The property is located at 3600 Youngfield Street and is zoned Planned Commercial Development (PCD). Pursuant to Section 26-115 (D) of the Wheat Ridge Code of Laws, the Zoning Administrator is empowered to decide upon applications for a thirty (30) day temporary use permit, without requirement of public hearing, provided that the following conditions are met: 1. The duration of the building, use or sign shall not exceed one (1) month. 2. No other temporary permit has been issued within the previous one (1) year for the same or similar building, use or sign on the same premises. 3. The director of planning and development has noticed adjacent property owners in a form and manner as required for minor variances and waivers as set forth in Section 26-109, and has received no objections. 4. The owner or owner's agent approves in writing of the proposed temporary use, building or sign. If all the conditions above are met, the director of planning and development may issue a one month temporary permit, provided the findings of fact below are met: Findings of Fact: The proposed temporary use, building or sign : 1. Will not have a detrimental effect upon the general health, safety or welfare and convenience of persons residing or working in the neighborhood of the proposed use; and 2. Will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution, or cause drainage problems for the general area; and 3. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off site; and 4. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties; and 5. Will not overburden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. This request for a 30 day temporary use permit meets all applicable conditions as required by Section 26-115(D) of the City of Wheat Ridge Code of Laws. Staff has not received comments in opposition to this request from the surrounding neighbors. I would like to take this opportunity to thank you for responding to our mailing. I am always pleased to hear from the residents of this community, especially when an issue within their neighborhood is of some concern. I would like to explore your letter further, and explain my role as the Planning Director as it applies to any Temporary Use Permit. When an applicant submits an application for a Temporary Use Permit, I am bound by the Wheat Ridge Code of Laws to notify the immediate neighborhood and start a ten-day review period. During this time, the Code of Laws dictates that I receive and review all comments submitted by residents which directly affect the proposal. In this case, the proposal was for a thirty-day Temporary Use Permit for the purposes of conducting an outdoor garden sale. Your letter contained three conditions which you feel should be addressed as part of any approval. The first condition is to limit the use to a 30-day permit. The applicant has the right under our Code to request two additional 30-day periods to conduct a temporary use. I cannot deny the applicant this right unless the conditions of the original approval are not met. The second condition in your letter is not directly related to the request of conducting an outdoor garden sale. The specific condition of the Applewood Shopping Center is not under scrutiny in this case. The third condition is a good idea and I will incorporate it into any approval. Thank you for your input. Our plans ( please refer to diagram) are set up both to provide the customers with easy access to our most popular summer items as well as a very organized layout using our beautiful array of flowers to give an inviting and attractive look. It will be our committment to the City to ensure the area will be kept neat and clean. The items we will use for our corral are bagged soils, play sand, assembled grills, assembled lawn mowers, swing set displays, plastic swimming pools, and of course a great color assortment of flowers. We will use cinder blocks and eight foot timbers to enclose the corral area. As you can see from the diagram, we are not planning to use the entire section of the upper parking lot leaving a loading zone, fire lane and a few parking spaces. We are really excited about the plan and the opportunity to increase our service to the people of Wheat Ridge. This plan will benefit both our stores ability to serve our customers and the community for an attractive looking store and increase of sales. We look forward to serving you.
