Dear Mr. Gidley:
At its meeting of January 10, 2005, City Council APPROVED Case No. WZ-04-08, a request for
outline development plan approval for property zoned Planned Industrial Development and located
at 4951 Miller Street for the following reasons:
1. It will legitimize the existing uses on the property.
2. It will allow the opportunity for future redevelopment.
3. All requirements for an outline development plan have been met.
City Council also APPROVED a request (under the same case number) for final development plan
approval for property zoned Planned Industrial Development and located at 4951 Miller Street for
the following reasons:
1. It will legitimize the existing uses on the property.
2. The final development plan is consistent with the outline development plan.
3. All requirements for a final development plan have been met.
With the following condition:
The applicant either be responsible for construction of public improvements utilizing
the design already prepared by TST, Inc. of Denver or be required to coordinate with
the contractor for the Arvada Ridge project for installation of the improvements.
Enclosed is a draft copy of the minutes stating the Council's decision. The outline and final
development plans have been recorded with Jefferson County.

Consent Agenda was introduced and read by Mr. DiTullio. Mr. Stites requested that
item 1A be removed from Consent.
Motion by Mr. DTullio for the approval of Consent Agenda Items 1 B, 1 C, 1 D, and 1 E;
seconded by Mrs. Sang; carried 8-0.
Tim Paranto, Director of Public Works, presented the staff report on Agenda Item 1.A.
Motion by Mr. Stites to approve the purchase of four new model year 2005 Ford Crown
Victoria, police option marked sedans from Lakewood Ford, Inc, Lakewood, Colorado in
the amount of their quotation of $20,780.00 per unit.
He further moved to approve the purchase of one new model year 2005 police option
marked SUV form Lakewood Ford, Inc. of Lakewood, Colorado in the amount of their
quotation of $23,129.00 per unit.
He further moved to approve the expenditure of not-to-exceed $25,000 for the
purchase, install and/or relocation of auxiliary equipment required for the operation of
the vehicles, along with installation of markings and communication equipment.
He further moved that all costs associated with these purchases be paid from account
number 01-303-800-807, and that these funds be encumbered in accordance with
Ordinance #787, 1989 Series; seconded by Mr. DiTullio; carried 6-2 with Ms. Berry and
Mrs. Rotola voting no.
PUBLIC HEARINGS AND ORDINANCES ON SECOND READING

Plans for property zoned Planned Industrial Development, located at 4951
Miller Street.

Case No. WZ-04-08 was introduced by Mr. Schulz.
Mayor Cerveny opened the public hearing.

Meredith Reckert, Community Development, was sworn in by the Mayor and presented
the staff report and entered all documents pertaining to the outline development plan
and the final development plan into the record.
Glen Gidley, speaking for the applicant, was sworn in by the Mayor and gave
background on the property. He agreed with Ms. Reckert's presentation.
Outline Development Plan:
Motion by Mr. Schulz to approve Case No. WZ-04-08, a request for approval of an
outline development plan for property zoned Planned Industrial Development located at
4951 Miller Street, for the following reasons:
1. It will legitimize the existing uses on the property.
2. It will allow the opportunity for future redevelopment.
3. All requirements for an outline development plan have been met.
Seconded by Mrs. Rotola; carried 8-0.
Final Development Plan:
Motion by Mr. Schulz to approve Case No. WZ-04-08, a request for approval of a final
development plan for property zoned Planned Industrial bevelopment located at 4951
Miller Street, for the following reasons:
1. It will legitimize the existing uses on the property.
2. The final development plan is consistent with the outline development plan.
3. All requirements for a final development plan have been met.
With the following condition:

EXECUTIVE SUMMARY:
City Manager
The applicant requests approval of outline and final development plans for property zoned Planned
Industrial Development located at 4951 Miller Street. The intent of the outline and final development
plan approvals is to legitimize the existing use of the property.
The property contains a two-family residence on the front portion of the lot and a tree and snow removal
service on the rear of the lot. The property is just less than one acre in size and is shaped like a
parallelogram.
The outline development plan establishes permitted uses and development standards for the property. The
final development establishes a site plan for usage of the property.
Planning Commission recommended approval of both the outline and final development plans with
conditions.
COMMISSION/BOARD RECOMMENDATION:
Planning Commission reviewed both portions of this request at a public hearing held on November 4,
2004.
A recommendation of approval was made for the outline development plan for the following reasons:
1. It will legitimize the existing uses on the property.
2. It will allow the opportunity for future redevelopment.
3. All requirements for an outline development plan have been met.
With the following condition:
In light of the current code which requires a 30-day period for filing of mylars, City Council
shall review and comment on the filing inconsistencies as far as the impact they have, or will
have, on Ordinance No. 1073.
A recommendation of approval was made for the final development plan for the following reasons:
1. It will legitimize the existing uses on the property.
2. The final development plan is consistent with the outline development plan.
3. All requirements for a final development plan have been met.
With the following conditions:
1. On the final development plan document, label buildings A, B and C.
2. On the final development plan document, correct the case number reference in the case history
box to WZ-04-08.
3. The applicant either be responsible for construction of public improvements utilizing the
design already prepared by TST, Inc of Denver, or be required to coordinate with the
contractor for the Arvada Ridge project for installation of the improvements.
No one was present at the public hearing to speak to either request.
STATEMENT OF THE ISSUES:
The property in question was subject to a zone change application to rezone the property from A-1 to PID
and for approval of an outline and final development plan and plat. The purpose of the zone change (Case
No. WZ-97-2) was to incorporate this parcel into the L & K Industrial Park Planned Industrial
Development which abuts 4951 Miller Street on the north and on the west. The incorporation of 4951
Miller would have allowed a 20,000 square foot building addition to 4975 Miller Street and
reconfiguration of interior drive aisles. The zone change was approved by City Council on March 27,
1997. (Exhibit 1, final development plan)
Although the case was approved, signatures of all property owners of record were required to record the
mylars with the Jefferson County Clerk and Recorder's office. The property owner tried for several
months to get all owners of record to sign the mylar but was unsuccessful. Therefore the outline and final
development plans and plat were never recorded. Because the mylars weren't recorded, Staff assumed
that the zone change and associated document approvals were null and void. The zone change ordinance
was recorded on September 23, 1998, without the knowledge of the planning staff. (Exhibit 2, recorded
zone change ordinance) The official zoning map has never reflected the zone change to PID (see the
vicinity map on the front page of the Planning Commission staff report).
Pursuant to Section 26-308 of the zoning and development code, if recordable outline and final
development plan mylars are not provided within 60 days of final decisions, a public hearing will be held
before City Council to reconsider its approval.
During the Planning Commission hearing, there was discussion about the legitimacy of the zone change
approval in 1998 because mylars were never recorded. As such, a condition was placed on Planning
Commission's outline development plan approval recommendation regarding the original zone change
ordinance (Ordinance No. 1073).
Staff has consulted the City Attorney who advised that regardless of whether or not the mylars pertaining
to Case No. WZ-97-2 were recorded, the property is zoned PID by passage and approval of Ordinance No
1073. The requested action by City Council for approval of the current request for outline development
plan approval ratifies the Planned Industrial Development zoning on the property.
Conditions #1 and #2 of Planning Commission's FDP recommendation of approval have been complied
with. The applicant has no problem with condition #3.

A one time review fee was collected for the processing of this application.

I. CASE ANALYSIS

The property contains a two-family residence on the front portion of the lot and a tree and
snow removal service on the rear of the lot. The property contains just less than one acre and
is shaped like a parallelogram.
The L & K Industrial Park Planned Industrial Development abuts it on two sizes. To the south
is a 100' wide strip of land zoned A-1 owned by Xcel Energy. Beyond that is an office
warehouse development with PID zoning. To the east is property located in the City of Arvada
being developed as the "Arvada Ridge" project, a regional mixed-use development containing
56 acres. Sanders Industrial Park Planned Industrial Development, a retail/wholesale plumbing
facility, is located to the southeast.
A tree service, which is similar to greenhouses and landscape nurseries, could be allowed in the
city under other zoning circumstances. In the A-1 and A-2 zone district, greenhouses and
landscape nurseries (either retail or wholesale) are permitted uses as long as a property has a
minimum of one acre of land area with 140' of lot width. Wholesale greenhouses and
landscape nurseries are special uses in C-1 but permitted uses in the C-2 and I zone districts.
Property history
The property in question was subject to a zone change application to rezone the property from

Original uses permitted by the approved outline development plan included all C-1, C-2 and I

II. OUTLINE DEVELOPMENT PLAN
The Outline Development Plan, which usually accompanies a rezoning ordinance, sets the
allowable uses and development standards for the property. Typically the outline development
plan is general in nature and serves as the blueprint for development of the property. The
proposed outline development plan provides more detail as it reflects the existing conditions
(Exhibit 3, outline development plan).
The existing conditions include a two-family dwelling (Building A) with accessory
outbuildings on the front portion of the property. Access is by way of a driveway adjacent to
the southern property line.
The commercial component on the rear of the property includes various buildings used as
workshop (Building B), office and storage space (Building Q. The very western part of the
commercial component is used for vehicle and outside storage. Access for the business is from
a driveway on the north side of the lot.
Allowable uses
The outline development plan identifies two use areas. Use Area A (front portion) allows
existing two family dwellings and accessory structures, the access drive for Use Area B, and
upon redevelopment, all uses allowed in Use Area B.
Use Area B (rear portion) allows tree and snow removal services, landscape nurseries, and
upon redevelopment, uses in the C-1 and C-2 zone districts.

of building additional structures at this time.
Provisions on both the outline and final development accommodate future redevelopment with
site plan approval required by Planning Commission and City Council.

The applicant will be responsible for the construction of public improvements along the Miller
Street frontage including curb, gutter and sidewalk. The civil engineer for the Arvada Ridge
project has designed the Miller Street corridor improvements. The applicant will either be
responsible for construction of these improvements utilizing the design already prepared by
TST, Inc of Denver, or be required to coordinate with the contractor for the Arvada Ridge
project for installation of the improvements.
V. STAFF CONCLUSION & RECOMMENDED MOTIONS
Staff concludes that the Planned Industrial District zoning is already in place on the property.
Outline and final development plans must be approved to legitimize the existing use of the
property and allow for future redevelopment. Therefore Staff recommends approval of the
outline and final development plans.

The City Council further determines that the ordinance bears a rational relation to the proper

Section 4. Severabilitx. If any clause, sentence, paragraph, or part of this ordinance or the

competent jurisdiction invalid, such judgement

3. All requirements for an outline development plan have been met.

Mr. Loecher appeared before the Commission to address pending gnges to the sign code and
particularly off-premise signs. He asked that the sign code make provision for reasonable
advertising for Wheat Ridge businesses. As an example, he expressed concern that his sister-
in-law is unable to display a sign on Wadsworth to advertise her apartment building at 4200
Yarrow because the apartment building is not located on the same parcel
7. PUBLIC HEARING
A. Case No. WZ-04-08: An application filed by Robert Dubois for approval of an
Outline Development Plan and Final Development Plan for property zoned Planned
Industrial Development (PID) and located at 4951 Miller Street.
The case was presented by Meredith Reckert. She entered all pertinent documents into the
record and advised the Commission there was jurisdiction to hear the case. She reviewed the
staff report and digital presentation. Outline and final development plans must be approved to
legitimize the existing use of the property and allow for future redevelopment. The City
Attorney advised that this property is zoned PID, not A-1 as depicted on the zoning map. Even
though the mylars were never recorded, the zone change ordinance was recorded in 1998
without the knowledge of the planning staff. Therefore, staff recommended approval of the
application with conditions as outlined in the staff report.
Commissioner WESLEY expressed concern about the failure to have the mylars recorded when
the PID was approved in 1997. Ms. Reckert stated that the case has been thoroughly reviewed
by the City Attorney and he concluded that the PID zoning stands. Commissioner WESLEY
suggested that, although he had no problem with the property being zoned PID, the
Commission delay a decision on this matter until the matter can go back to City Council to
render a decision regarding the legitimacy of the rezoning and go forward from there. He did
not feel this would cause any undue burden for the applicant.
Alan White commented that even though the mylars were not recorded, the zoning ordinance
was recorded and for seven years the property has been shown as PID on public records. He
further stated that action recommended by staff at this meeting was based upon legal advice
given by the city attorney.
Commissioner SCEZNEY stated that he believed action suggested by Commissioner WESLEY
would cause a month's delay in the process and present an undue burden on the applicant. In
light of legal advice received from the city attorney, he stated he would vote to approve the
case tonight.
Commissioner McMILLIN suggested that City Council review all of these matters before
making a decision.

Mr. Gidley, who was representing the applicant, was sworn in by Vice Chair McMILLIN. Mr.
Gidley explained that Mr. Dubois bought the subject property approximately a year ago with
the understanding it was zoned industrial. Mr. Dubois operates a tree trimming and snow
removal business. He was not aware of a problem until a Wheat Ridge code enforcement
officer informed him that the property was zoned A-1 and not industrial.
Mr. Gidley further stated that the problem with the ordinance getting recorded without the
mylars being recorded happened during a time of transition in the planning director's position
for the City. Mr. Gidley was leaving the position and was being replaced by the present
director, Alan White. He also commented that all of the past and present issues will be
discussed during the City Council hearing and will therefore receive adequate public notice and
discussion.
Mr. Gidley informed the Commission that Mr. Dubois has agreed to pay for the curb, gutter
and sidewalk although he had planned on paying for these items in the future if he ever decided
to redevelop the property.
Vice Chair McMILLIN asked if there were others present who wished to address the matter.
Hearing no response, the public hearing was closed.
Commissioner WESLEY stated that the application meets all city standards for outline and
final development plans and he would therefore vote in favor of the application with the
condition that City Council review and comment on the impact of the previous nonrecording
issues.
It was moved by Commissioner WESLEY and seconded by Commissioner WITT to
recommend approval of an outline development plan for property zoned Planned
Industrial Development located at 4951 Miller Street for the following reasons:
1. It will legitimize the existing uses on the property.
2. It will allow the opportunity for future redevelopment.

9. NEW BUSINESS
Commissioner McMILLIN asked what effect the recent sales tax increase would have on
the Community Development Department. Alan White replied that it would probably be
minimal. Already in the Department's budget is funding to hire a consultant to update the
Comprehensive Plan.
In response to a question from Commissioner WESLEY regarding the possible construction
of a Cabela's store in Wheat Ridge. Alan White stated that a pre-application meeting has
been held with representatives of Cabela's and a tentative schedule has the Planning
Commission hearing some time in March.

This letter is in regard to your submittal for approval of a Planned Industrial Development
outline and final development plan and plat for property located at 4951 Miller Street. I have
reviewed the submittal documents and have the following comments.
OUTLINE DEVELOPMENT PLAN
1. Add the following case number to the case history box: WZ-04-08.
2. Add the name and address of the property owner to the owner's certificate.

3. Under "Project Data" for building area, show the breakdown of building coverage for
buildings A, B and C in square footage and percent of total building coverage.
4. Relable the category of "Interior Space Breakdown" to "Interior Space Breakdown
(Gross Floor Area)".
5. Show the percentage of gross floor area for each of the different building components as
a percentage of total G.F.A. For example, Building A contains 2270 s.f, which is 65% of total
G.F.A.
6. Have the sheds been included in the G.F.A. calculation? If they are to remain, they
should be included as part of the total.
7. The tree count does not account for some of the existing plant materials. Please note the
existing red cedar located in building A's yard area in the tree count
8. There is an additional tree in the rear of building A's yard which isn't identified.
9. Identify the existing plant materials at the southeast corner of the site and include them in
the plant list.
10. Three existing lilac bushes are designated on the list but only two are identified on the
drawing. Please clarify.
11. Add the title "Landscaped coverage breakdown" and retitle the categories "living
landscaping" and "non-living landscaping". The existing information regarding composition,
square footages and percents of total should remain.
12. On the drawing, physically designate the parking provided.
13. In the parking breakdown, it indicates that there are twelve parking spaces on the rear
portion but only five are shown. Please designate the other seven spaces.
14. Are the twelve spaces in use area B to be used by employees only? Do customers ever
come to the site? If so, designate customer and employee parking.
15. Designate how the trash dumpster will be screened.
16. Remove arrows (see below).

The use of digital photographs to convey the architectural style of the structures is fine, however,
the amount used is overwhelming. It also complicates the site plan with the amount of
directional arrows. To make it less complicated, I would recommend using a couple of photos of
each structure. I have looked at the photos and believe that two photos of each structure would
be sufficient. I would suggest using photos 1 and 3 for building A, photos 9 and 22 of building B
and photos 10 and 18 for building C. Please include a notation for each photo regarding which
side of the structure is being shown.
In addition, I am somewhat concerned about the quality of reproduction of the recorded mylar. I
would suggest is that this sheet be used as an exhibit to the public hearing plan set and that it not
is recorded. If this is acceptable to you and your client, the front sheet of the FDP should be
renumbered 1 of 1. A statement should be added to sheet one regarding architectural style of the
existing structure (i.e., Structure A is a one-story clapboard two-family dwelling, etc.).
Attached is referral response from other city departments and outside agencies.

2004. A red-lined document set and drainage plan are also included.

1) Fire protection to this location is provided by the Arvada Fire Department
Station # 2 located at 12195 W 52"a Ave. and Station # I located at 7900 W
57`r' Ave.
2) Fire apparatus access roads shall be required for every building constricted
when any portion of an exterior wall of the first story is located more than 150
feet from fire department vehicle access. UFC 97 902.2.1.
3) All dead-end fire apparatus access roads in excess of 150 feet in length shall
be provided with approved provisions for the turning around of fire apparatus.
UFC 97 902.2.2.4.
4) All-weather fire department access roadways shall be capable of supporting
the imposed loads of 57,000 lb fire apparatus shall be provided. IIFC 97
901.3 Amended.
5) Fire apparatus access roadways shall have an unobstructed width of not less
than twenty tour (24) feet and an unobstructed vertical clearance of not less

Street.
Dear Mr. Lambert,
I have completed the first review of the above referenced documents received on September 21, 2004,
and have the following comments:
Drainage Letter
A Drainage Letter containing the following is to be written, signed, and sealed by a Professional
Engineer licensed in the State of Colorado and shall be included with the next submittal:
1. Specify how the on-site drainage currently functions, e.g., existing flow paths, surface type,
grades, etc.
2. State how the addition of curb, gutter and sidewalk will affect the current drainage pattern, and
whether or not any on-site grading will be necessary, etc.
3. If any on-site grading is to take place, it shall be done in such a manner as to not adversely affect
adjacent properties, and a Grading & Erosion Control Plan shall be submitted for review and
approval. If no grading is required for this project, this should be stated in the letter.
4. State whether the amount of impervious surface is to increase or not. If the amount of
imperviousness is going to increase, state specific runoff volume(s) and runoff path(s) for the
existing (historic) vs. proposed (developed), and include all design points, Q's, Ti`s, etc. in a
tabular format on the Drainage Plan (see below).
5. Please provide a P.E. seal and signature on the Drainage Letter.
Drainage, Erosion Control, and Construction Plan
A Drainage, Erosion Control, and Construction Plan sheet shall be included with the next submittal and
show the following information:
1. Please include the existing contours (as shown on the Final Development Sheet 1).
2. Show the existing (historic) runoff path(s), grade percents, etc.
3. Include all applicable erosion control and BMP's as necessary on the Plan.
4. Include any additional grading if proposed. If no on-site grading is proposed during this project,
state this on the Plan.
5. Show a plan and profile for the curb, gutter and sidewalk to be constructed along the Miller
Street frontage. The design will need to match the Miller Street realignment plan as proposed
with the Arvada Ridge development. For the Miller Street roadway realignment (design)
information, please contact Ward Mahanke, P.E. with TST Inc. at 303.792.0557.
6. All applicable standard City of Wheat Ridge details will need to be shown on the Plan sheet,
including, but not limited to:
a. (Monolithic) Vertical Curb with Sidewalk (Type CS2A).
b. Vertical Curb Drivecut (Type CD2A).
c. HBP Patching (9").
NOTE: City of Wheat Ridge standard details are available in AutoCAD® 2000 Awg format and
may be purchased for $40.00 at the Public Works Department, 303.235.2861.
7. Please provide a P.E. seal and signature on the Drainage, Erosion Control, and Construction Plan

Final Development Plan
1. Need to include the bearing for the Public Service Company right-of-way line in the Legal
Description.
2. Include a Basis of Bearings Statement.

frontage on the Site Plan.

Application for Grading/Fill Permit
Prior to the commencement of any on-site grading, an Application for Grading/Fill Permit, along with
the fees due will need to be submitted for review and approval. This Permit is generally issued at the
time of the Building Permit.
Public Improvements Cost Estimate & Performance Guarantee (Letter of Credit)
Prior to any construction commencing for the required public improvements within the 45`' Avenue
Right-of-Way, an itemized engineer's cost estimate will need to be submitted to the Public Works
Department for review and approval. Upon acceptance of this estimate, an Irrevocable Letter of Credit
reflecting the total of the approved cost estimate plus 25% (125% of engineer's estimate) will need to be
submitted by the owner/developer for review and approval.
Right-of-Way Construction Permit(s)/Licensing
Prior to the construction of any improvements, utility service connections, etc. within the public Right-
of-Way, the required Right-of-Way Construction Permit(s) and respective licensing shall be submitted
to the Department of Public Works for processing. Right-of-Way Construction Permits are issued only
after approval of all required technical documents, including but not limited to, the Final Drainage
Report & Plan, Final Plat, Final Development Plan, Traffic Impact Study, Storm Sewer Plans, Street
Construction Plans, Grading & Erosion Control Plan, and easement or ROW dedications.
2-Year. Warranty Period for Public Improvements
Upon completion of all public improvements and acceptance by the City Inspector, the original Letter of

Credit shall be surrendered. At this time a 2-year warranty period for the public improvements shall
commence. If at any time during said 2-year Warranty Period the City Inspector deems that the
constructed public improvements are in such condition as to require repairs or replacement, the
Developer shall complete such work upon request. Upon commencement of the 2-year Warranty Period,
a 2ad Letter of Credit in the amount of 25% of the original itemized engineer's cost estimate shall be
submitted to the City of Wheat Ridge and be dated as to expire on the 2-year anniversary of the
Warranty Period commencement date. The City shall retain said Letter of Credit for the entire 2-year
Warranty Period. Upon completion of the 2-year Warranty Period, the 2❑d Letter of Credit shall be
surrendered by the City of Wheat Ridge.

This letter is to serve as a follow-up to our conversation of May 5, 2004 regarding property
located at 4951 Miller Street.
The property in question was subject to a zone change application to rezone the property from A-
1 to PID and for approval of an outline and final development plan and plat. The purpose of the
zone change (Case No. WZ-97-2) was to incorporate this parcel into the L & K Industrial Park
planned industrial development plan which abuts 4951 Miller Street on the north and on the
west. The zone change was approved by City Council on March 27, 1997. The outline
development plan was not recorded, but the zone change ordinance was recorded on September
23, 1998.
We have discussed the situation with our City Attorney who advises that the property is in fact
zoned PID, not A-1 as depicted on our zoning map. I have reviewed the development plans
approved with the zone change and have concluded that although PID zoning is in place, new
outline and final development plans are required in order to allow your client to use the property
as he is currently. Pursuant to our current planning and development code, revisions to an
approved outline development plan are processed the same as a zone change approval.
You indicated that the property owner is willing to go through the process regardless, but there
was some question as to which zoning is more appropriate - Planned Commercial Development
or Planned Industrial Development. We have decided that Planned Industrial Development
would be the appropriate zone district for this location.
As you may be aware, the City of Arvada is in the process of approving a large mixed use
development on what is know as the Ridge Home property to the east of your client's parcel. In
light of this we think it may be appropriate to include future land use provisions for some retail
sales particularly in the area of home improvement product sales. I would be happy to meet with
you to discuss the proposed land use allowances for the property in more detail.
Attached for your records are copies our files related to Case No. WZ-97-2. Attached also are
revisions to the planned development district regulations which were approved by City Council
on April 12, 2004 and became effective on May 7, 2004.

NOTICE OF NEIGHBORHOOD MEETING
Robert Dubois, owner of Dubois Tree Service, is proposing a rezoning from Agricultural-One (A-1)
to Planned Commercial Development (PCD) and requesting approval of an Outline Development
Plan and a Final Development Plan on property located at 4951 Miller St., Wheat Ridge,
Colorado. This meeting is scheduled for May 5, 2004 at 7;00pm at the City of Wheat Ridge, City
Hall, 2n° floor glass conference room at the top of the stairs, 7500 W. 2e Ave., Wheat Ridge,
Colorado 80033.
The purpose of this proposal is to allow the continued use of the property for one existing 2 family
residential duplex, as well as to allow for the continued use as a tree service business. In
addition, the PCD zoning will allow for other future commercial type uses as permitted in the
Commercial-Two (C-2) zone district regulations, with future plan amendments required prior to
redevelopment of the property.
The City of Wheat Ridge has adopted a requirement that prior to any application for Rezoning of
property; an applicant must notify all residents and property owners within 600 feet of the subject
property and invite them to a Neighborhood Input Meeting. The purpose of this meeting is to allow
the applicant to present his proposal to the neighborhood and to give the neighborhood a forum to
express their concerns, issues and desires.
A staff planner from the City will attend the meeting to discuss City policies and regulations and
the process involved, however, the planner will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered
as testimony, it is the public hearings in front of Planning Commission and City Council where
decisions are rendered. If you want input in the decision-making process, it is imperative that you
attend the public hearings.
The kinds of concerns residents normally have include the following:
Is the proposal compatible with surrounding land uses and zoning?
• Are there adequate utilities and services in place or proposed to serve the project?
What is the impact on our streets?
• Where will the storm drainage go?
• How will the project be designed to enhance rather than detract from the neighborhood?
• What specific changes can be made in the proposal to make it more acceptable to me?

Applicant/Owner Preliminary Proposal:
Would like to rezone the parcel from A-1 to appropriate zoning, either Planned Industrial
Development (PID) or Planned Commercial Development (PCD). The intent will be to
combine the process with an Outline Development Plan (ODP) and Final Development
Plan (FDP), but with each document being freestanding for recording purposes.
Will a neighborhood meeting need to be held prior to application submittal? YES
Planning comments:
A rezoning will be necessary to accommodate the proposed uses on the property. The
rezone process entails hearings before Planning Commission and City Council.
Rezoning to a Planned Industrial Development or a Planned Commercial Development
would require submittal of an Outline Development Plan (ODP) and Final Development
Plan (FDP). The ODP will require a public hearing before Planning Commission and City
Council. Planning Commission will make a recommendation to City Council, who will
then approve, approve with conditions or deny the ODP. If the ODP is approved, this
process will be repeated for the FDP. The option is available to submit the development
plans concurrently. . nis will reduce the number of requirt„ public hearings, but all
associated technical documents must be submitted with the application.
If a rezoning to a Planned Industrial Development or a Planned Commercial Development
were pursued, submittal of the ODP will rezone the property and define the development
standards such as minimum landscaping, parking, maximum height, maximum building
coverage and architectural design standards. The FDP will address the finer details of
the development, and will be a site specific development plan.
Existing improvements on the property includes a structure with two residential units on
the front and a tree service business on the rear. The applicant is requesting approval of
a two-phase plan. The first phase would rezone the property, recognize the existing
property conditions and establish future uses. The existing uses, structures and site
improvements would remain until the property is fully developed. At that time, a final
development plan will be required for the proposed redevelopment.
There are two existing access points to the property; one for the residential use and one
for the commercial tree business use. The applicant would like the two access points to
remain. Staff is unsure at this point whether the two access points will be supported. It
was determined that one of the residential tenants has been driving across adjacent
property to the south for access. The owner indicated he would eliminate the fence
opening allowing this to happen.
It was determined that screening of the rear of the property would not be required unless
there is bulk storage of materials.
The applicant requested staff to research an ordinance recorded against the property on
September 23, 1998 at reception #F0700173. The legislation released the obligation for
a 10 year special improvement district established when the north 1-70 frontage road was
completed between Kipling and Ward Rd.
A pre-application neighborhood meeting has been schedule for May 5th at 7:00 p.m. at
City Hall. The Planning Division will initiate the 600' radius property owner search. There
is a $100 fee for the neighborhood meeting which needs to be received on or before the
date of the meeting.
Public Works comments:
Construction of public improvements will be required if the property is rezoned. It has
been determined that curb, gutter and sidewalk along the street frontage of the property
matching that to the north will be required as part of these public improvements. The
applicant is requesting that the installation of public improvements be delayed until the
front of the property is redeveloped. It is standard procedure in this type of situation that
financial security be provided for 125% of the cost of the future improvements.
If any substantial changes are made to the property besides the potential bathroom
addition there may be additional public works requirements (e.g. submittal of a drainage
study).
A final plat will not L- required.
Building comments:
Not in attendance. The building official will be consulted as to whether building permits
for completed improvements should be applied for prior to the zone change being
finalized.

On behalf of my client, Robert Dubois, owner of 4951 Miller St., I am submitting for a
Pre-application Review and Meeting for a rezoning from A-1 to PID or PCD.. The intent
will be to combine the process with an outline and Final Development Plan.
Mr. Dubois purchased the subject property in July 2003 from the adjoining property
owner to the north, which is an industrial zoned and used property. At the time of
purchase, the property was being used by the prior owner as a 2-family residential rental
on the front, and outside storage of trucks and construction equipment on the rear of the
property.
In summary, the owner would like to continue operation of his business from the property
and continue the residential use essentially as it currently exists. However, realizing that
this property is surrounded on 3 sides by industrial zoned and used property, he also
understands that he, or a future owner, may want to change the use or redevelop the
property. Thus, the plan would be to maintain the status quo development and use
configuration, allow for limited other uses in the back portion of the property so long as
no new development is required, and allow for future additional uses and revisions to the
development pattern, only with approval of a Final Development Plan amendment.
EXISTING CONDITIONS:
The owner currently operates his business, Dubois Tree Service, Inc., upon the rear
portion of this 1 acre tract. There is also an older 2 family dwelling situated on the front
portion of the property which has 2 rental units.
The business portion of the property utilizes 2 older buildings; a garage/shop and a small
barn. With the exception of 2 small portable sheds located on the residential portion of
the property, all buildings were existing in their current size and location on the property
prior to the current ownership. It appears that they have been on the property for over 50
years. The applicant has resided the garage/shop, and has finished the barn loft area as
his business office, and uses the lower part of the barn for equipment storage. He has alsc

created a separate "business" access point on the north side of the property no a driveway
business area. In addition, he has placed recycled asphalt aggregate
and the non-developed areas of the business portion of the site. No permits were obtained
for work on the buildings or creation of the new access point to Miller St.
The non-developed area of the business portion of the site is used for employee parking
and outside storage of several pickup trucks with snow plows and other trucks an.
equipment used in the business such as a chipper, bucket truck, and similar equipment.

PROPOSED PLAN
In summary, the owner would like to rezone the property to Planned Industrial
Development (PID) or Planned Commercial Development (PCD), whichever staff finds
more appropriate, obtain the required permits for work already done to the garag p,
old barn (office), fencing, and driveway access, and obtain required business licenses. In
addition, he would like to add a bathroom to one of the buildings, either the garage/shop,
or the barn/office building as the employees currently use a portable toilet. In short, his
plan is to keep things the way they are, except for the bathroom addition. He would like
to provide a plan that shows existing conditions, plus the bathroom addition.
The list of allowed uses would be as follows:
USE AREA "A"
1. Existing 2 family dwelling unit.
2. Private sheds and storage buildings accessory to the residential use.
3. Access drive to Use Area "B".
4. Any use permitted in Use Area "B" may be permitted in Use Area "A" only with
removal of the residential use of Area "A", and additionally shall require submittal and
approval of an amended Final Development Plan by Planning Commission and City
Council.
4. Any new buildings in use area A shall require submittal and approval of an amended
Final Development Plan by Planning Commission and City Council.
USE AREA "B"
1. Tree service including inside and outside storage of vehicles, equipment, and materials
related to the business. This business also includes snow removal services and related
equipment.
2. Landscape nursery, including wholesale and retail sales of related products such as soil
and soil amendments, rock, sand, firewood and similar materials.
3. Building and general contractor's service shop and storage yard. This would include
carpenters, painters, roofers, electricians, plumbers, heating and air conditioning

On January 14, 2004, we met to discuss property located at 4951 Miller Street in the City of
Wheat Ridge.
The property in question in zoned Agriculture-One and has a residential structure on the front
portion utilized as a two-family dwelling. The rear is being utilized as a tree service. The
property owner, Robert Dubois was recently sent a warning notice by the city's Property and
Zoning Enforcement Officer for various zoning and building violations including no current
business license, construction without proper permits, unscreened outside storage and having too
may employees for a home occupation.
The intent of our meeting was to address the zoning violations and to discuss long-term solutions
for the owner who purchased the property in August of 2003.
A tree service would be an allowed use in the A-1 zone district if the property meets the
minimums for the zone district. The minimum standards are one acre of lot size with 140' of lot
width. Pursuant to section 26-213.B. development standards, lots substandard to the
requirements for lot area and width are limited to usage as a single-family residence.
The property is over an acre in size at roughly 1.03 acres with 112' of lot width. Because the
property is substandard to the width requirement, the rear of the property cannot be legally used
as a tree contractor's business under the current zoning conditions. A variance to the lot width
minimum is not an option, as it would constitute a use variance.
The property would have to be rezoned to Planned Commercial Development to accommodate
and legalize the tree service contractor use. The City's planned development approval process is
comprised of two steps. The first step, which is zoning approval, requires submittal of an outline
development plan. The outline development plan will rezone the property and define the
allowable uses for the property, as well as set the development standards such as minimum
landscaped coverage, maximum building height and maximum building coverage. The rezoning
and outline development plan approval process takes at least six months to complete and
includes public hearings in front of both Planning Commission and City Council.
The second step, approval of the final development plan and platting, is required prior to
building permit and construction. The final development plan addresses the finer details of the
development including landscaping, architectural design of the proposed structure, and drainage
improvements. It also requires public hearing review by both Planning Commission and City
Council.
The outline development plan and final development plan can be processed individually or
combined into a single application. The combined process is an attractive alternative for those
who have a short project deadline. The disadvantage of the combined process is there is a large,
up-front monetary investment in architectural plans, drainage reports, etc., required without
knowledge of whether the zoning will be approved. It is reasonable to expect that the entire
zone change and development plan and plat process would take at least a year to complete.
With any zone change request, there is a requirement for a pre-application neighborhood
meeting. The applicant is responsible for notifying all of the property owners and residents
within a 600-foot radius of this meeting so those desiring to attend can comment on the proposed
land use application. The date, time and place of the neighborhood meeting must be coordinated
with a city staff member who will attend the meeting. There is a $100 charge for required staff
time for the neighborhood meeting.
The City will permit the tree business to continue operation as long as a planned development
approval process is actively being pursued and no complaints are received regarding the
operation. A completed zone change application with appropriate supporting documents should
be filed within the next six months. Other items of concern that should be addressed
immediately include the building improvements performed without permits, access drives which
appear not to be located on the property and the existence of a "porta-potty". Although the owner
submitted a business license, it cannot be issued because of the illegal use,

would be approximately $800 for the zone change plus $125 per acre and $300 for public
noticing. Fees for final development plan approval would be $500 plus $500 per acre and $300
for public noticing.
