Fax # 235-2949 Wheat GRidge Today I approved the third and final Temporary Use Permit for the triangular piece of your property for the purpose of temporarily storing trailers while your final development plan was in process. When this third Temporary Use Permit expires, anything stored on that property will need to be removed until such time as the final development plan is approved. I have discussed this issue at length with the City Attorney and he has confirmed that there are no administrative or Council approvals that would permit the continued temporary use of the property for storage. The director of planning and development has noticed adjacent property owners in a form and manner as required for minor variances and waivers as set forth in Section 26-109, and has received no objections. 4. The owner or owner's agent approves in writing of the proposed temporary use, building or sign. If all the conditions above are met, the director of planning and development may issue a one month temporary permit, provided the findings of fact below are met: Findings of Fact: The proposed temporary use, building or sign : 1. Will not have a detrimental effect upon the general health, safety or welfare and convenience of persons residing or working in the neighborhood of the proposed use; and 2. Will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution, or cause drainage problems for the general area; and 3. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off site; and 4. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties; and 5. Will not overburden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. This request for a 30 day temporary use permit extension meets all applicable conditions as required by Section 26-115(D) of the City of Wheat Ridge Code of Laws. Staff has not received comments in opposition to this request from the surrounding neighbors.
