to give public road access across our land by easement, but not by dedicated Right-of-Way (ROW). The 50-foot wide dedicated ROW makes the proposed middle lot unusable for any development. The second conflict involves the issue of parking. As stated in your General comments 1.1-1 and 1.1 of your letter dated May 30,2002, that the proposed parking in the middle lot as "R-3 zone district does not permit ancillary parking as an allowed use" and that any shared parking with "the future City park may not be used as overflow parking for any of the lots in the proposed Brauer Subdivision." These comments change the original Intent and Purpose of the proposed subdivision, as the middle lot no longer can have a "shared parking space arrangement" with the park area parking. We cannot agree to pay for the design and construction of a roadway and utilities across our property, which would be dedicated to the City, without any parking space benefits to us. The City's comments have forced a change to our original Intent and Purpose of the Brauer Subdivision. We have enclosed a drawing "OPT" (four copies), which shows the two Options that we could be in agreement with pursuing for approval. Option 1 shows that we are willing to dedicate an 8'-wide walkway along the centerline of the existing roadway dead end across our property. We desire to make the park accessible to the local neighborhood residents. Currently, as many as 20 people per day trespass across our property in order to catch a bus or walk across the park. This walkway would provide legal public access to the park and bus stop. The walkway will be comprised of a 6-foot wide concrete sidewalk with adjacent T to 4' high sidewalls or fencing. The general neighborhood opinion has been that a park access by walkway is preferred over a roadway, due to concerns for traffic and public safety issues. Located on each side of this walkway are proposed private, 18-foot wide driveway accesses to Lots 2 and 3. All these accesses are located at the 44th Place dead end. Option 2 would retain the existing dead end and guard rail at 44th Place and would not allow any access from 44th Place across our property to the park area. The existing access from 44th Avenue would be used to access Lot 1 and to provide a private driveway access to Lots 2 and 3 along the eastern property edge. This option would only be preferred by us if the City denies our private accesses from the 44th Place dead end in Option 1. The following general descriptions for the proposed Brauer Subdivision indicate the modified Intent and Purpose based upon the City's comments. MODIFIED INTENT AND PURPOSE OF SUBDIVISION The intent of the Brauer Subdivision is to divide the property into THREE (3) lots as shown on the enclosed Options Plans drawing, entitled "OPT". The subdivision lots divide the property along existing zone boundaries and allows future development of each lot to be addressed within a specific zoning classification. The entire property width is 69.09 feet (west-east direction) along its entire 498.48-foot length (north-south direction). The details and sizes of the proposed lots are as follows (from south to north): 1. Lot 1, Block 1 (north frontage on West 44th Ave. with existing building) • Zoned C-1, to have future building additions and/or parking with several retail stores, offices, and possible church • Property length of 170.00' with 11,745 ft2 (0.27 acre) area 2. Lot 2. Block 1 (north of Lot 1 with existing shed building) • Zoned R-3, to have future duplex residential building with garage • Property length of 135.19' with 9,340 ftz (0.21 acre) area • Proposed Option 1--4'-wide Dedicated ROW on northern edge for future 8-foot wide walkway to park (276 ft2 from Lot 2 area) 3. FUTURE PERSONAL RESIDENCE ON LOT 3 Lot 3 will be the location of our future personal residence. We intend to build our 41-foot wide by 68-foot long (about 2,800 ft2) house with a full walkout basement within the center of Lot 3. There will be a private driveway and double-car garage on the southern side of the house. Since Lot 3 is zoned as R2/R3, we request a variance for the minimum width requirement to allow us to build our home within the 69.09' width. This width meets the 65' minimum requirement for R-3 zoning, but not the 75' minimum for R-2 zoning. Along the western edge of Lot 3, there exists an 18-inch diameter storm sewer pipeline located about 2 to 3 feet outside the 10-foot wide storm easement on our property. We propose to protect this pipeline with a caisson and grade beam foundation system for the house located about 3 feet away from the pipe to the east with the grade beam placed higher than the pipeline elevation. The above Modified Intent and Purpose of the Brauer Subdivision with Options 1 and 2 are presented to the City of Wheat Ridge to arrive at a mutually agreeable solution and approval for the proposed Brauer Subdivision. We hope that we can work together with the City of Wheat Ridge to gain approval of either Option 1 or Option 2 for the proposed Brauer Subdivision. (See City of Wheat Ridge Code of Laws, Chapter 26-222). 3. A 5' wide treelawn (area between back of curb and the detached sidewalk) is required to be constructed along 44th Avenue. A 5' wide detached sidewalk (behind the 5' wide treelawn) is required. A sidewalk easement may be needed if existing ROW is not wide enough to accommodate the required widths for the treelawn and sidewalk. 4. In areas where the existing sidewalk is attached, the developer is required to detach the existing.walk. 5. The treelawn shall be sodded, irrigated, and have approved street trees planted every 35' to 40' along the frontage. (See Streetscape and Architectural Design Manual). 6. This letter of request describes the full intent and purpose for the proposed subdivision. PROPERTY LEGAL DESCRIPTION The west one (1) acre, except the north 132.00' of Block 9, Lake View Subdivision, a part of the northwest one-quarter of Section 24, Township 3 South, Range 69 West of the Sixth Principal Meridian, City of Wheat Ridge, County of Jefferson, State of Colorado. INTENT AND PURPOSE OF SUBDIVISION The intent of the Brauer Subdivision is to divide the property into four (4) lots as shown on the enclosed Preliminary Plat drawing. The subdivision lots divide the property along existing zone boundaries and allows future development of each lot to be addressed within a specific zoning classification. The entire property width is 69.09 feet (west-east direction) along its entire 498.48-foot length (north- south direction). The details and sizes of the proposed lots are as follows (from south to north): 1. Lot 1. FUTURE ROAD EXTENSION The proposed boundary line between Lots 3 and 4 is the centerline of the future 50-foot wide easement for the extension of West 44th Place to the City of Wheat Ridge future park area and parking to the east of the subdivision. This future road extension requires the removal of the existing guardrail and building a roadway to allow public access to the park area and our private access. We intend to allow neighborhood access to the park across our land in exchange for a shared parking space arrangement between Lot 3 of the Brauer Subdivision and the City's parking area within the future park. We intend to pay for the road paving with curb and gutters across the subdivision as part of this arrangement. FUTURE PERSONAL RESIDENCE ON LOT 4 Lot 4 will be the location of our future personal residence. We intend to build our 41-foot wide by 68-foot long (about 2,800 ft2) house with a full walkout basement within the center of Lot 4. There will be a double-car garage on the southern side of the house adjacent to the road extension. Since Lot 4 is zoned as R2/R3, we request a variance for the minimum width requirement to allow us to build our home within the 69.09' width. This width meets the 65' minimum requirement for R-3 zoning, but not the 75' minimum for R-2 zoning. Along the western edge of Lot 4, there exists an 18-inch diameter storm sewer pipeline located about 2 to 3 feet outside the 10-foot wide storm easement on our property. We propose to protect this pipeline with a caisson and grade beam foundation system for the house located about 3 to 4 feet away from the pipe to the east with the grade beam placed higher than the pipeline elevation. We hope that we can work together with the City of Wheat Ridge to gain approval of the proposed Brauer Subdivision. PROPOSAL FOR FUTURE RESIDENCE As indicated in the Wheat Ridge official zoning map NW 24, the parcel adjacent to West 44th Avenue is zoned C-1. This area, designated as Parcel A-1 on the site plan, will be addressed in a future development plan. This plan is currently being developed as per our July 2000 Pre-Application meeting to be submitted at a later date. This area is not part of the residential use addressed in this letter and meeting. The middle area (69'x 139'), designated on the site plan as Parcel A-2, has an R-3 zoning. We are proposing to use this area as paved private parking. The existing guardrail will be replaced with a steel gated entrance. Proper drainage will be accomplished by concrete curbs and gutters. The indicated Parcel A-3, as the most northern area (69'x 174'), currently is zoned R-2/R-3. In order to simplify the zoning and make it consistent with surrounding zone areas, we are requesting that this area be designated entirely as R-3. We are proposing to build a two-car garage and a UBC pre- manufactured house with a concrete walkout basement. There will be wood decking, sidewalks, landscaping, plus privacy walls around the property perimeter. Proper drainage will be accomplished by concrete curbs and gutters. Brauer, PE City Planners City of Wheat Ridge Wheat Ridge, Colorado 80033 Subject: Preliminary Proposal for Minor Development Plan for 6375 W. 44th Avenue Dear Sir: The purpose of this proposal is to discuss with the City of Wheat Ridge Planners some ideas concerning the possible development of said property. We desire to purchase this property as soon as possible and begin to develop it for commercial, church, and residential use. However, there are some factors and zoning issues that make it impossible to develop in its present state. We are suggestion that we join forces with the City of Wheat Ridge in also developing the adjacent park to make this entire area a pleasant and profitable site for all concerned. Following are a list of issues that we wish to negotiate: Parking: Due to the set back requirements and parking space requirements, most of the C-1 land would have to be paved for parking spaces. Due to set back requirements for the buildings, the commercial spaces would be too small to make it profitable, plus it would be aesthetically unpleasing. Proposed Solution: The City needs to have parking spaces for the park. Would it be beneficial to have access across the land to 44th Place? We will dedicate that 30-foot wide strip on R-3 as a roadway to join with the parking lot. This would provide acceptable access for two-way traffic flow, emergency vehicle usage, and foot travel from the neighborhood. We are proposing to donate the land and share in the costs of paving in exchange for sharing the parking spaces. The sketch shows 60 spaces for shared use between the park and C-1 areas. As a result, the C-1 land could be converted into high quality landscaping using fountains, creeks, and bridges from the parking lot to commercial areas. This property has well water to facilitate this design. 2. Rezoning: The property would have to be rezoned and replatted to accommodate the church and new roadway. We desire to put a church meeting facility in the R-3 section but zoning regulations require one acre of land. This is a high priority in this development plan. Proposed Solution: If this section was rezoned to C-1, we can make it meet the code. We are requesting the C-1 and R-3 to be entirely C-1 and PHONE/FAX: (303) 761-3390 EMAIL: fetg@bewelinet.com divided into 3 parcels of C-1. This would facilitate our financing each parcel with construction loans that fit the specific needs. 3. Storm Drainage Easement: The property is only 69 feet wide. There is a storm drainage easement that takes up 10 feet of the property on the west side. Please notice that the 18" diameter storm sewer line is actually located outside the easement by a few feet. This runs north about 200 feet on the R-2 section. Proposed Solution: On the R-2 section, we can accommodate this by keeping any house or structure about 5 feet from the existing line. We cannot make the project work without the R-3 land section being rezoned C-1 to accommodate the church, and the parking issue solved. Our engineering company is willing to offer appropriate help to facilitate this entire project. The presentation we are making meets every other zoning requirement to the best of our knowledge. It is our intention to develop this area into an appealing commercial area with a coffee shop, boutique-type shops, and engineering office.
