I have reviewed the document and have the following comments: 1. On page 1, under "Case History", add the following case file reference number: WZ-03-05 2. Modify the title of the document to read "Garrison Village, Amendment No. 1, Final Development Plan, Administrative Amendment, An Official Development Plan in the City of Wheat Ridge" 3. As this is an administrative amendment, please remove the signature block for Chairman of the Planning Commission. 4. Change the Planning and Development Director's signature block to Community Development Director 5. Modify the Mayor's signature block to read: "Approved this day of 2003 by the City of Wheat Ridge." Do not remove the signature line for the mayor and the City Clerk's attestation. 6. Change all references from 2002 to 2003 7. Please add an "Explanation of the Amendment" describing the changes. Sincerely, Meredith Reckert, AICP Senior Planner City of Wheat Ridge of WHEgTP Community Development Department ° U m Memorandum ~~C ORPDO TO: Case File No. WZ-03-05/Centex FROM: Meredith Reckert SUBJECT: Administrative Amendment DATE: May 20, 2003 The developers of the Garrison Village Planned Residential Development have requested an administrative amendment to the recorded final development plan for the subject multi-family development in the City of Wheat Ridge. The purpose of the amendment is to modify the allowed driveway lengths (IE, setback between garages and internal access ways) and separation between buildings. Pursuant to the recorded final development plan, the minimum length of driveways is 20'. Upon final engineering design it was determined that several of the driveways can't meet the 20' length standard based on layout of different building model types. The developer has requested that the minimum length be modified to allow 17' driveways in certain situations. The internal private access ways are 24' wide, which exceeds the minimum width of 22', thereby accommodating the shorter driveway lengths. No internal sidewalks or fire lanes would be impacted as a result of the shorter driveways. An additional modification would be to reduce the minimum distance between adjacent buildings from 24' to 17.8'. A letter has been submitted from the developer's engineer concluding there would be no impact to the drainage system in the development. Pursuant to the attached correspondence dated May 7, 2003, there will be no impact to the amount of landscaped coverage within the development. All affected utility agencies and city departments have indicated no concern with the proposed amendments. The Arvada Fire Protection district has requested that internal access drives be posted "no parking". The City of Wheat Ridge Public Works Department has indicated that encroachment of permanent structures including patios into drainage easements will not be permitted. Staff has reviewed the criteria for consideration of an administrative amendment detailed in Section 26-311 of the Wheat Ridge Code of Laws, and has concluded that the request does not violate any of the listed criteria. Therefore, the proposed administrative amendment is approved. As Garrison Village was platted the distances between the Utility and Access easements were established. The actual landscape areas and paved areas were calculated from the drawing that shows the dimensions as platted and recorded. The driveway distances were not 20 feet on the drawing, therefore the amount of landscaped area and the amount of paved area is correct as listed on the Final Development Plan. The error in the driveway distances occurred when the plans were transferred from the planner to the engineer. The total dimensions between the driveways were not verified and therefore the driveway lengths were not platted at 20 feet. The planner verified the landscape paving numbers on the plat as recorded. Therefore the open space area, parking, driveway and building coverage numbers all remain as recorded on the Final Development Plan, On the west side of Flower Street the same error occurred. As the plans were transferred between the planner and engineer no one checked the dimensions and thus we do not have enough space to get 24 feet between the buildings but only 17.8 feet. Again the area for landscaping, paving and building spaces were taken from the drawing with the incorrect distances between buildings. I have had discussions with both the planner and engineer; they are both unsure how an error like this would have slipped through all the people in their offices that review the plans. Thus I don't have a good explanation for the error. But I do know that the landscape and paving areas remain the same as recorded. As I reviewed the code I found no areas where this minor change would violate zoning regulations: I believe the standards set by the Final Development Plan Amendment will still exceed the regulations required by the City code. Section 28-311 Amendments to Development Plans, allows minor amendments if they will not cause changes to the: 1. Character of the development, The character of the development is not Impacted by these minor changes. 2. Density, The density of the project has not changed. 3. Circulation, The circulation patterns of the project have not been modified. 4. External effects of the project to adjacent properties, There will be no external effects from the amendment request. 5. Reduction of the perimeter setbacks, There are no reductions in the external setbacks requested. 7. Reduction of landscape area of the total site, The Landscape area was based on the buildings and driveways located as requested in the amendment rather than as defined on the FDP. 6. Increase in gross floor area of structures. The building floor areas have not been modified. These minor building separation issues will not affect any of the 6 items listed above. As we discussed we are requesting an amendment to the Final Development Plan to change the Front Garage Access from Internal Private Drives from 20 feet to 17 feet and to change the side-to-side building separation from 24 feet to 17.8 feet. Internal private drive setbacks are addressed under note L on page two of seven of the Final Development Plan. As you look at the plan you will see that none of the building locations change or the private drive widths or locations. The distance needed is 62'2" for the homes plus 20 feet on each side for driveways for a total of 102'2". The distance and in some situations ranges from 96.9 feet to 100.4 feet. With a 62'2" building footprint that leaves in the worse case a 17.3-foot driveway. This situation only occurs on the East side of Flower Street. Thus our request to modify the Final Development Plan L as follows: L. Building Setbacks: From Internal Private Drives: Front with Garage access: 17 Feet-Patios may encroach a maximum of 7 feet In addition we also ran into the same problem on the separation between buildings on the west side of Flower Street. Building #14 and Building #15 need a total distance from the Flower Street setback to the easement of 148 feet, this includes two 62'2" building envelopes and a 24 foot building separation. The actual dimension is 145.1 feet, which will not allow the full two buildings and 24 feet of separation. Thus we are asking for a reduction in the Building Separation from 24 feet to 17.8 feet. M. Building Separation Side-to-Side: 17.8 feet This would cover our worse case scenario and we would try to get as close to 24 feet a possible. If we can have the patio area within the 20-foot drainage easement we will be able to have a greater separation between buildings. Thus our question for clarification, Can we allow the patio area to encroach into the 20' drainage easement? The patio will consist of a concrete slab, which is 6' by 29 feet on the 3 plan and 6'8" by 12'4" on the 2 plan. These patios will include a maximum 42" fence to enclose the patio area. I believe the drainage is piped in this area and the grading would not be disturbed. I have enclosed a redlined version of the Final Development Plan, Preliminary Architectural plans, a fit analysis done by KMD for each building type, I have highlighted in the problem areas.
