Grantee shall indemnify and hold Grantor harmless from and against any claims, obligations, liabilities for injuries, death, or property damage, and all costs and expenses and attorney's fees incurred based upon or arising out of Grantee's use of the Easement, including use of the easement by Grantee's invitees, guests, contractors, successors, or assigns. The obligation of Grantee to indemnify and hold Grantor harmless is a continuing obligation and shall survive the closing of this grant of Easement. Grantee shall be solely responsible for all costs associated with the Easement, including but not limited to maintenance, repair, construction, or replacement costs. If legal action, arbitration, or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of the Agreement, the prevailing party shall b r entitled to recover all costs and reasonable attorney's fees incurred in that action or proceeding, in addition to any other relief to which it may be entitled. I have reviewed the submittal and have the following comments regarding the technical requirements of the plat: 1. Designate zoning on-site as being R-1, Residential One. 2. Designate zoning on adjacent properties (east: R-1, south: R-1, west: R-1A). 3. Add addresses for Lot 2 (12310 W. 38`h Avenue) and Lot 3 (12320 West 38`h Avenue). 4. The subdivision to the west is named Wheat Ridge Applewood Farms, not Wheat Ridge Applewood Farm. 5. Correct the year from 2003 to 2004 in the city certification block and recording block. 6. Add addresses and telephone numbers for the property owners. 7. Add an "Explanation of Amendment" which notes the specific width of the lot line adjustment. 8. Modify note number 6 by replacing the map citation with "Community panel no. 080509CO194E, dated June 17, 2003". 9. Add a case history box with the following case numbers: LLA-03-04, MS-79-03. 10. Any easements of record within the platted boundaries must be shown (see below). I have reviewed the easement documents requested for review and have the following comments: Easement #1 (reception no. F182855) is a drainage easement across Lot 3 of Frog Farm Subdivision. It references an attachment `A' which was not included in the submittal. This easement is not reflected on the plat. 2. Easement #2 (reception no. 80059341) is a utility easement across Lots 1 and 2 of Frog Farm Subdivision. This easement is not reflected on the plat 3. Easement #3: (reception no. F1620311) is a drainage easement across Lots 1, 2 and 3 of Frog Farm Subdivision. This easement is not reflected on the plat. 4. Easement #4 (reception no. F1911641) is vacation of an existing access and vehicle turn-around area on Lots 1, 2 and 3 of Frog Farm Subdivision. The vacated easement is reflected on the plat, but was not approved by the City of Wheat Ridge. 5. Easement #5 (reception no. F1820048) is an access easement for Lot 3 of Frog Farm Subdivision across Lot 2 of Shacklett's Subdivision, Amendment #1. The easement is 15' wide which is substandard to the City's requirements for private access. No information was provided regarding the easement to the east across the church property. Please provide a copy of this easement at your earliest convenience. The property (Lot 3, Frog Farm Subdivision) as it exists today, does not meet the standards of the City of Wheat Ridge zoning and development code for access. Actions taken to vacate easements apart from this lot line adjustment request have rendered Lot 3 unbuildable.
