The applicant is requesting approval of a Planned Building Group to bring into conformity two
existing dwelling units on one lot zoned Residential-Three and located at 5571 West 27`h
Avenue.
According to Section 26-30(C)(4)(a), of the Wheat Ridge Code of Laws, the zoning
administrator shall have the authority to review and approve applications for Planned Building
Groups of no more than 4 main structures on a single lot or parcel, except in the R-1 series, R-2
series, and A-1 zone districts.
Because this property is located in the R-3 zone district and the request is for two main
structures, the zoning administrator has the authority to approve the request.
Staff concludes that the above information supports approval of this request, with the condition
that a Planned Building Group mylar is submitted and signed for approval by November 19,
1999. r

This letter is provided in response to our discussions concerning the property located at 5571 W.
27'h Avenue. Our discussions centered on the second structure that was built on the property,
known as 5571 %2 W. 27`h Avenue. City records indicate this structure was originally intended to
be a garage, but at some point it was converted to a dwelling unit. Either because records were
lost or a permit was not requested, the City has little evidence a permit was obtained and the
required inspections were performed for this conversion.
Other required approvals were apparently not obtained. In order for two separate dwelling units
to be located on one lot, the following requirements must be met: 1) a Planned Building Group
plan must be approved, and 2) the lot must be a minimum of 9,000 square feet in size. The lot at
5571 W. 27th Avenue is 8,100 square feet. There was no Planned Building Group approved, nor
was a variance requested for the lot size deficiency.
The approval of a Planned Building Group plan is an administrative function, requiring the
preparation of a site plan. A variance to the lot size requirement can be requested and because
this variance is 10% or less, it can be reviewed administratively. This requires posting of the
property for 10 days. If the Department receives objections, the request must go to a public
hearing. If no objections are received, the variance can be approved administratively. As the
Zoning Administrator, I will support approval of both of these requests.
Approval of the Planned Building Group and variance will bring the property into compliance
with the City's zoning requirements. I encourage the prospective owners to complete these
processes so that similar questions about the property do not arise when or if they ever decide to
sell the property. These need to be approved prior to issuing building permits. Assuming all
procedures and requirements of the building codes are met, there should be no problem issuing
the permits for the remodeling. As I mentioned, for an inspection fee, our building inspectors
can perform an inspection of either unit and determine what, if any, deficiencies exist with
respect to the building codes.
