Pam Anderson read the executive summary and assigned Ordinance No. 1319. Travis Crane made the staff PowerPoint presentation. He stated that Planning Commission has denied this application, and the applicant has appealed to Council. Mr. Crane described the discussion with citizens regarding any potential for multi-family units on this site. He stated that any future re-zoning would require Council approval. Marc Cave, of MarcEm properties, spoke as the applicant regarding the rezoning request. He gave a PowerPoint presentation detailing his business and the application. Linda Loomis, 3285 Chase, spoke in opposition to the rezoning. She stated that she felt that more multi-family housing in the area would negatively impact her property values. It sets a bad precedent for the future. Bill McIntyre, 3283 Chase, spoke in opposition to the rezoning application. He said that he is concerned about the "high density" zoning. He works for the Denver Housing Authority and believes that there is a difference between an owner and renter property. He also stated that there would be access issues. The property is currently zoned Residential One-C. The applicant wishes to rezone the property to Residential-Three. The R-1C zone district allows only single-family structures and associated accessory buildings, while the R-3 zone district allows a range of residential uses from single-family through high density multi-family. The R-3 zone district requires a minimum lot size of 9,000 square feet and a minimum lot width of 75 feet to accommodate a two- family dwelling. The R-3 zone district requires a minimum lot size of 12,500 square feet and a minimum lot width of 100 feet to accommodate three or more family dwellings. The subject parcel is 9,375 square feet in size, is 75 feet wide, and therefore could accommodate a two-family dwelling. Pursuant to Chapter 26, a recommendation of denial by Planning Commission stands, unless the applicant appeals to City Council. Planning Commission heard this case on February 5, 2004 and recommended denial. COMMISSION/BOARD RECOMMENDATION: Planning Commission heard this request on February 5, 2004 and recommended denial for the following reasons: 1. Nonconformance with the comprehensive plan. 2. The developer has created a self-imposed hardship. There were several neighbors present at this public hearing to speak in opposition of this request. A letter of opposition was submitted to the Planning Commission the night of the hearing. STATEMENT OF THE ISSUES: Planning Commission recommended denial of this request at the public hearing on February 5, 2004. This recommendation was based partly on the ability for potential redevelopment of neighboring properties to multi-family. Planning Commission felt that even though Residential Three zoning existed to the east of this property, if this application were to be approved and the subject property were rezoned to Residential Three, the potential for additional large-scale multi- family dwellings in the area would be imminent. It should be noted that any future rezoning would require public hearings before both Planning Commission and City Council, and ultimately City Council must approve any such rezoning. Density in the R-3 zone district is regulated by the size of the subject parcel. The Code of Laws states that a two-family dwelling in the R-3 zone district must have a lot size of at least 9,000 square feet. A multi-family dwelling unit (3 or more units) requires a minimum lot size of 12,500 square feet. The subject property is 9,375 square feet in size. A multi-family dwelling unit would not be allowed on this property without multiple variances to lot size and width. The size of the lot constricts the redevelopment, and effectively would make a multi-family dwelling unit extremely difficult. The Comprehensive Plan designates this property as Single Family, not to exceed six dwelling units per acre (SF 6). If a two-family dwelling were to be located on this parcel, the density would be approximately 9 units per acre. This inconsistency with the SF (6) designation was discussed at Planning Commission, however, it should be noted that the current R-1C zoning also exceeds the six units per acre designation. ALTERNATIVES CONSIDERED: Staff considered advising the applicants to rezone the property to R-2 or R-2A. Rezoning to R-2 would allow a two-family dwelling, however variances to lot size and width would need to be processed, and rezoning to R-2 would constitute spot zoning. Rezoning to R-2A would also accommodate a two-family dwelling, but this would constitute spot zoning, as there is no R-2A zoning in the immediate vicinity. Staff felt that due to the development standards for lot size in the R-3 zone district and the presence of R-3 zoning in the neighborhood, R-3 zoning would be appropriate for this parcel. REQUEST The applicant is requesting approval of a rezoning from Residential One-C (R-1C) to Residential Three (R-3). H. CASE ANALYSIS The property in question is located at 3281 Chase Street, and is approximately 9,375 square feet in area. The property is zoned Residential One-C and previously contained a single-family structure. This structure has since been demolished and the lot remains vacant land. The applicant is requesting a rezoning from Residential One-C to Residential Three to accommodate a two-family dwelling. The Residential One-C zone district allows only single-family dwellings and associated accessory structures. The Residential Three zone district allows single, two- and multi-family structures, based upon the lot size and width. The Residential Three zone district requires a minimum lot width of 75 feet and a minimum lot size of 9,000 square feet to accommodate a duplex. The subject property meets both of these standards (Exhibit 1, Improvement Location Certificate). For a multi-family structure, a property in the R-3 district must have a minimum lot size of 12,500 square feet and a minimum lot width of 100 feet. Based on the current lot size, a multi- family structure would not be allowed without a variance to both the lot size and width. A variance that would increase density (add dwelling units) may not be approved administratively, rather the requests must be heard by the Board of Adjustment. III. NEIGHBORHOOD MEETING/REFERRAL A meeting for neighborhood input was held December 9, 2003. A sign-in sheet and synopsis are included for review (Exhibit 2, Neighborhood Meeting Summary and Exhibit 3, Sign-in Sheet). There were two neighbors in attendance, and they seemed generally accepting of this proposal. This request was referred to all affected agencies for comment. All outside service agencies that currently serve the property will continue to serve the property, and have indicated that the property owner will incur any associated costs of improvement. The Wheat Ridge Water District indicated that a separate water tap would be required for the additional unit. The Public Works Department has indicated a drainage report is not necessary. Drainage will be reviewed upon submittal of the building permit for construction of the new duplex. IV. CRITERIA Staff has the following comments regarding the criteria used to evaluate a change in zone: That the existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is an error. Planning Commission WZ-03-1 1/MarcEm The existing zone classification on the official zoning map is not in error. The property currently has Residential One-C zoning. 2. That a change in character in the area has occurred due to installation of public facilities, other zone changes, new growth trends, deterioration, or development transitions, and that the evidence supports the finding of the following. There has been no change in character to the area. Although much of the surrounding land is currently zoned as Residential One-C, this is a result of a mass rezoning that occurred in 1984. This entire area was originally zoned Residential Three when the City incorporated in 1969. Residents in the area petitioned the City to change the zoning to Residential One-C. Some of the property owners were given the opportunity to remain R- 3. Much of the surrounding area is used as residential. The property directly to the south of the subject property is a quasi-public use as the structure is occupied by the senior resource center and the Wheat Ridge library. 3. That the change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, and other related policies or plans for the area. The density, if the rezoning is approved, will be approximately nine units per acre. The Comprehensive Plan designates this area as SF (6) (single-family not to exceed six dwelling units per acre). The SF (6) classification is defined as single-family detached and existing two-family conforming structures and lots. While there is not an existing structure, the lot is large enough to accommodate a two-family structure. 4. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. The proposed change of zone will be compatible with the surrounding area. Much of the surrounding land is zoned and used residentially. The ability to construct an additional unit should not have a significant effect on the surrounding area. All properties within the immediate area are zoned either Residential One-C or Residential Three. A small enclave of Restricted Commercial zoning is located on the east side of Chase Street just north of 32"d Avenue. A large multi-family complex with 14 units is located directly to the east of this property. 5. That there will be social, recreational, physical and/or economic benefits to the community derived by the change of zone. This proposed zone change should create a benefit to the community. The property contained a dilapidated single-family structure. The applicants stated the structure, as it previously existed, was unfit for habitation as verified by a Wheat Ridge building inspector. A new structure will be a vast improvement for this property and the neighborhood. 6. That adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. Planning Commission WZ-03-1 1/MarcEm All responding agencies are able to serve the property, and the developer will incur the cost and maintenance of any improvements. The Wheat Ridge Water District will require the installation of an additional water tap. 7. That the change of zone will not adversely affect public health, safety or welfare by creating excessive traffic congestion, creating drainage problems, or seriously reducing light and air to adjacent properties. The change in zone will not affect public health, safety or welfare in the area. Traffic should not increase significantly, and a drainage study will be required when the building permit is submitted for review. This proposed development should not reduce air or light to adjacent properties. 8. That the change of zone will not create an isolated or spot zone district unrelated to adjacent or nearby areas. This change of zone will not create an isolated zone district. R-3 zoning is present to the east. This property was zoned Residential Three when the City incorporated in 1969, however the mass rezoning in 1984 changed the zoning to Residential One-C. V. STAFF CONCLUSION & RECOMMENDED MOTION (S) Staff concludes that the proposed zone change is consistent with the Comprehensive Plan. The proposed use will be compatible with adjacent land use and zoning. Therefore, staff recommends APPROVAL of Case No. WZ-03-11. I am writing to provide comment from the neighborhood about the proposed rezoning from R-1C to R-3 for 3281 Chase St. I understand that the current owner of the 3281 property would like to build a duplex on that property, and so needs a rezoning of that property. As a resident and homeowner on that block, I object to the rezoning to R-3 for the following reasons: • We worked very hard a few years ago with the city to get the zoning changed to DECREASED density in that neighborhood. Changing the zoning to increase density seems like a big step backwards for that neighborhood. Decreased density (a single-family home) is preferred for that property because increased density (a duplex) is likely to increase traffic. There already is a great deal of traffic from the Senior Resource Center (adjacent property to the south). Large RTD buses and many, many senior commuter vans traverse Chase Street every day as it is. I would prefer that the city does not add to this problem by rezoning the 3281 property. Decreased density also is preferred for that property because there is a great deal of traffic and commotion from the high-density development (apartment complex) across the street. Parking from that complex often extends to the west side of Chase Street. The current "parking lot" character of Chase Street is not attractive and unlikely to be improved by moving 2 families onto the 3281 property. I would prefer that the city does not add to this problem by rezoning the 3281 property. Decreased density also is preferred for that property because there is much traffic and commotion in the alley west of that property from activities associated with the library, firehouse, Senior Resource Center, and trash removal. Moving 2 families onto the 3281 property, a relatively small area, seems likely to increase the commotion and congestion in that neighborhood. Thank you for considering these comments. The subject parcel is 9,375 square feet in size, is 75 feet wide, and therefore could accommodate a two-family dwelling. Planning Commission recommended denial. Pursuant to Chapter 26, a recommendation of denial by Planning Commission stands, unless the applicant appeals to City Council. COMMISSION/BOARD RECOMMENDATION: Planning Commission heard this request on February 5, 2004 and recommended denial for the following reasons: 1. Nonconformance with the comprehensive plan. 2. The developer has created a self-imposed hardship. There were several neighbors present at this public hearing to speak in opposition of this request. A letter of opposition was submitted to the Planning Commission the night of the hearing. STATEMENT OF THE ISSUES: Planning Commission recommended denial of this request at the public hearing on February 5, 2004. This recommendation was based partly on the ability for potential redevelopment of neighboring properties to multi-family. Planning Commission felt that even though Residential Three zoning existed to the east of this property, if this application were to be approved and the subject property were rezoned to Residential Three, the potential for additional large scale multi- family dwellings in the area would be imminent. Density in the R-3 zone district is regulated by the size of the subject parcel. The Code of Laws states that a two-family dwelling in the R-3 zone district must have a lot size of at least 9,000 square feet. A multi-family dwelling unit (3 or more units) requires a minimum lot size of 12,500 square feet. The subject property is 9,375 square feet in size. A multi-family dwelling unit would not be allowed on this property without multiple variances to lot size and width. The size of the lot constricts the redevelopment, and effectively would make a multi-family dwelling unit extremely difficult. The Comprehensive Plan designates this property as Single Family, not to exceed six dwelling units per acre (SF 6). If a two-family dwelling were to be located on this parcel, the density would be approximately 9 units per acre. This inconsistency with the SF (6) designation was discussed at Planning Commission, however, it should be noted that the current R-1C zoning also exceeds the six units per acre designation. ALTERNATIVES CONSIDERED: Staff considered advising the applicants to rezone the property to R-2 or R-2A. Rezoning to R-2 would allow a two-family dwelling, however variances to lot size and width would need to be processed, and rezoning to R-2 would constitute spot zoning. Rezoning to R-2A would also accommodate a two-family dwelling, but this would constitute spot zoning, as there is no R-2A zoning in the immediate vicinity. Staff felt that due to the development standards for lot size in the R-3 zone district and the presence of R-3 zoning in the neighborhood, R-3 zoning would be appropriate for this parcel. CASE ANALYSIS The property in question is located at 3281 Chase Street, and is approximately 9,375 square feet in area. The property is zoned Residential One-C and previously contained a single-family structure. This structure has since been demolished and the lot remains vacant land. The applicant is requesting a rezoning from Residential One-C to Residential Three to accommodate a two-family dwelling. The Residential One-C zone district allows only single-family dwellings and associated accessory structures. The Residential Three zone district allows single, two- and multi-family structures, based upon the lot size and width. The Residential Three zone district requires a minimum lot width of 75 feet and a minimum lot size of 9,000 square feet to accommodate a duplex. The subject property meets both of these standards (Exhibit 1, Improvement Location Certificate). For a multi-family structure, a property in the R-3 district must have a minimum lot size of 12,500 square feet and a minimum lot width of 100 feet. Based on the current lot size, a multi- family structure would not be allowed without a variance to both the lot size and width. A variance that would increase density (add dwelling units) may not be approved administratively, rather the requests must be heard by the Board of Adjustment. III. NEIGHBORHOOD MEETING/REFERRAL A meeting for neighborhood input was held December 9, 2003. A sign-in sheet and synopsis are included for review (Exhibit 2, Neighborhood Meeting Summary and Exhibit 3, Sign-in Sheet). There were two neighbors in attendance, and they seemed generally accepting of this proposal. This request was referred to all affected agencies for comment. All outside service agencies that currently serve the property will continue to serve the property, and have indicated that the property owner will incur any associated costs of improvement. The Wheat Ridge Water District indicated that a separate water tap would be required for the additional unit. The Public Works Department has indicated a drainage report is not necessary. Drainage will be reviewed upon submittal of the building permit for construction of the new duplex. IV. CRITERIA Staff has the following comments regarding the criteria used to evaluate a change in zone: 1. That the existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is an error. Planning Commission WZ-03-1 1/MarcEm The existing zone classification on the official zoning map is not in error. The property currently has Residential One-C zoning. 2. That a change in character in the area has occurred due to installation of public facilities, other zone changes, new growth trends, deterioration, or development transitions, and that the evidence supports the finding of the following. There has been no change in character to the area. Although much of the surrounding land is currently zoned as Residential One-C, this is a result of a mass rezoning that occurred in 1984. This entire area was originally zoned Residential Three when the City incorporated in 1969. Residents in the area petitioned the City to change the zoning to Residential One-C. Some of the property owners were given the opportunity to remain R- 3. Much of the surrounding area is used as residential. The property directly to the south of the subject property is a quasi-public use as the structure is occupied by the senior resource center and the Wheat Ridge library. 3. That the change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, and other related policies or plans for the area. The density, if the rezoning is approved, will be approximately nine units per acre. The Comprehensive Plan designates this area as SF (6) (single-family not to exceed six dwelling units per acre). The SF (6) classification is defined as single-family detached and existing two-family conforming structures and lots. While there is not an existing structure, the lot is large enough to accommodate a two-family structure. 4. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. The proposed change of zone will be compatible with the surrounding area. Much of the surrounding land is zoned and used residentially. The ability to construct an additional unit should not have a significant effect on the surrounding area. All properties within the immediate area are zoned either Residential One-C or Residential Three. A small enclave of Restricted Commercial zoning is located on the east side of Chase Street just north of 32nd Avenue. A large multi-family complex with 14 units is located directly to the east of this property. 5. That there will be social, recreational, physical and/or economic benefits to the community derived by the change of zone. This proposed zone change should create a benefit to the community. The property contained a dilapidated single-family structure. The applicants stated the structure, as it previously existed, was unfit for habitation as verified by a Wheat Ridge building inspector. A new structure will be a vast improvement for this property and the neighborhood. 6. That adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. Planning Commission WZ-03-11/MarcEm All responding agencies are able to serve the property, and the developer will incur the cost and maintenance of any improvements. The Wheat Ridge Water District will require the installation of an additional water tap. 7. That the change of zone will not adversely affect public health, safety or welfare by creating excessive traffic congestion, creating drainage problems, or seriously reducing light and air to adjacent properties. The change in zone will not affect public health, safety or welfare in the area. Traffic should not increase significantly, and a drainage study will be required when the building permit is submitted for review. This proposed development should not reduce air or light to adjacent properties. 8. That the change of zone will not create an isolated or spot zone district unrelated to adjacent or nearby areas. This change of zone will not create an isolated zone district. R-3 zoning is present to the east. This property was zoned Residential Three when the City incorporated in 1969, however the mass rezoning in 1984 changed the zoning to Residential One-C. V. STAFF CONCLUSION & RECOMMENDED MOTION (S) Staff concludes that the proposed zone change is consistent with the Comprehensive Plan. Case No. WZ-03-11: An application submitted by Marc Cave for approval of a rezoning from Residential One C (R-1C) to Residential Three (R-3) for property located at 3281 Chase Street. This case was presented by Travis Crane. He reviewed the staff report and digital presentation. All pertinent documents were entered into the record and accepted by Chair McNAMEE. Staff recommended approval of the application for reasons outlined in the staff report. Mr. Crane entered a letter dated February 3, 2004 into the record from T. Baldwin Yagcr, 3287 Chase Street, Wheat Ridge and provided copies for the Commissioners. The letter expressed Mr. Yager's opposition to the application and was made a part of the official record. Commissioner McMILLIN asked why the applicant was applying for R-3 zoning rather than R- 2. Mr. Crane explained there was an abundance of R-3 zoning in the neighborhood and, further, R-2 zoning would require a variance to lot size in order to build a duplex. In reply to a question from Commissioner MCMILLIN concerning conformance with the Comprehensive Plan, Mr. Crane explained that while the application doesn't meet density requirements for the Comprehensive Plan, neither does the present zoning of RAC. He based his statement that the application was in conformance with the Comprehensive Plan on the fact that the single family six designation is mainly for single family structures and lots as well as duplex structures and lots. The existing senior resource center adjacent to the property is an allowable use, but would probably require a special use if it were being built today. Commissioner McMILLIN expressed concern that R-3 would indeed allow the owner to build a duplex; however, if the owner purchased an adjoining lot, he could build a multi-family unit. Approving this application could be a back door for buildings with greater density. Commissioner McNAMEE commented that she thought there was provision in the code to prevent consolidation of lots for this purpose. Mr. Crane commented that, in the case of purchase of an adjoining lot, it would be necessary to rezone the adjoining lot. Mark Cave 2600 South Parker Road, Aurora si s Mr. Cave, the applicant, was sworn in by Chair McNAMEE. His business, MarcEm Properties, is a franchisee of Homevestors of America. Their purpose is to buy and rebuild properties. He stated that when rebuilding began on the subject property and the existing structure was demolished, it was discovered that it would be necessary to build a new foundation for the house. This rendered the single-family project unprofitable. The plan is to put a modular structure on the property. In response to a question from Commissioner McMILLIN, Mr. Cave stated he did not know what he would do with the property if the zoning were not approved because it is economically unfeasible to build a single-family home. Planning Commission Page 2 February 5, 2004 Commissioner McNAMEE referred to page 1703, Section 26-117(C) of the city code and asked if this would apply to purchase of adjoining property and rezoning to R-3. Alan White interpreted this section to mean that if another lot next door rezoned to R-3, individually a single family or duplex could be built on each of the lots but the lots could not be consolidated to build multi-family development. Commissioner McMILLIN commented that the code also states "unless the predominant adjacent land use is multi-family of a similar density," this statement could support the argument that the existing high-density multi-family across the street could support more multi- family structures in the R-3 zone in the future. While she sympathized with the developer's situation, it was his mistake and was not a reason to allow the rezone. She pointed out that many of the houses in this neighborhood have future historic value. Bill McIntyre 3283 Chase Street Mr. McIntyre was sworn in by Chair MCNAMEE. He expressed opposition to the rezone. He stated that he had considered buying the subject house at one time, but decided against it because of the obvious problems with the foundation. A modular structure would be out of character with other masonry homes in the neighborhood. R-3 zoning could lead to more duplexes and multi-family in the neighborhood. S 1a John Becker 3230 Chase Street Mr. Becker was sworn in by Chair McNAMEE. He spoke in opposition to the rezone. The lot is too small for a duplex. If approved, he was concerned that everyone in the neighborhood would start selling out to developers of multi-family building buildings. Jay Sawicki 9741 Independence Way, Westminster Mr. Sawicki was sworn in by Chair McNAMEE. He works with the applicant. He stated the proposed duplex meets all code and UBC requirements. The city has reviewed the plans and determined that all city requirements are satisfied. Alan White stated that even though the proposed rezone is for R-3, development standards for three or more units would require a minimum lot size of 12,500 and the subject lot is 9,375 square feet. A minimum lot width of 100 feet would also be required and the subject lot is 75 feet. Nothing more than a duplex could be built unless there were consolidation with an adjacent property, which would require a subdivision process subject to Planning Commission review. Planning Commission Page 3 February 5, 2004 Commissioner PLUMMER stated that he would vote against the application based on nonconformance with the Comprehensive Plan and addition of more rental property in the city. There is an existing water/sewer tap and a single-family dwelling could be built on the property. Commissioner McMILLIN stated that the only reason to vote in favor of the application is one of economic benefit to the developer who is part of a national corporation with many resources. The developer didn't look into zoning on the property or the conditiomof the foundation at the time they began their project. He suggested that the dev er olild ~ ela rezone to R-2 and request a variance in order to build a duplex. It was moved by Commissioner McMILLIN and seconded by PLUMMER to deny the application based upon (1) nonconformance with the Comprehensive Plan; and (2) the developer has created a self-imposed hardship. The motion passed 5-0. B. Case No. WPA-04-01 (continued from January 15, 2004): A resolution adopting amendments to the City of Wheat Ridge Comprehensive Plan. The two proposed amendments are the following: (1) Extension of the Comprehensive Plan area outside the current city limits, and (2) Revisions to Chapter 7 dealing with regional cooperation. This case was presented by Alan White. He reviewed the staff report. Staff recommended approval of the resolution with changes outlined in the staff report. In response to a question from Commissioner WEISZ, Alan White explained that a plan needs to be in place under state statute in the event of any future annexation. These are only suggested land uses. If and when annexation occurs, it would still be necessary to adhere to the city's PID, PCD, etc. regulations. Commissioner McMILLIN asked if the intergovernmental agreements would include restrictions on flagpole annexations. Alan White iFlj lit this is something that could be addressed in the agreements. Planning. Commission 1 WZ-03-1 1/MarcEm I. REQUEST The applicant is requesting approval of a rezoning from Residential One-C (R-1 C) to Residential Three (R-3). II. CASE ANALYSIS The property in question is located at 3281 Chase Street, and is approximately 9,375 square feet in area. The property is zoned Residential One-C and previously contained a single-family structure. This structure has since been demolished and the lot remains vacant land. The applicant is requesting a rezoning from Residential One-C to Residential Three to accommodate a two-family dwelling. The Residential One-C zone district allows only single-family dwellings and associated accessory structures. The Residential Three zone district allows single, two- and multi-family structures, based upon the lot size and width. The Residential Three zone district requires a minimum lot width of 75 feet and a minimum lot size of 9,000 square feet to accommodate a duplex. The subject property meets both of these standards (Exhibit 1, Improvement Location Certificate). For a multi-family structure, a property in the R-3 district must have a minimum lot size of 12,500 square feet and a minimum lot width of 100 feet. Based on the current lot size, a multi- family structure would not be allowed without a variance to both the lot size and width. A variance that would increase density (add dwelling units) may not be approved administratively, rather the requests must be heard by the Board of Adjustment. III. NEIGHBORHOOD MEETING/REFERRAL A meeting for neighborhood input was held December 9, 2003. A sign-in sheet and synopsis are included for review (Exhibit 2, Neighborhood Meeting Summary and Exhibit 3, Sign-in Sheet). There were two neighbors in attendance, and they seemed generally accepting of this proposal. This request was referred to all affected agencies for comment. All outside service agencies that currently serve the property will continue to serve the property, and have indicated that the property owner will incur any associated costs of improvement. The Wheat Ridge Water District indicated that a separate water tap would be required for the additional unit. The Public Works Department has indicated a drainage report is not necessary. Drainage will be reviewed upon submittal of the building permit for construction of the new duplex. IV. CRITERIA Staff has the following comments regarding the criteria used to evaluate a change in zone: 1. That the existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is an error. Planning Commission W Z-03-11 /MarcEm The existing zone classification on the official zoning map is not in error. The property currently has Residential One-C zoning. 2. That a change in character in the area has occurred due to installation of public facilities, other zone changes, new growth trends, deterioration, or development transitions, and that the evidence supports the finding of the following. There has been no change in character to the area. Although much of the surrounding land is currently zoned as Residential One-C, this is a result of a mass rezoning that occurred in 1984. This entire area was originally zoned Residential Three when the City incorporated in 1969. Residents in the area petitioned the City to change the zoning to Residential One-C. Some of the property owners were given the opportunity to remain R- 3. Much of the surrounding area is used as residential. The property directly to the south of the subject property is a quasi-public use as the structure is occupied by the senior resource center and the Wheat Ridge library. 3. That the change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, and other related policies or plans for the area. The density, if the rezoning is approved, will be approximately nine units per acre. The Comprehensive Plan designates this area as SF (6) (single-family not to exceed six dwelling units per acre). The SF (6) classification is defined as single-family detached and existing two-family conforming structures and lots. While there is not an existing structure, the lot is large enough to accommodate a two-family structure. 4. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. The proposed change of zone will be compatible with the surrounding area. Much of the surrounding land is zoned and used residentially. The ability to construct an additional unit should not have a significant effect on the surrounding area. All properties within the immediate area are zoned either Residential One-C or Residential Three. A small enclave of Restricted Commercial zoning is located on the east side of Chase Street just north of 32❑d Avenue. A large multi-family complex with 14 units is located directly to the east of this property. 5. That there will be social, recreational, physical and/or economic benefits to the community derived by the change of zone. This proposed zone change should create a benefit to the community. The property contained a dilapidated single-family structure. The applicants stated the structure, as it previously existed, was unfit for habitation as verified by a Wheat Ridge building inspector. A new structure will be a vast improvement for this property and the neighborhood. 6. That adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. Planning Commission WZ-03-1 1/MarcEm All responding agencies are able to serve the property, and the developer will incur the cost and maintenance of any improvements. The Wheat Ridge Water District will require the installation of an additional water tap. 7. That the change of zone will not adversely affect public health, safety or welfare by creating excessive traffic congestion, creating drainage problems, or seriously reducing light and air to adjacent properties. The change in zone will not affect public health, safety or welfare in the area. Traffic should not increase significantly, and a drainage study will be required when the building permit is submitted for review. This proposed development should not reduce air or light to adjacent properties. 8. That the change of zone will not create an isolated or spot zone district unrelated to adjacent or nearby areas. This change of zone will not create an isolated zone district. R-3 zoning is present to the east. This property was zoned Residential Three when the City incorporated in 1969, however the mass rezoning in 1984 changed the zoning to Residential One-C. V. I am writing to provide comment from the neighborhood about the proposed rezoning from R-IC to R-3 for 3281 Chase St. I understand that the current owner of the 3281 property would like to build a duplex on that property, and so needs a rezoning of that property. As a resident and homeowner on that block, I object to the rezoning to R-3 for the following reasons: • We worked very hard a few years ago with the city to get the zoning changed to DECREASED density in that neighborhood. Changing the zoning to increase density seems like a big step backwards for that neighborhood. Decreased density (a single-family home) is preferred for that property because increased density (a duplex) is likely to increase traffic. There already is a great deal of traffic from the Senior Resource Center (adjacent property to the south). Large RTD buses and many, many senior commuter vans traverse Chase Street every day as it is. I would prefer that the city does not add to this problem by rezoning the 3281 property. Decreased density also is preferred for that property because there is a great deal of traffic and commotion from the high-density development (apartment complex) across the street. Parking from that complex often extends to the west side of Chase Street. The current "parking lot" character of Chase Street is not attractive and unlikely to be improved by moving 2 families onto the 3281 property. I would prefer that the city does not add to this problem by rezoning the 3281 property. Decreased density also is preferred for that property because there is much traffic and commotion in the alley west of that property from activities associated with the library, firehouse, Senior Resource Center, and trash removal. Moving 2 families onto the 3281 property, a relatively small area, seems likely to increase the commotion and congestion in that neighborhood.
