If any clause, sentence, paragraph, or part of this Zoning Code or the application thereof to any person or circumstances shall for any reason be adjusted by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 6. Supersession Clause. If any provision, requirement or standard established by this Ordinance is found to conflict with similar provisions, requirements or standards found elsewhere in the Code of Laws of the City of Wheat Ridge, which are in existence as of the date of adoption of this Ordinance, the provisions, requirements and standards herein shall supersede and prevail. Section 7. This ordinance shall take effect 15 days after final publication. I. REQUEST The applicant requests approval of a Special Use Permit to allow co-location of CMRS (commercial mobile radio service ) panels on an existing freestanding CMRS monopole. The existing monopole is located at 3900 Wadsworth Boulevard behind the Safeway/stip center in the Wheat Ridge Marketplace. Pursuant to Section 26-30(S) of the Wheat Ridge Code of Laws, freestanding CMRS facilities shall be allowed only by special use permit, including the co-location of additional antennas on an existing lattice tower or monopole. The existing facility was installed in 1995. The area where the monopole is located is in a rear loading area between the two buildings. There is an existing 6' high wooden fence running along the property line buffering this loading area from adjacent residential development to the east. The current legislation was adopted in 1966 as a response to the number of facilities being proposed by the cellular telephone industry. II. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on August 18, 1999. The following persons were in attendance: Matt Butler - applicant Meredith Reckert - city staff Since there were no members of the public or neighborhood attending, no issues were discussed. III. AGENCY REFERRALS Wheat Ridge Building Division will require all applicable codes of the Uniform Building and National Electric Codes to be met. The following agencies had no comments or concerns: Public Works Department Economic Development Division Wheat Ridge Fire District Public Service Company Wheat Ridge Sanitation District Wheat Ridge Water District .City Council Page 2 SUP-99-02/SBA IV. SPECIAL USE PERMIT CRITERIA Staff has the following comments regarding the criteria used to evaluate a special use permit: 1. Will meet a proven public need in that it will rill a void in necessary services, products or facilities especially appropriate at the location proposed, considering available alternatives. As the cellular telephone industry continues to expand so will the need for CMRS facilities. If the special use is approved allowing additional antennas to be hung on the existing monopole, it will eliminate the need for one more freestanding monopole. Staff feels the additional antenna will be less obtrusive than an additional tower. 2. Will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use. It has been proven by the industry that the operational characteristic of cellular facilities (low power and high frequency) do not pose a health risk to persons residing or working in the vicinity. 3. Will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics of the proposed use. As demonstrated in the photo simulations, the addition of the new antennas will have minimal visual impact and should not contribute toward blight in the area. 4. Will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution. Because the additional panel antennas are not obtrusive regarding mass, there will be little or no affect on the amount of light and air to adjacent properties and no negative affect due to air, water or noise pollution. There is some screening in place by way of the existing screening fence running along the Safeway Marketplace's eastern property line. 5. Is consistent with the Comprehensive Plan. The Comprehensive Plan designation is Community Commercial Service/Employment Center. The proposed special use is a typical ancillary use to this type of retail center and is, therefore, consistent with the Comprehensive Plan. 6. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. According to the applicant, there will be one service visit per month to the tower and cabinet. Therefore, staff concludes that the additional panel antennas will not contribute City Council Page 3 SUP-99-02/SBA toward traffic conflicts on the property or on the adjacent public streets. It should have no negative affect on loading for businesses in adjacent buildings. 7. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. It is impossible to totally screen this type of facility (the monopole) from adjacent properties. The additional panels create only slightly more visual impact than the existing tower and antennas. If City Council feels that more screening is appropriate, a new 6' high wooden fence could be erected around the lease area to screen the existing and proposed equipment cabinets. This was a condition of approval suggested by staff at the Planning Commission hearing. Planning Commission did not feel the additional fence was necessary. 8. Will not overburden the capacities of the existing streets, utilities, parks, schools and other public facilities and services. All appropriate utilities can serve the facility or have no problems with the additional antennas. There will be no affect on parks or schools V. PLANNING COMMISSION ACTION Planning Commission reviewed this request at a public hearing held on October 7, 1999. A recommendation of approval was given for the following reasons: 1. A special use permit is required to allow the co-location of CMRS panel antennas on an existing monopole., 2. The co-location could alleviate the need for an additional freestanding facility. 3. The evaluation criteria support approval of this request. With the following conditions: 1. That the service lights be directed away from areas to the east. 2. No additional height be added to the monopole. VI. STAFF CONCLUSIONS AND RECOMMENDATION Staff concludes that pursuant to current legislation, a special use permit is required to allow co- location of CMRS panel antennas on the existing monopole at 3900 Wadsworth Boulevard. Staff further concludes that the attachment to an existing facility could alleviate the necessity of another freestanding monopole. Since the criteria used to evaluate a special use permit supports this request, a recommendation of approval is given with the following conditions: City Council Page 4 SUP-99-02/SBA I . PUBLIC FORUM There was no one signed up to speak before the Commission on unscheduled matters. PUBLIC HEARING A. Case No. SUP-99-02: Application by SBA Communications Corp. for a Special Use Permit to place a commercial mobile radio antenna on an existing monopole located behind the Wheat Ridge Market Place shopping center located at 3900 Wadsworth Boulevard. This case was presented by Meredith Reckert. She reviewed the staff report and presented overheads and slides of the subject property. All pertinent documents were entered into the record and Ms. Reckert advised that there was jurisdiction to hear the case. Staff recommended approval of the application with one condition as outlined in the staff report. In response to questions from the Commission, Ms. Reckert informed that the existing monopole could be no higher than 50'. She informed that staff was requesting a condition of approval for a 6' fence to be placed around the cabinets with an access gate. The applicant would have to submit evidence that the existing monopole would be structurally sound prior to issuance of a building permit. There was much discussion regarding whether or not the antennas would interfere with the power or electrical supply to the surrounding neighborhood and business, as well as the brightness and impact to the surrounding neighborhood of the service light. Matt Butler, SBA, Applicant 1720 So. Bellaire STE 202 Discussed their proposal to add a 2'6" Sprint antenna to an existing US West monopole. He informed that the antenna would be just above the roof line in order to clear the existing building. They sought to minimize the bulk and height of the antenna and they are Arillifg to put up the fence. Bollards are placed around the equipment cabinets to make sure the trucks don't hit the fence and equipment. This an attempt of Sprint to improve the coverage in the area. In response to the Commission's questions, Mr. Butler informed that the antenna should not interrupt power or service to the surrounding neighborhood. In addition, he informed that the service light would be just bright enough to illuminate the area. He stated that he would have the current plan amended to specify that the service light reflect on the cabinet and not outside the fence area. Planning Commission Page 2 October 7. 1999 Commissioner MacDOUGALL asked whether or not there was a clearance light at the top of the pole. Mr. Butler informed that no, clearance lights are mandated by FAA at a specific height within flight patterns. Commissioner DOYLE inquired about fire equipment being placed within the fenced area. Mr Butler responded no since everything is metal and there would be no chance of fire. Ron Davis, Owner 7975 W. 39" Avenue Spoke in favor of the request for an additional antenna, but noted his concerns with the fence being requested by staff. He informed that the shopping center currently has a situation with homeless and juveniles and felt that a fence could hide them and would also encourage vandalism. Mr. Davis noted that a fire hydrant did exist within 30 feet of the monopole. The Commission reviewed the slide showing the visibility of the pole from the west. Commissioner THOMPSON inquired if there was another means of visually softening the effects of the monopole while maintaining security and discouraging the youth and homeless. Ms. Reckert responded that additional landscaping could be required, but that it would cause maintenance and irrigation problems. She informed that the residents on the east side of the monopole currently cannot see the equipment cabinet area, and would not be able to see the requested fence. Robert Makatura 4100 Wadsworth Spoke in opposition to the application. He informed the Commission that he owns the adjacent office building to the north and expressed his concern with the monopole's possible negative impact on the surrounding property values. He stated his concerns with the cell tower and its appearance, and noted that he is questioning whether or not he should build the second office building he had received approval for. He agreed that there are considerable problems with the homeless. Commissioner SNOW asked what offense would increase to Mr. Makatura if the Commission approved the second antenna. Mr. Makatura responded that it would add to the negative views from his existing and proposed office buildings. Commissioner THOMPSON discussed the impacts and benefits of adding an antenna to the existing monopole versus adding a new monopole for the Sprint antenna. She inquired as to whether or not the City could deny a request for a new pole and whether or not Sprint would need to locate a tower in this location if this request was denied. Ms. Reckert said that the City cannot legally deny an application unless the request does not meet criteria established within the Code of Laws. Commissioner THOMPSON noted that the visual impact of an additional antenna would be considerably less than the addition of new monopole. Planning Commission Page 3 October 7, 1999 Mr. Butler responded to questions from the Commission and informed that SBA had already researched other locations for a monopole and spoke with five other property owners. He informed that four decided they did not want antennas on their property or buildings and that Sprint would more than likely request a new monopole across the street. He also informed that the additional antenna would not add to the height of the existing monopole. It was moved by Commissioner THOMPSON, seconded by Commissioner SNOW that Case No. SUP-99-02, a request for approval of a Special Use Permit to allow co-location of CMRS antennas on an existing monopole located at 3900 Wadsworth Blvd., be recommended to the City Council for APPROVAL for the following reasons: 1. A special use permit is required to allow the co-location of CMRS panel antennas on an existing monopole. 2. The co-location could alleviate the need for an additional freestanding facility. 3. The evaluation criteria support approval of this request. With the following conditions: 1. That the service lights be directed away from areas to the east. 2. No additional height be added to the monopole. The motion unanimously carried by a vote of 5-0 with Commissioner COLLINS and Vice Chair GOKEY absent. Commissioner THOMPSON noted that she was purposely not including the need for a 6' fence as originally recommended by staff in her motion. B. Case No. ZOA-99-02: The City of Wheat Ridge is proposing to amend Section 26-30 (N): Access to Public Streets: of the Wheat Ridge Code of Laws regarding vehicle access to a new structure or lot. Planning and Development Director Alan White presented the staff report. All pertinent documents were entered into the record and Mr. White advised that there was jurisdiction to hear the case. Commissioner SNOW noted that the recommended changes to Section 26-30(N): Access to Public Streets were being offered to clarify existing interpretation. It was moved by Commissioner SNOW and seconded by Commissioner DOYLE to recommend to the City Council approval of Case No. ZOA-99-02. PUBLIC FORUM There was no one signed up to speak before the Commission on unscheduled matters. 7. PUBLIC HEARING A. Case No. SUP-99-02: Application by SBA Communications Corp. for a Special Use Permit to place a commercial mobile radio antenna on an existing monopole located behind the Wheat Ridge Market Place shopping center located at 3900 Wadsworth Boulevard. This case was presented by Meredith Reckert. She reviewed the staff report and presented overheads and slides of the subject property. All pertinent documents were entered into the record and Ms. Reckert advised that there was jurisdiction to hear the case. Staff recommended approval of the application with one condition as outlined in the staff report. In response to questions from the Commission, Ms. Reckert informed that the existing monopole could be no higher than 50'. She informed that staff was requesting a condition of approval for a 6' fence to be placed around the cabinets with an access gate. The applicant would have to submit evidence that the existing monopole would be structurally sound prior to issuance of a building permit. There was much discussion regarding whether or not the antennas would interfere with the power or electrical supply to the surrounding neighborhood and business, as well as the brightness and impact to the surrounding neighborhood of the service light. Matt Butler, SBA, Applicant 1720 So. Bellaire STE 202 Discussed their proposal to add a 2'6" Sprint antenna to an existing US West monopole. He informed that the antenna would be just above the roof line in order to clear the existing building. They sought to minimize the bulk and height of the antenna and they are willing to put up the fence. Bollards are placed around the equipment cabinets to make sure the trucks don't hit the fence and equipment. This an attempt of Sprint to improve the coverage in the area. In response to the Commission's questions, Mr. Butler informed that the antenna should not interrupt power or service to the surrounding neighborhood. In addition, he informed that the service light would be just bright enough to illuminate the area. He stated that he would have the current plan amended to specify that the service light reflect on the cabinet and not outside the fence area. Planning Commission Page 2 October 7, 1999 Commissioner MacDOUGALL asked whether or not there was a clearance light at the top of the pole. Mr. Butler informed that no, clearance lights are mandated by FAA at a specific height within flight patterns. Commissioner DOYLE inquired about fire equipment being placed within the fenced area. Mr. Butler responded no since everything is metal and there would be no chance of fire. Ron Davis, Owner 7975 W. 39" Avenue Spoke in favor of the request for an additional antenna, but noted his concerns with the fence being requested by staff. He informed that the shopping center currently has a situation with homeless and juveniles and felt that a fence could hide them and would also encourage vandalism. Mr. Davis noted that a fire hydrant did exist within 30 feet of the monopole. The Commission reviewed the slide showing the visibility of the pole from the west. Commissioner THOMPSON inquired if there was another means of visually softening the effects of the monopole while maintaining security and discouraging the youth and homeless. Ms. Reckert responded that additional landscaping could be required, but that it would cause maintenance and irrigation problems. She informed that the residents on the east side of the monopole currently cannot see the equipment cabinet area, and would not be able to see the requested fence. Robert Makatura 4100 Wadsworth Spoke in opposition to the application. He informed the Commission that he owns the adjacent office building to the north and expressed his concern with the monopole's possible negative impact on the surrounding property values. He stated his concerns with the cell tower and its appearance, and noted that he is questioning whether or not he should build the second office building he had received approval for. He agreed that there are considerable problems with the homeless. Commissioner SNOW asked what offense would increase to Mr. Makatura if the Commission approved the second antenna. Mr. Makatura responded that it would add to the negative views from his existing and proposed office buildings. Commissioner THOMPSON discussed the impacts and benefits of adding an antenna to the existing monopole versus adding a new monopole for the Sprint antenna. She inquired as to whether or not the City could deny a request for a new pole and whether or not Sprint would need to locate a tower in this location if this request was denied. Ms. Reckert said that the City cannot legally deny an application unless the request does not meet criteria established within the Code of Laws. Commissioner THOMPSON noted that the visual impact of an additional antenna would be considerably less than the addition of new monopole. Planning Commission Page 3 October 7, 1999 Mr. Butler responded to questions from the Commission and informed that SBA had already researched other locations for a monopole and spoke with five other property owners. He informed that four decided they did not want antennas on their property or buildings and that Sprint would more than likely request a new monopole across the street. He also informed that the additional antenna would not add to the height of the existing monopole. It was moved by Commissioner THOMPSON, seconded by Commissioner SNOW that Case No. SUP-99-02, a request for approval of a Special Use Permit to allow co-location of CMRS antennas on an existing monopole located at 3900 Wadsworth Blvd., be recommended to the City Council for APPROVAL for the following reasons: 1. A special use permit is required to allow the co-location of CMRS panel antennas on an existing monopole. 2. The co-location could alleviate the need for an additional freestanding facility. 3. The evaluation criteria support approval of this request. With the following conditions: 1. That the service lights be directed away from areas to the east. 2. No additional height be added to the monopole. The motion unanimously carried by a vote of 5-0 with Commissioner COLLINS and Vice Chair GOKEY absent. Commissioner THOMPSON noted that she was purposely not including the need for a 6' fence as originally recommended by staff in her motion. B. Case No. ZOA-99-02: The City of Wheat Ridge is proposing to amend Section 26-30 (N): Access to Public Streets: of the Wheat Ridge Code of Laws regarding vehicle access to a new structure or lot. Planning and Development Director Alan White presented the staff report. All pertinent documents were entered into the record and Mr. White advised that there was jurisdiction to hear the case. Commissioner SNOW noted that the recommended changes to Section 26-30(N): Access to Public Streets were being offered to clarify existing interpretation. It was moved by Commissioner SNOW and seconded by Commissioner DOYLE to recommend to the City Council approval of Case No. ZOA-99-02. ATTACHMENT 1- I. REQUEST The applicant requests approval of a Special Use Permit to allow co-location of CMRS (commercial mobile radio service) panels on an existing freestanding CMRS monopole. The existing monopole is located at 3900 Wadsworth Boulevard behind the Safeway/strip center in the Wheat Ridge Marketplace. Pursuant to Section 26-30(S) of the Wheat Ridge Code of Laws, freestanding CMRS facilities shall be allowed only by special use permit, including the co-location of additional antennas on an existing lattice tower or monopole. The existing facility was installed in 1995. The area where the monopole is located is in a rear loading area between the two buildings. There is an existing 6' high wooden fence running along the property line buffering this loading area from adjacent residential development to the east. The current legislation was adopted in 1996 as a response to the number of facilities being proposed by the cellular telephone industry. II. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on August 18, 1999. The following persons were in attendance: Matt Butler - applicant Meredith Reckert - city staff Since there were no members of the public or neighborhood attending, no issues were discussed. III. AGENCY REFERRALS Wheat Ridge Building Division will require all applicable codes of the Uniform Building and National Electric Codes to be met. Public Works had no comments. Wheat Ridge Economic Development had no concerns. Wheat Ridge fire District had no comments. Public Service Company had no problems. Wheat Ridge Sanitation District had no problems. Wheat Ridge Water District had no problems. SUP-99-02/SBA Planning Commission Page 2 -0-1- IV SPECIAL USE PERMIT CRITERIA Staff has the following comments regarding the criteria used to evaluate a special use permit: 1. Will meet a proven public need in that it will fill a void in necessary services, products or facilities especially appropriate at the location proposed, considering available alternatives. As the cellular telephone industry continues to expand so will the need for CMRS facilities. If the special use is approved allowing additional antennas to be hung on the existing monopole, it will eliminate the need for one more freestanding monopole. Staff feels the additional antennas will be less obtrusive than an additional tower. 2. Will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use. It has been proven by the industry that the operational characteristics of cellular facilities (low power and high frequency) do not pose a health risk to persons residing or working in the vicinity. 3. Will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics of the proposed use. As demonstrated in the photo simulation, the addition of the new antennas will have minimal visual impact and should not contribute toward blight in the area. 4. Will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution. Because the additional panel antennas are not obtrusive regarding mass, there will be little or no affect on the amount of light and air to adjacent properties and no negative affect due to air, water, or noise pollution. There is some screening in place by way of the existing screening fence running along the Safeway property line. Staff would recommend that an additional 6' high wooden fence be built around the lease area to encompass the ancillary mechanical equipment cabinets of both US West and Sprint. 5. Is consistent with the Comprehensive Plan. The existing Comprehensive Plan designates this area as a commercial activity center. The proposed Comprehensive Plan designation is Community Commercial Service/Employment Center. The proposed special use is a typical ancillary use to this type of retail center and is, therefore, consistent with the Comprehensive Plan. 6. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. SUP-99-02/SBA Planning Commission Page 3 1~-3 According to the applicant, there will be one service visit per month to the tower and cabinet. Therefore, staff concludes that the additional panel antennas will not have a negative affect on traffic conflicts on the property or on the adjacent public streets. It should have no negative affect on loading for businesses in adjacent buildings. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. It is impossible to totally screen this type of facility (the monopole) from adjacent properties. The additional panels create only slightly more visual impact than the existing tower and antennas. A new 6' high wooden fence around the lease area will screen the existing and proposed equipment cabinets. 8. Will not overburden the capacities of the existing streets, utilities, parks, schools and other public facilities and services. All appropriate utilities can serve the facility or have no problem with the additional antennas. There will be no affect on parks or schools. V. STAFF CONCLUSIONS AND RECOMMENDATION Staff concludes that pursuant to current.legislation, a special use permit is required to allow co-location of CMRS panel antennas on the existing monopole at 3900 Wadsworth Blvd. Staff further concludes that the attachment to an existing facility could alleviate the necessity of another freestanding monopole. Since the criteria used to evaluate a special use permit supports this request, a recommendation of Approval is given for Case No. SUP-99-02 with the following condition: A six foot high wooden screening fence with gate be built around the lease area to encompass both equipment cabinets. VI. RECOMMENDED MOTIONS Option A: "I move that Case No. SUP-99-02, a request for approval of a Special Use Permit to allow collocation of CMRS antennas on an existing monopole located at 3900 Wadsworth Blvd., be recommended to the City Council for APPROVAL for the following reasons: 1. Name Address Co 80401 SBA4D] Neighborhood Announcement At the request of the City of Wheat Ridge, SBA Communications on behalf of Sprint PCS is notifying those residents who live in a 600-foot radius of the Wheat Ridge Marketplace of Sprint's plans to install cellular antennas on the existing U.S. West cellular tower behind the retail center. The antennas are to be installed below the existing antennas at a height of 25 feet on the existing tower. Attached is a photosimulation for your reference. Sprint's equipment will be collocated on the tower so as to avoid the need to construct an additional tower within the City of Wheat Ridge. By collocating Sprint will not need to increase the height or bulk of the tower as it stands today and have thus met the aesthetic concerns of the City of Wheat Ridge. The addition of the Sprint antennas are designed to improve the coverage and capacity of cellular consumers in the area now and into the future.
