CITY OF WHEAT RIDGE, COLORADO
APRIL 25, 1994
The ritv Council Meeting was called to order by Mayor Wilde at 7 00 p m
rouncilmembers present Rae Jean Behm, Don Eafanti, Vance Edwards, Jean
Fields, Dennis Hall, Tony Solano, and Claudia Worth Ken Siler was
absent Also present City Clerk, wanda Sang, City Administrator,
Robert Mijdaugh, rity Attorney, Kathryn Schroeder, Director of Public
Works, Bob Goebel, Chief of Police, Jack Hurst, staff, and interested
citizens
PROCLAMATIONS AND CEREMONIES
Mayor Wilde presented Proclamations for

APPROVAL OF MINUTES of April 7, 1994 and April 11, 1994
Motion by Mr Eafanti for the approval of the Minutes of April 7, 1994,
seconded by Mrs Fields Mrs Worth asked for an addition to the
Minutes, that 29 people spoke against the special meeting, 2 letters
were read into the record against the special meeting, 11 people spoke
for the meeting and one person was noncommittal on the meeting Motion
carried 7-0
Motion by Mr Eafanti for the approval of the Minutes of April 11, 1994,
seconded by Mrs Behm Mrs Worth asked for an addition to the Minutes
that 5 people spoke against having the special meeting on West 38th
Avenue Motion carried 7-0
CITIZENS' RIGHTS TO SPEAK
The following speakers were sworn in by the Mayor
Todd Hills, 5990 W 44th Avenue, is concerned about our Pawnshop
Ordinance and Resolution that charge 60 cents per item, rather than 60
cents per transaction
Mr Middaugh stated that the intention is to charge 60 cents per
transaction form, not for each item
Karen Thiessen, 9560 W 38th Avenue, took exception to some the of the
comments made by Councilmembers during the April 12 meeting She feels
that the Councilmembers in her District III should represent their
district If 44 ft are approved on W 38th Avenue, their property
values are going to plummet

Mary Jean Anderson, 3990 Garland Street, presented 339 signatures on
petitions to be put with the other 500 signatures alreaiy in the Clerk's
Office, which request that the City of Wheat Ridge proceed as soon as
possible with the constrlJction of 38th Avenue between Cody and Kipling
to the 36 foot, 3 lane design
David Wagner, 9630 ~ 38th Avenue, feels it is better to keep the trees
we alreaiy have, instead of cutting them down and planting new ones
somewhere else Don't put in 4-1ane freeways in residential neighbor-
hoods
Chris Bell 3850 Independence Court, spoke in favor of 36 ft on 38th
Avenue and asked that there be a light at 38th and Independence Court
because so many kids are crossing there
Ron Patera, 4125 Pierce Street, was dismayej by the dialogue that ensuej
at the end of the April 12 meeting
LOCAL LIQUOR LICENSING AUTHORITY MATTERS
Items
Application for a Special Events Permit from Cinco de Mayo,
Inc , 828 Santa Fe Drive, Denver, Colorado, to serve 3 2%
beer on May 15, 1994, at a Mother's Day festival
Carmen Garcia, 4200 W Barnett Place, Denver, was sworn in by the Mayor,
she is the Event Manager and was present to answer questions
Motion by Mrs Behm to approve the Special Events Permit for Cinco de
Mayo, Inc , at the location of 9110 West 44th Avenue, in Wheat Hidge, ti
dispense 3 2% Beer on May 15, 1994 from 9 00 a m to 9 00 p m I
further move to authorize the Mayor to sign the approval for the Special
Events Permit, seconded by Mr Eafanti, carried 7-0
PUBLIC HEARINGS AND ORDINANCES ON SECOND READING

Council Bill No 49 - An Ordinance amending the rode of Laws
of the City of Wheat Ridge, Colorado to clarify the trapping
requirements and regulations for the protection of wildlife
Council Bill 49 was introduced on second reading, title read by the
Clerk, Ordinance No 961 assigned
Motion by Mr Edwards for the adoption of Council Bill 49 (Ordinance
961) and have it effective 1 day after final publication, seconded by
Mrs Fields, carried 7-0

Council Bill 54 was introduced by by Mrs Behm on first reading, title
read by the Clerk
Motion by Mrs Behm that ~ouncil Bill 54 be approved on first reading,
ordered published, public hearing be set for Monday, May 23, 1994
at 7 00 p m in City Council Chambers, M~nicipal Bldg , and if approved
on second reading, take effect on passage, seconded by Mr Hall, carried

Item 4. Council Bill No 55 - ~n Ordinance providing for the approval
of rezoning from Agric~ltural-Two to Restricted Commercial on
land located at 4217 Xenon Street, City of Wheat Ridge, rounty
of Jefferson, State of Colorado

Council Bill 55 was introduced by Mr Hall on first reading, title
read by the Clerk
Motion by Mr Hall that Council Bill 55 be approved on first reading,
ordered published, public hearing be set for Monday, June 13, 1994
at 7 00 p m in City Council Chambers, Municipal Bldg , and if approved
on second reading, take effect upon passage, seconded by Mrs Behm,
carried 7-0
Item 5. Council Bill No 5b - An Ordinance adopting by reference a
replacement official zoning map pursuant to Wheat Ridge
Code of Laws, Section 26-3(D)
Council Bill 5b was introduced by Mrs Worth on first reading, title
read by the Clerk
Motion by Mrs Worth that Council Bill 56 be approved on first reading,
ordered published, public hearing be set for Monday, May 23, 1994
at 7 00 p m in Citv Council Chambers, Municipal Bldg , and if approved
on second reading, take effect 15 days after final publication Copies
of the existing and proposed Official Zoning Map will be placed at City
Hall, Wheat Ridge Community Center, Jefferson County Librarv, Wheat
Ridge Branch, and Wheat Ridge Historical Society, for public review and
inspection as detailed with Council Bill No 56, Section 3 , seconded by
Mr Edwards, carried 7-0

Item 6. Council Bill No 57 - An Ordinance amending the Sign Code of
Code of Laws of the City of ~heat Ridge relating to political
signs
Council Bill 57 was introduced by Mr Eafanti on first reading, title
read bv the Clerk
Motion by Mr Eafanti that Council Bill 57 be approved on first reading,
ordered published, public hearing be set for Monday, May 23, 1994
at 7 00 p m in City Council Chambers, MuniCipal Bldg , and if approved
on second reading, take effect 15 days after final publication, seconded
by Mrs Behm, carried 7-0
Item 7. Council Bill No 58 - An Ordinance regulating the possession
of drug injection devices and possession, sale, manufacture,
delivery, or advertisement of drug paraphernalia
Council Bill 58 was introduced by Mr Edwards on first reading, title
read by the Clerk
Motion by Mr Edwards that Council Bill 58 be approved on first reading,
with the changes indicated by the City Attorney, ordered published,
public hearing be set for Monday, June 13, 1994, at 7 00 p m in City
Council Chambers, Municipal Bldg , and if approved on second reading,
take effect one day after final publication, seconded by rlrs Fields,
carried 7-0
DECISIONS, HESOLUTIONS, AND MOTIONS
Item 8
Resolution No 1400 - A Resolution authorizing the Mayor
and City Clerk to sign the agreement for purchase and sale,
the agreement for construction and maintenance of a common
boundary line fence, and authorize Jefferson County Open
Space to ac~uire the easterly 2 705 acres of property
including water rights located at 4300 Tabor in Wheat
Ridge
Resolution 1400 was introduced by Mrs worth, title read by the Clerk
Motion for the adoption of Resolution 1400, seconded by Mr Edwards,

Item 9. Authorize Purchase and transfer of funds for speed board
Motion by Mr Edwards that $13,490 be appropriated from the Capital
Improvement Fund balance and transferred to Acct 57-610-800-807 for the
purchase of a speed board from Kustom Signals, Inc in the amount of
$13,490, and that said purchase is hereby authorized and that the 1994
budget is amended to reflect the appropriation and transfer, seconded by
Mr Solana, carried 7-0

Item 10. Municipal Building ~nd Anderson Building roof repairs
Motion by Mrs Fields that the Municipal Building and Anderson Building
Roof Project (RFB #94-14), be awarded to CEI West Roofing Company in the
amount of their base bid of $29,3U5 00 That a contingency/force
account in the amount of $7,900 00 be established That $1,300 00 be
transferred from the Capital Improvement Fund Balance to Acct No
30-610-811 That the Director of Parks and Recreation and the
Purchasing Agent be authorizej to issue change orders up to the total
contract and contingency amount and that the total costs of this project
of $37,205 00 be charged to Acct No 30-61-811 and 54-601-877 as
appropriate That the funds be encumbered for the length of the
project, which expressly allows the expenditure of funds in 1995 for
this project in accordance with Ordinance #787, 1989 Series, seconded by
Mr Edwards
Mr Solano stated that he would not be able to vote on this matter
because he has a contractual relationship with CEI
Motion carried 6-0 with Mr Solano abstaining
Item 11 Board and Commission appointments
Motion by Mr Edwards to appoint William Echelmeyer to the Board of
Adjustment from District I to fill Mr Reynolds term, seconded by Mrs
Worth, carried 7-0
Motion by ~':r Solano to appoint Sharleen Strickland to the Personnel
Commission from District II, seconded by Mr Edwards, carried 7-0
Motion by Mr Solano to appoint Debby Mauldin to the Animal Control
Commission from District II, seconded by Mr Edwards, carried 7-0
Item 12. Acceptance of Quit Claim Deed - 4545 & 4555 Hoyt Street
Motion by Mrs Worth that the parcel of land (aka 4545 and 4555 Hoyt
street) describej in the attached warranty deed be accepted by the City
as right of way on Hoyt Street for the sum of $10 00 That $10 00 be
transferred from Fund Account 01-302-793, title searches, to Fund
Account 01-302-799, Miscellaneous Services and Charges and that payment
for the right of way be made from Acct No 01-302-799, seconded by Mr
Edwards, carried 7-0
CITY ADMINISTRATOR'S MATTERS
Robert Middaugh advisei Council of a conference on the subject of
"Reinventing Government", he urgej Council to attend
CITY ATTORNEY'S MATTERS
Kathryn SChroeje~ pointed out her memorandum attached to this Agenda
She asked for an Executive Session on litigation update

Motion by Mr Hall to holj an Executive Session undpr Section 5 7(b)(1)
of the Charter and adjourn immediately thereafter, seconded by Mr
Edwards, carried 7-0
ELECTED OFFICIALS' MATTERS
Rae Jean Behm commended our Parks and Recreation Department on our
beautiful flower beds
Jean Fields explained about the ribbons they are wearing, black is for
mourning, because their first amendment rights have been violated,
yellow is for hostage, because the citizens are being held hostage by a
small group The little screw everybody understands
Don Eafanti thanked everybody that helped with the first annual fishing
derby
Claudia Worth statej that there is conference in Boulder on Eljer Abuse
and she would like to send as many police officers as possible
She asked that somebody be present in departments to give permits during
lunch hours and that the permit process be streamlined
EXECUTIVE SESSION WAS HELD.
