Case No. WA-99-17, an application by Joel Lusby requesting an administrative variance of three
(3) feet from the 30' minimum front yard setback for a single-family addition of a garage and
bedrooms above the garage. The property is located at 3555 Estes Street and zoned R-2.
Pursuant to Section 26-6 (D)(2)(a) of the Wheat Ridge Code of Laws, the Zoning Administrator
is not empowered to decide upon application for a waiver from the front yard setback
requirement since the following conditions apply:
1. The variance does not exceed ten (10) percent of the minimum or maximum standard.
2. That the Zoning Administrator finds that the "findings of fact," as set forth in subsection
(2)(c), are substantially complied with and support the request.
3. The Zoning Administrator has not received objections to the project after noticing and
posting the site for ten days.
4. No additional dwelling units would result from this approval.
This request for a 3' foot variance from the 30' minimum front yard setback requirement meets all
applicable conditions as required by Section 26-6(D)(2)(a) of the City of Wheat Ridge Code of
Laws. Staff has not received comments in opposition to this request from the surrounding
neighbors.
Therefore, staff recommends APPROVAL of Case No. WA-99-17.

This is to inform you that Case No. WA-99-17 a request for an administrative
variance of three (3) feet from the 30' minimum front yard setback for a single-
family addition of a garage and bedrooms above the garage at the property located
at 3555 Estes Street has been received by the Department of Planning and
Development. ,
The applicant is requesting an administrative variance review which allows no
more than a ten percent (10%) variance to be granted by the Zoning Administrator
without need for a public hearing. Prior to the rendering of a decision, all adjacent
property owners are required to be notified of the request, by certified mail.
If you have any questions, or would like to submit comments concerning this
request, please contact the Planning Division at 235-2846 by 9:00 a.m. May 31,
1999.
