Case No. WA-99-03, an application by Thomas Yang, which is a request for a one foot front yard
setback variance from the 30 foot front yard setback requirement at 4088 Oak Street.
Pursuant to Section 26-6 (D)(2)(a) of the Wheat Ridge Code of Laws, the Zoning Administrator
is empowered to decide upon application for a waiver from the front yard setback requirement
since the following conditions apply:
1. The variance does not exceed ten (10) percent of the minimum or maximum standard.
2. That the Zoning Administrator finds that the "findings of fact," as set forth in subsection
(2)(c), are substantially complied with and support the request.
3. The Zoning Administrator has not received objections to the project after noticing and
posting of the site for ten days.
4. No additional dwelling units would result from this approval.
Thomas Yang's request for a 1 foot front yard setback variance from the front yard setback
requirement meets all applicable conditions as required by Section 26-6(D)(2)(a) of the City of
Wheat Ridge Code of Laws. Staff has received no comments regarding this request.
Therefore, staff recommends approval of Case No. WA-99-03.

setback administrative variance from the 30 foot front yard setback requirement for
the development of a new home at the property located at 4088 Oak Street has been
received by the Department of Planning and Development.
The applicant is requesting an administrative variance review which allows no
more than a ten percent (10%) variance to be granted by the Zoning Administrator
without need for a public hearing. Prior to the rendering of a decision, all adjacent
property owners are required to be notified of the request by certified mail.
