Board Member THIESSEN stated that she was considering voting for denial of the request
because she was reluctant to grant a variance over neighborhood opposition. She stated,
however, that she felt this was a good alternative to other types of business that could possibly
go into that location.
It was moved by Board Member ECHELMEYER and seconded by Board Member WALKER
that Case No. WA-99-01, a request for approval of a 16' 3" front yard setback variance to the
50' front yard setback requirement to allow for the construction of a fuel station canopy for a
property zoned Commercial-One and Residential-Three and located at 5600 West 38th
Avenue, be denied for the following reason:
1. The request is based on a self-imposed hardship. There are many other design
alternatives that would allow for full compliance of all setbacks. It has been our basic
practice that variances are needed for the use and overriding of a severe hardship to the
property owner. This isn't the case on a piece of ground this size that has never been
worked upon for this particular project.
Board Member ABBOTT stated that, although it troubled him considerably, he would vote for
the motion for the same reasons stated by Board Member THIESSEN.
The motion for denial passed by a vote of 6-1 with Board Member HOWARD voting no.
C. Case No. WA-99-02: An application by Best Marine Service for approval to allow a 6' chain
link fence on the west portion of the front yard property line approximately 130' to provide
security and employee protection on the north side of the building. Said property is zoned
Industrial and located at 12098 West 50th Place.
This case was presented by Sean McCartney. He reviewed the staff report and presented
slides and overhead projections of the subject property. He entered all pertinent documents
into the record and advised that there was jurisdiction for the Board to hear the case. In
addition to information contained in the staff report, he requested that a condition be placed
on approval of the application that no storage would be allowed in the front of the property.

Mr. Horonto was sworn in by Chair MAURO. He stated the purpose of the proposed fence is
to allow protection from traffic for employees who are working outside of the building as well
as to provide additional security to the building. In response to a question from Board
Member ECHELMEYER, Mr. Horonto stated that the proposed fence would be in alignment
with existing fences on adjacent properties.

Following brief discussion regarding the location and purpose of the fence, and upon a motion
by Board Member ABBOTT and second by Board Member ECHELMEYER, the following
resolution was stated:

JURISDICTION:
The property is within the City of Wheat Ridge, and all notification and posting requirements have been
met, therefore, there is jurisdiction to hear this case.

I. REQUEST
The applicant is requesting approval of a 2' fence height variance to the 4' maximum fence height
requirement to allow the construction of a 6' chain link fence along the front property line. If approved,
the proposed 6' fence would be used for extra security and employee protection. The proposed front
enclosure is not intended for storage.
The applicants have expressed interest in constructing two service bays on the north side of the building.
The intent will be to bring the boats to the north side of the building and bring them into the service bays
to be repaired. While the boats are awaiting repair, they will be kept in this "staging" area. It should be
stressed that this area may not be used for storage of any sort.
Pursuant to Section 26-30(I)(1), no fence or divisional wall above the height of 48 inches shall be
located within the designated front yard setback. The applicant stated that the enclosed area would be
used for extra security purposes and that no storage would be placed within the front area. The Wheat
Ridge Code of Laws prohibits the storing materials within the designated front yard setback. Any
material stored outside must be located within the front or side yard areas, screened from view by a 6'
opaque fence.
To date, staff has not received any opposition regarding the above request.
II SITE PLAN
The property in question is located in the industrial section of Wheat Ridge. It is located directly south
of Jolly Ranchers and has other storage facilities as adjacent neighbors. The property measures 325'
wide by roughly 278' deep (on the east property line) and 372' deep on the west property line. The
reason for the request is not based on the irregular shape of the property.
West 50th Place is located directly north and is not a through street, as it comes to an end on the eastern
property line of the property in question.
III VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district in
which it is located?
Yes. If the request is denied, the property may continue to be used as a boat repair shop.
However, the owners are intending on reconfiguring the property to allow for two service bays to
be located on the north side of the building (where the proposed fenced area will be located), and
they will be using the fenced area as a staging yard for the soon-to-be repaired boats.
2. Is the plight of the owner due to unique circumstances?
No. The plight of the owner is due to the proposed intent for the use of the property. According
to the attached improvement location certificate, there is plenty of development alternatives
remaining on the property. However, the applicants are seeking the most cost effective solution
to re-using the existing structure and therefore require the need for further fenced protection.
3. If the variation were granted, would it alter the essential character of the locality?
No. As previously stated, this property is located in the designated Industrial area of Wheat
Ridge, where uses vary from light manufacturing to candy production to specifically outside
storage. Also, most of the properties in the immediate vicinity currently have 6' chain link fences
that are located in the front yard setback. Staff is uncertain whether any of the fences have been
in place prior to the establishment of the current fence height regulation.
4. Would the particular physical surrounding, shape or topographical condition of the
specific property involved result in a particular hardship (upon the owner) as distinguished
from a mere inconvenience if the strict letter of the regulations were carried out?
No. The property is square in shape and relatively flat in topography. Therefore, the physical
shape or topography of the property does not result in a particular hardship.
5. Would the conditions upon which the petition for a variation is based be applicable,
generally, to the other property within the same zoning classification?
Yes. All applications are reviewed on a case-by-case basis thereby changing the outcome for
each request.
6. Is the purpose of the variation based exclusively upon a desire to make money out of the
property
No. The purpose of the variation is to allow for additional security and employee protection.
Has the alleged difficulty or hardship been created by any person presently having an
interest in the property?
Yes. The applicant, who has sole interest of the property, has created a self-imposed hardship. It
is possible that there are other development alternatives that would allow for the staging area to
be located somewhere other than the front of the building.
8. Would the granting of the variations be detrimental to the public welfare or injurious to
other property or improvements in the neighborhood in which the property is located?
No. Because the proposed fence will be chain link, passing motorists should have more than
adequate visibility through the fence. Staff will ensure that the proposed fence will not be
located within the required 15'X 15' sight-distance-triangle which is required for all commercial

driveways.
9. Would the proposed variation impair the adequate supply of light and air to adjacent
property or substantially increase the congestion in the public streets or increase the
danger of fire or endanger the public safety or substantially diminish or impair property
values within the neighborhood.
No. Because the request is to allow for a 6' chain link fence and the fence will be primarily
located in the designated front yard, approval of this variance should not impair the adequate
supply of light and air nor increase the danger of fire on the adjacent properties. Also, because
West 50`° Place is not a through street and the proposed fence will be open to view, approval of
this request should not increase the congestion in the public streets.
10. If it is found in criteria 8 and 9 above that granting of the variation would not be
detrimental or injurious to other property or improvements in the neighborhood, and it is
also found that public health and safety, public facilities and surrounding property values
would not be diminished or impaired, then would the granting of the variance result in a
benefit or contribution to the neighborhood or the community as distinguished from an
individual benefit on the part of the applicant, or would granting of the variance result in a
reasonable accommodation of a person with disabilities?
No. Approval of this request will not directly benefit or contribute to the neighborhood or
community. This request is purely for individual benefit.
VI. STAFF CONCLUSIONS AND RECOMMENDATION
Staff concludes that the above request is based purely on convenience and not on an individual hardship.
However, it was also found that the immediate vicinity is primarily industrial in land use which currently
provides for 6' chain link fences in the front yard of the adjoining properties. Because the other
properties have had the fences for quite a number of years, and there have not been any complaints
received regarding the fences, staff concludes that the addition of another 6' chain link fence within this
established industrial district should not have a negative impact on the vicinity nor on the public's
welfare.
VII. RECOMMENDED MOTIONS
Option A: "I move that Case No. WA-99-02, a request for approval of a 2' fence height variance to the 4'
maximum fence height requirement for a property zoned Light Industrial and located at 12098 West 50,'
Place, be APPROVED for the following reasons:
1. Approval of this request should not be detrimental to the public's welfare.

BOARD OF ADJUSTMENT on January 28, 1999, at 7:30 p.m. at 7500 West 29th Avenue,
