He was upset that water tap fees were so expensive, and wanted to know if anything could be done about them. He indicated that he wanted to sell some of his land to the neighbor to the south to help lessen the water tap fees. I advised him that he would have to go through the subdivision process again because a LLA cannot be processed if the LLA created the ability to construct additional dwelling units. In this case, the neighbor to the south would have been enabled to construct a duplex. Although it.is inconsistent with the Comprehensive Plan, it appears that the present public streets leave the City with adequate access for emergency services. 2. Allowing construction of a street at this site will negate the point of the site being rezoned as a Conservation District. 3. This vacation of right-of-way will be granted only if City Council approves the change in zoning. 4. Arvada Fire Department did not indicate they need this street for fire access; seconded by Ms. Figlus; failed 5-3 with Councilmembers Schneider, Mancinelli and Gokey voting No. (This needed 6 votes in favor to pass). Mr. Schneider is confused because staff had said earlier that this could hamper future emergency services and the motion says there is adequate access for emergency services. He cannot support this. Item 2. Public Hearing on application filed by Neil Boucher for approval of a three- lot replat of properties zoned Residential-Two (R-2) and located at 3240 Pierce Street, 3225 Otis Street, and 6745 West 32"d Avenue. (Case No. MS-02-09) Item 2 was introduced by Mr. DiTullio; Executive Summary read by the Deputy Clerk. Travis Crane, Community Development, was sworn in by the Mayor and presented the staff report and showed slides of the properties. Ralph Colasanfi was sworn in by the Mayor and stated he was here for the applicant, who was not able to attend. He agreed with everything staff had presented tonight and was available to answer questions. Mr. DiTullio stated that the former owner had stated that a ,single family home would be put on Lot 2. Mr. Crane said the new owner is planning to put a duplex on Lot 2. Mr. DiTullio will not make the motion because he cannot support this. Motion by Mr. Edwards to approve Case No. MS-02-09 for the following reasons: 1. The replat meets all requirements of a final plat. 2. All requirements of the zone district will be met. CITY COUNCIL MINUTES: April 14, 2003 Page -5- Mr. DiTullio will not support this because Council was told previously that a single family home would be put on this lot and now all of a sudden it looks like there are going to be 3 duplexes going in this area. Mr. Gokey will not support this because there needs to be a movement in this community to move toward owner occupied housing. We have dwindled down to a rental community. We have one of the largest rates of rental of any community per capita in the Denver Metro area. Why are we letting this proliferate by letting more of these take place. Public Hearing on Street Width Designation for Harlan Street between West 44th Avenue and West 48th Avenue Jay Street from 4530 Jay Street to 4640 Jay Street West 49th Place from Van Gordon Street and east approximately 230 lineal feet. Item 3 was introduced by Mr. Mancinelli, who also read the executive summary.. Tim Paranto, Director of Public Works, was sworn in by the Mayor. He explained that the Harlan Street Streetscape Project, which runs north of 44th Avenue and only impacts the portion that is within the City, which is the southbound lanes, is proposed as a Streetscape Project providing some street landscape features between the sidewalk and the curb and gutter. To accommodate those features the project is envisioned to move the curb and gutter to the east to allow space for the planting of material and pedestrian lights, etc. This portion of the street would actually change from a 30 feet width to a 24 feet width to accomplish the desired results. The Jay Street project involves a short 1 block section that does not have curb and gutter on the west side of the street in the 4500 and 4600 blocks. That project would build curbwalk along the west side of the street and align that street as it is to the north and to the south of the improvement, changing in that one location the street width from a 28 feet width to a 34 feet width, which is the street width for a majority of the street in either direction. West 49th Place-is an unimproved Asphalt Street at this time; it is proposed to be paved approximately 230 feet long, as a curb and guttered street. The existing pavement has a 22 feet edge to edge asphalt and would ultimately have a 36 feet width. There are three lots involved with this request: 3240 Pierce Street (Lot 1), 3225 Otis Street (Lot 2) and 6745 W. 32' Avenue (Lot 3). Lot 1 was originally a part of the Pierce Street Subdivision, approved in 1907. Lot 2 was originally a part of The Last Greenhouse Subdivision, approved in 2002. Lot 3 was originally a part of the Pierce Street Minor Subdivision, approved in 1998. The applicant is requesting a replat to correct a problem with lot lines between the three lots. The previous owner of Lot 2 sold parts of Lot 2 to adjacent property owners. The Code of Laws states: "The transfer of any portion of a parcel by the use of description for the purpose of sale, transfer, lease or development is prohibited until the proper city process is completed and approved." The proposed replat will transfer approximately 1,000 square feet from Lot 2 to Lot 1, and 7,500 square feet to Lot 3. Single-family structures currently exist on Lots 1 and 3. A duplex is proposed for construction on Lot 2. All three lots will meet standards for lot size and width required in the R-2 zone district. This subdivision will not create any new lots; the applicant simply wishes to correct a problem created by a previous owner. The Public Works Department is requesting that the applicant dedicate 5 feet of land along the Pierce Street frontage adjacent to Lot 1. This dedication is shown on the plat. The dedication was requested to meet the standard width of City right-of-way. Curb, gutter and sidewalk will be required for the Otis Street frontage, only for the portion adjacent to Lot 2. Planning Commission reviewed the request on March 20, 2003 and recommended approval without conditions. COMMISSION/BOARD RECOMMENDATION: Planning Commission reviewed the request on March 20, 2003 and recommended approval for the following reasons: 1. The replat meets all requirements of a final plat. 2. All requirements of the zone district will be met. STATEMENT OF THE ISSUES: The one outstanding issue associated with this request is the fee in lieu of parkland dedication. When the previous subdivision plat for Lot 2 (Last Greenhouse Subdivision) was originally approved, the fee in lieu of parkland dedication was not collected. The fee was to be collected before a certificate of occupancy is issued. The previous owner sold the lot without constructing, so the current owner will be responsible for paying the fee. ALTERNATIVES CONSIDERED: None. FINANCIAL IMPACT: The City has received a one-time application fee for the subdivision application. If any development occurs, the City would receive a one-time fee for a building permit application. CASE ANALYSIS The properties in question are located north of 32„d Avenue between Otis Street and Pierce Street, and are approximately 52,472 square feet in area. The properties are all zoned Residential Two (Exhibit 2, Vicinity Map). Currently, lot 2 is vacant land. Lot 1 and lot 3 have existing residential structures located on them. This case was originally scheduled for March 6, 2003, however the meeting was continued until March 20, 2003. This postponement was due to an error with the property posting. III. PROPERTY HISTORY There are three lots involved in this request: 3240 Pierce Street (lot 1), 3225 Otis Street (lot 2) and 6745 W. 32nd Avenue (lot 3). Lot 1 was originally a part of the Pierce Street Subdivision, approved in 1907. Lot 2 was originally a part of The Last Greenhouse Subdivision, approved in 2002. Lot 3 was originally a part of the Pierce Street Minor Subdivision, approved in 1998. The applicant is requesting this replat to correct a problem with lot lines between the three lots (Exhibit 3, Plat). The previous owner of lot 2 sold portions of land to his neighbors via deed transfer. Pursuant to Chapter 26 of the Wheat Ridge Code of Laws, any transfer of land is considered a subdivision; therefore a subdivision plat must be submitted and approved. The applicant is the owner of lot 2. The owners of lots 1 and 3 have given written consent for this application to be filed (Exhibit 4, Letters of Consent). IV. PLAT REVIEW This plat would transfer approximately 1,000 square feet from lot 2 to lot 1. This will make lot 1 approximately 15,844 square feet in size. Lot 2 would also transfer approximately 7,578 square feet to lot 3. This proposal would increase the size of lot 3 from 10,436 square feet to 18,014 square feet. Lot 2 would be reduced to a size of 18,064 square feet. All of these lots are currently zoned R-2. The R-2 zone district requires a minimum lot width of 75 feet for a single family dwelling, and a minimum lot width of 100 feet for a duplex. Lot 1 and lot 2 will each be almost 110 feet in width. Lot 3 is a corner lot. A corner lot in the R-2 district must be at least 80 feet wide on each frontage. Both the Otis Street frontage and the West 32nd Avenue frontage of lot 3 exceed this lot width standard. The R-2 district requires a minimum lot size of 9,000 square feet for a single-family structure and 12,500 square feet for a duplex. All three of these lots will be in excess of 12,500 square feet in size. Planning Commission MS-02-09/Boucher V. NEIGHBORHOOD MEETING The meeting for neighborhood input was held on December 3, 2002 in the Municipal Building located at 7500 West 29`h Avenue. Two people attended the meeting, and were in favor of the proposal. A summary of the meeting and sign in sheet has been included as Exhibits 5 & 6. VI. AGENCY REFERRALS All outside service agencies that currently serve the property will continue to serve the property, and have indicated that the property owner will incur any associated costs of improvement. A Drainage report has been reviewed and approved by the Public Works Department. The Final Plat has been reviewed by the City Surveyor, and has been approved in accordance with the subdivision regulations. The Public Works Department has indicated that 5 feet of dedication adjacent to lot 1 will be required for Pierce Street. This dedication is required to establish the standard right-of-way width of 50 feet. This area of dedication has been indicated on the plat. No public improvements will be required, and there will not be any escrow taken for construction of public improvements along Pierce Street. The Public Works Department has indicated that curb, gutter and sidewalk will be required on Otis Street for the portion only adjacent to lot 2. These public improvements will be constructed when the property develops. A development covenant and escrow will be required for the installation of curb, gutter and sidewalk on Otis Street, for the portion only adjacent to lot 2. VII. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff concludes that the final plat meets the subdivision requirements as described in Article IV of Chapter 26 of the Code of Laws. Therefore, staff recommends APPROVAL of Case No. MS- 02-09. VIII. Commissioner DAVIS expressed concern about the area between the King Soopers building and neighbors to the east. She asked if the plan included better screening in this area since there is only 38 inches between the building and the neighbors' fences. Travis Crane replied that this was not part of the plan. She also expressed concern about watering needs for proposed landscaping and lack of adequate lighting in some of the parking lot islands. Robert Bautsch 7838 S. Poplar Way, Englewood Mr. Bautsch, architect for the applicant, was sworn in by Chair McNAMEE. He stated that the applicant wishes to add additional retail space to the existing store as well as improve traffic circulation through the shopping center. In reply to a question from Commissioner DAVIS, Mr. Bautsch stated the application does not address any improvements behind the building. Commissioner DAVIS expressed concern about installation of sod which would require much water during the drought. Mr. Bautsch stated that landscaping is not finalized and watering needs will be taken into consideration. The City of Wheat Ridge is suggesting that the drainage be designed to flow to the west through the drainage and utility easement on the Last Greenhouse Subdivision. The City suggests holding the finish floor elevation along the rear of the structure, creating a high point at this location and grade the rear of the lots to release at the centerline of the drainage easement located along the boundary of Lots 2 and 3 of the Last Greenhouse Subdivision. This would require that the drainage swale on the Last Greenhouse be designed and constructed to convey flows to Pierce Street. Elevations would be required to verify grade from the Otis Lot 2, western lot line, to Pierce Street. The swale along the Last Greenhouse Subdivision would require that the construction be limited to the drainage easement and be constructed of rip-rap or approved equal (for maintenance purposes - or until the Last Greenhouse Subdivision application is in for a building permit). Swales along the perimeter of the lot would convey flows from the developed site to Otis Street as well as Pierce Street. This design would require that perimeter swales be located within the drainage easement to convey runoff. This design may eliminate the requirement of a detention pond. Please remove the Detention Pond Easement from the Final Plat. This design should also reduce the runoff that is flowing offsite to the north and south properties. The date and time of the meeting is Tuesday, December 3, 2002 at 6:30 PM. The location of this meeting is 7500 W. 29'" Ave, Wheat Ridge, Colorado. The purpose of this proposal is to change the property lines to show the ownership as it exists. We are not adding any additional lots or changing the zoning. We have attached an Exhibit portraying the changes. The City of Wheat Ridge has adopted a requirement that prior to any application for Rezoning of property, a Minor or Major Subdivision, and for Special Use Permits an applicant must notify all residents and property owners within 600 feet and invite them to a Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to present his proposal to the neighborhood and to give the neighborhood a forum to express their concerns, issues and desires. A Staff Planner will attend the meeting to discuss City policies and regulations and the process involved, however, the Planner will remain impartial regarding viability on the project Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimony, it is the public hearings in front of the Planning Commission and City Council where decisions are rendered. If you want input in the decision-making process, it is imperative that you attend the public hearings. The kinds of concerns residents normally have include the following: Is the proposal compatible with surrounding land uses and zoning? Are there adequate utilities and services in place or proposed to serve the project? What is the impact on our streets? How will this proposal affect my property? Where will the storm drainage go?
