City of Wheat Ridge Community Development Department Memorandum TO: Case File FROM: Travis Crane, Planner SUBJECT: 8321 W. 32"d Ave./Location of Dumpster DATE: 11 October 2005 m Per discussions with a neighbor located at 3285 Balsam Street, Exempla Lutheran has decided to move the location of the dumpster for the Hospice Facility. The Final Development Plan detailed the dumpster in the northeast corner of the property, east of the rear access driveway on the north side of the building. The neighbor had concerns about rodents and the smell generated by the dumpster, which would abut her property. Exempla Lutheran has decided to move the dumpster to the west side of the access driveway on the north side of the building. Because the change is minute in nature, an amended Final Development Plan is not needed. We are already actively engaged in moving the trash enclosure and the turnaround, but we (Exempla) don't want to remove parking spaces. We also plan to involve Mrs. Sullivan with the landscaping selections behind her fence. These will be selected to screen the parking without blocking her mental mountain view. Our plan now is to let these "changes" and any other future changes settle in and just amend the FDP once, while keeping you aware verbally or in writing, towards the end of the project. They are apparently upset with the hospice, specifically, the impact upon their property. I am fairly certain they have already talked with John Cook and Al Davis about some minor changes. Their main concerns were the locations of the dumpster and the small bank of parking in the northeast corner of the property. They indicated to me that they went to `some' of the public meetings, and that they never saw the proposed locations of the parking or dumpster. They would like to see the dumpster moved to the west side of the service entry and either delete, move or further screen the small bank of parking spaces adjacent to the dumpster. I let them know that the project had already been approved by City Council, and that Exempla had the right to construct per plan. I get the feeling that these neighbors could be very contentious if the dumpster and parking issues are not dealt with. Would it be possible for you to meet with me to discuss this matter? It may be beneficial to have Al Davis attend as well. Let me know when/if your schedule permits. The subject parcel is approximately 5.89 acres in size, and is currently zoned Planned Hospital District. Condition number one has been addressed by the applicants, and the landscaping plan has been amended to reflect the change. There was no one in attendance to discuss the Final Development Plan with Planning Commission. STATEMENT OF THE ISSUES: There is a drive aisle and small parking area located just to the north of the hospice property. The parking and access aisle are located on the larger hospital campus property. As a result, the Final Development Plan for the hospital campus (Exempla Lutheran Final Development Plan) must be amended. The amendment to the Exempla Lutheran FDP has been submitted by the applicants, and is currently under review. The Code of Laws dictates that an amendment of this nature is administrative. ALTERNATIVES CONSIDERED: Do not approve the Final Development Plan. FINANCIAL IMPACT: The City has received a one-time application fee for the land use application. A one-time fee will also be collected for a building permit issued for the hospice. CASE ANALYSIS The applicant (owner) is requesting approval of a Final Development Plan. The purpose of this application is to allow eventual construction of a hospice facility. The properties involved in the Final Development Plan are 8301 & 8321 West 32°d Avenue and are collectively 256,728 square feet in size and have a rectangular shape. The properties are currently zoned PHD, and are currently vacant. IL FINAL DEVELOPMENT PLAN The Final Development Plan is a site specific development plan for the properties (Exhibit 1, Final Development Plan). The properties were rezoned from Residential Two (R-2) to Planned Hospital District (PHD) in December 2004. Additionally, an Outline Development Plan was approved which set the allowed uses and development standards for the properties. The Final Development Plan must comply with those standards. The applicant intends to construct a hospice facility, an allowed use listed on the ODP, with an eventual total of 32 beds. The Construction Phasing note under Character Development Standards states that an approximately 4,000 square feet will be added with Phase 2. There is no timetable listed for the phasing. The western 200 feet of the property is labeled as "Tract A". Tract A is actually part of the northern hospital property (Exempla Lutheran Medical Center); however it was never incorporated into the original PHD. This tract was rezoned to PHD on the Outline Development Plan. Tract A is used as an access point to the hospital campus. There are no changes planned to Tract A. Development Standards There are no criteria for approval of a Final Development Plan, as there are for a rezoning. The Final Development Plan should be reviewed for compliance with the development standards established by the Outline Development Plan. The most eastern point of the building is located 54 feet from the eastern property line and the adjacent neighborhood. A minimum 25 foot landscape buffer is required from adjacent residential. Page 5 details the architectural elevations of the building. The ODP specified that the building must meet the requirements of the Streetscape and Architectural Design Manual. The building will incorporate a large amount of brick on each elevation, accented by contrasting masonry borders. A tile roof is proposed, which will create cohesion between the hospice facility and the hospital campus. Decorative wood trusses will create interest at the entrances. Landscaping Pages three and four of the FDP detail the landscaping species, sizes, quantities and location. As the table above shows, the landscaping quantities have either been met or exceeded. There will be 14 three inch caliper street trees along West 32nd Avenue installed in the tree lawn created when the deceleration lane was constructed in 2003. The plans detail two-inch caliper trees to be installed. A condition of approval should be added which requires the street trees to be at least three inches in caliper. The remaining trees, shrubs and annuals will be dispersed throughout the site. Planning Commission 3 WZ-04-12/Exempla Access/Parking One access point has been provided from Lutheran Parkway. Access will be gained through the existing hospital property. Currently, the Lutheran Parkway runs north-south through the campus, and splits into two parkways: Lutheran Parkway and Lutheran Parkway west. The access point to the hospice will be created at the intersection of these parkways. The addition of the hospice access point will complete a four-way controlled intersection. An access easement must be established on the Final Plat. The Wheat Ridge Fire District has reviewed and approved all interior-turning radii and the secondary emergency fire access point. Page two of the FDP shows a crosshatched area on the northern property to be used for parking and access. Because this access point and overflow parking are located on the hospital campus property, the Exempla Lutheran Medical Center Final Development Plan must be amended. Lighting Page 6 of the FDP is a photometric lighting plan which not only shows details of freestanding lighting fixtures, but also emitted lighting levels, shown in foot-candles. The freestanding fixtures are 18 feet tall, the maximum height allowed by the ODP. There will be some 42-inch low-level landscaping lights clustered around the building. All lighting generated will be kept onsite, as is required by Section 26-503 of the Code of Laws. The low-level lighting coupled with the grade change of the parking area will create a low-impactive lighting pattern. Slgnage There is one existing sign located on Tract A, which will remain. Any additional signage will be reviewed in accordance with Article VII with the building permit. Fencing Page 2 shows two sections of six-foot wrought iron fence to be installed near the building. These sections of decorative fence will enclose the courtyards. The ODP specified that any fencing shall be compliant with Section 26-603 of the Code of Laws. The proposed fencing meets these requirements. Final Plat A plat has been submitted which will consolidate two of the lots; 8301 W. 32"d Avenue and 8321 W. 32"d Avenue. The Code of Laws dictates that a consolidation of two lots shall be reviewed administratively. This plat has been reviewed and approved by staff. Agency Referral All responding agencies have indicated that they can serve the property, and the applicant will bear the cost of upgrading any service to the property. Three fire hydrants are being required by the Wheat Ridge Fire District. III. STAFF CONCLUSION & RECOMMENDED MOTION (S): Staff concludes that the Final Development Plan complies with the development standards as established by the approved Outline Development Plan. Additionally, the FDP complies with the form and content of a development plan, as specified in Article III of the Code of Laws. Therefore, staff recommends APPROVAL of the Final Development Plan. In reply to a question from Commissioner McMILLIN, Mr. Crane stated that the lighting plan for this project would be consistent with new lighting standards recommended to City Council. The offsite sub-basin runoff rates may change from those shown subsequent to a review of the Final Drainage Report for the 32nd Avenue Decel Lane project. 3. The City of Wheat Ridge has the following suggestion regarding the WQ orifice plate: The City fully understands the requirements of the Clean Water Act, and the reason for the 40-hr drain time recommended by UDFCD. However, in an effort to minimize the potential health risks posed by the recent outbreak of West Nile Virus, the City is seeking possible alternatives to the standard drill-hole orifice plate design. One such design incorporates the use of a vertical slit (no less than 3/< in. wide for maintenance reasons) that extends upward from the flowline of the outlet box. The height of the slit is determined by the release rate. A concrete trickle channel that runs along the bottom of the detention pond is typically used with this design as well (to allow the pond to fully drain). An expanded metal grate bolted to the outlet structure is also employed with the above-mentioned system, to minimize maintenance and potential clogging of the vertical slit from larger debris. The City prefers this type of design with the understanding that the drain time will most likely be less than the recommended 40 hours. The City is also aware of the recommendations made in the memo to UDFCD from Steve Puttman, Senior Biologist (State Division of Wildlife) that discusses mosquito abatement and the MS4 stormwater BMP requirements in Colorado. The memo states the larvae for the type of mosquito that carries West Nile will hatch within 24-48 hours in standing water. Taking into account the "balancing act" of adhering to the Clean Water Act while minimizing the impact of West Nile Virus, the City's suggestion seems to be a reasonable orifice plate design alternative. Again this is only a suggested design, but I ask that you consider this or a similar design for this detention pond. (I have drawn an example of the design on the Drainage Plan for illustrative purposes). Drainage Plan 1. Include a table for the sub-basin areas and runoff amounts on both the historic and developed plans. 2. On Sheet D-1, be sure that the off-site runoff from W. 32nd Avenue (through the chase) is taken into account. Please be advised a swale was designed to convey the runoff northerly from the chase. (Please refer to the Final Drainage Report for the W. 32nd Avenue Decel Lane by Duane Jansen of Martin/Martin, approved by the City on September 10, 2003. 3. On Sheet D-2 a. The proposed design is currently not acceptable because there is only one foot of fall in 145 feet 0.69%). Creating a more defined swale will ensure that runoff flows are properly directed, minimizing the impact to the adjoining southerly neighborhood. h. Identify the location of the emergency spillway, and include the detail on this sheet. i. Show the curb chase on W. 32nd Avenue (southeasterly corner of site). j. NPDES Permit The Federal Clean Water Act implemented by the EPA requires that stormwater discharges from certain types of facilities as part National Pollutant Discharge Elimination System (NPDES) be authorized under stormwater discharge permits. Construction sites greater than one (1) acre in size require an NPDES construction activities permit. The proposed area of disturbance is about 5 acres and shall therefore comply with NPDES regulations. The NPDES permit for construction activities is issued by the State through the Colorado Discharge Permit System (CDPS), and may be obtained by contacting the Colorado Department of Public Health & Environment, Water Quality Control Division. A copy of the CDPS Permit is to be submitted to the Department of Public Works prior to issuance of the Minor Grading/Landfill and Building Permits. Integral reveal channels along top surface of housing promote heat extraction and prolonged electrical component life. Solid cast wall separates optical chamber from electrical area. II-Electrical Tray Ballast and related electrical componentry are mounted to a reinforced one piece galvanized steel tray with integral handle. For ease of maintenance, tray hinges open via toolless release of one spring loaded latch. Electrical quick disconnects allow tray to be completely removed from housing providing ample hand and tool room for attachment of fixture during installation, and a safer servicing environment. Optional tray mounted fuse connections offer a distinct and easy to maintain alternative to common inline fuse connections. DIMENSIONS C Door One-piece aluminum die-cast door frame. Door frame opens via release of one flush mount toolless latch. Tempered 1/8" thick clear glass lens seals to door with a weather-tight continuous gasket.
