Re: - First Review Comments of the Site and Building Plan for Mountain View Masonry Duplex at 5250
West 41st Avenue.
Dear Mr. Sloan,
I have completed the first review of the above referenced plan received on August 22, 2003, and have
the following comments:
Drainage Report
1. A Final Drainage Report will be required (please see attached sheets for the format of the Site
Drainage Requirements to be followed in the report).
2. Please provide P.E. seal and signature on the Final Drainage Report.
Site Plan
1, Please indicate all dimensions for the proposed structure. Also include distances to the side and
rear lot lines from the building.
2. Show existing contours (and proposed contours if incorporating the Grading Plan) at 2' intervals.
3. Change the drawing scale to either 1" = 20' or 1" = 10'.
4. Include the Legal Description as shown on the Improvement Survey Plat.
5. A signed, sealed Surveyor's Certification.
6. Any existing or proposed easements (if none, please state so).
7. If a driveway is to be constructed, please indicate the location and type of material to be placed.
Drainage Plan
1. A Final Drainage Report was not included with this submittal.
2. Please provide P.E. seal and signature on the Final Drainage Plan.
Development Covenant
A Development Covenant for the public improvements on W. 41st Avenue that will have to be
completed prior to issuance of a building permit. There will be an escrow that will be due at this time as
well. The value will be based upon the total frontage of the property. The required Site Plan will be
used to obtain this distance.
Grading & Erosion Control Plan
1. If any grading is to be performed on-site, a Grading and Erosion Control Plan will be required. If
the grading is limited to a small portion of the site, the Grading Plan may be incorporated into
the Site Plan.
The Public Works Department requires 2 signed and stamped copies of the Site Plan, Final
Drainage Report and Plan, Improvement Survey Plat, and Grading & Erosion Control Plan (if
applicable). Please provide these with the next submittal.
Application for Minor Dumping/Landfill Permit
Prior to the commencement of any onsite grading, an Application for Dumping/Landfill Permit, along
with the fees due will need to be submitted for review and approval. This Permit is generally issued at
the time of the Building Permit.
Right-of-Way Construction Permit(s)/Licensing
Prior to construction of any public improvements, the necessary Right-of-Way construction permit(s)
and respective licensing will need to be submitted for processing by the City. Right-of-Way
Construction Permits are issued only after approval of all required technical documents, including but
not limited to, the Final Drainage Report & Plan, Final Plat, Final Development Plan, Traffic Impact
Study, Storm Sewer Plans, Street Construction Plans, Grading & Erosion Control Plan, and easement or
ROW dedications.

A. Case No. MS-03-01: An application filed by James Sloan for approval of a two-lot
minor subdivision plat on property zoned Residential-Three (R-3) and located at 3995
Sheridan Boulevard.
The case was presented by Meredith Reckert. She reviewed the staff report and digital
presentation after entering all pertinent documents into the record and advising the Commission
there was jurisdiction to hear the case. Staff recommended approval with a condition that a
parkland dedication fee of $1,188.82 be paid prior to issuance of a building permit.

Mr. Sloan, the applicant, was sworn in by Chair McNAMEE. He stated that his application
was a simple request to plat the land to allow construction of a duplex on the western parcel.
Chair McNAMEE asked if there were any present who wished to address this matter. The
following person addressed the Commission.
Don Peterson
9945 West 34th Drive
Mr. Peterson was sworn in by Chair McNAMEE. He spoke in favor of the application and
suggested a condition to require installation of curb, gutter and sidewalk which would define
where cars could park along the street. The reason for his suggestion related to comments from
neighbors in Mountainview who were concerned about traffic flow.
Commissioner McMILLIN asked what the city policy was on the installation of curb and
gutter. Ms. Reckert stated it depended upon whether or not curb and gutter exists on other
portions of the street which it does not in this case. She stated that the city would require the
applicant to sign a development covenant to remain in effect for ten years. This would allow
the city to reassess the curb and gutter situation at any time during the ten years.
It was moved by Commissioner STITES and seconded by Commissioner PLUMMER that
Case No. MS-03-01, a request for a two-lot minor subdivision for property located at 3995
Sheridan Boulevard be approved for the following reasons:
1. All requirements of the City's Subdivision Regulations have been met.
2. The minimum lot size and lot width requirements of the R-3 zone district have
been met.
With the following condition:
1. Parkland dedication fee will be paid prior to issuance of a building permit.

B. Case No. MS-03-03: An application filed by Brad Bunger for approval of a two-lot
minor subdivision plat on property zoned Residential-Three and Commercial-One and
located at 6900 West 38th Avenue (behind 6920 West 38 h Avenue).
The case was presented by Meredith Reckert. She reviewed the staff report and digital
presentation after entering all pertinent documents into the record and advising the Commission
there was jurisdiction to hear the case. Staff recommended approval of the application for
reasons outlined in the staff report.
In reply to a question from Commissioner McMILLIN, Ms. Reckert stated that direct street
frontage is not a requirement for building lots and that four-homes are allowed on a private
drive provided there is a 25-foot wide access aisle.
Commissioner WEISZ asked if fire access from 38 h Avenue would remain open regardless of
what happens to the restaurant property on 38th. Ms. Reckert replied that fire access is
provided via a recorded document on the north and an access easement on the plat which will
remain in perpetuity.

Brad and Marsha Bunger, the applicants, were sworn in by Chair McNAMEE. Mr. Bunger
stated that their daughter and son-in-law currently live on their property in the structure called
"the bam" and now wish to purchase that portion of the property. In order for this purchase to
take place, the property must be subdivided.
In reply to a question from Commissioner WEISZ, Marsha Bunger stated that they access their
property both from 38th Avenue and from 37 h and Quay.

Mr. Onorato was sworn in by Chair McNAMEE. He stated that he and his wife desire to
purchase the property and plan to keep the property just the way it is.
Jeff Reese

Mr. Reese was sworn in by Chair McNAMEE. He expressed concern about traffic safety in the
neighborhood as drivers do speed along 37th Avenue. Since the applicant has indicated that
they have no plans to change the property, he stated he would be in favor of the application.
Peter Young
6895 West 36`h Place
Mr. Young was sworn in by Chair McNAMEE. He also expressed concern about the issue of
speeding on 37th Avenue, especially because there are two blind curves. He was in favor of the
application, but expressed concern that any future development in the area would increase
traffic in the area.

L REQUEST
The applicant is requesting approval of a 2-lot minor subdivision on property zoned Residential-Three (R-
3) and located at 3995 Sheridan Blvd (Bxhibit=1, Applicatiop .
The purpose of the subdivision is to allow for the adjustment of a lot line to bring an existing parcel into
conformance with the R-3 development regulations in order to construct a duplex. The parcel in question
currently is 8,874 square feet in size, which is 126 square feet short of the 9,000 square foot requirement
to have a duplex in the R-3 zone district. Moving the eastern lot line by 2 feet will give the parcel the 126
square feet needed to build a duplex in the R-3 zone district. The lot on the east has an existing three-plex
on it. Conveyance of 2' to the western lot line will not create a density problem. See discussion under
Section IV.
If Lot 2 were developed with the current zoning, one single family residence would be allowed.
Included in your packet are full size plans for the minor subdivision. The plan shows the proposed layout
for Lots 1 and 2 (Exhibit,2, Mrndr Subdrvisroi).
II. CASE HISTORY
The property in question is approximately 22,440 square feet in area and is zoned Residential-Three (R-3)
Mxk bit 3, Vicinity Map). The property does not have a unique configuration to it. Lots 1 & 2 are
rectangular in shape and relatively flat. There is currently a two-car garage setback 8 feet from the front
property line on Lot 2. The applicant is proposing that the garage remain, and that it be used for off-street
parking for the proposed duplex.
On February 27, 2003, the applicant came before the Board of Adjustment for a lot size variance of 126
square feet from the 9,000 square foot lot area requirement for a two family dwelling in the R-3 zone
district. No unique circumstances or hardship were found that warranted approval of the request, and the
Board of Adjustment rendered a 5-0 vote to deny the variance 44* 4~-
There is vehicular access to both properties via W. 41" Avenue.
III. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on April 1, 2003. A synopsis of the meeting and a sign in

IV. SUBDIVISION PLAT
This minor subdivision will not create any new lots. The purpose of the subdivision is to reconfigure the
existing eastern lot line of Lot 2 to bring the lot into compliance with the R-3 zone district development
standards for a two-family dwelling. Typically, this request would be an administrative lot line
adjustment. Because the applicant is requesting to add dwelling units, the proposal must go through the
City's Subdivision Plat review process. If the minor subdivision is approved, the applicant is proposing
to construct a duplex on Lot 2 and leave Lot 1 unchanged.

Presently, Lot 1 has 13,566 square feet of land, which exceeds the minimum needed for a 3-unit
multifamily dwelling in the R-3 zone district. The proposed lot line change will not result in Lot 1
becoming a nonconforming lot. 13,362 square feet of area will remain after the conveyance, which
accommodates the existing units.
Lot 2 will be 9,078 square feet in area with 89 feet in width. Lot 1 is 13,362 square feet with 102 feet in
width. Lot 2 will have frontage on W. 41" Avenue and Lot 1 will front Sheridan Boulevard. Lot 1
currently has a multi-family structure on it. The R-3 zone district requires a minimum of 12,500 square
feet of lot area and 100 feet of lot frontage for a multi-family structure. In addition, a minimum of 3,630
square feet of land area is required for each dwelling unit in the R-3 zone district, and Lot 1 will still meet
all of the above requirements if the subdivision is approved.]
Each lot will have the standard utility easements required by Xcel Energy around the perimeter of the
property. These easements will be reserved for utility purposes only. Note number 1 on the Plat contains
the City's standard language for these easements.
V. AGENCY REFERRALS
All agencies are currently able to serve the property and can continue to do so with the proposed minor
subdivision. Any service upgrades required by the referral agencies will be addressed when the applicant
submits for building permit.
Xcel Energy requires a 10 foot utility easement along the front and rear property lines. The existing
garage will extend into the 10 foot easement. Staff has not received approval from Xcel to allow the
garage to remain.
The applicant will be required to provide $1,188.82 dollars in lieu of land dedication for park purposes
per the request of the Parks and Recreation Department.
VI. STAFF CONCLUSIONS AND RECOMMENDATION
The requirements of the Subdivision Regulations have been met and the parcels meet the lot area and lot
width requirements of the R-3 zone district. Therefore, staff recommends APPROVAL for the following
reasons:
1. All requirements of the City's Subdivision Regulations have been met.
2. The minimum lot size and lot width requirements of the R-3 zone district have been met.
With the following conditions:
1. Parkland dedication fee of $1,188.82 dollars shall be paid prior to issuance of a building
permit.

Please be advised that at its meeting on February 27, 2003, the Board of Adjustment DENIED your request for
a 126 square foot variance from the 9,000 square foot minimum lot area requirement to allow a two-family
dwelling on vacant land zoned Residential-Three and located immediately west of 3995 Sheridan Boulevard
(approximately 5250 W. 41" Avenue) for the following reasons:
1. The property can still yield a reasonable return in service or income.
2. There are no significant features which render the lot unbuildable.
3. The applicant has a self-imposed hardship.
4. Related to criteria No. 3, there are no significant conditions present as to warrant a variance.
5. An alternative exists by the ability of the common property owner to deed sufficient square
footage from adjacent property.
Enclosed is a copy of the Certificate of Resolution, as we] I as a draft copy of the minutes, stating the Board's
decision. Should you decide to appeal the decision of the Board, you will need to notify the Jefferson County
district court in writing within 30 days of the Board's decision.

objection to the project. ~~I

It was moved by Board Member HOWARD and seconded by Board Member
ABBOTT to amend the motion to change the variance to a 3.5-foot setback.
Board Member ABBOTT suggested a condition could be added to require that no
overhang be allowed over the fence. Meredith Reckert explained that the City would not
allow an overhang to exist and further, approving the variance as requested would allow
the applicant some flexibility. For instance, it may be necessary to provide only 12
inches between the shed and the fence.
Board Member ABBOTT commented that he preferred 0 rather than 18 inches because
18 inches allows room for storage of junk and accumulation of leaves, etc.
Mike Kashefska returned to the podium to state that he preferred the variance be issued
for five feet as originally requested.
A vote was taken on Board Member HOWARD's motion to amend the resolution.
The motion failed by a vote of 2 to 3 with Board Members ABBOTT, BLAIR and
ECHELMEYER voting no.
The original motion passed 4-1 with Board Member HOWARD voting no, and
Board Members DRDA, MONTOYA and YOUNG absent.
C. Case No. WA-03-03: An application filed by James Sloan for approval of a 126
square foot variance from the 9,000 square foot minimum lot area requirement to
allow a two-family dwelling on vacant land zoned Residential Three and located
immediately west of 3995 Sheridan Boulevard (approximately 5250 W. 41 n
Avenue).
This case was presented by Mike Pesicka He advised the Board that all posting and
noticing requirements had been met and there was jurisdiction to hear the case. He
entered all pertinent documents into the record and reviewed the staff report. Staff
recommended denial of the request for reasons outlined in the staff report. In conclusion,
he entered a letter into the record which was faxed to the Planning Department the
morning of the hearing. The letter was from Ann Ver Valin of 4100 Ames Street,
Mountain View expressing concerns about setbacks, parking area and Mountain View
right-of-way directly north of the subject property.
In answer to a question from Board Member HOVLAND, Mr. Pesicka stated that the
subject property is a lot of record.

Board Member ABBOTT noted that square footage of the property was based on an
improvement location certificate (ILC) rather than a survey. Meredith Reckert stated that
the City has allowed ILC's to be used in place of surveys in obtaining buildin ermitt~
and variance applications.
James Sloan

Mr. Sloan, the applicant, was sworn in by Vice Chair HOVLAND. He stated that the
owner, Donald L. Maher who lives in Ireland, asked him to enter a partnership to build a
duplex on this land. Mr. Sloan testified that he would live in one side of the duplex and
the other side would be occupied by Ernestine Simpson and her son. He stated that the
property east of the subject property is also owned by Mr. Maher.
Board Member ABBOTT commented that Mr. Maher could do a lot line adjustment and
deed 126 feet to the subject property. Mike Pesicka replied that it is possible this amount
of land could be deeded over with a minor subdivision plat, although it would be
necessary to determine if this could be done while still meeting the density requirements
for the other lot. Mr. Sloan testified that a survey completed in 1964 indicated the
property is 8,874 square feet in size.
Cindy Calloway
5280 West 415f Avenue
Ms. Calloway was sworn in by Vice Chair HOVLAND. She owns the property behind
the subject property. She stated she was neither in favor nor opposed to the application
but expressed concern about setbacks, increased traffic and parking if the duplex is built.
She also expressed concern that, since there is a basement planned for each unit, four
families could live in the structure.' Meredith Reckert assured Ms. Calloway that only
two families would be allowed.
Duane Simpson and
Ernestine Simpson
3995 Sheridan
Both of these individuals were sworn in by Vice Chair HOVLAND. Duane Simpson is
the son of Ernestine. Mr. Simpson testified that Mr. Maher is the godfather for his
brother who is mentally disabled and is in the process of becoming a legal co-guardian.
Mr. Maher plans to provide half the duplex as a home for Ms. Simpson and his brother
and asked the Board to approve the application.
Robert and Barb Hendrickson
3945 Sheridan
Both of these individuals were sworn in by Vice Chair HOVLAND. Mr. Hendrickson
stated that he was not opposed to a duplex being built on the property but did express
concern that the variance could affect his property line. Meredith Reckert explained that

the variance would not affect Mr. Hendrickson's property line in any way as only the
comer of his lot is touching the property in question.
In response to a question from Board Member BLAIR, Mike Pesicka explained that
should the variance be approved access would be from West 41St Avenue.
Upon a motion by Board Member ABBOTT and second by Board Member
HOWARD, the following resolution was stated:
Whereas, the applicant was denied permission by an administrative officer; and
Whereas, Board of Adjustment Application Case No. WA-03-03 is an appeal to this
Board from the decision of an administrative officer; and
Whereas, the property has been posted the fifteen days required by law; and in
recognition that there were no protests registered against it;
Whereas, the relief applied for MAY NOT be granted without impairing the intent
and purpose of the regulations governing the City of Wheat Ridge.
Now, therefore, be it resolved that Board of Adjustment Application Case No. WA-
03-03 be, and hereby is, DENIED.

which would be an enhancement to the neighborhood, there is no reason presented in the
request to justify a variance. There is also a possible solution in that the extra square feet
could be deeded by a minor subdivision plat from the adjacent property.

significant issues present to make this property unique.
A vote was taken on the motion for denial. The motion passed 5-0 with

Vice Chair HOVLAND declared the public hearing closed. AFT
6. OLD BUSINESS
Meredith Reckert asked Board members if they wished to have a study session to
consider criteria issues related to the recently adopted ordinance which addresses
variances for inoperable automobiles.
It was moved by Board Member BLAIR and seconded by Board Member
ABBOTT to direct staff to schedule a study session for the Board of Adjustment
to discuss the inoperable vehicle ordinance. The motion passed 5-0 with Board
Members DRDA, MONTOYA and YOUNG absent.
Meredith Reckert introduced Larry Schulz, the newly appointed Board of Adjustment
member from District IV.
• Meredith Reckert introduced Gina Gabriel who volunteers in the Planning
Department in order to gain experience toward becoming a planner.
7. NEW BUSINESS
A. Approval of Minutes - It was moved by Board Member HOWARD and
seconded by Board Member BLAIR to approve the minutes of January 23,
2003 as presented. The motion passed unanimously.

It was moved by Board Member HOWARD and seconded by Board Member
BLAIR to adjourn the meeting at 10:00 p.m. The motion passed unanimously.

I have completed my initial review of the above-mentioned project, and I have the following
comments:
1. General:
A. I have included information supplied by various referral agencies. If you have
any questions regarding these comments, please direct them to the agency that
generated the comment.
B. Pursuant to section 26-421 of the Wheat Ridge Code of Laws, all residential
subdivisions are subject to a fee in lieu of parkland dedication. The fee is based
upon the price per acre of the lot (as determined by the assessed value of the lot)
in relation to the number of proposed dwelling units. The fee in lieu of parkland
dedication for this subdivision will be $1,188.82. This fee shall be paid when the
plat is recorded with Jefferson County.
2. Plat Review:

I am applying for a minor subdivision in order to increase the size of vacant land located
at approximately 5250 W. 41 " Avenue, from 8874 square feet to at least 9000 square feet.
The extra land would be taken from the property located at 3995 Sheridan Blvd., located
just east of and adjacent to 5250 W. 41s` Avenue.
Both parcels of land are owned by Donald L. Maher who resides in Ireland. I have
Power of Attorney to reflect this change.
The reason we are requesting to change the size of the lot at 5250 W. 41'` Ave. is to meet
the minimal size requirement of 9000 square feet to build a duplex. The land is currently
zoned R-3.
