Case No. SUP-06-07/Queen of Vietnamese Martyrs Church I I. REQUEST The applicant requests approval of a Special Use Permit to allow a previously-approved playground site to be used as a parking lot in a Residential-Two zone district at 4690 Ingalls Street. II. EXISTING CONDITIONS/CASE HISTORY The Queen of Vietnamese Martyrs Catholic Church has established itself into a campus-type facility with multiple buildings on 5.56 acres of property. The existing zoning on the site is C-1 on the south half and R-2 on the remainder. The property is bounded by Harlan Street on the east and W. 470' Avenue to the north. The current facilities consist of three buildings on the southern C-1 zoned portion of the property including an education building with 6800 s.£, a sanctuary with 800 seats with a 9600 s.f footprint and a meeting hall with 2400 s.f. of building area. The rectory is the southernmost dwelling on the east side of Ingalls Street with R-2 zoning (4660 Ingalls Street). An "outlot" just south of the rectory is used as garden area. An additional education building with 21,500 s.f. of area was built on the R-2 portion in 1998. The structure is 35' high and has the potential seating capacity in the auditorium for up to 1200 persons for Holy Day masses. The parking requirements for a church are based on the seating capacity in the main assembly area at a rate of 1 space for every 4 seats. Required parking for the entire campus is 300, where 323 are provided. Included in this count are 12 handicapped spaces dispersed around each building and overflow parking behind the rectory. There are two entrances on Harlan Street which provided access to the church campus. An additional entrance onto the property is provided from West 47`h Avenue running south behind the new education building. Case No. CUP-97-1 was approved to allow construction of the aforementioned education building. Included in this approval was the development of vacant property located at the southeast comer of Ingalls Street and W. 47a' Avenue or 4690 Ingalls Street. The approved site plan showed this parcel as being developed as a playground which would be available for use by children of the congregation and the general public. (Exhibit 1, CUP site plan) Due to liability concerns, the church is not moving forward with the playground and would like to use the parcel as overflow parking, requiring a modification to the prior approval. At the time that the 1997 case was processed, churches were a permitted use in C-1, but were a conditional use in R-2. In 2001, the zoning and development code was rewritten and conditional uses were done away with and were replaced with special uses. Now all previously approved CUP's will be processed as SUP's. Pursuant to Section 26-114, the Community Development Director has the ability to decide upon applications for administrative special use approval, without requirement for a public hearing, provided the following conditions are met: 1. A completed application package has been submitted and fee paid; Case No. SUP-06-07/Queen of Vietnamese Martyrs Church 2 2. The Community Development Department has notified adjacent property owners by letter notice and the site has been posted for at least ten (10) days; 3. No written objections have been received in such ten-day period; 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; or, 2. Whether the SUP is personal to the applicant and may or may not be inherited; and /or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section III. PROPOSED PLAN MODIFICATION The property at 4690 Ingalls Street is currently vacant and is fenced by a 4' high decorative brick and wrought iron fence on the north and west sides. A 6' high chain link fence runs along the south side and appears to be owned by the adjacent property owner. There is existing curbwalk along the Ingalls and 47th Avenue frontages. A site plan has been submitted showing use of the property as parking for 20 vehicles. The lot is accessed from the east side by an existing driveway running south from W. 47th Avenue between this property and the new education building. No access is proposed from Ingalls Street. The perimeter of the property will be landscaped with a 10' wide strip containing trees and shrubs with additional landscaped islands at the entrance to the property. IV. SPECIAL USE PERMIT CRITERIA Before an administrative special use is approved, the applicant shall show and the Community Development Director shall find that the proposed special use: 1. Will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use. This is a proposal for an ancillary church use and will be used for overflow parking for church functions. The additional parking may alleviate on-street parking on Ingalls. There should be no negative impact on the general health, welfare, safety and convenience of persons in the neighborhood. 2. Will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics of the proposed plan. The property is currently vacant and has an unmaintained appearance. Paving and the installation of landscaping will be an improvement for the neighborhood. Case No. SUP-06-07/Queen of Vietnamese Martyrs Church ? 3. Will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution. As no buildings are proposed, there should be no impact on light to adjacent properties. A drainage report will be required to ensure that storm drainage does not impact the adjacent streets. There may be a small amount of air and noise pollution generated by vehicles entering and exiting the new parking area. 4. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service of internal traffic conflicts to the detriment of persons whether on or off the site. The existing access point to 47th Avenue is already in place. No additional access points are proposed so there should be no negative impact resulting from traffic congestion or hazards. The proposed parking layout meets the City's standards for parking stall size and width and drive aisle design. 5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The property is currently vacant and somewhat of an eyesore. The proposed paving and landscaping should be an improvement for the neighborhood. 6. Will not overburden the capacities of the existing streets, utilities, parks, schools and other public facilities and services. All responding utility agencies have expressed no concerns regarding the proposed use of the property. There will be no impact to utilities, parks or schools as a result of the parking expansion. 7. History of compliance by the applicant with Code requirements and prior conditions, if any, regarding the subject property. A search of the City's code enforcement records has shown that there was one zoning code violation in the past relating to a dumpster enclosure. The violation was abated in a timely manner. 8. Ability of the applicant or any permitted-in-interest to continuously meet the conditions of the proposed permit. If the conditions of an approved special use are violated, the permit can be revoked. If the permit is revoked, then the use of the property for parking must stop. It is in the applicant's best interest to follow the terms and conditions of any approval received from the city. 9. Other factors relevant to the specific application. There are no other relevant factors. Case No. SUP-06-07/Queen of Vietnamese Martyrs Church 4 V. AGENCY REFERRAL All affected service agencies were contacted regarding the ability to serve the property. Specific referral responses follow. Wheat Ridge Fire Protection District: Can serve. Wheat Ridge Water District: No problems. Wheat Ridge Police Department: No problems. Wheat Ridge Sanitation District: Can serve. Wheat Ridge Public Works Department: At the time of building permit, a drainage letter and plan will be required. A grading and erosion control plan will be required, as will civil construction plans. VI. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on October 18, 2005. There were approximately 16 area property owners in attendance. (Exhibit 2, Sign-up sheets, Exhibit 3, Neighborhood Meeting Recap). Two comment letters were received regarding the request as a result of the administrative review noticing. Neither of the respondents was opposed to the request. A property owner who lives on the west side of Ingalls Street expressed concern that drainage be addressed at the time of building permit. The other respondent, who lives directly to the south, had several concerns which were addressed by staff in the conditions of approval. VII. STAFF FINDINGS OF FACT Staff recommends approval of Case No. SUP-06-07, a request for approval of a special use permit for property located at 4690 Ingalls Street to allow parking lot improvements, with the following findings of fact: 1. This request for an administrative special use meets all applicable conditions as required by Section 26-114 of the City of Wheat Ridge Code of Laws. 2. Staff has not received written comments in opposition to this request from the adjacent property owners. 3. The proposed paving and landscaping should improve the appearance of the property and create a benefit for the neighborhood. 4. There should be no substantial impact on light, air, or water to adjacent properties and no impact on traffic in the area. 5. The proposed design of the parking lot meets the provisions of Section 26-501 of the zoning and development code. 6. All agencies can serve the property. 7. There has been a history of compliance of the property with the provisions of the Zoning and Development Code. Case No. SUP-06-07/Queen of Vietnamese Martyrs Church Therefore, Case No. SUP-06-07 is hereby APPROVED with the following conditions: 1. The special use shall be a grant of use to the applicant, Queen of Vietnamese Martyrs Church. 2. The church parishioners be discouraged from parking on Ingalls Street. 3. The gap between the fences at the southwest corner of the site be closed to eliminate cut- through pedestrian traffic. 4. At the time of building permit, a drainage plan and report, a grading and erosion control plan and civil design documents be submitted for review and approval. Accurately show the existing sidewalk along the Ingalls Street and 47`s Avenue frontages, as well as the entire entryway (see redlined plans). d. CIVIL DOCUMENTS 1. No civil documents were included with this submittal. The following information shall be submitted for review and approval by the Department of Public Works prior to approval of the SUP Permit Plans: a. Drainage Letter and Plan: The City of Wheat Ridge is an MS4 City and must enforce the provisions set forth in the federal Clean Water Act. Therefore, water quality measures are now required for all commercial developments. Normally a full Final Drainage Report is required, but due to the relatively small area of this parking lot no stormwater detention will be required; a Drainage Letter with Drainage Plan will suffice. The Drainage Letter shall state how the parcel is to be graded without negatively impacting adjacent properties, describing the proposed directions of flow, methods of flow conveyance and release (i.e., using curb & gutter, grass-lined swale, curb-cuts, etc.), and also specifying what items are to be constructed for water quality, i.e., porous pavement design with stone edging, grass lined swales, landscaping strips, etc. The Drainage Letter shall be accompanied by a Drainage Plan showing the proposed site grading, including all percent grades, high and low points, grade breaks, and flow direction. Both drainage documents are to be signed and sealed by a Professional Engineer licensed in the State of Colorado. b. Grading & Erosion Control Plan: A Grading & Erosion Control Plan (signed and sealed by a Professional Engineer) which includes details for all utilized BW's both during and subsequent to construction is required. Include on the Grading & Erosion Control Plan: i. To-scale cross-sections A-A through C-C as identified on Sheet 101 of the SUP Plans. ii. Clearly show all proposed grading including the side slope percentage(s) between the lot and the street frontages. iii. Yes. • How could the property be used under existing zoning conditions? As a single family residence. • How will drainage be handled? Prior to issuance of a building permit for construction of the parking lot, a drainage plan and report will be required to be approved and reviewed by the City of Wheat Ridge Public Works Department. The improvements must be completed in accordance with the approved plan. • Will there be a public hearing regarding the drainage? No. • What materials will be required for the parking lot? For all uses other than single and two- family residences, parking areas are required to be hard surfaced with asphalt or concrete. • The following neighborhood property owners spoke in favor of the church's application: Bradley Hughes (6160 W. 47` Place), Dennis and Jami Boyat (6075 W. 46th Avenue), JoAnn Flores (4595 Ingalls Street), Fran Sawyer (6095 W. 46`h Avenue), Ruth Howard (4695 Ingalls Street), Becky Harrington (4685 Ingalls Street). • One member of the audience was concerned about the access onto W. 47"' Avenue and the potential for traffic turning west into the neighborhood. There is already traffic exiting onto 47`h Avenue; however, this curb cut was designed and signed to prohibit left-hand turns. • Bob Howard (4695 Ingalls Street) indicated that he did not have a problem if the parking lot was properly constructed. Provisions must be made to control drainage as the property slopes quite steeply from the southeast to the northwest. Storm drainage must be controlled as it flows onto the street. He does not want his driveway and garage flooded. He also stated an objection to the Community Development Director being able to approve a special use application administratively.
