I. REQUEST The applicant requests approval of a Special Use Permit to allow the construction of a car wash on property zoned C-1 located at 7980 W. 44`h Avenue. Section 26-204 (zone district use schedule) of the Zoning and Development code prescribes that car washes in the C-1 zone district must receive approval of special use permit. Pursuant to Section 26-114 (special uses), the Community Development Director has the ability to decide upon applications for administrative special use approval, without requirement for a public hearing, provided the following conditions are met: 1. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter notice and the site has been posted for at least ten (10) days, 3. No written objections have been received in such ten-day period; 4. The Community Development Director concludes that the criteri a for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; or, 2. Whether the SUP is personal to the applicant and may or may not be inherited; and /or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section II. PROPOSED SITE DESIGN The property in question is zoned Commercial-One, is comprised of 33,000 square feet of land area (.75 acres) and contains a 1-1/2 story single family residence built in 1887. A site plan, landscape plan and building elevations have been submitted for review. Construction on the property must adhere to the standards dictated in the C-1 zone district regulations, and meet all other applicable development codes for commercial development in the zoning and development code. Upon approval of the special use permit request, the application must submit complete building plans as part of the building permit application. Structure design: The applicant has submitted a design with a building containing 3163 square feet computing to building coverage on the lot of 10%. The structure will consist of two automatic wash bays, Ai 6 self serve bays and an associated equipment room. Total lot coverage by building and hard surfaces is 18,800 square feet or 57%. The maximum permitted lot coverage in C-1 is 80%. All Case No. SUP-05-02/Linus setback requirements have been met or exceeded. The proposed architectural materials of the structure are brick with block accents. Access and parking: Access is by way of a single curb cut to W. 44`h Avenue. The proposed access point is centered on the common property line between this lot and the lot to the east (Lot 3, Charles Graul, Jr. Minor Subdivision). A recorded joint access/cross access easement will be required prior to issuance of a building permit. Regarding circulation, the car wash patrons enter the structure from the south and exit on the north. Vacuum islands are located on both the north and south sides of the building. All parking requirements have been met. Landscaping: The zoning and development code requires 20% landscaped coverage on the property. The proposed landscape plan exceeds this figure with 33% landscaped coverage. The landscape design either meets or exceeds the minimums for number of streets trees and additional trees and shrubs required on the property. Signage: A single monument sign with 40 square feet of sign area is proposed to be located in the landscaped buffer along W. 44`h Avenue. Per staff's request the applicant has agreed to provide a sign with a dark background with light colored sign copy. One wall sign is proposed on the north side of the building. 111. AGENCY REFERRALS The application was referred to all appropriate city departments and outside agencies. All agencies have indicated that they can serve the property with upgrades at the developer's expense. Xcel Energy has expressed concern that the design proposed may be in conflict with an existing easement. If this is the case, the applicant must process an encroachment application. Public Works will require a drainage report and plan at the time of building permit. A grading and erosion control plan and public improvement construction plans will also be required. A traffic impact study will not be required based traffic figures submitted. Wheat Ridge Sanitation District must approve sanitary sewer plans at the time of building permit. Wheat Ridge Water District must approve water service plans at the time of building permit. Wheat Ridge Fire Protection District has reviewed the revised plans and has no conflicts at this time. IV. SPECIAL USE PERMIT CRITERIA Before an administrative special use is approved, the applicant shall show and the Community Development Director shall find that the proposed special use: 1. Will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use. The proposed use should not have a detrimental effect on the general health, safety or welfare of persons in the neighborhood. 2. Will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics of the proposed plan. Case No. SUP-05-02/Linus 3 The proposed car wash facility should not contribute to blight in the neighborhood. The property currently has an existing house on it which is in general disrepair. The applicant proposes to construct a new building which should be an improvement to the property. 3. Will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution. The proposed car wash facility should not affect the adequate light and air, nor cause significant air pollution. The business may increase the noise pollution in the area. The automatic car wash bays will have automatic dryers at the north side of the building. The vacuum islands located adjacent to 44a' Avenue will add to the noise. There will be storm water run-off generated by the development. 4. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service of internal traffic conflicts to the detriment of persons whether on or off the site. The request will result in an increase in traffic in the area. All of the City's parking requirements have been met. The installation of public improvements along W. 44a' Avenue will result in the extension of the curb cut onto the property to the east. When the property to the east develops, it will share this access point with the carwash. There should be no loading or service conflicts to the detriment of persons whether on or off the site. 5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The proposed car wash facility will conform to all Commercial-One development standards. The use of brick will be consistent with the City's architectural standards. The proposed landscaped coverage of 33% exceeds the minimum 20% requirement in the C-1 regulations. 6. Will not overburden the capacities of the existing streets, utilities, parks, schools and other public facilities and services. The proposed use will not overburden the capacities of existing streets, utilities, parks, schools or other public facilities. All responding utility agencies are able to serve the property with upgrades at the developer's expense. 7. History of compliance by the applicant with Code requirements and prior conditions, if any, regarding the subject property. A search of the City's code enforcement records has shown that there has been no previous code action against the applicant. 8. Ability of the applicant or any permitted-in-interest to continuously meet the conditions of the proposed permit. Case No. SUP-05-02/Linus 4 If conditions of an approved special use are violated, the permit can be revoked. If the permit is revoked, then the CMRS facilities must be removed. It is in the applicant's best interest to follow the terms and conditions of any approval received from the city. 9. Other factors relevant to the specific application. There are no other relevant factors. V. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on February 17, 2005. There were several property owners in attendance; however, no significant opposition was expressed regarding the request. VI. STAFF RECOMMENDATION/FINDINGS OF FACT Staff recommends approval of Case No. SUP-05-02, a request for approval of a special use permit for property located at 7980 W. 44a' Avenue allow a car wash facility in a Commercial-One zone district with the following findings of fact: 1. This request for an administrative special use meets all applicable conditions as required by Section 26-114 of the City of Wheat Ridge Code of Laws. 2. Staff has not received written comments in opposition to this request from the adjacent property owners. 3. The car wash facility will create minimal impacts upon the general health, safety welfare and convenience of persons residing or working in the neighborhood. 4. The proposed car wash will not create nor contribute to blight in the neighborhood by virtue of physical or operational characteristics of the proposed use. 5. All agencies can serve the property with improvements at the developer's expense. With the following conditions: 1. The car wash is allowed to be open 24 hours per day. However, if complaints regarding the operation are received from area residents, these hours shall be reconsidered. 2. The property shall be developed in accordance with the site plan shown in the case file. 3. The grant of use shall be for the property and may be inherited. 4. Prior to building permit, the applicant shall provide a recorded joint access/cross access agreement with the property to the east (Lot 3, Charles Graul, Jr. Minor Subdivision). 5. The car wash typically only has a handful of days (less than ten) each year where it is operating at peak capacity throughout most of the day. These days are usually a sunny, warm Saturday in the winter following a snowstorm earlier in the week. Since cars are dirtiest at this time of year, 90%. of the customers get one of the top two washes in the automatic wash (which take longer than the lower priced washes) and customers use more time when washing in one of the self-serve bays. The average top automatic wash takes approximately nine minutes when you also factor in the time it takes for each car to enter and exit the wash. This equates to approximately seven cars per automatic bay per hour. The proposed wash will have two automatic bays, resulting in fourteen cars entering and eating the automatic car wash bays per hour. Throughout the year, the average person washing in a self-serve bay spends five dollars, which translates to ten minutes at a price of fifty cents per minute. However, once again on these peak days, can are dirtier than usual and people take longer to wash, increasing the average to over six dollars. I have reanalyzed the city's landscape requirements and have concluded that my original figures are accurate. The landscape code requires one street tree for every 30' of street frontage (140'130' = 4.6 rounded up to 5) plus one additional tree and ten shrubs for every 1000 square feet of required landscaping on-site. The required landscaped coverage of 20% computes to 6636 square feet. Based on this figure (6636 s.f. / 1000 s.f. = 6.6), an additional 7 trees (6.6 x 1 = 6.6) and 66 shrubs (6.6 x 1000 = 66) are required. 2. I spoke with Tim Paranto, Director of Public Works, regarding access and he indicated that the suggested location of the access point aligning with Allison Street is not realistic as the adjacent property to the west has already been developed. Public Works will require a joint access with the property to the east for access to the carwash. The neck of the drive must extend far enough back to accommodate future development on the eastern parcel. An easement will be recorded to memorialize the joint access point. 3. In regard to the architectural elevations, I have discussed the changes with the other planning staff and the primary use of brick with block accents and stucco, as we discussed, will be allowed. There is no problem with block construction as long as the brick fascia is used on all four sides of the structure. No, but one of the owners will be on-site a couple of hours each day. • The residents in attendance were asked about the materials for the building which is proposed to be two different colors of concrete block. They had no concern that the proposed building wasn't to be brick. • The applicant was asked how many nighttime users there are on a typical summer night? The applicant replied there are very few between 11 PM and 5 PM. Facilityy escription The car wash will consist of two Karcher automatic touchless washes and three self-serve wash bays, in addition to vacuum, shampoo, fragrance, and vending machines with car care products. The Karcher wash is the finest touchless wash available. The wash uses laser eyeballs that sense the outline of the vehicle, enabling it to contour and wash each vehicle according to its size and shape. It can accommodate vehicles up to 7.5 feet high, 8 feet wide, and 25 fleet long, which includes SUVs, dualy pickups, and Hummers. Currently there is no wash of this type in Wheatridge. The building will be constructed of masonry block, predominantly tan with a secondary color for architectural accent. Customers will be able to pay with cash, debit, or credit cards at the wash. Water RMyelmg & Water Use Reduction The facility will use water recycling and reduced water usage to receive a Certificate of Efficiency from the Denver Water Car Wash Certification Program. Site Zoning and Current Condition The commercial zoning for this site allows for a car wash with a special use permit. CITY OF WHEAT RIDGE NOTICE OF NEIGHBORHOOD INPUT MEETING Linus Enterprises, LLC is proposing to develop a car wash on property located at 7980 West 44th Avenue. THE DATE AND TIME OF THE MEETING IS: Tuesday, February 15, 2005 at 6:00 p.m. THE LOCATION OF THE MEETING IS: Second Floor Conference Room, Municipal Building, 7500 West 29`h Avenue. THE PURPOSE OF THIS PROPOSAL IS: to develop an automatic (two bays) and self-serve (three bays) car wash at 7980 West 44' Avenue. Facility Description The car wash will consist of two Karcher automatic touchless washes and three self-serve wash bays, in addition to vacuum, shampoo, fragrance, and vending machines with car care products. The Karcher wash is the forest touchless wash available. The wash uses laser eyeballs that sense the outline of the vehicle, enabling it to contour and wash each vehicle according to its size and shape. It can accommodate vehicles up to 7.5 feet high, 8 feet wide, and 25 feet long, which includes SUVs, dualy pickups, Hummers, and vans. Currently there is no wash of this type in Wheat Ridge. The building will be constructed of masonry block, predominantly tan with a secondary color for architectural accent. Customers will be able to pay with cash, debit, or credit cards at the wash. Water Recycling & Water Use Reduction The facility will use water recycling and reduced water usage to receive a Certificate of Efficiency from the Denver Water Car Wash Certification Program. Denver Water has already reviewed the planned operations of the facility and has stated that it will certify the car wash once it is operational. Site Zoning and Current Condition The C-1 commercial zoning for this site allows for a car wash with a special use permit. There is currently a deserted home in disrepair on the property that will be removed to make room for the car wash and landscaping. Most of the trees on the site are unsightly and/or interfere with overhead utility lines. All of the trees, except for one large, mature tree in good condition along the south property line, will be removed. 44"' Avenue Traffic Approximately 200 vehicles will visit the wash on an average day, thus creating virtually no impact on traffic on 44s' Avenue. Daily traffic count on 44th Avenue is approximately 15,000 cars. Utilities & Storm Drainage All relevant utilities are available to the site. Xcel Energy will upgrade the existing power service; the site has two sewer taps; and water is available from the water main in 44 s Avenue. Storm runoff will drain into landscaped on-site detention ponds along the north side of the property and subsequently drain into 44`s Avenue. The City of Wheat Ridge has adopted a requirement that prior to any application for Rezoning of property and for Special Use Permits an applicant must notify all residents and property owners within 600 feet and invite them to a Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to present his proposal to the neighborhood and to give the neighborhood a forum to express their concerns, issues and desires. A Staff planner will attend the meeting to discuss City policies and regulations and the process involved, however, the Planner will remain impartial regarding viability of the project. Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimony, it is the public hearings in front of the Planning Commission and City Council where decisions are rendered. If you want input in the decision-making process, it is imperative that you attend the public hearings. The kinds of concerns residents normally have include the following: • Is the proposal compatible with surrounding land uses and zoning? • Are there adequate utilities and services in place or proposed to serve the project? • What is the impact on our streets? • How will this proposal affect my property? • Where will the storm drainage go? • How will the project be designed to enhance rather than detract from the neighborhood? • What specific changes can be made in the proposal to make it more acceptable to me? The Karcher automatic car wash equipment is the finest in the industry and will be the first in Wheatridge. The site is 32,931 square feet, with the car wash building occupying approximately 3,232 square feet. The car wash will also provide vacuums, shampoo and fragrance machines, as well as vending products for cleaning the inside of vehicles. The building will be constructed of tan masonry concrete block in order to help hide the efflorescence that occurs in such block, along with a secondary accent color band of block to add an architectural accent to the building. The roof will be a hidden flat metal roof in order to accommodate hoses and lines running between the bays and the equipment room. Landscaping will be completed to accommodate city requirements. There are currently several existing trees on the property that are unsightly and/or interfere with the elevated power lines along the west property line. All of the trees will be removed, with the exception of the largest tree on the property, which is near the south property line. All efforts will be made to keep this large tree.
