Approval of this request will enable the applicant to start operation prior to a TUP approval hearing by the Board of Adjustment on April 22, 1999. Pursuant to Section 26-6 (D)(3)(a) of the Wheat Ridge Code of Laws, the Zoning Administrator is empowered to decide upon application for a one-month temporary use permit since the following conditions apply: 1. The duration of the building, use or sign shall not exceed one (1) month. 2. No other temporary permit has been issued within the previous one (1) year for the same or similar building, use or sign on the same premises. 3. That the Zoning Administrator finds that the "findings of fact," as set forth in subsection (3)(b), are substantially complied with. 4. The zoning administrator has notified adjacent property owners in a form and manner as required for minor variances and waivers as set forth in subsection (.D)(2)(a), and has received no objections. 5. The owner or owner's agent approves in writing of the proposed temporary building, use or sign. Ms. Aiello's request for a 30-day temporary use permit to operate a plant bedding and produce stand meets all applicable conditions as required by Section 26-6(D)(3)(a) of the City of Wheat Ridge Code of Laws. Staff has received no comments regarding this request. Therefore, staff recommends approval of Case No. TUP-99-02. Dear Ms. Aiello, This letter is intended to inform you that your request for an administrative Temporary Use Permit to allow for the temporary sales of bedding plants and produce for a maximum of one month, has been approved. Pursuant to the administrative approval regulations, you are permitted to operate your produce stand for a maximum of one month, while you are pursuing approval of a one year Temporary Use Permit. Approval of this request will allow for the operation of the produce sales until May 5, 1999. You are scheduled for a public hearing in front of the Board of Adjustment on April 22, 1999 to allow for a one year temporary use permit. If you are denied that request, you will be required to remove the produce stand by May 5, 1999. Unfortunately, you are only permitted one administrative temporary use permit per year. The applicant is requesting an administrative review which allows no more than a 30-day temporary use permit to be granted by the Zoning Administrator without need for a public hearing. My intention is to operate a bedding plant and farm fresh produce market. We will also offer soil, plant food, planters and related items. There will be no permanent structures installed. As the attached drawing illustrates I will install a temporary tent, fence and racks for plants. A temporary refrigerated van will be on site. The unit will be insulated and only operate from 8:00 A.M. to 7:00 P.M and will face 44`h Ave. The grounds will be mowed and kept clear of trash. A survey of the adjacent neighbors revealed no opposition to the bedding plant/produce stand. I still want the previous application that I have made to stand. This will just allow us to get everything ready in anticipation of the board of adjustment hearing on April 22, 1999.
