Dear Sirs or Madame, This letter is to inform you that your request for an administrative variance for a property legally described as Lot 15 of Maple Grove Subdivision, has been DENIED. The reasons for denial of this request is based on a requirement established in Section 26-6(2)(a)(3) of the Wheat Ridge Code of Laws, which states that the zoning administrator may approve an administrative variance approval only if there aren't any protests received. The Planning and Development department did receive numerous letters and phone calls of opposition for this request. At this point, there are two options that you may consider. You may apply to the Board of Adjustment for approval of the same request. This option would require a public hearing before the Board of Adjustment and would involve the same notification process and the ability of the protestors to voice their opinions at the public hearing. Prior to placement onto a public hearing docket, a valid land use case application would nee to be completed, in it's entirety, as well as the $135 processing fee. Another option would be to completely remove the existing patio which is located on the west side of the residential structure, and build on Lot 15 through the approval of a building permit. You may recall that the main reason for this variance request is based on the fact that the existing patio extends over the western property line. If the patio is removed, Lot 15 would remain in compliance with both the lot width and lot area requirement established in the Residential-Two zone district and could legally be built upon. DATE: April 12, 1999 It has come to my attention that Case No. WA-99-11, a request for a 3' lot width variance to the 75' lot width requirement and a 720 square foot lot area variance to the 9,000 square foot lot area requirement to allow for the construction of a new house on a vacant lot has met the required 10 days of notification. However, I must note that this request has received numerous letters of opposition and therefore, pursuant to Section 26-6(2)(a)(3) of the Wheat Ridge Code of Laws, this request must be either denied or forwarded to the Board of Adjustment for public hearing. This property is located on the northwest corner of West 29t" Avenue and Ward Court, and is comprised of lots 15 and 16 of the Maple Grove Village Subdivision. Currently, there is a single-family residence located on Lot 16 which gains access off of Ward Court. Most of the existing structure is located entirely on Lot 16, with the exception of a patio on the west side of the structure which extends past the west property boundary. Because of this, the applicant must either remove the patio of adjust the property lines to allow for construction on Lot 15. Based on the numerous phone calls and letters of complaint for this administrative request, staff recommends DENIAL for Case No. WA-99-11. We have owned our property located at 2960 Wright Street for over thirty nine (39) years. Our opposition to the above mentioned case number are as followed: 1. New construction would limit our view. 2. It would not fit in with the footprint of our neighborhood. This neighborhood prides it self on good sized building sites. 3. The site at 2915 Ward Court has been deeded the way it now sits, since the original plat map of this particular subdivision. The year of occupancy was 1960. We can see NO GOOD REASON to change a variance of minimum lot for anyone at this point in time. We are registering our opposition to this case. The specific nature of the request for the variance is to reduce the minimum lot width by three feet (from 75 feet to 72 feet) and a further variance in the minimum lot area square footage by 805 sq ft (9085 sq ft - 805 sq ft= 8280) on the above described property but retaining this lot as a buildable lot. A review of your records and the plat of this subdivision will disclose that Lot 15 is a separate build- able lot which has never been developed. Lot 16 has been developed but the rear of the single family resi- dence located thereon is five (5)feet from the common lot line between the two. The proposed variance would bring the rear set back of lot 16 to twelve(12) feet which we understand from your current restric- tions will bring Lot 16 into compliance with the R-2 minimum rear set back restrictions. Such a variance would also eliminate the encroachment now existing whereby the concrete patio at the rear of the Lot 16 residence encroaches onto Lot 15 by seven (7) feet.
