If the mylars are not received, the approval for Case No. WZ- 02-12 will be rescinded. Pursuant to Section 26-308.C.6.Recordation "Should a recordable approved outline development plan not be provided to staff within thirty (30) days of council's final action, staff shall schedule a public hearing before city council and city council shall reconsider its approval." Once approval status is lost, the property reverts back to Agriculture-One zoning and code action will be taken to bring the property into conformance with all code violations. As the property has been utilized in violation of zoning for over a year, the resultant fines could be very substantial. If you have any questions please contact me at 303-235-2845. The area is transitioning toward more commercialization. 2. The desirability of the property to be used for residential purposes is questionable. 3. The proposal is consistent with adjacent commercial uses. 4. There will be economic benefits derived from the zone change. 5. The requirements for an outline development plan have been met. Michael Pesicka, Community Development, was sworn in by the Chair and presented the staff report. John Durham, was sworn in by the Chair. He is with the Norris Dullea Company. They are representing the ownership on this application. He clarified some points and was present for questions. Charles Steismeyer, 4996 Parfet Street, was sworn in by the Chair and spoke in support of the application, provided that some trees are planted as promised by the applicant. STATEMENT OF THE ISSUES: The applicant does not concur with condition number 2 regarding building size and height. They have requested that the City Council consider a 35' height limitation rather than 25'. Staff agrees with the modifications from the Planning Commission recommendation and has modified the recommended conditions of approval accordingly. Planning Commission WZ-02-12/Hoss 1 ATTACHMENT 1 L REQUEST The applicant is requesting approval of a change in zone for property located at 5130 Parfet Street from Agriculture-One (A-1) to Planned Industrial Development (PID), and for approval of an outline development plan (Exhibit 1, Application). The purpose of the rezoning is to allow for an existing electrical contractors yard to remain on the property, and to construct a new building to house the business (Exhibit-2, Letter of Request). The applicant/owner does not reside on the property. The business is currently located in an existing house, detached garage and storage shed, all of which will remain on the property with the proposed change in zone district. Behind the house, the applicant has constructed a six-foot chain link fence for storage of bulk materials. The intent of the outline development plan is to establish allowed uses of the property, and sets general design standards such as maximum building height, minimum landscape coverage, parking standards, and intended character of the development. Currently, the applicant is petitioning to be removed from the Fruitdale Sanitation District, and become a part of the Clear Creek Sanitation District (Exhibit 3, Petition Letter). The applicant stated that the petition application will require 90-120 days to be processed, and staff has allowed the applicant to proceed with the outline development plan portion of his application. Once the petition process is finalized, the final development plan and final plat will be processed. If the property were redeveloped with the current zoning, three single-family residences would be allowed. Included in your packet are full size plans for the outline development plan (Exhibit 4, Outline Development Plan). The plan shows the proposed layout for Lots 1,2 & 3, these lots will be used for reference purposes only in this report. II. CASE HISTORY The property in question is approximately 97,633 square feet in area. The property is presently zoned Agriculture-One (A-1) (Exhibit 5, Vicinity Map). The proposed change in zone is for Lots 1 & 2. Lot 3 will remain unchanged. Lot 1, is currently being utilized as an electrical contractors storage yard, and for bulk storage and vehicle parking, which is not allowed in the A-1 zone district. Because of these violations, the applicant was notified that he would need to apply for a zone change. Lot 2 is undeveloped land. This property has a unique configuration to it. Lot 1 is rectangular in shape and is relatively flat. It is connected to Lots 2 & 3 by a narrow strip of land (approximately 50' wide by 80' long) running north to south. A rather severe slope runs from north to south on Lot 2, and there are two irrigation ditches that cross the property east to west, (the Wadsworth Ditch and the Swadley Ditch), and both ditches are active (Exhibit 6, Topo Map). The surrounding area of the property cannot be fully appreciated looking only at a zoning map, so an aerial photo of the property has been included for viewing purposes (Exhibit T Aerial Ploto The large area of land that lies west of Parfet Street is used for an Xcel Energy electrical substation. Properties to the north are planned industrial/business parks. Four single-family residences abut the western property line that does extend to Parfet Street. A large piece of A-1 zoned land lies immediately to the south, and is currently used for grazing. Further to the south lies a vacant eight-acre parcel of land that is zoned Planning Commission WZ-02-12/Hoss commercial. To the southeast is L &K Industrial Park, and to the east are Inland Container Corporation, and Rocky Mountain Bottling Company. Except for the subject property, and the remaining single- family homes, the majority of the surrounding uses are light industrial or commercial in nature. There is vehicular access via the Parfet Street frontage, while Oak Street and W. 50'h Avenue dead end into the southeast corner of the property, where a gate now blocks previous access. A pre-application meeting was held with the applicant on January 22, 2002, at which time the applicant was notified of all processes and procedures required to rezone the property. If the zone change is denied by City Council, the city will proceed with code action with the owner to cease the existing use on the property. III. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on July 9, 2002. The following persons were in attendance: Michael Pesicka - City Staff Dave Hoss - Owner/applicant Frank Wehling - 5006 Parfet Street C.B. Steismeyer - 4996 Parfet Street The following issues were discussed: -Area residents requested that the southern portion of the proposal remains zoned Agricultural -Neighbors do not want to see more agricultural land disappear from Wheat Ridge. -Area residents would like to see access be restricted to Parfet Street. -How will the drainage problems that are not related to the ditches be resolved? IV. AGENCY REFERRALS All agencies are currently able to serve the property and can continue to do so with the proposed zone change. Any changes required by the referral agencies will be addressed when the final development plan and plat are submitted. V. PROPOSED OUTLINE DEVELOPMENT PLAN ALLOWED USES A wide variety of commercial and light industrial uses are proposed for the development. Uses that are inappropriate or do not fit in with the general character of the area are not listed in the use chart on the outline development plan. Uses proposed are consistent with those allowed in adjacent commercial and industrial areas. Outside storage will be allowed as long as it is screened. GENERAL DESIGN PARAMETERS The intent of the outline development plan is to establish the zoning and general development concept. It provides generalized graphic and written information on layout, uses and intended character of the development. VI. CRITERIA Staff has the following comments regarding the criteria used to evaluate a change in zoning: 1. That the existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is an error. The existing zone classification on the official zoning map is not in error. The property currently has Agriculture One (A-1) zoning. 2. That a change in character in the area has occurred due to installation of public facilities, other zone changes, new growth trends, deterioration, or development transitions, and that the evidence supports the finding of the following Surrounding neighborhoods have remained unchanged for several years. The property to the north has been an industrial park since 1972, and the property to east has been zoned PID since 1982, and is presently occupied by Inland Container Corporation. This is a transitional area. Although there are four existing single-family residences to the west, the general trend in this neighborhood is towards more commercialization of properties. The agricultural identity of the area is diminishing, and development is transitioning towards light industry and commercial uses. 3. That the change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, and other related policies or plans for the area. The Comprehensive Plan future land use map designates that this property should consist of Agricultural and Estate Residential (AER) uses (Not to exceed one dwelling unit per acre). The AER designation describes the desired character as "neighborhoods with very low density housing and a predominantly rural character." Desired attributes consist of. well maintained dwellings, lots comprised of primarily open lands, allowed to raise domesticated farm or ranch animals, ability to construct accessory structures that assist in the production of value-added agricultural products, private and unpaved roads, and densities not to exceed one dwelling unit per acre. Staff questions the desirability of this area as estate lots within such close proximity of commercial and industrial uses. Planning Commission WZ-02-12/Hoss The Comprehensive Plan Designation is AER, but property directly to the east and further to the north is shown as Planned Business/Industrial Park. There are no existing dwelling units on the property, Agriculture-One zoning borders the property to the south and west, and PID zoning lies to the north and east. If developed under A-1 zoning, three single-family units could be developed on this property 4. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. Across Parfet Street to the west is A-1 zoning, and an Xcel electrical substation, single-family residences with ancillary agricultural uses abut the property to the south and immediately to the west of the subject property. To the north and east lies PID zoning, with light to moderate industrial activities on these properties. 5. That there will be social, recreational, physical and/or economic benefits to the community derived by the change of zone; and There will probably not be social, recreational or physical benefits to the community as a result of the change in zone. If the property is developed there may be an economic benefit to the city through tax increases since the majority of the property is presently undeveloped land. 6. That adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. All agencies are currently able to serve the property and can continue to do so with the proposed zone change. Any changes required by the referral agencies will be addressed when the final development plan and plat are submitted. That the change of zone will not adversely affect public health, safety or welfare by creating excessive traffic congestion, creating drainage problems, or seriously reducing light and air to adjacent properties. The proposed rezoning will not create any adverse public health, safety or welfare issues. There will be no excessive traffic congestion or drainage problems, and light and air to adjacent properties will not be compromised as a result of the proposed rezoning. 8. That the change of zone will not create an isolated or spot zone district unrelated to adjacent or nearby areas. Currently, the subject property is zoned A-1, which is in character with the existing zoning to the south and west. Rezoning the property to PID would not constitute spot zoning since properties to the north and east are zoned PID. VII. STAFF CONCLUSIONS AND RECOMMENDATION Staff concludes that this is a transitional area that is becoming more commercialized. Although the property is designated as AER on the Comprehensive Plan, Staff questions the desirability of the property for residential estates given the amount and intensity of businesses in close proximity. Because the proposal is consistent with adjacent commercial uses and there will be economic benefits derived from the zone change, a recommendation of APPROVAL is given. This site will serve as the Hoss Electric business office, supply storage, and indoor work area. The primary work site of the Hoss Electric employees is on the job sites around the metro area, not at the office site. 2. Rezoning a. Need for the change of zone. As you are aware, Hoss Electric is currently operating within an Agricultural Zone District and is in violation of the Wheat Ridge Code. Rezoning to Planned Industrial Development will bring the current use into compliance with the Code. However, the need for the zone change extends beyond Code compliance. This is an area of Wheat Ridge that is characterized by a combination of industrial and agricultural uses, with residences on agricultural lots. This parcel, adjacent to existing industrial uses on the north and east sides and large lot agricultural residences on the south and west sides, allows Wheat Ridge to change their zoning to allow this type of use without greatly affecting the character of the existing development or creating any significant negative impacts to the residential development. This parcel would act as a transition area between the larger, higher intensity industrial developments and the large lot residences. As the FDP illustrates, the smaller lot sizes will inherently result in development at a scale that is more moderate and more compatible with the agricultural nature of the residential lots. This is an opportunity for Wheat Ridge to create a parcel where a small industrial business can operate and co-exist peacefully with its neighbors. b. Present and future effect on the existing zone districts, development and physical character of the surrounding area. The effect of this development on the surrounding area will be one of a transition zone . between larger industrial uses to the north and the large lot agricultural uses to the south and west. The FDP, being processed concurrently, illustrates the proposal for future development and demonstrates that it will not adversely affect the surrounding character of the area. c. Access to the area, traffic patterns and impact of the requested zone on these factors. Access to the area is from Parfet Street. Rezoning from A-1 to PID will increase the amount of trips generated by this parcel. The traffic demand for Hoss Electric would be generated from 6-8 on site office employees, with the foremen and electricians working offsite. The foremen, approximately 9-15 people, come to the office once a week. Should Lot 1 be occupied by another user, the square footage and the fact that it is a residential structure would not lend themselves to a high traffic generating use - the parking for that site has been based on office usage - and therefore would not significantly impact traffic. d. Availability of utilities. Lot 1 is currently served with water, sewer, and dry utilities. A water and sanitary sewer easement currently follows the western boundary of the site, from which those utilities will be extended to the proposed building on Lot 2. Dry utilities will be extended to Lot 2 from Lot 1. e. Present and future effect on public facilities and services, such as fire, police, water, sanitation, roadways, parks, schools, etc. This development is projected to have minimal if any impact on public facilities and services with the exception of roadways, although as mentioned previously the traffic generated is projected to be low. In regards to the availability and usage of water, the plant palette selection has been developed with a conscious effort to minimize the use of irrigated water. These plants are deemed xeric by Denver Water. In addition, the majority of the existing trees have been saved in an effort to reduce the amount of irrigated water required for new trees and also to minimize impact on the landscape. 2. Specifics of the Character of Development a. Design Concept This site was designed as a light-moderate intensity of industrial use. The existing residential structure is proposed to remain on Lot 1. Lot 2 would be of a more moderate intensity, but has been designed so that the building is located away from the side of the lot adjacent to existing agricultural lots with residences to the west, set back approximately _ feet. The outdoor storage area has been located so that it would have minimal effect on adjacent agricultural lots with residences. A proposed 6' wood fence and landscaping will be located between the parking lot and the lots to the west. b. Architecture The proposed Hoss Electric office/warehouse will be one story with a mezzanine. The proposed new structure will contain 4,484 sq. ft. of office and 4,694 sq. ft. of warehouse/shop area, totaling 9,178 sq. ft. The building style is consistent with existing adjacent industrial development, but is significantly smaller. The proposed architectural plans provide detailing at the entrance through the use of stucco and exposed concrete with a roof overhanging a stoop area. A metal frieze will be used consistently on all sides of the building, and the majority of the building materials will consist of concrete block and split face block. A galvanized or stainless steel metal roof is proposed. A four-foot wainscot of colored block will wrap around the entire building to add visual interest and help break up the mass of the building. c. Landscaping The proposed landscape plan has been designed with a conscious effort to minimize the use of irrigated water. With continued concern over the use of water, the plant palette selected in the landscape plan have been chosen because of their ability to thrive in tough conditions, for their low water usage, and for their aesthetics. These xeric plants and materials will not only compliment the existing surroundings but will also provide beauty and utility to the landscape. However, landscape on the east boundary of the property will be limited due to the existing water and sanitary easements. Trees have been included on the south and west side of the property to screen from adjacent residential neighbors. Since a xeric landscape is proposed, only a temporary irrigation, until initially established, is required. A temporary method of irrigation will be provided until establishment. These restrictions came after the applicant's presentation and public input from two neighbors. We respectfully request that a compromise be considered as we approach City Council for our final vote. Specifically, we would request that the 10,000 square foot minimum building coverage condition of approval be expanded to 15,000 square feet. This would allow the owner more flexibility in the construction of his new office and we are confident that it is still less coverage than is allowed by the PID zone district that we are requesting. Secondly, the height limitation that was approved (25) is only half that allowed by the PID zone district (50')_ As a compromise, we respectfully request 35% the allowable height in most single family detached residential zone districts. We feel these compromises are justified based on the fact that both are still more restrictive than the standards currently allowed by the zone district we are seeking and that neither coverage nor height were mentioned as concerns raised by the two citizens who spoke at the Planning Commission public hearing. Furthermore, we have attempted to be good neighbors, hosting a neighborhood meeting to discuss neighborhood concerns and making revisions to the original plan to address these concerns. This includes limiting our access to a single point off Parfet Street and limiting development of our lower lot to aopen space" uses such as detention. In an effort to do so and to address the future use of the property, a Minor Subdivision Plat that will divide the property into three lots is proposed. The purpose of the subdivision is to allow a portion of the parcel, Lot 3, to remain in agricultural use with its existing A-1 zone; to create Lot 2 to become the future site of a new Hoss Electric office and warehouse building; and bring Lot 1 into compliance for a PD zone. The Rezoning, PDP and FDP apply only to Lots 1 and 2. Lot 3 will not be rezoned. Hoss Electric is a locally owned business that employs 6-8 people on site for office operations, with an additional 100 or more people employed as foremen and electricians. This site will serve as the Hoss Electric business office, supply storage, and indoor work area. The primary work site of the Hoss Electric employees is on the job sites around the metro area, not at the office site. 2. Rezoning a. Need for the change of zone. As you are aware, Hoss Electric is currently operating within an Agricultural Zone District and is in violation of the Wheat Ridge Code. Rezoning to Planned Industrial Development will bring the current use into compliance with the Code. However, the need for the zone change extends beyond Code compliance. This is an area of Wheat Ridge that is characterized by a combination of industrial and agricultural uses, with residences on agricultural lots. This parcel, adjacent to existing industrial uses on the north and east sides and large lot agricultural residences on the south and west sides, allows Wheat Ridge to change their zoning to allow this type of use without greatly affecting the character of the existing development or creating any significant negative impacts to the residential development. This parcel would act as a transition area between the larger, higher intensity industrial developments and the large lot residences. As the FDP illustrates, the smaller lot sizes will inherently result in development at a scale that is more moderate and more compatible with the agricultural nature of the residential lots. This is an opportunity for Wheat Ridge to create a parcel where a small industrial business can operate and co-exist peacefully with its neighbors. b. Present and future effect on the existing zone districts, development and physical character of the surrounding area. The effect of this development on the surrounding area will be one of a transition zone . between larger industrial uses to the north and the large lot agricultural uses to the south and west. The FDP, being processed concurrently, illustrates the proposal for future development and demonstrates that it will not adversely affect the surrounding character of the area. c. Access to the area, traffic patterns and impact of the requested zone on these factors. Access to the area is from Parfet Street. Rezoning from A-1 to PID will increase the amount of trips generated by this parcel. The traffic demand for Hoss Electric would be generated from 6-8 on site office employees, with the foremen and electricians working offsite. The foremen, approximately 9-15 people, come to the office once a week. Should Lot 1 be occupied by another user, the square footage and the fact that it is a residential structure would not lend themselves to a high traffic generating use - the parking for that site has been based on office usage - and therefore would not significantly impact traffic. d. Availability of utilities. Lot 1 is currently served with water, sewer, and dry utilities. A water and sanitary sewer easement currently follows the western boundary of the site, from which those utilities will be extended to the proposed building on Lot 2. Dry utilities will be extended to Lot 2 from Lot 1. e. Present and future effect on public facilities and services, such as fire, police, water, sanitation, roadways, parks, schools, etc. This development is projected to have minimal if any impact on public facilities and services with the exception of roadways, although as mentioned previously the traffic generated is projected to be low. In regards to the availability and usage of water, the plant palette selection has been developed with a conscious effort to minimize the use of irrigated water. These plants are deemed xeric by Denver Water. In addition, the majority of the existing trees have been saved in an effort to reduce the amount of irrigated water required for new trees and also to minimize impact on the landscape. 2. Specifics of the Character of Development a. Design Concept This site was designed as a light-moderate intensity of industrial use. The existing residential structure is proposed to remain on Lot 1. Lot 2 would be of a more moderate intensity, but has been designed so that the building is located away from the side of the lot adjacent to existing agricultural lots with residences to the west, set back approximately _ feet. The outdoor storage area has been located so that it would have minimal effect on adjacent agricultural lots with residences. A proposed 6' wood fence and landscaping will be located between the parking lot and the lots to the west. b. Architecture The proposed Hoss Electric office/warehouse will be one story with a mezzanine. The proposed new structure will contain 4,484 sq. ft. of office and 4,694 sq. ft. of warehouse/shop area, totaling 9,178 sq. ft. The building style is consistent with existing adjacent industrial development, but is significantly smaller. The proposed architectural plans provide detailing at the entrance through the use of stucco and exposed concrete with a roof overhanging a stoop area. A metal frieze will be used consistently on all sides of the building, and the majority of the building materials will consist of concrete block and split face block. A galvanized or stainless steel metal roof is proposed. A four-foot wainscot of colored block will wrap around the entire building to add visual interest and help break up the mass of the building. c. Landscaping The proposed landscape plan has been designed with a conscious effort to minimize the use of irrigated water. With continued concern over the use of water, the plant palette selected in the landscape plan have been chosen because of their ability to thrive in tough conditions; for their low water usage, and for their aesthetics. These xeric plants and materials will not only compliment the existing surroundings but will also provide beauty and utility to the landscape. However, landscape on the east boundary of the property will be limited due to the existing water and sanitary easements. Trees have been included on the south and west side of the property to screen from adjacent residential neighbors. Since a xeric landscape is proposed, only a temporary irrigation, until initially established, is required. A temporary method of irrigation will be provided until establishment.
