The property is 10,125 square feet in size. Pursuant to Article VIII, Chapter 26 of the Wheat Ridge Code of Laws, a class I special exception permit may be granted by the flood plain administrator, provided the improvements proposed are not "substantial improvements", as defined in Section 26-802. The applicant wishes to construct a 330 square foot addition to the existing 1,549 square foot house. Based upon the size of the existing structure and the scope of the proposed addition, the application is considered a class I special exception permit, and may be approved administratively. Pursuant to Section 26-808 of the Wheat Ridge Code of Laws, the Community Development Director is empowered to decide upon applications to allow a class I special exception, without requirement of public hearing, provided that the following conditions are met: 1. That the Community Development Director.finds that the "findings of fact," as set forth below, are substantially complied with and support the request; and 2. The Community Development Director has notified adjacent property owners by posting of the site at least fifteen (15) days prior to rendering his decision, and that no protests have been received in such ten-day period; and If all the conditions above are met, the Community Development Director may issue an administrative variance provided the findings of fact below are met: Findings of Fact: The Community Development Director shall decide upon a request for a Class I special exception permit, and shall base his decision in consideration of the extent to which the following facts, favorable to the applicant, have been established by the evidence: The flood hazard areas of Wheat Ridge are subject to periodic inundation, which results in loss of life and property, health and safety hazards, disruption of commerce and governmental services, extraordinary public expenditures for flood protection and relief, and impairment of the tax base, all of which adversely affect the public health, safety and general welfare. 2. These flood losses are caused by the cumulative effect of obstructions in areas of special flood hazards which increase flood heights and/or velocities and when inadequately anchored damage uses in other areas. Flood losses are also caused by uses that are inadequately floodproofed, inadequately elevated or otherwise protected from flood damage. 3. The addition will be elevated at least one foot above the base flood elevation. 4. There should be no negative impact on the storage capacity of the Lena Gulch 100-year floodplain. This request for an administrative variance meets all applicable conditions as required by Article VIII, Chapter 26 of the City of Wheat Ridge Code of Laws. Staff has not received comments in opposition to this request from the surrounding neighbors. Case No. WF-04-02 is hereby: F APPROVED 1-1 DENIED FX WITH CONDITIONS: 1. We appreciate the opportunity to review this request. The referral package you sent to us does not contain enough information regarding the proposed improvements for us to be able to comment. The referral package included two copies of an elevation certificate for the existing structure, a sketch plan view of the proposed additions and a drawing of a column footing. Also, the flood hazard data on the first page of the permit application is blank. The request for a permit for 11732 West 34th Avenue, which you referred to us in April of this year, is a better example of the types of information that should be provided. If you can provide additional information we will be happy to review it again. Otherwise, we would have to say that there is not enough information to issue a permit.
