Case No. WA-99-20, an application by Jenkins Construction requesting an administrative
variance of three (3) feet from the 30' minimum front yard setback. The property is located at
3815 Cody Street and zoned R-2.
Pursuant to Section 26-6 (D)(2)(a) of the Wheat Ridge Code of Laws, the Zoning Administrator
is empowered to decide upon application for a waiver from the front yard setback requirement
since the following conditions apply:
1. The variance does not exceed ten (10) percent of the minimum or maximum standard.
2. That the Zoning Administrator finds that the "findings of fact," as set forth in subsection
(2)(c), are substantially complied with and support the request.
3. The Zoning Administrator has not received objections to the project after noticing and
posting the site for ten days.
4. No additional dwelling units would result from this approval.
This request for a 3' foot variance from the 30' minimum front yard setback requirement meets all
applicable conditions as required by Section 26-6(D)(2)(a) of the City of Wheat Ridge Code of
Laws. Staff has not received comments in opposition to this request from the surrounding
neighbors. In addition, the Zoning Administrator received two comments in support of the
project from the surrounding neighbors.
Therefore, staff recommends APPROVAL of Case No. WA-99-20.
