Dear Mr. Kotzebue, I have completed the second review of the above referenced documents received on August 6, 2004 of the above referenced documents, and have the following comments: Final Drainage Report (Discussion) 1. Include the project address on the cover page. 2. Please include a statement on page 5 regarding the proposed fence and curb construction along the southerly portion of the site being constructed in such a manner so as to not impede historical runoff flows from the south. For example, the fence shall be constructed with a 6" opening between the fence bottom and the ground, and the curb & gutter shall be constructed with a few 12" wide depressed curb-heads or "notches" to allow the existing runoff to continue to flow in an unimpeded fashion. Please provide a P.E. seal and signature on the Final Drainage Report. Final Drainage Report (Appendix) 1. All comments have been addressed. Drainage Plan 1. Include the total Q for the developed flow rate in the table provided. - 2:- Please include cross-sections A-A and B-B as shown.- - - - 3. Include all of the grades (as shown on the Grading Plan) for clarity. 4. Identify the curb chase along Fenton Street. 5. Include a Note regarding the fence and curbing along the southerly portion of the site. (Please see comment 2 under Final Drainage Report (Discussion) above). 6. Please provide a P.E. seal and signature on the Plan. Surveying Final Plat: 1. Please remove all topographic information from the Plat. (Please see redlined Plat). 2. The top margin needs to be a minimum of 1" per County recording requirements (with 2" left- side, and 'h" for right-hand and bottom margins). 3. The 5-foot sidewalk easement along 44`h Avenue needs to have the following statement included: "Hereby dedicated by this Plat", as shown on the redlined Plat. 4. Include the County Reception Number for the ingress/egress easement(s) along the westerly side of the site. If the 7.8' portion is to be dedicated by this plat, it should be clearly stated as such. 5. Please show all existing and proposed utility easements. Final Development Plan (Sheet 2 - Site Plan): 1. Change the words "Metes & Bounds Description" to "Legal Description" on Sheet 1. 2. Show the width of the 22' wide ingress/egress easement (along the westerly side) on Sheet 2. 3. Show the width of the 5' wide sidewalk easement (along the northerly side) on Sheet 2. 4. Include any other existing or proposed utility easements. 5. Remove the vacated roadway line on the proposed construction portion (see redlined Plan). Outline Development Plan: 1. Include the parcel area in the Legal Description as shown on the FDP. Civil Plans Sheet 1 (Cover Sheet) 1. Please show the 7.5' monolithic vertical curb and sidewalk along Fenton Street. 2. Please provide a P.E. seal and signature on the revised Sheet. Sheet 2 (Site & Overall Utilities Plan) 1. Include the total parcel area in the Legal Description. 2. Add a Key Note and include the width of the 22' wide ingress/egress easement (along the westerly side) as shown on the redlined plans. 3. Add a Key Note and include the width of the 5' wide sidewalk easement (along the northerly side) as shown on the redlined plans. 4. For Key Note 3, change text to: 7.5' monolithic curbwalk (5' sidewalk w/ 2.5' vertical curb). 5. Add a Key Note and arrow for the southerly driveway along Fenton Street as shown. 6. Please provide a P.E. seal and signature on the revised Sheet. Sheet 3 (Street Plan & Profile) 1. Extend the asphalt patchback 2 ft. beyond the proposed concrete driveway on the northwest (see redlined plans). 2. Please include a scale on this Sheet. 3. Indicate the construction limit on the westerly side of site. 4. Show the cross-slope grades and corresponding stations along Fenton Street (from asphalt match points to the proposed curb and gutter). 5. Identify the curb & gutter along 44`h Avenue as being 6" Vertical Curb, Type CG2, and the monolithic curbwalk along Fenton as being 6" Vertical Curb with Sidewalk, Type CS. 6. Include existing elevations for the crown on Fenton Street (on station, e.g., at 2+00, 3+00, etc.). 7. There needs to be positive drainage along Fenton. The negative grades, or those flowing AWAY from the curb and gutter are not acceptable. The existing roadway appears to have approximately a 3% crown (3% cross-slope to west), and the proposed design needs to match this as closely as possible - especially when there is an inlet in which the runoff can be directed. 8. For construction purposes, ALL high points, grade breaks, etc. need to be clearly identified as such, with the BL station, offset (if necessary), and elevation shown. (Please see redlined Sheet). 9. The curb & gutter along the southerly portion of the site needs to be designed to accommodate 5800 W44th(MiracleOn44th)-reviewlitr historic runoff by allowing it to pass ("notched" curb?). 10. Please provide a P.E. seal and signature on the Sheet. Sheet 4 (Grading and Erosion Control Plan) 1. The topographic information currently found on the Proposed Construction should be removed. 2. Show the vehicle tracking control to scale on the plan view. 3. If the northerly entrance is to be used for construction traffic, vehicle tracking will need to be placed here. If the construction traffic is to be limited exclusively to the southerly entrance, a Note will need to be included on this sheet specifically stating this. 4. Show the construction limits along the westerly side of the site. 5. For construction purposes, include elevations at all break points, grade breaks, etc. for the entire site. 6. Show Include the cross-sections A-A and B-B as indicated (the same ones as on the Drainage Plan). 7. Show the existing inlet located at the SW corner of 44`h & Fenton, on both the Proposed Construction and Existing Condition plan views. 8. Show the placement of the silt fencing to be used, and include in the Legend. 9. Use an arrow pointing to the sidewalk chase to better identify it on the Proposed Construction plan view. 10. Change the "hay bale" (currently indicated in the Legend) to "gravel filter" for the inlet protection. 11. Please provide a P.E. seal and signature on the Sheet. Sheet 5 (Detail Sheet) 1. Need to include details for the followin¢: a. The vertical curb with drivecut Type CD2A (for commercial driveways). The Type CD2A has a thickened section (8" both in the gutter and in the sidewalk). b. Silt Fencing. c. Typical section for the 44`h Avenue frontage, showing the curb & gutter, 5' detached sidewalk w/5' landscape strip, etc. 2. Please modify the Type 2A ADA ramp to include the truncated dome area. 3. As the City specifications for asphalt changed in February 2004, the HBP detail will need to be modified to reflect these changes: Grade S for bottom lifts(s), Grade SX for top lift, with the Binder: PG 64-22. 4. The vertical curb to be use along 44`h Avenue is CG2. Please modify the detail to minimize confusing during construction. 5. The detached sidewalk detail indicates the sidewalk width to be a minimum of 4'-0". All plan views show the detached walk to be 5'-0" which is correct. Please modify the detail per redlined plan (5'-0" width with a 4" thickness). 6. The monolithic curbwalk along Fenton is shown on the plan views of all the other sheets as including a 5' sidewalk. All plan views should scale to the width shown on this detail, and either the detail needs to be modified to be consistent with all other sheets, or all of the other sheets need to be modified to match the detail. When the width of the sidewalk has been established, show ONLY that width on the detail as well as the other sheets (get rid of the minimum width, etc.). 7. Please provide a P.E. seal and signature on the Sheet. • Please return all redlined plans with the next submittal. 5800 W44th (MimcleOn44[h) - mviewlltr \\v The Public Works Department requires 2 signed and sealed copies of the Final Drainage Report and Plan and Civil Construction Plans. Please provide these with the next submittal. Public Improvements Cost Estimate & Performance Guarantee (Letter of Credit) Prior to the commencement of the public improvement construction within the 44th Avenue Right-of- Way or sidewalk easement, an itemized engineer's cost estimate will need to be submitted to the Public Works Department for review and approval. Upon acceptance of this estimate, an Irrevocable Letter of Credit reflecting the total of the approved cost estimate plus 25% (125% of engineer's estimate) will need to be submitted by the owner/developer to the City. The City of Wheat Ridge must be in receipt of said Letter of Credit prior to the issuance of any construction permits. 2-Year Warranty.Period for Public Improvements Upon completion of all public improvements and acceptance by the City Inspector, the original Letter of Credit shall be surrendered. At this time a 2-year warranty period for the public improvements shall commence. If at any time during said 2-year Warranty Period the City Inspector deems that the constructed public improvements are in such condition as to require repairs or replacement, the Developer shall complete such work upon request. Upon commencement of the 2-year Warranty Period, a 2°d Letter of Credit in the amount of 25%t of the original itemized engineer's cost estimate shall be submitted to the City of Wheat Ridge and be dated as to expire on the 2-year anniversary of the Warranty Period commencement date. The City shall retain said Letter of Credit for the entire 2-year Warranty Period. Upon completion of the 2-year Warranty Period, the 2°d Letter of Credit shall be surrendered by the City of Wheat Ridge. Application for Minor Grading/Landfill Permit Prior to the commencement of any onsite grading, an Application for Grading/Landfill Permit, along with the fees due will need to be submitted for review and approval. This Permit is generally issued at the time of the Building Permit. Right-of-Way Construction Permit(s)/Licensing Prior to the construction of any improvements, utility service connections, etc. within the public Right- of-Way, the required Right-of-Way Construction Permit(s) and respective licensing shall be submitted to the Department of Public Works for processing. Right-of-Way Construction Permits are issued only after approval of all required technical documents, including but not limited to, the Final Drainage Report & Plan, Final Plat, Final Development Plan, Traffic Impact Study, Storm Sewer Plans, Street Construction Plans, Grading & Erosion Control Plan, and easement or ROW dedications. I have reviewed the submitted documents and have the following comments. CONSOLIDATION PLAT 1. Add a signature line for the surveyor. 2. Add a reception number for the Fenton Street right-of-way vacation. 3. Depict the utility easements on the plat drawing. 4. Any detention easements must be depicted on the plat drawing conjunction with an approved drainage report. 5. Add the City's standard language for detention easements. See attached. 6. Correct note 2 to reference the most recent version of the FIRM map with "Community panel no.080509CO218E, dated June 17, 2003". The property is located in a zone X (unshaded) per the new FIRM maps. 7. Add a reception number for the recorded alley cross-access easement. OUTLINE DEVELOPMENT PLAN 1. Correct the vicinity map to show the property at the southwest corner of 44th and Fenton. 2. A metes and bounds legal description needs to be on the front sheet. The legal description should correspond to the approved legal description on the plat. 3. The surveyor's certification needs to be on the front sheet. 4. Add a signature line for the surveyor. 5. Add a unified control statement, which describes anticipated future ownership and indicates proposed manner of maintaining unified control. 6. Add the following note: "Exterior lighting shall be in accordance with section 26-503 of the Wheat Ridge Code of Laws. Exterior lighting shall be arranged to reflect the direct light and glare away from any adjoining residence and adjacent streets". 7. Staff is going to recommend that itinerant merchants be eliminated from the allowable uses. 8. Another of the permitted uses that may create concern is pawnshops. Would you be willing to eliminate this category? PAGE TWO 1. Remove the outlines of the existing structures and lot lines on the "bubble plan". 2. Both the legal description and the surveyor's certification should be on the first page. 3. I realize now that the drawing illustrating existing conditions was used to show contours at 2' intervals as required for the outline development plan step. Please either show the contours as a layer on the site plan, or add back in a small-scale map of "existing conditions". I apologize for any inconvenience this has caused you. 4. On the "bubble plan", remove the line for the Fenton Street vacation and the utility easement on the west side. FINAL DEVELOPMENT PLAN PAGE ONE 1. Correct the vicinity map to show the property at the southwest corner of 44th and Fenton. 2. There should be only one legal description on the document. The one at the upper right hand corner should be removed. The legal provided must match that shown on the plat and outline plan. The Public Works Department must approve the legal description. 3. Only one surveyor's certification should be on the document. Relocate the one at the upper right hand comer so it corresponds to the metes and bounds legal description. 4. Modify the Planning Director's certificate to Community Development Director. 5. Provide a parking breakdown showing required number of parking stalls (9216 square feet x.9 = 8294 square feet/ 200 = 41 spaces including two handicapped spaces). Include the number of parking spaces provided. Please note that since the rear parking area has not been designed in accordance with City standards, much less parking is available. In my redesign of the rear parking, only six spaces can be accommodated with 30-degree angle parking, versus 15 spaces shown on the plan. Using a 90% occupancy rate, only an 8000 square foot building can be built. It would be possible to include a request for a parking variance with this application. Staff would not support this. 6. Add the city's standard cross-access language as a note. 7. Staff is going to recommend that itinerant merchants be eliminated from the allowable uses. 8. Another of the permitted uses, which may create concern, is pawnshops. Would you be willing to eliminate this category? 9. Renumber this sheet as 1 of 4. PAGE TWO 1. To be consistent with the landscape plan, please show the 6' high solid fence on the rear property line. 2. Be advised that the southern driveway location does not meet the city standard of a 25' offset from adjacent property line. 3. Show all regulated sight distance triangles on the drawing. It appears that one of the signs will be located in the sight triangle for the 44th Avenue/Fenton street intersection. This sign needs to be relocated. 4. Show details regarding height and size for both the existing and proposed signs. 5. The location of the dumpsters to the rear of the building is inappropriate as they are adjacent to the residence to the south. Please relocate the dumpsters away from this common property line. On the drawing, specify what type of materials will be used. 6. The parking area to the rear of the structure does not meet the City's standards for angled parking. The spaces shown are 60-degree parking spaces but the standards used are for 30 degree angled parking. This parking area must be redesigned to meet the City's standards. It appears that 6 stalls with either a thirty-degree angle or perpendicular parking stalls may work. 7. Show adjacent zoning (south: R-3, west: RC, north: Town of Lakeside, east: Town of Mountain View). 8. Clarify handicapped access and it's relationship to number 9 (5' wide turndown edge sidewalk). 9. Provide a detail for the handicapped ramp design. 10. On the drawing, remove item 10 as it should be shown on the plat and is in the wrong location on this drawing. 11. On the drawing, remove contour lines. 12. Remove the line showing the right-of-way vacation for Fenton Street. 13. Show a detail of the parking lot lighting with locations. No freestanding light poles will be allowed in the rear parking area. 14. Correct the spelling of "existing" in number 15 in the legend. 15. Clarify the purpose for number 17 (pedestrian easement). 16. Renumber this sheet as 2 of 4. 17. Is the centered walkway from 44'h Avenue into the front parking area necessary? This space could be incorporated into one of the parking area end caps as additional landscaping. PAGE THREE 1. Provide accurate property dimensions. 2. Redesign the parking in the rear so it meets the City's standards for parking design. See item 6. above. 3. Please provide a breakdown of proposed landscaped coverage including the amount of living versus non-living coverage in both square footage and percent of total. 4. Show all regulated sight distance triangles on the drawing. 5. A portion of the landscaping at the northeast corner of the lot is located within the required sight distance triangle. Please modify the plant materials in this area so as to remove the potential sight distance obstruction. 6. The sign also needs to be moved out of the comer sight distance triangle. 7. The street trees along W. 44'h Avenue must have a caliper size of 3". This needs to be corrected in the plant material legend. 8. In the plant material legend, correct the number of crabapple trees to four. 9. In note number 1, correct the spelling of "efficiency irrigation". 10. In the plant material legend, remove the reference to bluegrass sod and replace with a low water use variety of turf. 3 11. There are seven evergreen shrubs at the very northeast comer of the site, which are not identified by species. 12. Show turf grass between the sidewalk and the back of curb and gutter. 13. Show turf grass between the back of the sidewalk and the parking lot boundary. 14. There are shrubs shown as being on top of the dumpster pads along the rear. 15. There are shrubs located in the walkway from the sidewalk along 44th Avenue into the parking. 16. Relocate the dumpsters away from the common property line with the residence to the south. 17. On the drawing, remove item 10 as it should be shown on the plat and is in the wrong location on this drawing. 18. On the drawing, remove contour lines. 19. Remove the line showing the right-of-way vacation for Fenton Street. 20. Renumber this sheet as 3 of 4. 21. Revise the rear parking area to be consistent with the City's parking design standards. ELEVATION SHEET 1. The architectural elevations need to be incorporated into the final development plan plan- set as sheet 4 of 4. All of the other sheets must be renumbered accordingly (1 of 4, 2 of 4, etc). 2. The elevation sheet should be reoriented on the page so it is consistent with the other sheets in the final development plan. 3. Please show scales on the different components of the drawing. 4. Show elevations for all four sides of the structure. 5. Please provide the colors and materials to be used for each of the sides of the structure. 6. The use of concrete masonry units (i.e., block) will not be allowed. This is true for all four sides of the structure, not just the front elevation. 7. Re-fable the elevations to designate west, east, north and south elevations. 8. Show architectural elevations for both signs with dimensions and proposed materials. Materials should be consistent with those used on the building. 9. Show a detail for the dumpster screening. 10. Where will the mechanical equipment be located? If it is roof-mounted, it must be totally screened from view from all streets and adjacent properties. MAJOR AREAS OF CONCERN Landscaped coverage: The current drawings reflect only 13% of the site being landscaped where the city's requirement for commercial landscaping is 20%. The amount of landscaped coverage on the site must be increased. Residential buffering: The trash dumpsters must be relocated out of the residential buffering strip. 4 Rear parking area: The parking area in the back of the building does not meet the city standards and must be redesigned. The redesign of this area allows six spaces consistent with the City's parking design standards for a total of 35 spaces. 35 spaces would be required to park a structure of around 8000 square feet (based on 10% being removed for mechanical spaces, etc). It is doubtful that adequate parking can be provided without a reduction in the size of the structure from 9200 to 8000 square feet. Construction scheduling: You have indicated that you want to leave the existing structure in place while the other building is being constructed so that your tenants' businesses aren't closed while the new building is being built. This scenario is problematic as when the new structure is completed, Staff will not be able to issue a certificate of occupancy because there will be no parking or landscaping in place. It is naive to think that the existing structure can be demolished and the required landscaping and parking improvements be installed over a weekend. Staff does not support this proposed construction schedule and will recommend against it to City Council. If all of the areas of concerns for the design have not been addressed (lack of landscaped coverage, parking not meeting the City's standards, lack of residential buffering), Staff will have no other choice but to recommend denial. Based on our fee schedule (copy attached), a resubmittal fee will be required with the third submittal, which is one-half of the original application fee. The fee for the next review will be $1362. If a fourth review is required, the resubmittal fee will be the amount of original application fee ($2725). Something to consider would be splitting the public hearing schedules for the outline plan and final plan and plat. The outline development plan needs minimal corrections and could be scheduled immediately. Problems with the final development plan and construction drawings could be worked on while the outline plan/zone change is being processed. Let me know how you would like to proceed. I have reviewed the submitted documents and have the following comments. CONSOLIDATION PLAT 1. Remove all existing building locations. 2. Remove the sign location. 3. In the dedicatory language, correct a typographical error in the 17th line from "of' to "to" 4. Add a signature line for the surveyor. 5. Add a certification block for Planning Commission with the following languge: Recommended for Approval this day of by the Wheat Ridge Planning Commission" with a signature line for the chairperson. 6. Modify the signature block for "Director of Planning and Development" to "Director of Community Development". 7. Add a case history box with the following case numbers: MS-04-06, WZ-04-03. 8. The margin on the top must be at least 1" in width to meet the Jefferson County Recorder's Requirements. 9. Add a reception number for the Fenton Street right-of-way vacation. 10. Enlarge the title. 11. Modify the title of the document to read as follows: "Miracle on 44th Avenue Final Plat A Consolidation Plat of Lots 17, 18 andl9....". 12. Designate the property to the west as Lots 1, 2 and 3 of Seger Subdivision. 13. Add the city's standard language for utility easements and physically depict them on the plat. See attached. 14. The requirement for parking lot buffering adjacent to residential land uses is a 6' wide landscaped strip with a six-foot high solid fence. The buffering provided is inadequate as it is only a 5' wide strip of rock planted with nine upright junipers. Staff would suggest that the strip be increased to 6' to meet code, that a six-foot high solid fence be built on the common property line and that the amount of plant material in this area be tripled. 3. Please provide a breakdown of proposed landscaped coverage including the amount of living versus non-living coverage in both square footage and percent of total. 4. Show all regulated sight distance triangles on the drawing. 5. A portion of the landscaping at the northeast comer of the lot is located within the required sight distance triangle. Please modify the plant materials in this area so as to remove the potential sight distance obstruction. 6. The street trees along W. 44th Avenue must have a caliper size of 3". 7. Add the following note: "All landscaping will be served by a fully automatic, high efficiency irrigation system." 8. Relocate the sign at the northeast comer of the site out of the sight triangle. 9. Plant materials generally appear to meet the city's requirements for quantity of street trees and additional trees and shrubs. However, the quantities shown in the plant materials chart and the numbers shown on the plan do not match. Please correct. 10. At the northeast comer of the building, five ash trees are designated on what are supposed to be six evergreen bushes. Please correct. 11. What are SSC's? They need to be identified by species in the plant materials chart. 12. Identify the tree lawn located between the back of the curb and the leading edge of the sidewalk. The street trees need to be located in this planting strip. 13. Because there is such a large amount of rock mulch, staff suggests that a low-water usage turf be utilized in the landscaped strip located between the back of the sidewalk and the north edge of the front parking area. ELEVATION SHEETS I. The architectural elevations need to be incorporated into the final development plan plan- set as sheet 4 of 4. All of the other sheets must be renumbered accordingly (1 of 4, 2 of 4, etc). 2. The elevation sheet should be reoriented on the page so it is consistent with the other sheets in the final development plan. 3. Please show scales on the different components of the drawing. 4. Only one elevation of the front of the structure should be shown. Staff supports using the one at the "bottom" of the page (current orientation). 4. Please provide the colors and materials to be used for each of the sides of the structure. 5. The use of concrete masonry units (i.e., block) will not be allowed. This is true for all four sides of the structure, not just the front elevation. 6. Re-lable the elevations to designate west, east, north and south elevations. 5 7. Show architectural elevations for both signs with dimensions and proposed materials. Materials should be consistent with those used on the building. 8. Show a detail for the dumpster screening. 9. Where will the mechanical equipment be located? If it is roof-mounted, it must be totally screened from view from all streets and adjacent properties. MAJOR AREAS OF CONCERN Alleyway Access: None of the drawings provided reflect the 22' wide access easement to the west. The latest version of the easement paperwork designates 7' of the alleyway coming from your property. Because the easement is not reflected, all drawings must be reconfigured. Staff will not support reducing the eastern setback to less than 15', nor would we support any further reduction in landscaped coverage. Landscaped coverage: The current drawings reflect only 13% of the site being landscaped where the city's requirement for commercial landscaping is 20%. The amount of landscaped coverage on the site must be increased. Staff would suggest some of the extra parking stalls provided be replaced with landscaping. Residential Buffering: Minimal buffering is provided for the residence to the south. A five- foot wide strip of rock with nine upright junipers is not adequate buffering for a commercial building and parking lot. Staff will require that the width of the strip be increased to 6' to meet code, that a six-foot high solid fence be built on the common property line and that the amount of plant material in this area be tripled. The trash dumpsters should be relocated out of this buffering strip. Construction scheduling: You have indicated that you want to leave the existing structure in place while the other building is being constructed so that your tenants' businesses aren't closed while the new building is being built. This scenario is problematic as when the new structure is completed, Staff will not be able to issue a certificate of occupancy because there will be no parking or landscaping in place. It is native to think that the existing structure can be demolished and the required landscaping and parking improvements be installed over a weekend. Please correct the spelling error on page 2. 2. On page 3, further describe the existing surface conditions, e.g., commercial site is comprised of 100% impervious surfaces including the structure and surrounding asphalt parking lot, the residential property is approximately 20% landscaped, etc. (The existing property description should fully describe the existing conditions). 3. On page 4: a. Include the areas for both the historic and developed basins. b. State both the historic and developed flow rates for all design points (as calculated in the Appendix). 4. On page 5: a. For the General Concept, state how the runoff will be directed across the site, e.g., across the asphalt parking lot, using curb & gutter, open ditch, concrete channel, etc. b. Also under the General Concept (0), regarding the tables and charts. While the Table 5.2 (T-I-F curves) is still applicable, Table 3-1 is no longer to be used. Please use the currently accepted charts and tables from the (current) June, 2001 edition of the Urban Drainage and Flood Control Criteria Manuals. c. Please remove the language from the Report regarding the minimum of 10,000 ftz increased impervious surface area before detention is required. The City of Wheat Ridge requires stormwater detention for all multi-family and commercial developments. The volume of the detention required for a site is generally obtained using the Rational Method, with the maximum release rates following Table SO-1 found in Section 3.2.1 of the UDFCD Manual, Volume 2. The City utilizes the 5 and 100-yr events in stormwater storage/release determination, comparing developed vs. historic release rates for determination of downstream impact. (Please see attached sheets for the current City of Wheat Ridge Site Drainage Requirements) 5. Please provide a P.E. seal and signature on the Final Drainage Report. Upon acceptance of this estimate, an Irrevocable Letter of Credit reflecting the total of the approved cost estimate plus 25% (125% of engineer's estimate) will need to be submitted by the owner/developer to the City. The City of Wheat Ridge must be in receipt of said Letter of Credit prior to the issuance of any construction permits. 2-Year Warranty Period for Public Improvements Upon completion of all public improvements and acceptance by the City Inspector, the original Letter of Credit shall be surrendered. At this time a 2-year warranty period for the public improvements shall commence. If at any time during said 2-year Warranty Period the City Inspector deems that the constructed public improvements are in such condition as to require repairs or replacement, the Developer shall complete such work upon request. Upon commencement of the 2-year Warranty Period, a 2nd Letter of Credit in the amount of 25% of the original itemized engineer's cost estimate shall be submitted to the City of Wheat Ridge and be dated as to expire on the 2-year anniversary of the Warranty Period commencement date. The Community Development and Public Works staff has reviewed the submitted documentation and has concluded that general access from your property through the adjacent access way is not allowed; nor would we support a design utilizing it for commercial vehicle traffic. The Seger Subdivision reserves 5' of easement on the rear of the properties in the subdivision which includes your three lots and the parcels running south from 44`h Avenue on Fenton and Gray Street. The specific language on the plat indicates this area as a "perpetual easement through, over and across the rear five feet of each of said plats for the construction, maintenance and repair of sewer lines and public utilities with the right of ingress and egress therefore." This language is intended to allow for ingress and egress only for the maintenance and repair of the utilities located within the 10' wide combined easement area; not for the property owners and general public to utilize this for access into their properties. Further, we do not support use of this area as access for your property as it would be unsafe. The "alley" is constructed to a width of about 17' between the commercial properties. This width includes the side setback for the structure to the west. It then narrows down to about eleven feet in width adjacent to the residential development to the south to allow for the maintenance of utilities as stated above. It is not specified as being one-way from either the south from West 43rd Avenue, or from West 44`h Avenue on the north. The City's minimum width standard for a one-way traffic aisle is 12'. The minimum aisle width for two-way traffic is 22'. Since the alley is not restricted to one-way traffic, there would be potential for traffic conflicts. If a delivery truck were exiting your property via this access way and a vehicle turned south into it from West 44 h Avenue, there would not be adequate room for the vehicles to pass by each other. It is also questionable whether there is adequate room for a large delivery vehicle to complete a safe turn into this "alley" due to the location of the adjacent structure where the southern access from your property would exit. If your common property line with the parcel to the west is the centerline of the alley, the western half of the easement is located on the adjacent parcel. A specific grant of easement for ingress/egress and cross-access would be required from the adjacent property owner for your tenants and customers to legally utilize the "alley" as intended by the submitted proposal and site design. The planned development process is comprised of two steps: 1). rezoning and outline development plan approval and, 2). final development plan and plat approval. These steps can be separate or can be combined and processed concurrently. Both of the steps, whether processed separately or combined, require public hearings in front of Planning Commission and City Council. The outline development plan is typically a single sheet "bubble" plan document which contains the list of permitted uses, general use areas (location of landscaping, parking and building) and general development parameters such as maximum building height, maximum building square footage, minimum landscaped coverage and minimum setbacks. The final development plan is a more in-depth document, which requires submittal of detailed information including a drainage report, a landscape plan and architectural building elevations. The plan is to leave the existing building standing until the new building is completed, and then demo the old building. Not interested in pushing the building forward to W. 44 h Avenue. Presented several options for the exterior design of the building. Proposed uses are a liquor store, laundromat, salon and dry cleaners. Parking for customers will be in the front of the building and trash dumpsters will be in the rear of the building. Proposed setback from Fenton Street is approximately 18 feet. Proposing to use the existing alley to the west for egress from the site. The owner of the liquor store would like the existing freestanding sign to stay where it is. Will a neighborhood meeting need to be held prior to application submittal? YES Planning comments: The City of Mountain View will need tc be contacted with regard to access off of Fenton. City right-of-way maps show that Fenton Street has bAn vacated, and is completely within Mountain View. A 30 foot setback is required from both streef`frontages. Trash dumpster location is potentially too close to the residences south of the site. Staff would like to see the dumpsters located elsewhere on the site. Potential problems for garbage and fire truck access to the building. 2 handicapped spaces are required for this site. The south drive At along Fenton Street must be a minimum of 24 feet from the adjacent property to the south. Staff would like to see the freestanding sign demolished and replaced with a monument sign. This proposal will require an Outline Development Plan, Final Development Plan and Final Plat. All three can be run concurrently. Public Works comments: No dedicated alley exists on the property. A survey will be needed to verify if an alley exists, and for right-of-way issues along Fenton Street. If the alley is to be used for access into or out of the site a cross-access agreement with the owner to the west will be needed. The City of Mountain View should be contacted if any public improvements will be required along Fenton Street.
