TITLE: AN ORDINANCE AMENDING ORDINANCE 1160, SERIES
1999 AND VACATING IN PART AN EASEMENT HELD BY
THE CITY
WHEREAS, the following portion of Lamar Street, a dedicated street within
the City of Wheat Ridge, County of Jefferson, State of Colorado, (the "subject
right-of-way") was vacated by Ordinance 1160, Series 1999:
The East 25 feet of the North 120.2 feet of the South 280.2
feet of Block 8, Lake View Subdivision Jefferson County,
Colorado.
Total area being approximately 3,500 square feet (the "subject
right-of-way");
WHEREAS, by Ordinance 1160, Series 1999, recorded on July 23, 1999 at
Reception No. F0913892, Jefferson County Clerk & Recorder, the Council vacated
the subject right-of-way, reserving an easement across the entirety thereof for
utility purposes; and
WHEREAS, City Council wishes to vacate said easement in part.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WHEAT RIDGE, COLORADO:
Section 1. Ordinance 1160, Series 1999 Amended. Section 2, Paragraph 1
of Ordinance 1160, Series of 1999 is hereby amended to read as follows:
Section 2. Conditions The City will retain the easterly five (5) feet of the
utility easement.

Section 3. Safety Clause. The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the
City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of
the public and that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The City Council
further determines that the Ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 4. Severability; Conflicting Ordinances Repealed. If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses
shall not be affected thereby. All other ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed.
Section 5. Effective Date. This Ordinance shall take effect fifteen days after
final publication, as provided by Section 5.11 of the Charter.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to 0 on
this 27th day of May, 2003, ordered published in full in a newspaper of general
circulation in the City of Wheat Ridge and Public Hearing and consideration on final
passage set for June 23, 2003, at 7:00 o'clock p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.

MaryAustin, staff planner for the City of Wheat Ridge Community Development
Department, was sworn in by the Mayor and presented the staff report.
Don Casper, consultant for the applicant, was present to answer questions.
Motion by Mr. Mancinelli to approve Council Bill 23-2003 (Ordinance 1295), Case No.
WZ-03-04 for the following reasons and that it take effect 15 days after final publication.
1. The rezoning is consistent with the Comprehensive Plan designation of
Neighborhood Serving Retail.
2. The rezoning will not adversely impact the public health, safety or welfare.
3. The requirements of the City's Planned Development Regulations have been
met.
4. The rezoning and proposed Final Development Plan propose a good re-use of an
existing but unoccupied developed site, thereby creating physical and economic
benefits to the community.
5. The zone change is compatible with the surrounding area and there will be
minimal adverse impacts associated with the rezoning.
6. Adequate infrastructure is available to serve the proposed use.
With the following conditions:
1. The wall sign as proposed on the Final Development Plan be reduced to a
maximum of 69 square feet in size to comply with the City's sign code.
2. The fence, built to match existing wood fences, shall be extended north to the
adjacent property owner's fence, if approved by the adjacent property owner;
Seconded by Mr. Edwards; carried 7-0.
Item 2. Council Bill 22-2003 - An Ordinance amending Ordinance 1160, Series
1999 and vacating in part an easement held by the City.
(Case No. WV-03-02)
Council Bill 22-2003 was introduced on second reading by Mr. Mancinelli, who read the
title and summary. Clerk assigned Ordinance No. 1296.
Alan White, Director of Community Development, was sworn in by the Mayor and
presented the staff report. He requested that instead of 25 feet vacation it be changed
to 20 feet in order to allow the construction of garages.
Larry Nelson, representing Cornerstone Realty, who is the broker for the Wheat Ridge
Housing Authority. He spoke in support of the 5 garages to help with non-existent
storage space.
Motion by Mr. Mancinelli to approve Council Bill 22-2003 (Ordinance 1296), Case No.
WV-03-02, an ordinance amending Ordinance 1160, Series of 1999, vacating an
unused portion of public right-of-way located on Lamar Street, east of 6400 West 44~
Place, on second reading, with the following amendment: Section 2. of the Ordinance
shall be changed to read as follows: "The City will retain the easterly five (5) feet of the
utility easement"; seconded by Mr. Edwards; carried 7-0.

EXECUTIVE SUMMARY:
The Wheat Ridge Housing Authority has purchased the property at 6410 W. 44`s Auie The
Authority is pursuing improvements to the property, including the construction of garages for some of
the units. The garages are proposed along the eastern property line.
In 1999 City Council vacated unused right-of-way for Lamar Street south of W. 44ffi Place, measuring
25 feet in width, and this right-of-way became a portion of the lot the Housing Authority now owns.
The ordinance vacating the right-of-way reserved an easement for utility purposes over the entire 25-
foot width of the vacated right-of-way. City regulations prohibit the construction of permanent
structures over easements. Construction of the garages by the Housing Authority is not possible in this
area unless all or a portion of the utility easement is vacated.
COMMISSION/BOARD RECOMMENDATION:
No other review is required.
STATEMENT OF THE ISSUES:
Requests for comments concerning this vacation have been sent to all parties who could have an
interest in the easement. Only one, Xcel Energy, indicated a need to retain a portion of the easement.
They have indicated that 10 feet is sufficient for the remaining easement. Of the 25 feet, 15 feet of
easement will be vacated and 10 feet will remain as easement. This does not require a change to the
ordinance from first reading.
ALTERNATIVES CONSIDERED:
Not vacating the easement.
FINANCIAL IMPACT:
There should be no financial impact to the City from vacating the easement.
RECOMMENDED MOTION:
"I move to approve Council Bill No. Case No. WV-03-02, an ordinance amending
Ordinance 1160, Series of 1999, vacating an unused portion of public right-of-way located on Lamar
Street east of 6400 W. 44 h Place on second reading."

WHEREAS, the subject right-of-way is not needed for any public purpose; and
WHEREAS, no land adjoining the subject right-of-way will be left without access to the public
street system as a consequence of its vacation.

COLORADO THAT:

Department.

promulgated for the health, safety, and welfare of the public and that this ordinance is necessary for the

provided by the Charter.

Ridge Housing Authority to vacate an easement as shown on the enclosed map.
The subject easement was reserved as a utility easement when right-of-way covering the same land
area was vacated by the City in 1999. The Authority wishes to vacate the easement to allow the
construction of garages.
Please inform us as to the presence of any utilities in the easement and, if none, any concerns you
