DRAFT B. Case No. MS-03-03: An application filed by Brad Bunger for approval of a two-lot minor subdivision plat on property zoned Residential-Three and Commercial-One and 1~r located at 6900 West 38`h Avenue (behind 6920 West 38t° Avenue). The case was presented by Meredith Reckert. She reviewed the staff report and digital presentation after entering all pertinent documents into the record and advising the Commission there was jurisdiction to hear the case. Staff recommended approval of the application for reasons outlined in the staff report. In reply to a question from Commissioner McMILLIN, Ms. Reckert stated that direct street frontage is not a requirement for building lots and that four homes are allowed on a private drive provided there is a 25-foot wide access aisle. Commissioner WEISZ asked if fire access from 38`h Avenue would remain open regardless of what happens to the restaurant property on 38th. Ms. Reckert replied that fire access is provided via a recorded document on the north and an access easement on the plat which will remain in perpetuity. Brad and Marsha Bunger 6900 West 38`h Avenue Brad and Marsha Bunger, the applicants, were sworn in by Chair McNAMEE. Mr. Bunger stated that their daughter and son-in-law currently live on their property in the structure called "the bam" and now wish to purchase that portion of the property. In order for this purchase to take place, the property must be subdivided. In reply to a question from Commissioner WEISZ, Marsha Bunger stated that they access their property both from 38 h Avenue and from 37`h and Quay. Donald Onorato 6910 West 38`h Avenue, Unit A Mr. Onorato was sworn in by Chair McNAMEE. He stated that he and his wife desire to purchase the property and plan to keep the property just the way it is. Jeff Reese 7005 West 37`h Avenue Mr. Reese was sworn in by Chair McNAMEE. He expressed concern about traffic safety in the neighborhood as drivers do speed along 37`h Avenue. Since the applicant has indicated that they have no plans to change the property, he stated he would be in favor of the application. Peter Young 6895 West 36th Place Mr. Young was sworn in by Chair McNAMEE. He also expressed concern about the issue of speeding on 37`h Avenue, especially because there are two blind curves. He was in favor of the application, but expressed concern that any future development in the area would increase traffic in the area. Case No. ZOA-03-05 (continued from June 5, 2003): An ordinance amending Chapter 26 of the Wheat Ridge Code of Laws concerning "Family Foster Homes" and "Residential Group Homes." Alan White stated that this matter was continued in order to have a member of the city attorney's office present to answer questions Carmen Beery of the city attorney's office, explained the Supreme Court's decision against the City of Northglenn which led to the need for the subject ordinance. The decision essentially tells municipalities they cannot tell the state, acting through the county division of social services, how many juvenile sex offenders can reside in one foster home. Wheat Ridge has an ordinance which limits the number of juveniles living in a foster home to four. She learned from Jeffco social services that the state, acting through the county of social services, generally puts no more than four children in a foster home with the exception of licensed foster homes known as receiving homes which can have more than four children for a period of time. Receiving homes keep children until a permanent foster home is found. Another exception to the limit of four children is when they do not want to separate siblings. The state requires different licensing procedures for foster homes versus group homes. The city's differentiation between the two is that foster homes can have up to four children and more than four children constitutes a group home. Alan White pointed out that group homes in Wheat Ridge are a special use and foster homes are permitted uses in all residential zone districts. In answer to a question from Commissioner WITT, Carmen stated that the courts and social services place children in foster homes or group homes based on many factors but tenure of a child in a foster home is not a determining factor. Commissioner BERRY asked if the city's family foster home definition was the same as the state's definition of family care home. Carmen replied that they were the same. Planning Commission MS-03-03/Bunger I. REQUEST The applicant is requesting approval of a two-lot subdivision on property zoned Residential- Three and Commercial-One. The purpose of the subdivision is to allow conveyance of Lot 2 to a family member. R. PROPERTY HISTORY Although the property is addressed as 6900 West 38`h Avenue, it is located south of West 38`h Avenue behind the old "Mare's" restaurant. The property is zoned Residential-Three with a 10' wide strip of Commercial-One zoning running along the northern property line. (Exhibit 1, Vicinity Map) There are two accesses into the property. An access easement recorded in 1982 with the adjacent property owner crosses the parking lot to the north allowing access from West 38`, Avenue. The other access is to the intersection of Quay Street and West 37 h Avenue. The existing single family home was built in 1940. Another structure, the "barn", was built in 1998 with an apartment on the upper level. The lower level originally consisted of a large, open room to be utilized for family gatherings. An administrative planned building group plan was approved and recorded in 1998, allowing the two primary structures pursuant to Case No. PBG- 98-02. In 2000, the lower level was converted to an additional living unit. III. PLAT REVIEW This plat would subdivide the property into two lots. The "L-shaped" lot, Lot 1, would be approximately 36,207 square feet and would contain the existing single-family residence. Lot 2 would be approximately 18,652 square feet in size and would contain the duplex "barn" structure. (Exhibit 2, Plat) Both lots are oversized according to the R-3 zone district development standards. Lot 1 will contain the existing single family residence but has a lot area exceeding 36,000 square feet. Pursuant to the R-3 density standards, a total of nine multi-family units could be developed on the property. Lot 2 could accommodate five multi-family units if the density were maximized. The owners have not indicated intent to develop additional units on either of the properties. A 25' wide ingress/fire access easement commences on the northern property line of Lot 1, connecting with the access easement to the north. It extends south into Lot 2 and extends west to the entrance to the Quay Street/37`h Avenue intersection. The City's standard access easement language has been included as a plat note. Since this is a request for a two-lot subdivision without dedication, Planning Commission will be the final deciding authority. Planning Commission MS-03-03/Banger IV. NEIGHBORHOOD MEETING The meeting for neighborhood input was held on March 25, 2003, in the Municipal Building located at 7500 West 29"' Avenue. Ten people from the neighborhood attended the meeting. A summary of the meeting and sign-in sheet have been included as Exhibits 3 & 4. At the neighborhood meeting, the design document shown to the neighbors contained three lots - one lot for each structure and a vacant lot to be developed in the future. Prior to application submittal, the plat was redesigned reducing the number of lots from three to two. V. AGENCY REFERRALS All outside service agencies that currently serve the property will continue to serve the property. The City Surveyor has reviewed the document and requested changes have been incorporated. He has requested the survey pins be shown on the plat prior to mylar recording. No right-of- way dedications are required. Wheat Ridge Water had no comments. Wheat Ridge Fire Protection District had no comments. VI. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff concludes that the final plat meets the subdivision requirements as described in Article IV of Chapter 26 of the Code of Laws. Staff further concludes that all requirements of the R-3 zone district regulations have been met or exceeded. For these reasons, staff recommends APPROVAL of Case No. MS-03-03 with the condition that the survey pins be shown on the plat prior to mylar recording. VII. Applicants proposal: The applicant wishes to subdivide the property into three lots - one for each of the structures and to create another vacant parcel. The purpose of the request is for conveyance of the barn parcel to family members. Although there are no plans at the moment, an additional single family home may be built on the vacant parcel in the future. Issues discussed: • Will the existing access points remain? • What will happen with the vacant lot? • What will, the effect be on traffic in the neighborhood? The 37 "/Quay intersection is somewhat of a blind corner. It is a hazard for small children. • Will the proposed private drive interfere with the existing Xcel Energy access easement on the south property line? • How high will the structure on the vacant lot be? • The primary concern of the neighbors attending is that the existing neighborhood to the south/southwest is quiet. The neighbors do not want additional traffic generated from the property. I have reviewed the document and have the following comments: 1. The property to the west, just north of 37`h Avenue, is unsubdivided and is zoned NC. 2. In both the dedicatory statement and its notarial attestation, the owner's first name is spelled "Bradney", rather than "Bradley". 3. In the notary space for the owner's signature block, please correct the spelling of "forgoing". 4. Please add the following case numbers to the case history box: PBG-98-02, MS-03-03 5. Modify the Planning Commission certification to read, "Approved this day of 2003". Do not remove the signature line for the chairperson. 6. Modify the Planning and Development Director signature block to "Community Development Director". 7. Other items of concern: • The ingress/egress easement should line up with the existing easement to the north. According to this document, it's about five feet off to the east. Please modify. The minimum front setback for properties which do not have direct access to a public street is determined as the lot line parallel to the public street where access is gained. The minimum front setback requirement in the R-3 zone district is 30'. Therefore, if the front lot line for Lot 2 is from the north (via West 38`h Avenue), a 25' frontyard setback variance will be required. I would suggest that the front lot line for lot 2 be established from the west. There is adequate room to shift the lot line which is parallel with Quay Street 20' to the west and avoid having to process a variance. We would additionally suggest a change of address for the structure on Lot 2 to make it clear access is obtained from Quay Street. This could be done subsequent to the public hearing. If your client wants to pursue a variance, keep in mind that the application fee is $390 and staff will not support it. The variance could be processed concurrently with the minor subdivision. The case planner must be in attendance at this meeting, however the applicant will be responsible for explaining the proposal. Approximately one week prior to this meeting, a letter must be sent out to all neighbors within 600 feet of the subject property. You should submit your letter to the case planner for review prior to mailing to the neighborhood. The City will generate a neighborhood list, but the applicant will be responsible for distributing these letters. After the meeting has occurred, an application may be filed with the Community Development Department. Once an application has been submitted, a referral period will begin. During this time, outside agencies are given a chance to review the proposal and send comments to the Community Development Department. After the referral period has ended, a list of required corrections will be sent back to the applicant. Please be aware that it may take several resubmittals. After all required corrections are made, a Planning Commission date will be set. Fifteen days prior to the Planning Commission public hearing, the applicant will be responsible for posting the property. Planning staff will create the public notice signs, however the applicant must post the signs. The applicant (or his representative) must be present at the public hearing, and should be prepared to address members of the Planning Commission.
