Dear Mr. Hogue:
The Zoning Administrator has DENIED your request for a 50' variance from the 12,500'
minimum lot size requirement for the property located at 6995 W. 33`d Avenue for the purpose of
meeting the lot size requirements for a duplex.
Denial of your application was based a number of calls in opposition from the surrounding
property owners within the immediate area and on the fact that approval of this request would
create one additional dwelling unit.

Case No. WA-99-12, an application by Clinton Hogue requesting a 50' variance from the 12,500
minimum lot size requirement for the purpose of converting the existing single family home into
a duplex. The property is located at 6995 W. 33`d Avenue and zoned R-2.
Pursuant to Section 26-6 (D)(2)(a) of the Wheat Ridge Code of Laws, the Zoning Administrator
is not empowered to decide upon application for a waiver from the front yard setback
requirement since the following conditions apply:
1. The Zoning Administrator has received a number of objections to the project after
noticing and posting of the site for ten days.
2. One additional dwelling unit would result from this approval.
This request is for a 50 foot variance from the 12,500 foot minimum lot size requirement and
does not meet all applicable conditions as required by Section 26-6(D)(2)(a) of the City of Wheat
Ridge Code of Laws. Staff did receive six comments in opposition to this request from the
surrounding neighbors.
Therefore, staff recommends DENIAL of Case No. WA-99-12.

To Whom It May Concern;
We were very surprised today when our neighbor from across the street came to show us
a letter he had received last week by certified mail concerning request for a variance to
convert a single family residence into a duplex. Since this property located at 6995 West
33rd Avenue is only separated from our property by a driveway, (our property is on the
corner of 33rd Ave. and Reed St.) why did we not receive once of these notices, also?
This neighborhood has always been a nice place to five, with home-owners taking a lot of
care of their homes and living for many years in this area. It is a good solid neighborhood
and we are very interested in keeping it that way. We feel that converting the property
mentioned above into a duplex, and thus probably creating rentals, our property values
would go down and our neighborhood would not maintain the same desirable level that
has been true in the past.
We certainly would not be in favor of such action to allow this to happen, and would like
to trust our civic leaders to not let this happen.

This is to inform you that Case No. WA-99-12 a request for an administrative
variance of 50 square feet from the minimum lot area requirement of 12,500 square
feet in order to convert the existing single-family residence into a duplex at the
property located at 6995 West 33`d Avenue has been received by the Department of
Planning and Development.
The applicant is requesting an administrative variance review which allows no
more than a ten percent (10%) variance to be granted by the Zoning Administrator
without need for apublic hearing. Prior to the rendering of a decision, all adjacent
property owners are required to be notified of the request by certified mail.
If you have any questions, or would like to submit comments concerning this
request, please contact the Planning Division at 235-2846 by 5:00 p.m. April 29,
1999.
