Case No. SUP-05-04/Fiber Tower I. REQUEST The applicant requests approval of a Special Use Permit to allow the erection of rooftop-mounted CMRS facilities on property zoned C-1 located at 4251 Kipling Street. Section 26-615 of the Zoning and Development code prescribes that rooftop and freestanding CMRS facilities must receive approval of special use permit. Pursuant to Section 26-615, the Community Development Director has the ability to decide upon applications for administrative special use approval, without requirement for a public hearing, provided the following conditions are met: 1. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter notice and the site has been posted for at least ten (10) days, 3. No written objections have been received in such ten-day period; 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; or, 2. Whether the SUP is personal to the applicant and may or may not be inherited; and /or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section II. PROPERTY DESCRIPTION The property in question is zoned Commercial-One, is comprised of 3.84 acres and contains an 83,480 square foot office building. The existing structure is close to 50' in height. There are existing building mounted CMRS antennas on all sides of the structure near the top of the structure walls. There are currently no rooftop-mounted CMRS antennas; however, there is screened mechanical equipment on the roof. III. SPECIAL USE PERMIT CRITERIA Before an administrative special use is approved, the applicant shall show and the Community Development Director shall find that the proposed special use: 1. Will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use. Case No. SUP-05-04/Fiber Tower The property in question has always been utilized commercially. No substantial changes are proposed to the site, except for the addition of the rooftop antennas which would be screened similar to the mechanical equipment for the building; therefore, there will be no detrimental effect on the health, welfare, safety and convenience of persons residing or working in the area. 2. Will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics of the proposed plan. There will be no blight in the neighborhood as a result of the antennas. There is already roof- mounted mechanical equipment on the structure. 3. Will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution. The site conditions are not changing, therefore, there should be no impact on light, air, or water to adjacent properties. The property is bounded on the northwest, north and east by commercially zoned and used property. There will be minimal impact to the Clear Creek corridor to the south. 4. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service of internal traffic conflicts to the detriment of persons whether on or off the site. The proposed dishes will be a supplement to the existing AT &T Wireless Services/Cingular antennas already located on the building walls. The proposed facility is unmanned and should generate minimal additional trips to and from the site for maintenance. 5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. Adjacent properties are commercial in nature and will experience minimal impact from the proposed special use. The applicant is intending on screening the new microwave dishes similar to the screening around the existing roof-top mechanical equipment already in place. All related electrical equipment will be located inside the structure. 6. Will not overburden the capacities of the existing streets, utilities, parks, schools and other public facilities and services. All responding utility agencies are able to serve the property. There will be no impact to streets, utilities, parks or schools as a result of the installation. 7. History of compliance by the applicant with Code requirements and prior conditions, if any, regarding the subject property. A search of the City's code enforcement records has shown that there was one zoning code violation which occurred in 2000. The violation notice was for obstruction of the public sidewalk by mailboxes. The violation was abated in a timely manner. Case No. SUP-05-04/Fiber Tower 8. Ability of the applicant or any permitted-in-interest to continuously meet the conditions of the proposed permit. If conditions of an approved special use are violated, the permit can be revoked. If the permit is revoked, then the CMRS facilities must be removed. It is in the applicant's best interest to follow the terms and conditions of any approval received from the city. 9. Other factors relevant to the specific application. There are no other relevant factors. IV. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on March 8, 2005. There were no area property owners in attendance. V. AGENCY REFERRAL All affected service agencies were contacted regarding the ability to serve the property. Specific referral responses follow. Arvada Fire Protection District: No comments. Public Works Department: No comments. VI. STAFF RECOMMENDATION/FINDINGS OF FACT Staff recommends approval of Case No. SUP-05-04, a request for approval of a special use permit for property located at 4251 Kipling Street to allow rooftop CMRS facilities, with the following findings of fact: 1. This request for an administrative special use meets all applicable conditions as required by Section 26-114 of the City of Wheat Ridge Code of Laws. 2. Staff has not received written comments in opposition to this request from the adjacent property owners. 3. There will be no changes to the property itself therefore; there will be no detrimental effect on the health, safety and welfare of the area. 4. Since the antennas will be located on the roof and screened, there should be no resultant blight. 5. The site conditions are not changing, therefore, there should be no impact on light, air, or water to adjacent properties. 6. There should be no impact on traffic in the area as the sight will be unmanned with only occasional trips to the site for maintenance. 7. The proposed antennas will be compatible with the character of the area as they will be screened similar to the existing rooftop mechanical equipment. 8. All agencies can serve the property. 9. There has been a history of compliance of the property with the provisions of the Zoning and Development Code. Case No. SUP-05-04/Fiber Tower 4 3 Therefore, Case No. SUP-0 -0b hereby APPROVED with the following conditions: 1. The special use shall be a grant of use to run in perpetuity with the property and can be assigned to other carriers with approval of the City of Wheat Ridge Community Development Department. 2. The proposed antennas shall be located as shown on the roof and screened from view as represented in the case file.
