Pursuant to Section 26-6 (D)(2)(a) of the Wheat Ridge Code of Laws, the Zoning Administrator is empowered to decide upon application for a waiver from the lot coverage since the following conditions apply: 1. The variance does not exceed ten (10) percent of the minimum or maximum standard. 2. That the Zoning Administrator finds that the "findings of fact," as set forth in subsection (2)(c), are substantially complied with and support the request. 3. The Zoning Administrator has not received objections to the project after noticing and posting of the site for ten days. 4. No additional dwelling units would result from this approval. Marquis Builders' request for a ten percent variance from the lot coverage meets all applicable conditions as required by Section 26-6(D)(2)(a) of the City of Wheat Ridge Code of Laws. Staff has received no comments regarding this request. Therefore, staff recommends approval of Case No. WA-99-07.
