She had understood that this was going to be Planned Residential and Planned Industrial. She feels she has been highly fooled by what has just been read by Mary Austin. She thinks all of the public has. This hearing should be postponed until people who live in that area have been alerted as to what is actually being done. Mr. Pennington stated for the record that noise issues are disclosed with the closing documents that are recorded with the home, so they are on notice that these issues do exist. Motion by Mrs. Rotola to approve Council Bill 34-2003 (Ordinance 1307), Case No. WZ- 02-13, a request for a rezoning of property located at 10285 Ridge Road from Agricultural-One to Planned Residential Development and Planned Industrial Development and I further move to approve the Outline Development Plan, and that this action take effect 15 days after final publication for the following reasons: 1. The requirements of the City's Planned Development regulations have been met. 2. The rezoning will not adversely impact the public health, safety, or welfare. 3. The zone change is compatible with the surrounding area and the adjacent zoning of residential to the north and west as well as the adjacent zoning of industrial to the south and west. 4. A change in character of the area has occurred due to the zone changes on adjoining property to the north and west. 5. There are physical benefits to be derived from the construction of public improvements and a tree lawn along Ridge Road. 6. Adequate infrastructure will be constructed with the development to serve the proposed use. PUBLIC HEARING on an amendment to the Youngfield Plaza Phase II Final Development Plan, located at 4120 Youngfield Street. (Case No. WZ-03-1)6) (Casey's Recreational Vehicle Sales) David Schneider introduced. Item 2 and read the title and summary. Travis Crane, Community Development, was sworn in by the Mayor and presented the staff report and showed slides. The applicant is requesting an amendment to increase the building square footage to about 3700 square feet, that is an increase of about 1100 square feet. He is also requesting to raise the freestanding sign to a height of 35 feet and increase the sign size to 121 square feet. No neighborhood meeting was required or held. CITY COUNCIL MINUTES: September 8, 2003 Page 6- Steve Casement, owner of Casey's Recreational Sales, was sworn in by the Mayor. He explained that the extension was basically about bathrooms and office space, which they desperately need. The visibility of their sign has been lost due to the nice big trees in Wheat Ridge and they need a higher sign. COUNCIL BILL 35-2003 -AN ORDINANCE AMENDING CHAPTER 21 OF THE CODE OF LAWS PERTAINING TO STREET WIDTH DESIGNATION. Council Bill 35-2003 was introduced on second reading by Mr. Edwards, who also read the title and summary. Clerk assigned Ordinance 1308. Gerald Dahl, City Attorney, stated that this Ordinance implements Charter Section 5.20. Council has the power to implement provisions of the Charter by Ordinance. Tim Paranto explained that the Charter speaks to construction and re-construction of streets. In practice there has been some confusion as to when a street width is being changed during a reconstruction project. When we install a speed bump, we are actually changing the street width, typically narrowing it some, but it's for a short distance, maybe 20, 30 feet. We need direction and guidelines from City Council as to when they believe street widths are being altered and should come to Council for designation. If there is an accelaration and deccelaration lane constructed, the street width would be changed at that speck destination. Michael Snow, 3850 Carr Street, spoke on behalf of Wheat Ridge United Neighborhoods. They would like to note their opposition to Council Bill 35-2003. This Ordinance changes the language and meaning of the Charter Section itself. The Charter Section states quite clearly that there must be a hearing before any street construction or reconstruction and that citizens adjacent to and near the street can require a 3/4"' vote of the Council to do the construction or reconstruction if they object to the plan. There are two or three parts in this Ordinance, which directly contradict the Charter. First, the Ordinance says that only an improvement of over 500 feet counts as a reconstruction. The purpose for this amendment is to allow an expansion of the existing building and increase the height and square footage of the existing freestanding sign. The property currently has a 2,560 square foot building. The applicant wishes to add 1,152 square feet to this building, creating a total building size of 3,712 square feet. The building addition will not decrease any landscape area; the building addition will be located on an existing concrete pad. The applicant will be adding four additional shrubs around the perimeter of the building addition, and will replace all quantities that must be removed. The property currently has a 25-foot tall freestanding sign located on the south side of the drive aisle. This sign is 83 square feet in size. The applicant wishes to raise the freestanding sign to a height of 35 feet and increase the sign size to 121 square feet. A consolidation plat has been reviewed and approved by city Staff as a part of this request. This consolidation plat will remove the lot line that bisects this property. The plat will create one lot, called "Lot 3A". Pursuant to the Code of Laws, a two-lot consolidation plat may be reviewed and approved administratively. This plat is in the process of being finalized and recorded with Jefferson County. Planning Commission reviewed this request on August 21, 2003 and recommended approval without conditions. COMMISSION/BOARD RECOMMENDATION: Planning Commission reviewed this case on August 21, 2003 and recommended approval of the amended Final Development Plan for the following reasons: 1. It meets the requirements for a Final Development Plan. 2. This amendment will increase overall landscape quantities. 3. The building addition will be compatible with the existing building. 4. The freestanding sign height is not inconsistent with other signs in the area. No one was present at this public hearing to speak either in favor or opposition of these requests. STATEMENT OF THE ISSUES: The Code of Laws specifies that any freestanding sign located within one-quarter mile of the interstate may have a sign as tall as 50 feet. The applicant is requesting a 35-foot tall sign. The Code of Laws specifies that for any standard commercial property, the size of a freestanding sign be based upon building square footage. Given a building square footage of 3,712 square feet, the applicant would be allowed a 79.22 square foot sign. This property is zoned Planned Commercial Development, which affords the opportunity to modify certain standards with an amended Final Development Plan. Using the Code of Laws as a guide, the applicant would be allowed a maximum of 80% total lot coverage in a straight commercial zone district. Total lot coverage is defined as all areas covered by asphalt or building. The proposed addition will bring the total lot coverage to 64.7%. ALTERNATIVES CONSIDERED: None FINANCIAL IMPACT: Camper trailers are taxed in the same manner as automobiles. Taxes are collected based on the buyer's city of residence. There may be increased revenue to the City if additional inventory results in additional sales to Wheat Ridge residents. The City has received a one-time application fee for the amendment to the Final Development Plan. The City will receive a one-time fee for a building permit application. ATTACHMENT I Planning Commission WZ-03-06/Casey's I. REQUEST The applicant is requesting approval of an amendment to the Youngf eld Plaza Phase II Planned Commercial Development Final Development Plan. This amendment would increase the overall building square footage and allow a larger freestanding sign. II. CASE ANALYSIS The property in question is located at 4120 Youngfield Street, and is approximately 9.17 acres in area. The property is zoned Planned Commercial Development (Exhibit 1, Vicinity Map). III. PROPERTY HISTORY The Final Development Plan was approved as a phased project; phase one was approved in December 1980. This phase established the business park located at 4000 Youngfield Street. Phase two was approved in July 1991. It contained three lots; Lot 2, Lot 3 and Lot 4. However, it only established the development of Lot 2. Over the years, Final Development Plans for both Lots 3 and 4 were processed and approved. In April 1995, City Council reviewed and approved the FDP for Phase Two, Lot 4 (Exhibit 2, Phase Two Lot 4). Lot 2 will remain unchanged. Lots 3 and 4 are the focus of this amendment. A consolidation plat is in the process of being finalized and recorded with Jefferson County. This plat will consolidate lots 3 and 4, and create "Lot 3A". Pursuant to Chapter 26, a two-lot consolidation plat may be reviewed and approved administratively. IV. SITE PLAN REVIEW This amendment would allow a 1,120 square foot addition to the existing building (Exhibit 3, FDP). The existing building is 2,560 square feet in size. The proposed building will be 3,680 square feet in size. The applicant is also requesting an increase to freestanding sign height and signage area. An amendment to a Final Development Plan may be processed one of two ways: either administratively or by public hearing process. An amendment to a FDP may be processed administratively, that is reviewed by the Community Development Department, as long as none of the eight items outlined in Section 26-311 are met. These eight items are: 1. Change in character of the development. 2. Increase in intensity (or density) or use. 3. Increase of the problems of circulation, safety and utilities. 4. Increase of the external effects on the adjacent properties. 5. Increase in maximum building height. 6. Reduction in the originally approved setbacks from perimeter property lines. 7. Reduction in landscaped area of the total site, or relocation of landscaped areas, which are required as buffer yards or establish project character. 8. Increase in the gross floor area of structures beyond the authorized maximum allowed with the approved planned development. Planning Commission 2 WZ-03-06/Casey's This proposed amendment will increase the gross floor area; therefore, public hearings before Planning Commission and City Council are required. Parking The proposed amendment will not change the total number or orientation of existing parking spaces. Landscaping This amendment will increase landscape quantities, specifically by adding shrubs. Landscaping is detailed on page 3 of Exhibit 3. A vast majority of the landscaping shown on this page is existing. The landscaping to be added will be located around the perimeter of the building addition. The construction of the building addition will cause the removal of 21 shrubs. The landscape plan details the addition of 25 shrubs, a net increase of 4 shrubs. The existing landscape coverage is not changing. The existing landscape area and landscape quantities far exceed the requirements as specified in the original Final Development Plan. Building Coverage This amendment will add approximately 1,120 square feet of building area. Given a site of 399,269 square feet, the addition will increase building coverage from 2,560 square feet (0.064% of the total site) to 3,680 square feet (0.092% of the site). Because the addition will be constructed on an existing concrete pad, no landscape or parking areas will be removed. Architecture Page four of the FDP details the proposed building addition elevations. The addition will match the existing building in both design and color. Signage The applicant is requesting an increase to freestanding signage. The existing sign is 25 feet in height, and 83 square feet in size. The applicant wishes to increase the sign height to 35 feet, and increase the sign area to 121 square feet. The Code of Laws specifies that any freestanding sign located within one-quarter mile of the interstate may be a maximum of fifty feet in height. Using the Code of Laws as a guide, a commercially zoned property with a building of this size would be allowed a 78.6 square foot sign. However, because this is a planned development, these standards may be varied. Because the freestanding sign was detailed on the original Final Development Plan, any change to the freestanding sign requires an amendment to the FDP. The height of the sign is not inconsistent with other businesses located in the I-70 corridor. V. NEIGHBORHOOD MEETING A neighborhood meeting is not required for an amendment to a Final Development Plan. There has been no public comment received by staff as of this date. Planning Commission WZ-03-06/Casey's VI. AGENCY REFERRALS All outside service agencies that currently serve the property will continue to serve the property, and have indicated that the property owner will incur any associated costs of improvement. VII. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff concludes that this amendment meets the requirements as described in Chapter 26 of the Code of Laws. This amendment conforms to the required parking counts as detailed in the original FDP, and has increased the overall landscaped quantities. Therefore, staff recommends APPROVAL of Case No. WZ-03-06. VIII. This case was presented by Travis Crane. He entered all pertinent documents into the record and advised the Commission there was jurisdiction to hear the case. He reviewed the staff report and digital presentation. Staff recommended approval for reasons outlined in the staff report. OLD BUSINESS Alan White reported that staff evaluated the suggestion from the last Planning Commission meeting that setbacks be based on shade cast by accessory structures. Results of this evaluation revealed that, at the winter solstice, a 10-foot high shed would cast a 20-foot long shadow at noon, with longer shadows at different times of the day. Planning Commission WZ-03-06/Casey's I. REQUEST The applicant is requesting approval of an amendment to the Youngfield Plaza Phase 11 Planned Commercial Development Final Development Plan. This amendment would increase the overall building square footage and allow a larger freestanding sign. H. CASE ANALYSIS The property in question is located at 4120 Youngfield Street, and is approximately 9.17 acres in area. The property is zoned Planned Commercial Development (Exhibit 1, Vicinity Map). III. PROPERTY HISTORY The Final Development Plan was approved as a phased project; phase one was approved in December 1980. This phase established the business park located at 4000 Youngfield Street. Phase two was approved in July 1991. It contained three lots; Lot 2, Lot 3 and Lot 4. However, it only established the development of Lot 2. Over the years, Final Development Plans for both Lots 3 and 4 were processed and approved. In April 1995, City Council reviewed and approved the FDP for Phase Two, Lot 4 (Exhibit 2, Phase Two Lot 4). Lot 2 will remain unchanged. Lots 3 and 4 are the focus of this amendment. A consolidation plat is in the process of being finalized and recorded with Jefferson County. This plat will consolidate lots 3 and 4, and create "Lot 3A". Pursuant to Chapter 26, a two-lot consolidation plat may be reviewed and approved administratively. IV. SITE PLAN REVIEW This amendment would allow a 1,120 square foot addition to the existing building (Exhibit 3, FDP). The existing building is 2,560 square feet in size. The proposed building will be 3,680 square feet in size. The applicant is also requesting an increase to freestanding sign height and signage area. An amendment to a Final Development Plan may be processed one of two ways: either administratively or by public hearing process. An amendment to a FDP may be processed administratively, that is reviewed by the Community Development Department, as long as none of the eight items outlined in Section 26-311 are met. These eight items are: 1. Change in character of the development. 2. Increase in intensity (or density) or use. 3. Increase of the problems of circulation, safety and utilities. 4. Increase of the external effects on the adjacent properties. 5. Increase in maximum building height. 6. Reduction in the originally approved setbacks from perimeter property lines. 7. Reduction in landscaped area of the total site, or relocation of landscaped areas, which are required as buffer yards or establish project character. 8. Increase in the gross floor area of structures beyond the authorized maximum allowed with the approved planned development. Planning Commission 2 WZ-03-06/Casey's This proposed amendment will increase the gross floor area; therefore, public hearings before Planning Commission and City Council are required. Parking The proposed amendment will not change the total number or orientation of existing parking spaces. Landscaping This amendment will increase landscape quantities, specifically by adding shrubs. Landscaping is detailed on page 3 of Exhibit 3. A vast majority of the landscaping shown on this page is existing. The landscaping to be added will be located around the perimeter of the building addition. The construction of the building addition will cause the removal of 21 shrubs. The landscape plan details the addition of 25 shrubs, a net increase of 4 shrubs. The existing landscape coverage is not changing. The existing landscape area and landscape quantities far exceed the requirements as specified in the original Final Development Plan. Building Coverage This amendment will add approximately 1,120 square feet of building area. Given a site of 399,269 square feet, the addition will increase building coverage from 2,560 square feet (0.064% of the total site) to 3,680 square feet (0.092% of the site). Because the addition will be constructed on an existing concrete pad, no landscape or parking areas will be removed. Architecture Page four of the FDP details the proposed building addition elevations. The addition will match the existing building in both design and color. Signage The applicant is requesting an increase to freestanding signage. The existing sign is 25 feet in height, and 83 square feet in size. The applicant wishes to increase the sign height to 35 feet, and increase the sign area to 121 square feet. The Code of Laws specifies that any freestanding sign located within one-quarter mile of the interstate may be a maximum of fifty feet in height. Using the Code of Laws as a guide, a commercially zoned property with a building of this size would be allowed a 78.6 square foot sign. However, because this is a planned development, these standards may be varied. Because the freestanding sign was detailed on the original Final Development Plan, any change to the freestanding sign requires an amendment to the FDP. The height of the sign is not inconsistent with other businesses located in the I-70 corridor. V. NEIGHBORHOOD MEETING A neighborhood meeting is not required for an amendment to a Final Development Plan. There has been no public comment received by staff as of this date. Please consider the following general recommendations while developing this site: LANDSCAPE: 1. All mature trees to be trimmed of branches up 6'-8' from the ground to allow for natural visual observation from surrounding areas to the parking lots and building. 2. All shrubs and bushes mature height to not exceed 36". This height reduces the risk of persons hiding. It also allows for natural visual observation onto the property both for the parking lot and building. 3. Plants/ landscape immediately next to the building should be low-growing ground cover, not to exceed 18" mature height to allow for maximum natural visual observation and eliminate concealment for potential offenders. 4. Ground cover should not include rock material. Rocks can be used to break windows in the buildings and cars. Consider using natural products such as bark or mulch. BUILDINGS: 1. The building finish should be with an anti-graffiti paint or sealant. FENCING: 1. Consider using wrought iron fence instead of cedar. By putting up a wrought iron fencing around the property, you will minimize the chance of vandalism, graffiti and climbing. The initial investment in the fence will be higher, however the long term pay-off by not having to repair the fence will be greater. Page 1 of 2 SITE: 1. During construction, the property should be clearly posted with "No Trespassing" signs. This may help deter trespasses, and allow the Police Department to cite offenders with the crime along with any others offenses that may be committed by trespassers. LIGHTING: 1. Exterior lighting around the buildings and in parking lots should be a minimum of 1.5 candle minimum maintained. This will provide for brightly lit areas that discourages criminal activity due to the illusion /perception of observation and recognition. While my recommendations do not guarantee a crime-free environment, it has been experienced that application of the concept of Crime Prevention Through Environmental Design (CPTED) will reduce the opportunity for crime to occur and will enhance the quality of life. Please consider these suggestions while developing this property. Space is also needed to accommodate additional computer equipment. The addition will have the same exterior appearance as the existing building. There will be no additional entry doors and window treatments will be consistent with existing. The driveway will not be altered in any way and landscaping will remain the same.
