Please make these changes and submit a blackline photographic mylar for recording with Jefferson
County. Please make sure the plat is acceptable for recordation with Jefferson County. The fees
for recording with Jefferson County are $11 per page.

Dear Mr. Grosse:

The purpose of this letter is to follow up with Case No. SUP-04-05. The above properties are zoned A-2. In
order for a dog day care to be allowed on a property zoned Agricultural Two (A-2), the lot the use is on must
be at least one acre in size. One of the conditions of approval for the special use permit was regarding a
consolidation plat to be filed in order to create a lot at least one acre in size encompassing this use. As of
this date, the consolidation plat has been filed, and fee received, however the final plan has not been
submitted. The last correspondence sent by the City contained corrections to be made on the plat submitted.
That letter is dated July 13, 2005.
The final plat for recordation (to make the consolidation plat valid) has not been received as of this date.
The lot is therefore considered nonconforming, and the conditions of the special use permit approval are not
being met.
Therefore, a hearing for the revocation of the special use permit has been scheduled before City Council for
Monday, November 28, 2005 per Section 26-114 (F) of the Code of Laws. If the corrected final plat for
recordation has not been received by Thursday, November 17, 2005, the case will proceed for a public
hearing before City Council. This entails submitting a photographic mylar for recording with Jefferson
County. Please submit the above information by the above date, as we wish to accommodate you but simply
cannot continue to wait for these documents.

Re: - First Review Comments of the Sturm Consolidation Plat.
Dear Mr. Daley,
I have completed the first review of the above referenced plat for the property located at 4322 & 4330
Xenon Street received on June 2, 2005, and I have the following comments:
1. The Plat needs to have a unique title; the name of the property owner can be used in the title.
Even though this is a consolidation and really the opposite of a subdivision, you can use the word
"subdivision" for the purposes of recording as long as the consolidated parcel is identified as Lot
1. Here are a couple of suggestions: "Deorio (or Sturm) Minor Subdivision", "Deorio (or Sturm)
Subdivision", etc.
2. In the Legal Description, the section tie (Point of Commencement) shall be to a Section and/or 1/4
Section Corner.
3. The Section ties shown on the graphical portion are unacceptable. First of all, the double
monument/double section line is rather unclear, and second of all the tie as shown (to the County
monument) can not be accepted due to the fact that the tie must be made to a Section and/or 1/4
Section Comer per Section 26-407-D of the City of Wheat Ridge Municipal Code of Laws.
4. Show the Basis of Bearing line on the graphical portion as being a section line (and only a single
line).
5. Identify the Section and'/4 Section Corner monuments used in the Basis of Bearing.
6. Please include all Dates of Revision.
7. Add the words "BY THIS PLAT" to the "LOT LINE HEREBY REMOVED" statement on the
graphical portion.
8. Need to lighten and clarify the Site on the Vicinity Map.
9. Please increase the text (font) size to 1/8" min., to be more readable (and reproducible).
10. Margins need to be as follows: 2" along the left-hand, 1" along the top, and %2" along all other
sides.
11. If there are 2 owners as stated, there needs to be a signature block for both of them.
12. If you are going to reference Exhibit C (Driveway Easement), please show it on the Plat. The
Driveway Easement widths will need to be shown and the corresponding Reception Number is
currently shown, so please explain what is "NOT PLOTTABLE" (or remove if it isn't pertinent
to the Plat).
13. Please remove Notes 5 and 6. While this may be very good advise to your client, it does not
belong on a Land Survey Plat.
14. Need to double-check that the owners are in fact the Deorio's rather than EILEEN M. and
LOUIS D. STURM.

RE: Special Use Permit Issued for 4322-4330 Xenon
Dear Mr. Grosse:
The purpose of this letter is to follow up with the letter sent on January 20, 2005 regarding Case No. SUP-04-05. In
that letter you were informed that in order for the special use permit to remain valid certain steps needed to take place.
As has been discussed, a consolidation plat must have been filed within 30 days of approval, which was December 13,
2004. As of this date, no formal application for the consolidation plat has been received. A "preliminary"
consolidation plat has been received and sent out on referral to the necessary outside agencies with comments and
corrections forthcoming.
In order to operate the business approved for the special use permit, a business license must be obtained through the
city. As of this date, no business license application for the above use has been received. Per Section 11-22 of the
Wheat Ridge Code of Laws it is a violation of city code to conduct a business without a valid business license. Each
day that a business is conducted in violation is considered a separate offense. A property inspector may visit the site to
determine if there are any violations.
As discussed throughout the process, and as specified in the January 20 letter, prior to issuance of the business license,
all applicable development standards must be adhered to, particularly with regards to parking. In addition, the
completed application for the consolidation plat, including the $300 fee, must be received prior to issuance of the
business license.
Please be aware of the following:
If a complete application for the consolidation plat is not received by April 9, 2005 the community
development department will initiate revocation of the special use permit per Section 26-114 (1) of the Code
of Laws. This may include scheduling a revocation hearing before City Council.
If a business license is not applied for by April 9, 2005, a property inspector will be sent to investigate a
violation of the above referenced Section 11-22 of the Code of Laws. In order for the business license to be
approved, the city's parking requirements must be met as specified in the letter dated January 20, 2005.

I have completed my initial review of the above mentioned plat and I have the following comments:
1. The case number is MS-05-01. Please include a case history box on the plat.
2. A vicinity map needs to be on the plat.
3. Easements need to be shown on the plat consistent with the city's required language.
4. Please note the zoning on each lot including adjacent lots.
5. Please note where all pins for property corners were found and set.
6. Any cross access easements need to be shown on the plat.
7. Need a city certification signature block.
8. Need a county clerk and recorders signature block.
9. The county is Jefferson County in the owner's certificate block.
10. The language in the surveyors certificate block should read "under my direct supervision".
The following needs to be included in the submittal as well:
• Completed, notarized application
• $300 fee
• Proof of ownership (deed)
• If the owner is not consistent with who is on the application, written approval for the individual on the
application must be received, signed by the owner
• Written request, i.e. briefly stating the purpose of the application
Once all of the corrections have been made, you may submit a blueline (paper) copy of the consolidation plat prior to
printing the mylar. Once the paper copy of the plat has been reviewed, you may submit a blackline photgraphic mylar
for recording with Jefferson County. The fees for recording with Jefferson County are $11 per page. You may submit
a mylar without first submitting the paper copy for review, however there may be corrections necessary.

I have completed the first review of the above referenced plat received on February 25, 2005, and have the
following comments:
1. Need to have a unique title for this plat. E.g., Deorio Consolidation. The subtitle should reflect what the
plat is, e.g., "A Consolidation of the 2 Previously Unplatted Parcels located at 4322 & 4330 Xenon
Street".
2. The consolidated parcel does not fit the section as described. Please include a tie to the NW Corner of the
NE 114, Section 29 as indicated on the redlined plat. Please be advised that City-based bearings/coordinates
shall be used per Section 26407-D-6 of the Municipal Code of Laws.
3. Please include a Basis of Bearing statement, using the City-base bearing. The City ROW maps are
available on the City's website: www.ci.wheatrid eg co.us (under Maps & Directions - on homepage).
4. Identify the Point of Commencement.
5. Show all existing and proposed easements. E.g., utility, cross-access, etc.
6. Indicate if all property comer pins are found or set.
7. If the POC shown on the graphical portion is a Right-of-Way intersection monument, please identify as
such (and include the City ID number found on the Half-Section Map). Need to show the bearing along
the N-S CL Section 20 (on City-base).
8. Move the statement regarding zoning of the subject property and the adjoining parcels under the Legal
Description.
