It appears the retention pond is holding water and is not percolating at the rate indicated in the final drainage report dated April 7, 2001. The infiltration rate of the pond was estimated at one-inch every seven (7) minutes based on a report from Complete Engineering Services, Inc dated July 18, 1996. This letter is to inform you the city will issue a certificate of occupancy for your existing permits, but will not be able to issue any further building permits until this drainage issue has been resolved and re-certified by your engineer of record. Due to the nature of this issue the city will also require that you contact our office no later than August 18, 2003 with a detailed time line indicating when these issues will be corrected and the retention area re-certified. The revised bearing along the westerly side of Lot 1 allows it to close and the area is good. However, when the bearing of the line is rotated more easterly as it has been, the distance along the southerly boundary line of Lot 3 will need to be adjusted by the 0.219' that the line has been rotated to the east. Likewise, the area for Lot 3 will need to be adjusted to reflect the larger lot created by the increase to the southerly lot line. EXECUTIVE SUMMARY: The applicant requests approval of a three-lot subdivision in order to define current property ownership lines and facilitate sale and development of Lot 3 (11661 W. 441h Avenue). Under the current R-3 density standards, up to 18 multi-family units could be built on Lot 3. FINANCIAL IMPACT: The financial impact to the City as a result of action will include revenues from building permits for new construction on Lot 3 and parkland dedication fees. COMMISSION/BOARD RECOMMENDATION: Planning Commission reviewed this case at a public hearing held on November 21, 2002. A recommendation of approval was made for the following reasons: 1. All minimum requirements of the R-3 development standards have been met. 2. All minimum requirements of the Subdivision Regulations have been met. With the following conditions: 1. At the time of building permit, the developer of Lot 3 contribute cash in lieu of land dedication for parks and recreation purposes. There was one interested party who testified regarding the proposed subdivision. Kent Young, 11280 W. 46th Avenue, voiced concern for maximization of density on Lot 3. He would prefer to see duplexes built rather than multi-family. PROJECT HISTORY: The subject properties and the 2.5 acres to the north were rezoned from A-1 to R-3 pursuant to Case No. WZ-80-28. This was a speculative zone change request which, at the time, could have resulted in construction of up to 105 multi-family units on the combined five acres. Because of this, a condition was placed on the zone change that prior to any development, a plat and site plan be approved showing circulation and building envelopes. In 1996, the northern 2.5 acres were sold and permits were issued for the construction of two four-plex structures on the northern two lots of the original five parcels. A subsequent series of attempts to allow further development on the northern 2.5 acres were unsuccessful. This included Case No. WS-96-2 which was a platting application on the northern 2.5 acres and Case No. WS-99-01 which was an attempt to plat the entire five acres. Case No. WS-99-01 was denied by City Council on February 28, 2000. In 2001, zoning and subdivision action occurred on the entire five acres to remove the original zoning conditions (Case No. WZ-O1-03), rezone the vacant property remaining on the northern 2.5 acres from R- 3 to R-2 (Case No. WZ-01 -04) and subdivision approval to allow construction of four additional duplexes on the northern portion (Case No. WS-0 1 -02). The zone change and subdivision approval included negotiations with the neighborhood regarding traffic calming devices on Swadley installed at the developer's expense. These cases were approved by City Council on February 11, 2002. STATEMENT OF THE ISSUES: The property is zoned R-3 and contains three houses, one on each proposed lot, and numerous outbuildings. It is the owners' intention that the houses located on Lots 1 and 2 remain. Lot 3 is being marketed for sale. Under current R-3 development standards, 18 multi-family units could be constructed on Lot 3. A remnant piece of right-of-way for Simms Street abuts the eastern edge of Lot 2. Although it does not connect to right-of-way to the north or south, the applicant chose not to pursue vacation at this time. Tracts `A' and `C' have been created for conveyance to the adjacent property owners. Tract `B' has been created to accommodate a well house which is used and maintained jointly by the owners of Lots 1, 2and3. A 25' wide access easement across Lot 1 provides access to Lot 2. Although public improvements on West 44 h Avenue were constructed as part of a city project in the mid- 1980's, the right-of-way was never dedicated. This document dedicates that right-of-way. All agencies can provide service to the property with improvements completed at the developer's expense. • Public Works has reviewed the plat document. A drainage report will be required prior to construction on Lot 3. The Parks and Recreation Commission has requested a monetary contribution in lieu of land dedication for parks and recaretion purposes upon redevelopment of Lot 3. She entered all pertinent documents into the record which were accepted by Chair WEISZ and advised the Commission there was jurisdiction to hear the case. She reviewed the staff report and digital presentation. Staff recommended approval of the case for reasons outlined in the staff report. Commissioner SNOW asked if staff contacted the ditch company. Ms. Reckert and the applicant explained that the ditches on the property are lateral ditches and therefore, permission from the ditch company is not required. Herbert Fightmaster 11641 West 44th Avenue Mr. Fightmaster, the applicant, was sworn in by Chair WEISZ. In response to a question from Commissioner SNOW about water, he explained that lot 1 has city water, lot 2 is on a well, and a tap is available for lot 3. A Kent Young 11280 West 46th Avenue Mr. Young was sworn in by Chair WEISZ. He inquired about the sale of lot 3 and asked what could be developed there. Ms. Reckert replied that the lot is zoned R-3 which would allow 18 dwelling units. Mr. Young expressed concern about the saturation of this area. He would like to see development limited to two or three duplexes. Commissioner SNOW explained that the land is zoned R-3 and the owner can build as many units as the law allows in this zoning district. REQUEST The applicant requests approval of a three-lot minor subdivision on properties located at 11641 W. 44' Avenue, 11661 W. 44' Avenue and 4455 Simms Street. H. CASE HISTORY The subject properties and the 2.5 acres to the north were rezoned from A-1 to R-3 pursuant to Case No. WZ-80- 28. This was a speculative zone change request which, at the time, could have resulted in construction of up to 105 multi-family units on the combined five acres. Because of this, a condition was placed on the zone change that prior to any development, a plat and site plan be approved showing circulation and building envelopes. In 1996, the northern 2.5 acres were sold and permits were issued for the construction of two four-plex structures on the northern two lots of the original five parcels. A subsequent series of attempts to allow further development on the northern 2.5 acres were unsuccessful. This included Case No. WS-96-2 which was a platting application on the northern 2.5 acres and Case No. WS-99-01 which was an attempt to plat the entire five acres. Case No. WS-99-01 was denied by City Council on February 28, 2000. In 2001, zoning and subdivision action occurred on the entire five acres to remove the original zoning condition (Case No. WZ-Ol-03), rezone the vacant property remaining on the northern 2.5 acres from R-3 to R-2 (Case No. WZ-O1-04) and subdivision approval to allow construction of four additional duplexes on the northern portion (Case No. WS-01-02). See attached Exhibit `A'. The zone change and subdivision approval included negotiations with the neighborhood regarding traffic calming devices on Swadley installed at the developers' expense. These cases were recommended for approval by Planning Commission on December 6, 2001, and approved by City Council on February 11, 2002. Attached is a reduced copy of the approved plat labeled as Exhibit `B'. Attached as Exhibits `C' and `D' are copies of the minutes from the December 6, 2001, Planning Commission and February 11, 2002, City Council meetings. III. SUBDIVISION DESIGN The purpose of the current application is to define current property ownership lines and to facilitate sale and development of Lot 3 (11661 W. 44"' Avenue). The property is zoned Residential-Three and contains three houses, one on each proposed lot, and numerous outbuildings. It is the owners' intention that the houses located on Lots 1 and 2 remain. Lot 3 is being marketed for sale. Under current R-3 development standards, 18 multi-family units could be constructed on Lot 3. If the existing single family home were demolished on Lot 1, five multi-family units could be built. If redeveloped, lot 2 could also accommodate five multi-family units based on lot size, but because access is by way of a private drive, only four units could be built (pursuant to 26-609 - Access to Public Streets). A remnant piece of right-of-way for Simms Street abuts the eastern edge of Lot 2. Although it does not connect to right-of-way to the north or south, the applicant chose not to pursue vacation at this time. Tracts `A' and `B' have been created for conveyance to the adjacent property owners. Tract 'C' has been created to accommodate a well house which is used and maintained jointly by the owners of Lots 1, 2 and 3. A 25' wide access easement across Lot I provides access to Lot 2. Although public improvements on West 44' Avenue were constructed as a city project in the mid-1980's, the right-of-way was never dedicated. This document would dedicate right-of-way for those existing improvements on 44' Avenue. All minimum standards of the R-3 zone district regulations have been met or exceeded. All requirements of the Subdivision Regulations have been met, except that a signature block for the Planning Commission chairman must be provided. III. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on October 1, 2002. No residents of the neighborhood attended the meeting. IV. AGENCY REFERRALS All agencies can provide service with improvements completed at the developer's expense. Public Works has reviewed the plat document. A drainage report will be required prior to any new construction on Lot 3. Public improvements are in place along West 44' Avenue. The Parks and Recreation Commission has requested a monetary contribution in lieu of land dedication for parks and recreation purposes upon redevelopment of Lot 3. Public Service Company has requested their standard language which has been included on the plat as a plat note. V. STAFF CONCLUSIONS AND RECOMMENDATION Staff concludes that all minimum standards of the R-3 zone district regulations have been met or exceeded and that all requirements of the subdivision regulations have been met. For these reasons, a recommendation of approval is given for Case No. MS-02-06 with the following conditions: A signature block for the chairman of the Planning Commission be added. At the time of building permit, the developer of Lot 3 contribute cash-in-lieu of land dedication for parks and recreation purposes." VI. Case No. WS-01-02: An application submitted by Dan Turgeon and James Turgeon for approval of combined six-lot preliminary subdivision plan and final subdivision plat for properties, zoned Residential-Two (R-2) and Residential-Three (R-3) and located at 11680 and 11690 Wet 46a' Avenue. Cases No. WZ-01-03, WZ-01-04, and WS-01-02 were presented by Meredith Reckert. She reviewed the staff reports, entered all pertinent documents into the record and advised the Commission there was jurisdiction to hear the case. Slides and overheads of the subject property were presented. Staff recommended approval of the cases for the reasons and with conditions outlined in the staff report. Commissioner BRINICMAN wanted to know what would happen if soils testing revealed that the retentionpond would compromise the structures. Mike Garcia replied that the engineer of record would have several options to address such a situation. However, if the problem could not be solved, permits would not be issued. Commissioner SNOW asked if there would be a homeowners association who would be responsible for maintenance of drainage structures. Bob Goebel explained that owners of those properties containing drainage easements would be responsible for maintenance. In response to a question from Commissioner BRINKKkN,,Meredith Reckert stated that land dedication in this case would be too small for a park and the Parks and Recreation Director indicated that cash-in-lieu of dedication would be requested. James Henry 200 Union, Suite G-16 Lakewood Mr. Henry, attorney for the Fightmaster's, was sworn in by Chair THOMPSON. He appeared in regard to Case No. WZ-01-03.' He stated that the Fightmaster's joined in the application because they wanted to have the condition released on the five acres which would be of benefit to the Turgeon's. They have no current plans to develop their three parcels. In answer to a question from Commissioner SNOW, Mr. Henry stated that he believed one of the parcels is still for sale. James Turgeon 706 Elm Circle, Golden Mr. Turgeon, the applicant, was sworn in by Chair THOMPSON. He stated that, through neighborhood meetings, a solution was reached regarding traffic and density concerns. He stated that all requirements have been met and he requested approval of the application. In response to a question from Commissioner SNOW, Mr. Turgeon stated that he did not plan to sell his lots at this time; however, he plans to build on the lots at some time in the future. In regard to detention pond maintenance, he stated that each property owner would be responsible for maintenance of ponds on their property. Bob Goebel commented that if detention ponds are not properly mowed and maintained, code enforcement procedures could be initiated. Chair THOMPSON invited testimony from members of the audience. It was moved by Commissioner SNOW and seconded by Commissioner COOPER to approve Case No. WZ-01-03, a request for approval of removal of a zoning condition placed pursuant to Ordinance No. 443, Case No. WZ-80-28, specifically the requirement for platting of the entire property, for the following reasons: 1. Removal of the 1980 condition will allow the vacant portion of the Turgeon property to be rezoned from R-3 to R-2. 2. The neighborhood is generally in support of removal of the condition with the proposed downzoning and platting for duplexes. 3. It is no longer city policy to pursue a north/south connection between West 32aa Avenue and I40. With the following condition: 1. The removal of the 1980 condition be effective only upon approval of Case No. WZ-01-t14, the rezoningfrom R-3 to R-2 on vacant property south of 11680 and 11690 West 46th Avenue. Said properties are located at 4651 Tabor Street, north of 4651 and 4601 Tabor Street. This case was presented by Meredith Reckert. Commissioner SNOW expressed concern about access to the property and was surprised that the Highway Department once sold this piece of land and is now going to buy it back for ramps to I-70. Mr. Hanley introduced Item 1, A. B. C. D. and read the titles. Clerk read summaries and backgrounds and assigned Ordinance No. 1242 for Council Bill 02-2002 and Ordinance No. 1243 for Council Bill 03-2002. Rich Rodriguez, attorney, representing the applicants, was sworn in by the Mayor and introduced one of the applicants, Jim Turgeon. Mr. Rodriguez asked that the applicants be approved as presented in the packet. Meredith Reckert Senior Planner for the City of Wheat Ridge, was'sworn in by the Mayor and presented the staff report and background for all the sub .items. CITY COUNCIL MINUTES: February 11, 2002 Page - 3 - Mr. Gokey questioned the process for installation of traffic calming devices. Motion by Mr. Schneider to override the Rules and allow Mr. Gokey more time for questions; seconded by Mr. Hanley; carried 7-1 with Mr. DiTullio voting no. Kim Stewart was sworn in by the Mayor; she lives right next to the Turgeon property. This has been a long, tedious and acrimonious process. She gave background on traffic problems and asked for passage of traffic calming devices. Mr. DiTullio asked if the applicant has met all the conditions required by the current zoning laws for Wheat Ridge; Ms. Reckert replied yes. Mr. DiTullio further asked if there currently any other outstanding issue that the City is aware of on this project. Ms. Reckert stated that there are two conditions added on to the recommendations for the subdivision: the parkland dedication needs to be paid and the submission of the soil reports. He asked the applicant if he understood all the conditions that have been recommended to Council: Applicant's attorney replied that they did. Do they have any issues with those recommendations and conditions? Answer was no, they feel they can meet them and intend to. Case No. WZ-01-03 Motion by Mr. Hanley to approve Council Bill 02-2002 (Ordinance No. 1242), Case No. WZ-01-03, a request for approval of removal of a zoning condition placed pursuant to Ordinance #443, Case No. WZ-80-28, for the following reasons: 1. Removal of the 1980 condition will allow the vacant portion of the Turgeon property to be rezoned from R-3 to R-2. 2. The neighborhood is generally in support of removal of the condition with the proposed downzoning and platting for duplexes. 3. It is no longer City policy to pursue a north/south connection between West 32nd Avenue and 1-70. With the following condition: 1. The removal of the 1980 condition be effective only upon approval of Case No. WZ-01- 04, the rezoning from R-3 to R-2 on vacant property south of 11680 and 11690 West 46", Avenue; seconded by Mr. DiTullio; carried 8-0. The developers have agreed to pay for these improvements as a concession to the neighborhood. 2. The speed and volume study indicates that the NTMP criteria have been met. 3. There has been a good deal of confusion regarding the status of the right-of-way for West 4411 Avenue. The submitted plat shows roughly 33' of right-of-way as being dedicated to the city by this document. had originally indicated that the city does allow public sidewalks on private property and that this is a situation that may be considered. However, the city surveyor researched the reception numbers referenced on the plat document with the following conclusion and coarse of action. When the street project for W. 44" Avenue was undertaken in 1985, easements were secured for the city to perform improvements for both the sidewalk and the roadway area. We are not sure why this was done with easements, but it is against current city policy to have roadway improvements on private property. Therefore, it has been determined that right-of-way dedications should occur as shown on the original document. In addition, because the boundary legal description includes this area to be dedicated, revisions would be required to change the legal description back to exclude this area. Although contrary to what we originally discussed, we should just plan on going to both Planning Commission and City Council. Attached are referral responses received from other city departments and outside agencies. All of their requirements must be met. Of particular note, is the recommendation for fees in lieu of parkland dedication. This figure is based on assessed valuation and the number of units being proposed to be built. Staff will be recommending that this fee be paid prior to issuance of a building permit so the cost is passed on to the developer of this lot. According to staff's calculation, this could be as high as $22,000 using the assessed valuation of and maximization of density (18 units). Your family holdings include property and buildings located at 11661 W. 44`" Avenue,. 11641 W. 44a' Avenue and 4455 Simms Street. All of the existing houses were constructed prior to the incorporation of the city in 1969. However, because the properties were never platted and the original property boundaries have been modified, a subdivision plat is being required (prior to sale and redevelopment of 10661 W. 44th Avenue). If the proposed subdivision has five or fewer lots and there are no right-of-way dedications required, there is a single public hearing required in front of Planning Commission. If there are over five lots or there are right-of-way dedications, then City Council review is required as well. A previous plat submittal which was never finalized included a 3' right-of-way dedication to accommodate an existing public sidewalk adjacent to West 44°i Avenue. Although it is desirable to have all public improvements located within the public right-of-way, it is common practice that the city will allow a sidewalk to be located in a sidewalk easement . Even though it's on private property, the sidewalk will continue to be maintained by the city, and there is no liability for the private property owner if an accident were to occur on it. Therefore, if there is no right-of-way dedication for the sidewalk, there is a single public hearing in front of Planning Commission. As part of the review, the property will be assessed for parkland impacts. It is my opinion that the Parks and Recreation Commission will require fees-in-lieu of land dedication. This fee is assessed only for new units. Although I cannot give you the estimated fee, based on maximization of the western parcel, it could exceed $10,000. It is typically collected at the time of issuance of a building permit for new construction. If the existing single family residence were to remain on the western parcel, no fee is required as it is assessed based on new construction. There is piece of right-of-way abutting the property addressed as 4455 Simms Street. This right-of-way is an isolated piece that has no connection either to the north or the south. It would be prudent to process a right-of-way vacation at the same time the subdivision is being processed. Vacation procedures require public hearings in front of both Planning Commission and City Council but could processed concurrently with the subdivision plat. Attached is a copy of the 600' radius list for the pre-application neighborhood meeting. Pre-application meetings are generally conducted on Tuesday or Thursday in the early evening (6:00 or 6:30 PM). Plan: SF(4) Single Family Applicant/Owner Preliminary Proposal: Create a patio home development with zero lot line between duplex units, and a five foot side yard setback for each structure. Proposal includes nine structures (eighteen units) which are served by a private drive. Each lot would be approximately 3500 square feet in size, and the units would be sold as townhomes. Will a neighborhood meeting need to be held prior to application submittal? Yes Planning comments: The proposed plan does not meet the minimum lot size, lot width, or setback regulations as required in the R-3 zone district. The R-3 zone district dictates that any single family lot be at least 7500 square feet in size, and at least 60 feet in width. Each lot which contains a duplex (2 units) must be at least 9000 square feet in size and be at least 75 feet in width. Additionally, the R-3 zone district does not allow a zero-lot line for the side yard setbacks. If this plat were to be processed as is under the existing R-3 zoning, the applicant would need to request a total of 54 separate variances to accommodate for the small lot size, deficient lot width and reduced side yard setback. A rezoning to a Planned Residential District maybe more feasible, and allow more flexibility. The rezoning process will require an Outline Development Plan (ODP) and Final Development Plan (FDP), and a final subdivision plat. The process will consist of public hearings in front of Planning Commission and City Council. These documents may be processed concurrently to expedite the process. If the ODP and FDP are processed separately, there will be two public hearings required for both Planning Commission and City Council. If these documents are processed separately, the final subdivision plat may be submitted with the FDP. The ODP will be a conceptual plan which deals mainly with the rezoning for the property and dictates the allowable uses and development standards, such as lot size, lot width and setbacks. A general site plan must be created which shows the building layout, parking areas and landscaping areas. The FDP will contain more specific details such as, but not limited to, detailed figures for landscaping square footage, building square footage, parking spaces and architectural details. In the R-3 zone district, a private drive may only accommodate up to 4 lots. Rezoning to PRO will afford greater flexibility to the number of lots served by a private drive. The drive must meet the Fire District's requirements for turnaround and accessibility. The private drive must meet City standards for pavement thickness. There will be parkland dedication, cash in lieu of dedication, or a combination of both associated with the final subdivision plat. The fee is based on amount of land required for dedication, and the amount of land is based on the number of dwelling units created. Based on a proposal of 18 units on this property, the applicant would need to dedication $33,730.56. City Council is the ultimate deciding authority on parkland dedication, so this figure is subject to change. Public Works comments: The final plat should include ingress and egress easements. A final drainage report and grading plan will be required at the time of initial submittal. This property contains a portion of the Lane Ditch (303.424.1387). The applicant should contact the ditch company and discuss drainage issues with them. A streetlight will be required along West 4411 Avenue, and Xcel Energy should be contacted to discuss the location. Building comments: None Streetscape I Architectural Design comments: The City may require a sidewalk easement adjacent to West 44" Avenue. A detached sidewalk is desirable adjacent to West 44t' Avenue, and the applicant will be responsible for the construction of this sidewalk. Other comments: It would be wise to contact Valley Water (303.424.9661), the Arvada Fire Department (303.463.7813) and the Fruitdale Sanitation Department (303.424.5476) to discuss your potential project. Although these agencies will receive copies of your plans when you officially submit an application with the City, it may be beneficial to discuss potential. issues in advance. Your next course of action, should you choose to pursue this application, is to contact the Planning Department (303.235.2846) to set up a neighborhood meeting. The City will generate a list of neighbors within a 600 foot radius which need to be notified of the meeting. The applicant will be responsible for the creation and delivery of the letters. A Staff member will be present at the meeting, however, the applicant will be responsible for discussing the project and answering questions in relation to the project.
