Case No. WA-99-07, an application by Steve and Marilyn Fisher, which is a request for an
increase in lot coverage from 25% to 27.5% for the construction of a new home at 3850 Union
Court.
Pursuant to Section 26-6 (D)(2)(a) of the Wheat Ridge Code of Laws, the Zoning Administrator
is empowered to decide upon application for a waiver from the lot coverage since the following
conditions apply:
1. The variance does not exceed ten (10) percent of the minimum or maximum standard.
2. That the Zoning Administrator finds that the "findings of fact," as set forth in subsection
(2)(c), are substantially complied with and support the request.
3. The Zoning Administrator has not received objections to the project after noticing and
posting of the site for ten days.
4. No additional dwelling units would result from this approval.
Marquis Builders' request for a ten percent variance from the lot coverage meets all applicable
conditions as required by Section 26-6(D)(2)(a) of the City of Wheat Ridge Code of Laws. Staff
has received no comments regarding this request.
Therefore, staff recommends approval of Case No. WA-99-07.

This is to inform you that Case No. WA-99-07 a request for an administrative
variance to increase the lot coverage requirement from 25% to 27.2% for the
development of a new home at the property located at 3850 Union Court has been
received by the Department of Planning and Development.
The applicant is requesting an administrative variance review which allows no
more than a ten percent (10%) variance to be granted by the Zoning Administrator
without need for a public hearing. Prior to the rendering of a decision, all adjacent
property owners are required to be notified of the request by certified mail.
If you have any questions, or would like to submit comments concerning this
request, please contact the Planning Division at 235-2846 by 5:00 p.m. March 4,
1999.

Dear Mr. White:
At this time, we are requesting an administrative variance to the lot coverage requirement
for Lot 9, Prospect Ridge Subdivision. Lots 3 and 5 within the subdivision have
previously been granted administrative variances similar to what we are requesting. Due
to the architectural layout of our proposed home, we are requesting that the lot coverage
requirement restriction be changed to allow 27.2% coverage of the building footprint on
the lot.
