At its meeting of July 8, 2002, City Council approved your request of a zone change from Restricted-
Commercial (R-C) to Restricted-Commercial (R-C) and Residential-One C (R-1C) for property
located at 6455 West 38`h Avenue for the following reasons:
1. The change in zone will bring the properties into conformance with the City of Wheat
Ridge Comprehensive Plan goals, objectives and policies.
2. The change in zone will eliminate the encroachment of commercial zoning into this
neighborhood.
3. The change in zone will not create an isolated or spot zone district.
4. The zone change is compatible with the surrounding area.
5. The change of zone will not adversely affect the public health, safety or welfare.
Attached is a draft copy of the minutes stating the Council's decision.
A blackline photographic mylar of the subdivision plat approved by Planning Commission on May 16,
2002, needs to be submitted for recording with Jefferson County within 90 days of final action.

title, summary and background Clerk assigned Ordinance No 1252
Leslie Cavness, 2273 S Fillmore Street, applicant, was sworn in by the Chair She stated
that the property is a little over 1 acre and they are proposing 2 residential lots to be
subdivided of what is currently zoned R-C and would become R-1 C, the remainder of the
property would remain the existing zoning and there are no development plans at this time
Alan White, Planning Director for the City, was sworn in by the Chair, and presented the
staff report. He also stated that the title of the Ordinance is incorrect and submitted a new
title
Motion by Mr Mancinelli that Case No WZ-02-01, a request for approval of rezoning for

Section 2. Vested Property Rights. Approval of this rezoning does not create a vested
property right. Vested property rights may only arise and accrue pursuant to the provisions of

Section 3. Safety Clause. The City Council hereby finds, determines, and declares that
this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it
is promulgated for the health, safety, and welfare of the public and that this ordinance is
necessary for the preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a rational relation to
the proper legislative object sought to be attained.
Section 4. Severability. If any clause, sentence, paragraph, or part of this Zoning Code
or the application thereof to any person or circumstances shall for any reason be adjusted by a
court of competent jurisdiction invalid, such judgment shall not affect application to other
persons or circumstances.
Section 5. Sunersession Clause. If any provision, requirement or standard established by
this Ordinance is found to conflict with similar provisions, requirements or standards found
elsewhere in the Code of Laws of the City of Wheat Ridge, which are in existence as of the date
of adoption of this Ordinance, the provisions, requirements and standards herein shall supersede
and prevail.
Section 6. This. ordinance shall take effect . 15 days after final publication.

on this 10ttday of June 2002, ordered published in full in a newspaper of general
circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set

SUMMARY AND BACKGROUND: The applicant (The Buckeye Group) is requesting approval of a rezoning

JURISDICTION:
The property is within the City of Wheat Ridge, and all notification and posting requirements have been
met, therefore, there is jurisdiction to hear this case.
I. REQUEST
The applicant is requesting approval of a rezoning from Restricted Commercial (R-C) to Restricted
Commercial and Residential-One C (R-1C)(Exhibit 1, Application and Exhibit 2, Applicant Letter).
Two lots would be rezoned from Restricted Commercial to R-1C for the purposes of constructing
single family homes.
H. CASE ANALYSIS
The property in question is approximately 55,103 square feet in area. The current zoning is Restricted
Commercial (Exhibit 3, Vicinity Map). The lot has frontage on both W. 38' Avenue and W. 39`h
Avenue. Currently, there is a single-family home on the lot. All lots meet the minimum lot size
requirements in their respective zone districts. Lots 1 and 2 are approximately 8,500 square feet in size.
The R-1C zone district requires a minimum lot size of 5,000 square feet. Lot 1 is approximately 80 feet
in width, and Lot 2 is 67.5 feet in width. The R-1C zone district requires a minimum lot width of 50
feet. Lot three will remain Restricted Commercial. While there are no minimum requirements for lot size
or area, future development must comply with the minimum landscaping and parking requirements, as
well as the maximum lot coverage requirement.
The single family lots will have access from W. 39`t` Avenue. The house and all appurtenant structures,
which are currently located on lot 3, will remain as a legal use. Pursuant to Section 26-204, any
residential use which was in existence on 3/11/97 located on a commercially zoned property is a
permitted use. The proposed R-1C rezoning will be compatible with the existing zoning of the
surrounding neighborhood.
There will be a detention pond required which will be located on the northern end of lot 3. The pond
will be located in an easement, and will be the responsibility of the owner of lot 3. The Public Works
Department has indicated that the pond must be constructed at time of development of lots 1 and 2.
The pond will outlet on the eastern side of lot 2 in a drainage easement. The drainage will then flow
north to W. 39`x' Avenue, where it will enter the City's system. The Public Works Department has also
indicated that the construction of curb and gutter will be required on 39' Avenue adjacent to lots 1 and
2. The Public Works Department has indicated that there are no plans to extend Lamar Street to the
south, and the small piece of Lamar which is adjacent to lot 1 will remain.
III. NEIGHBORHOOD MEETING
The meeting for neighborhood input was held on July 24, 2001 in the Municipal Building located at
7500 West 29`h Avenue. A sign in sheet (Exhibit 4) and synopsis of the meeting (Exhibit 5) are
included.

Two letters in opposition were submitted to the City, and have been added as Exhibits "6" and "T'.
IV. AGENCY REFERRALS
All outside service agencies that currently serve the property will continue to serve the property. The
Public Works Department has reviewed the drainage report and final plat document. The drainage
report has been approved.
All responding agencies have indicated that they may serve the property, and any improvement costs
will be incurred by the property owner. The Water and Fire Districts have indicated that a fire hydrant
is required at the northwest corner of 39' Avenue and Kendall Street. The cost of installation of the
hydrant will be the responsibility of the property owner.
V. PLANNING COMMISSION ACTION
Planning Commission heard this case on May 16, 2002, and recommended approval with no
conditions. Planning Commission also heard a request for a minor subdivision in conjunction with this
rezoning. There was no public dedication required, therefore Planning Commission was the final ruling
authority for the plat. Planning Commission recommended approval of the final plat contingent upon the
approval of the rezoning request by City Council.
VI. CRITERIA
Staff has the following comments regarding the criteria used to evaluate a change in zone (change of
zoning conditions):
1. That the existing zone classification currently recorded on the official zoning maps of
the City of Wheat Ridge is an error.

has Restricted Commercial zoning.
2. That a change in character in the area has occurred due to installation of public
facilities, other zone changes, new growth trends, deterioration, or development
transitions, and that the evidence supports the finding of the following.
There has not been a change in character to the area. This will, in effect, be down-zoning a
portion of the parcel to a residential classification. Currently, the entire lot could be developed
as a low intensity commercial site, extending north to 39' Avenue. The proposed zone change
will essentially extend the R-1C zone boundary from the neighboring properties to the east.

3. That the change of zone is in conformance, or will bring the property into conformance,
with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies; and
other related policies or plans for the area.
The Comprehensive Plan designates this area as Transitional Residential (TR) and Single Family
(SF-4). By subdividing and rezoning lots 1 and 2 to R-1C, the uses would be more consistent
with the Comprehensive Plan.
4. That the proposed change of zone is compatible with the surrounding area and there
will be minimal adverse impacts considering the benefits to be derived.
The proposed change of zone will be compatible with the surrounding area. 39' Avenue to the
north is entirely residential, and this proposed change of zone will create two more residential
lots in the neighborhood. Currently, the lot stretches more than 380 feet from W. 38"' Avenue.
This change of zone will reduce the amount of Restricted Commercial land, creating a buffer
from the more intensive uses of 38" Avenue.
5. That there will be social, recreational, physical and/or economic benefits to the
community derived by the change of zone; and
This could be a benefit to the area. The current zoning will allow a low-intensity commercial use
on the property extending north to W. 39' Avenue. The rezoning will create two residential lots
on W. 39`h, thereby creating a buffer to the neighborhood to the north.
6. That adequate infrastructure/facilities are available to serve the type of uses allowed
by the change of zone, or that the applicant will upgrade and provide such where they
do not exist or are under capacity.
All responding agencies are able to serve the property, and the cost and maintenance of any
improvements will be incurred by the developer. The applicant will incur the cost for the new
fire hydrant at the northwest corner of 39' and Kendall.
7. That the change of zone will not adversely affect public health, safety or welfare by
creating excessive traffic congestion, creating drainage problems, or seriously
reducing light and air to adjacent properties.
This proposed rezoning will not create excessive traffic or create drainage problems for the
neighborhood. This proposal should not reduce air or light to adjacent properties.
8. That the change of zone will not create an isolated or spot zone district unrelated to
adjacent or nearby areas.
This change of zone will not create an isolated zone district. The property is currently zoned
Restricted Commercial, and is surrounded to the south and west by commercially zoned
property. The proposed R-1C zoning on lots 1 and 2 will also be consistent with the
surrounding neighborhood, which is zoned R-1C.

VI. STAFF CONCLUSIONS AND RECOMMENDATION
Staff concludes that the proposed zone change is consistent with the Comprehensive Plan. The zone
change will eliminate the encroachment of commercial zoning into this neighborhood, and will not create
a negative impact in the neighborhood. Therefore, staff recommends APPROVAL of Case No.
WZ-02-O1.
VII. RECOMMENDED MOTIONS

The enclosed documents comprise the land use application for a partial rezoning and a minor
subdivision for the property located at 6455 West 38`h Avenue. The entire property is currently zoned R-C
and has a land area of 55,125 square feet (1.265 acres). The property fronts on both 38 h and 39`h
Avenues. The property owners propose rezoning the northern portion of the property (which fronts on 39`h
Ave.) to R-1C and subdividing two single-family residential lots at the northern end of the property. The
southern portion of the property which fronts on 38`h Avenue is not proposed for change. The zoning will
remain the same (R-C) on this portion of the property.
Summarized below is the proposed change in terms of land use and square footage on the parcel.
1. Lot 1 Zoning: R-1 C (Single Family Residential) Square Feet: 8,559
2. Lot 2 Zoning: R-1C (Single Family Residential) Square Feet: 8,437
3. Lot 3 Zoning: R-C (Restricted Commercial) Square Feet 38,129
Total Sq. Ft.: 55,125
The minimum lot size allowed in the R-1C zone district is 5000 sq. ft with side yard setbacks of 5
ft, front yard setbacks of 30 ft. and rear yard setbacks of 10 ft. The minimum lot width on such lots is 50 ft.
There are single family homes adjacent to the subject property which are also zoned R-1C. The proposed
land use change would be very compatible with the existing surrounding land uses. The general perception
given to the applicants by the attendees of the neighborhood meeting held July 24, 2001 was that 2
residential lots would be acceptable instead of 3 (originally proposed at that mtg.).

Existing use/site conditions: Parcel which extends from 38`h to 39" Avenue along Lamar Street with
an old house and some appurtenant structures. Much of the lot is
undeveloped land.
Applicants proposal: Rezone the northern half of the property to R-1C. This land would then
be subdivided into 3 lots for the purposes of constructing 3 single family
homes. The redevelopment of the southern portion of the lot is unclear
at this time.
Issues discussed: The first item that was discussed was that many of the attendees
remember this parcel being rezoned in 1987 to SFR. They remember
going through the process of rezoning and attending Council hearings.
After research by Staff, it was determined that this parcel was not part
of the mass rezoning that took place (Case # WZ-84-04). Many
people had questions about the quality of the new homes, the
construction materials, and if they would be owner occupied. A major
recurring question was about the size of the lots, and if they would fit
with the character of the existing neighborhood. A few attendees asked
if the City planned to continue Lamar Street through to 38' Avenue.
There was much concern about the side yard setbacks, parking, and
density. It seemed this idea would be much more appealing to the
neighbors of the applicant only created 2 single family lots.

Please be advised that at its meeting of May 16, 2002, the Planning Commission has recommended that City
Council approve your request for approval of a zone change from Restricted-Commercial (R-C) to Restricted-
Commercial (R-C) and Residential-One C (R-IC) for property located at 6455 West 38' Avenue for the
following reasons:
1. The change in zone will bring the properties into conformance with the City of Wheat Ridge
Comprehensive Plan goals, objectives and policies.
2. The change in zone will eliminate the encroachment of commercial zoning into this
neighborhood.
3. The change in zone will not create an isolated or spot zone district.
4. The zone change is compatible with the surrounding area.
5. The change of zone will not adversely affect the public health, safety or welfare.
Also, the Planning Commission approved your request of a three-lot minor subdivision for property located at
6455 West 38" Avenue for the following reasons:
1. The subdivision meets all requirements of the subdivision regulations.
2. The proposed lots all meet the minimum lot area and lot width requirements of the
subdivision regulations.
With the following conditions:
That the plat corrections recommended by city staff be made prior to recordation with
Jefferson County.
The subdivision approval is contingent upon prior City Council approval of the rezoning
request.

Commissioner SNOW stated she made the request to clarify the law concerning executive
sessions for the Urban Renewal Authority and whether or not the law is different than the law
for City Council executive sessions.
Commissioner COOPER commented that the Planning Commission was in unanimous
agreement to request the legal opinion.
Commissioner McNAMEE stated that she was not in agreement with this request made during
the May 2 Planning Commission meeting.
Commissioner McMILLIN stated he was in agreement with the request because he wanted
clarification as to when conversations with developers become a matter of public record.
Jerry DiTullio stated that the Urban Renewal Authority hired consultants to talk with potential
developers; however, there have never been any secret meetings between any developers and
the City Council or the Urban Renewal Authority. He took exception to the insinuation that
such meetings have occurred. He suggested that Planning Commissioners contact the City
Council when such questions arise.
Chair WEISZ commented that she was in agreement with the request because she just wanted
further clarification as to how the Planning Commission fits into the urban renewal process.
Commissioners PLUMMER, McMILLIN and COLLINS also indicated that this was their
purpose for the request.
PUBLIC HEARING
A. Case No. WZ-02-01: An application by the Buckeye Group, LLC for approval of a
rezoning from Restricted-Commercial (R-C) to Restricted-Commercial (R-C) and
Residential-One C (R-1 C) for property located at 6455 West 38a' Avenue.
The case was presented by Travis Crane. He reviewed the staff report, entered all pertinent
documents into the record and advised the Commission they had jurisdiction to hear the case.
A visual presentation was given showing photographs and layouts of the property included in
the application. Mr. Crane noted that a letter of opposition was received by the Planning
Department following the neighborhood meeting and was included as Exhibit C in the staff
report. Staff recommended approval of the application because the proposed zone change is
consistent with the Comprehensive Plan, would eliminate encroachment of commercial zoning
into the neighborhood, and would not create a negative impact upon the neighborhood. In
conclusion, Mr. Crane distributed copies of a letter from Kay Wells, 3895 Lamar Street, which
was received Monday, May 13. The letter stated she was not in favor of rezoning until her
questions could be answered.
Commissioner SNOW asked if the 35 foot detention pond easement was a part of lot 3. Mr.
Crane replied that it was a part of lot 3 and the owner of that lot would be responsible for
maintenance of the pond. Commissioner SNOW questioned number 4 of the notes regarding
dedication of the sidewalk. Mr. Crane explained that the Public Works Department did not
recommend dedication but suggested the sidewalk be placed in an easement. Commissioner

SNOW noted that the address in the letter of opposition (Exhibit C) was not close to the subject
property and asked if the person who wrote the letter also owned property near the area. Mr.
Crane replied that he did not know.

Ms. Cavness, representing the Buckeye Group, was sworn in by Chair WEISZ. Commissioner
McMILLIN asked if the applicant planned to develop lots 1 and 2. Ms. Cavness replied that it .
has not been determined whether they will build or sell the lots. They will definitely not be the
developer for lot 3.
Commissioner McMILLIN referred to the irregular shape of lot 1 and asked if Ms. Cavness had
received an architectural opinion regarding access. Ms. Cavness stated she has done
preliminary site planning and is satisfied that the driveway can be placed in an attractive and
functional manner.
In response to a question from Chair WEISZ, Ms. Cavness stated there are no present plans to
remove the structures from lot 3.
John Wright
3955 Lamar Street
Mr. Wright was sworn in by Chair WEISZ. He stated he would prefer one-story homes to be
built on the property to stay in character of the neighborhood. He also asked if Lamar Street
would be extended through to 38ffi. Travis Crane stated there are no plans for Lamar Street to
be extended.
James Johnson
3845 Kendall
Ms. Johnson was sworn in by Chair WEISZ. He expressed concern about maintenance of the
detention pond which would be directly behind his home. He was in favor of the zone change
to residential but asked that any development match the surrounding neighborhood. He also
expressed concern that building a home and driveway on lot one could adversely affect the
existing home on lot twelve.
Larry Maske
3855 Kendall
Mr. Maske was sworn in by Chair WEISZ. He preferred to see single story homes built on lots
one and two. He expressed concern about the location of the fire hydrant. Ms. Cavness
explained that the fire hydrant would be on the northwest corner of 39"' and Kendall and would
not be in front of Mr. Maske's house.
James Johnson returned to the podium. He stated that he had talked with a person surveying
the subj ect property who told him that modular homes were planned for the lots. He expressed
concern that modular homes would not fit in with the neighborhood.
In response to a question from Commissioner McMILLIN, Travis Crane stated that modular
homes are allowed in the City of Wheat Ridge.

Chair WEISZ asked the applicant if the Buckeye Group planned to build single story homes.
Ms. Cavness stated there are no development plans at present but would expect those rights
afforded under the zone district.
In response to a question from Commissioner McMILLIN, Travis Crane stated there are no
single story height limit restrictions in any zone district in the city.
There were no other individuals who wished to address the Commission. Chair WEISZ closed
the public hearing.
It was moved by Commissioner PLUMMER and seconded by Commissioner SNOW, that
a request for approval of a rezoning for property located at 6455 West 38th Avenue be
approved for the following reasons:
1. The change in zone will bring the properties into conformance with the City of
Wheat Ridge Comprehensive Plan goals, objectives and policies.
2. The change in zone will eliminate the encroachment of commercial zoning into this
neighborhood.
3. The change in zone will not create an isolated or spot zone district.
4. The zone change is compatible with the surrounding area.
5. The change of zone will not adversely affect the public health, safety or welfare.
Commissioner McMILLIN complimented the applicant for presenting a good design which
will serve as buffering between residential and commercial along 38 h Avenue. In regard to the
concerns expressed about single story houses, he reminded the neighbors that commercial
zoning has a height limitation of fifty feet.
Commissioner SNOW advised the neighbors that there is no way, other than subdivision
covenants, to limit houses to one story. She further stated that state law does not allow the city
to prohibit modular homes.
The motion passed 8-0.
B. Case No. MS-02-02: An application by the Buckeye Group, LLC for approval of a 3-
lot minor subdivision plat on property located at 6455 West 38th Avenue.
This case was associated with the prior case. There were no questions of staff or the applicant.
Chair WEISZ asked to hear from members of the public. The following addressed the
Commission:

Mr. DiManna was sworn in by Chair WEISZ. He expressed concern about increased parking
that would result from the proposed development because the street is very narrow. He
expressed concern about the detention pond which could be a breeding ground for mosquitoes.

Mr. Larson was sworn in by Chair WEISZ. He also expressed concern about increased parking
in the area.
There were no other individuals who wished to address the Commission. Chair WEISZ closed
the public hearing.
Commissioner SNOW asked if there was any way to restrict parking in the area. -Travis Crane
replied that there was not.
Commissioner McMILLIN commented that the proposed development would result in fewer
parking problems than other types of development could cause.
It was moved by Commissioner SNOW and seconded by Commissioner MCNAMEE that
Case No. MS-02-02, a request for a three-lot minor subdivision for property located at
6455 West 38th Avenue be approved for the following reasons:
1. The subdivision meets all requirements of the subdivision regulations.
2. The proposed lots all meet the minimum lot area and lot width requirements of the
subdivision regulations.
With the following conditions:
1. That the plat corrections recommended by city staff be made prior to recordation
with Jefferson County.
2. The subdivision approval is contingent upon prior City Council approval of the
rezoning request.
The motion passed 8-0.

I have completed the third review of the above referenced documents
for the Cavness-Huggins Subdivision received on April 26, 2002, and
have the following comments:
Subdivision Plat
1. The parcel boundary and Lot 1 do not close due to an incorrect
bearing along the East line of Lamar Street.
2. The bearing of the lot line along the east side of Lamar Street
for Lot 1 needs to be changed to a Southeasterly bearing. The
bearing of the Lamar Street Right-of-Way is S 00°17'19" E.
3. Use a solid dark line for the sidewalk easement for clarity.
4. Move the text of the diagonal line of the sidewalk easement.

Public Improvements Cost Estimate & Guarantee
Prior to any construction commencing for the required public
improvements within the Lamar Street & W. 38th Avenue right-of-way,
an itemized engineer's cost estimate has been submitted for review
and approval. A letter of credit reflecting total costs of the
approved cost estimate plus 250, will need to be submitted by the
owner/developer for review and approval. This updated estimate is to
be stamped by the engineer.
Right-of-Way Construction Permit(s)/Licensing
Prior to any construction of the public improvements, the necessary
right-of-way construction permit(s) and respective licensing will
need to be submitted for processing by the City.

Dear Mr. Hollender,
The Public Works Department has completed a site analysis for the proposed subdivision and made the
following conclusions:
❑ The Right-of-Way requirement of 5-feet along W. 39`h Avenue will not be required.
❑ The pubic improvements will be required. A plan and profile will be required to verify that
flows will get to Kendall Street.
❑ W. 39`h Avenue may require a skin patch to make the surface flow reach the new flowline. It
visually appears that there is an existing depression on the south side of W. 39`h Avenue and
adjacent to the proposed development. Cross-sections may be required to determine the limits
of the asphalt skin patch.
❑ The Final Drainage Report shall describe how the flows from the commercial property will not
flow onto the single family residences. This should include discussion regarding the roof tops of
the existing structures along the north property line. The Drainage Report shall have discussion
regarding the construction of the pipe from the commercial property to W. 39`h Avenue. There
should also be language to include the requirements for the pond design. The pipe needs to be
functioning with a temporary inlet design that will allow the flows to pass through it without
debris clogging the pipe. The pipe and inlet shall be constructed and functioning prior to
issuance of the Certificate of Occupancy for the single family residences.

The Public Works Department has reviewed the Planning Department referral dated January 4, 2002 for the

The proposed Final Plat has been forwarded to the Dave Brossman, P.L.S. for review. Subsequent
comments will be coordinated in writing to the preparer of this document, M. Douglas Hoos, P.L.S. of
American West Land Surveying Company, Inc.
2. A Subdivision Improvement Agreement will need to be executed by the developer/owner upon City
Council approval of the proposed Final Plat.
3. The Final Plat will need to be recorded with Jefferson County no later than ninety (90) days after the
execution of the Subdivision Improvement Agreement.
4. We are in receipt of a final drainage report prepared by Henry Hollender, P.E. of HV S Engineering,
Inc. Subsequent comments will be coordinated in writing to Mr. Henry Hollender.
We will need engineered construction plans based upon the City's street construction plan criteria, and
prepared by a Colorado licensed professional engineer, for the public improvements required to be
constructed along the Lamar Street and W. 39th Avenue frontages.
6. We will need a completed Application for Minor Dumping/Landfill Permit, along with fees due. In
conjunction with the requirements of this permit, an erosion control plan will need to be submitted for
review and approval.,
Prior to recording the Final Plat, an irrevocable letter of credit, in which the-City is designated as
beneficiary, for one hundred twenty-five percent (125%) of the total cost of the proposed public
improvements, will need to be submitted by the developer/owner to serve as guarantee for the value of
those public improvements (as determined by the itemized cost estimate prepared by the project's civil
engineer-of-record), that are required to be constructed per item 5 above.
8. The terms of Section 5.20 - Street Width Designation - of the City Charter, will need to be satisfied by
the developer for the proposed W. 391 Avenue and Lamar Street right-of-way dedication.

I have completed the initial review of the application and plat for the rezoning and subdivision of 6455
W. 38' Avenue, and I have the following comments:
General:
A. All agencies referrals have been included for your review. These referrals include
comments from the water district, sanitation district, fire district, police department, and
public works department. Any questions concerning their comments should be directed
to the agency which generated the comments.
Plat Review:
A. The Xcel Energy and Qwest Communications signature blocks should be removed
from the plat.
B. Under the Clerk and Recorders signature block, the phrase Plan File Fees
Paid_ should be removed and replaced with "Book Page
C. Each lot should have drainage and utility easements located at the perimeter. Front and
rear property lines should have a ten foot easement, while both sides should have a five
foot easement. These easements should be clearly noted and shown on the plat.
D. Under the Notes heading, an additional note should be added which reads: "Ten-foot
(10') wide easements are hereby granted on private property adjacent to all public
streets and front and rear property lines of each lot in the subdivision or platted area.
Five-foot (5') wide easements are hereby granted on private property adjacent to all
side lot lines of each lot in the subdivision or platted area. These easements are

Drainage Study (Discussion)
1. The Drainage Study submitted for review has been reviewed. After
reviewing this Study, staff strongly suggests that the pond have to
its own tract located on the south lot against the lot lines. The
appropriate detention pond language shall be on the plat. The pond
and all drainage apertures are to be maintained by a Homeowners
Association.
2. Please include language stating how deep the water would be in the
pond during the 5-year and 100-year storm events and the respective
drain times.
3. Please indicate in the report who would be responsible for
maintaining the pond, structure and pipe.
4. Please provide P.E. seal and signature on the final approved
report.
Drainage Plan(s)
1. Please provide clear, concise cross-sections at the locations
shown on the plan.
2. Please provide a trench detail for the 12" CMP.

details (low impact handicap ramp, local street typical
section, patch back, monolithically placed 6" vertical curb and
gutter & sidewalk section, standard driveway cut, recharge inlet, and
sidewalk chase), have been provided for implementation into the
requested plan.
Subdivision Plat
1. The parcel boundary does not close.
2. The lot line along the east side of Lamar Street for Lot 1 is
encroaching into City ROW by approximately 1 foot and is not parallel
with east ROW line of Lamar.
3. Use City Base bearing for Basis of Bearing (please see Plat).

5. Need to indicate the Detention/Retention Easement area, and

The design concept that was submitted for review is acceptable in
concept. The Public Works Department suggests that an alternative
drainage solution be investigated so that the pond is not located in
the backyard of one of the two new single family residences. This
design would make the property owner with the pond liable and
responsible for maintenance on the detention pond, pipe and
structure. An alternative location may be on the north side of the
lot that has the existing structures. A pond with a recharge inlet
located in it may be an alternative should soil tests allow such a
design. Language stating it would support this design would have to
be included in the Final Drainage Report. Should the soils not
warrant the use of a recharge inlet, a pipe from the pond that flows
north to W. 3811 (with a drainage easement for the pipe on the Final
Plat) is another alternative design. The Planning Department has
informed the Public Works Department that Staff would not support the
concept of having the backyard of a single family residence as a
detention pond when there are other solutions that may be used and
the amount of property available at another location.

I have reviewed the plans for the above listed site. Please consider the following
recommendations while developing this site:
LANDSCAPE:
1. All mature trees to be trimmed of branches up 6'-8' from the ground to allow for
natural visual observation from surrounding areas to the parking lots and building.
2. All shrubs and bushes mature height to not exceed 36". This height reduces the
risk of persons hiding. It also allows for natural visual observation onto the property
both for the parking lot and building.
3. Plants/ landscape immediately next to the building should be low-growing ground
cover, not to exceed 18" mature height to allow for maximum natural visual
observation and eliminate concealment for potential offenders.
4. Ground cover should not include rock material. Rocks can be used to break
windows in the buildings and cars. Consider using natural products such as bark or
mulch.
BUILDINGS:
1. The building finish should be with an anti-graffiti paint or sealant.
FENCING:
1. Consider using wrought iron fence instead of cedar. By putting up a wrought iron
fencing around the property, you will minimize the chance of vandalism, graffiti and
climbing. The initial investment in the fence will be higher, however the long term
pay of by not having to repair the fence will be greater.
SITE:
1. During construction, the property should be clearly posted with "No Trespassing"

signs. This may help deter trespasses, and allow the Police Department to cite
offenders with the crime along with any others offenses that may be committed by
trespassers.
LIGHTING:
1. Exterior lighting around the buildings and in parking lots should be a minimum of
1.5 candle minimum maintained. This will provide for brightly lit areas that
discourages criminal activity due to the illusion /perception of observation and
recognition.
From these plans, I have no further recommendations at this time. Revisions in the
plans, may alter my recommendations.
While my recommendations do not guarantee a crime-free environment, it has been
experienced that application of the concept of Crime Prevention Through
Environmental Design (CPTED) will reduce the opportunity for crime to occur and will
enhance the quality of life. Please consider these suggestions while developing this
property.

This letter is in response to your request for confirmation of the availability of sanitary sewer
service for the above parcel.
The property is entirely within the boundary and service area of the Wheat Ridge Sanitation
District. Treatment of sewage generated within the Wheat Ridge Sanitation District is provided
by the Metro Wastewater Reclamation District (Metro).
Proposed Lot 1 might possibly be served via an existing 8-inch sanitary sewer in Lamar Street,
however, the District's sanitary sewer facilities will need to be extended in order to provide
service to Lot 2. It is assumed that service to Lot 3 will be via existing District facilities in 38"'
Avenue. The developers should make their own determination as to the most appropriate means
of providing service to these parcels, consistent with the District's rules, regulations and criteria.
Service to these new parcels will be subject to the assessment of both Wheat Ridge Sanitation
District and Metro tap charges.
In addition, you should be aware that the District requires approval of plans for sewer service
connections, determination of the associated tap fees and payment therefor, as well as inspection
of construction by the District's Engineer.

Existing use/site conditions: Parcel which extends from 38" to 39' Avenue along Lamar Street with
an old house and some appurtenant structures. Much of the lot is
undeveloped land.
Applicants proposal: Rezone the northern half of the property to R-1 C. This land would then
be subdivided into 3 lots for the purposes of constructing 3 single family
homes. The redevelopment of the southern portion of the lot is unclear
at this time.
Issues discussed: The first item that was discussed was that many of the attendees
remember this parcel being rezoned in 1987 to SFR. They remember
going through the process of rezoning and attending Council hearings.
After research by Staff, it was determined that this parcel was not part
of the mass rezoning that took place (Case # WZ-84-04). Many
people had questions about the quality of the new homes, the
construction materials, and if they would be owner occupied. A major
recurring question was about the size of the lots, and if they would fit
with the character of the existing neighborhood. A few attendees asked
if the City planned to continue Lamar Street through to 38' Avenue.
There was much concern about the side yard setbacks, parking, and
density. It seemed this idea would be much more appealing to the
neighbors of the applicant only created 2 single family lots.

Notice of Nelahborhood Input Meetinsi
The Buckeye Group, LLC and Jim Huggins are proposing a partial rezoning and a minor
subdivision for three single-family residential lots on the northern portion of the property
located at 6455 West 3e Avenue, Wheat Ridge, Colorado. The date and time of the
meeting is Tuesday, July 24, 2001 at 6:00PM. The location of the meeting is the
2nd Floor Conference Room, Wheat Ridge Municipal Building (7500 West 2e
Ave.) The purpose for this proposal is to request that 3 single-family residential lots (R-
10 zoning) be subdivided and rezoned from the existing R-C (Restricted Commercial)
zoning on the property. The zoning of the southern portion of the property fronting on
38s' Avenue will remain the same. Only the northern portion of the property is proposed
for rezoning and minor subdivision.
The City of Wheat Ridge has adopted a requirement that prior to any application for
rezoning of property, a minor or major subdivision, and for special use permits an
applicant must notify all residents and property owners within 600 feet and invite them to
a Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to
present his proposal to the neighborhood and to give the neighborhood a forum to
express their concerns, issues and desires.
A Staff Planner will attend the meeting to discuss City policies and regulations, and the
process involved, however, the Planner will remain impartial regarding viability of the
project.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be
entered as testimony, it is the public hearings in front of the Planning Commission and
City Council where decisions are rendered. If you want input in the decision-making
process, it is imperative that you attend the public hearings,
The kinds of concerns residents normally have include the following:
• Is the proposal compatible with surrounding land uses and zoning?
• Are there adequate utilities and services in plats or proposed to serve the
project?
• What is the impact on our streets?
• How will this proposal affect my property?
• Where will the storm drainage go?
• How will the project be designed to enhance rather than detract from the
neighborhood?
• What specific changes can be made in the proposal to make it more
acceptable to me?
