The request lies within the area annexed into the City of Wheat Ridge on February 28, 2005 and subject to an ODP application pending before the City of Wheat Ridge. It is located immediately west of a footbridge which carries the Clear Creek Trail across the stream. The location is noted on the attached drawing within Coors Parcel 3, as depicted on sheet 3 of 3 of the ODP application. The exemption will be to construct a temporary crossing of Clear Creek to assist in a gravel extraction operation. An area north of Clear Creek on the ODP, denoted as Coors Parcels 2A and 2B is subject to a State of Colorado Mined Land Reclamation Permit (number M-1989-127). This area was mined for sand and gravel by the Asphalt Paving Company from 1990 through 1998. Other aggregate from this area will be transported across Clear Creek to Coors Parcel 4, Retail Parcel 1 and Retail Parcel 2, as denoted in the ODP. It is anticipated this movement of material will commence in early April, 2005 and continue through August/September, 2005. The reclamation plan approved for Parcel 2A and 2B calls for backfill of the mined area to historic ground surface. The transport of construction material to complete this reclamation will also use temporary crossing. That material will be sourced from Coors Parcel 1 on the ODP (also subject to a State of Colorado Mined Land Reclamation Permit) and from other nearby Coors property as part of a water storage reservoir maintenance project. The movement of various construction materials to complete reclamation of parcels 2A and 2B will commence in late 2005 and be completed by June, 2006. The temporary crossing will be removed thereafter and the disturbed area reclaimed. 0SAFE Also enclosed in this application are: • Page 3 of 3 from the ODP, dated 1.11.05, • a Martin and Martin Consulting Engineers design drawing of the temporary crossing, • a letter from the US Army Corps of Engineers providing their consent to construct the crossing within the channel of Clear Creek, and • a $200 processing fee. Olivet South Pit (Mine Permit No. M-1989-127) and Clear Creek Corps File No. 199015027 Dear Mr. Vaught: Mr. Terry McKee of this office has reviewed this project located in the SE V< of Section 19, T3S, R69W, Jefferson County, Colorado. This review was in accordance with Section 404 of the Clean Water Act under which the U.S. Army Corps of Engineers regulates the discharge of dredged and fill material, and any excavation activities associated with a dredged and fill project, into waters of the United States. Waters of the United States include ephemeral, intermittent and perennial streams, their surface connected wetlands and adjacent wetlands and certain lakes, ponds, irrigation and drainage ditches that have a nexus to interstate commerce. Under the authority of the Clean Water Act, an a roved jurisdictional determination has determined that Clear Creek is waters of the U.S. Approved jurisdictional det rminatinn The Mt. Olivet Pit is still an active gravel pit. This pit is now going to be reclaimed as per the mined land reclamation Mine Permit No. M-1989-127. There were no jurisdictional wetlands where the gravel pit was constructed. This gravel pit is not waters of the U.S. and therefore non jurisdictional. No permit or other authorization by the DA is required for work in this gravel pit. These approved jurisdictional determinations and are valid for a period of five years from the date of this letter unless new information warrants revision of the determination. The attached Jurisdictional Determination form provides the basis jurisdiction for the Mt. Olivet South Pit and Clear Creek. If the applicant wishes to appeal these approved jurisdictional determinations, the attached Notification of Administrative Appeal Options form should be completed and sent to Mr. Mores Bergman at the address noted on the form. Although a DA permit will not be required for work in the Mt. Olivet South Pit, this does not eliminate the requirement that you obtain any other applicable Federal, state, tribal or local permits as required. Based on the information provided, this office has determined that the proposed temporary culverted road crossing of Clear Creek to be use for the reclamation of the Mt. Olivet South Pit within Colorado is authorized by the Department of the Army Nationwide Permit No. 14, found in the January 15, 2002, Federal Regicrrr, Issuance of Nationwide Permits; Notice (67 FR 2077). Enclosed is a fact sheet, which fully describes this Nationwide Permit and lists the General Conditions, Section 404 Only Conditions, and Colorado Regional Conditions, which must be adhered to for this authorization to remain valid. Permit No. 14 (Corps File No. 199015027) Special Conditions: In order for this nationwide permit verification to be valid, 0.0036 acres of wetlands will be mitigated as stated in your October 19, 2004 letter to this office. A mitigation monitoring report must be sent to this office prior to December 31of each year, after this work has been authorized, until the Corps of Engineers determines that, after the roadway has been removed, the 0.0036 acres of wetlands has been restored as proposed by your restoration plan Although an Individual Department of the Army permit will not be required for this project, this does not eliminate the requirement that any other applicable Federal, state, tribal or local permits be obtained as required. Please be advised that deviations from the original plans and specifications of this project could require additional authorization from this office. The applicant is responsible for all work accomplished in accordance with the terms and conditions of the nationwide permit. If a contractor or other authorized representative will be accomplishing the work authorized by the nationwide permit on behalf of the applicant, it is strongly recommended that they be provided a copy of this letter and the attached conditions so that they are aware of the limitations of the applicable nationwide permit. Any activity which fails to comply with all the terms and conditions of the nationwide permit will be considered unauthorized and subject to appropriate enforcement action. This verification will be valid until October 25, 2006. In compliance with General Condition 14, the attached "Certification of Completed Work" form (blue) must be signed and returned to this office upon completion of the authorized work and any required mitigation. Should anyone at any time become aware that either an endangered and/or threatened species or its critical habitat exists within the project area, this office must be notified immediately. At the time that the accepted BEC-II study was completed a temporary crossing existed in the same location as the proposed temporary crossing. Martin/Martin obtained the accepted model from Urban Drainage and has utilized the same location and cross sections for the hydraulic modeling of the proposed crossing. In the historic model no culverts were modeled to accept flow during the 100-year event and a blockage was modeled across the river at a constant elevation. Martin/Martin has modeled six reinforced concrete pipes to convey normal flows through the temporary crossing. These pipes in conjunction with an existing 84" corrugated metal pipe convey 1745 cubic feet per second (cfs) or approximately half of the 10-year event, as determined by FEMA. In the 100-year event the crossing will overtop and the culverts were assumed to pass half of their combined capacity. Therefore, the HEC-II model that Martin/Martin has developed uses the roadway profile for the bottom of the channel within the channel banks. In addition 875 efs was removed through the temporary crossing sections to reflect the culverts' conveyance. The results of the hydraulic modeling show that the proposed crossing shows negligible difference from the historic crossing. The results of this study have been attached for your use.
