CITY COUNCIL STUDY SESSION MINUTES
CITY OF WHEAT RIDGE, COLORADO
MAY 16, 1994
The city ('ouncil Stuiy Session was called to order by Mayor Dan Wilde at
7 00 p m Councilmemb~rs pres~nt Vance Edwards, Jean D Fields, Ken
Sil~r, Donald R E~fanti, Dennis Hall, Claudia Worth, Rae Jean Behm and
Tony Solano absent Also present City Clerk, Wanda Sang, City
Administrator, Robert Middaugh, City Attornev, Kathryn Schroeder, City
Treasurer, John Malone, staff, and interested citizens
Mr Middaugh reviewed agenda items for discussion and distributed a
memorandum pertaining to CAP meeting format and responsibilities

Discussion on development agreements
Mr Gidley reviewed and described when it is appropriate to have
development agreements, who is appropriate to pay for it and how
development agreements are used There are two separate and distinct
types of development agreements that emanate from two different
legislative authorities Development agreements that are associated
with subdivisions, planned developments by platting and the enabling
legislation related to those specific requirements for public
improvements are derived from the subdivision regulations--
subdivisions, planned developments and site development plan approval
He further stated the real difference between the first type is that
subdivisions, the development plan, the site plan and the building
permit is that under the subdivision planned development and site plan
provisions there would be a continual obligation Under the Building
Permit procedure there is a ten year reverter provision that states that
if the improvements are not called for within ten years then you no
longer can call for those improvements on the part of the property
owner or the party that has the current obligation The obligation
is filed with the County Clerk and Recorder after it is signed by the
owner of the property It is filed against the title of the property
and is picked up in any title search when the property is sold So that
any future buyers would know that they too have that obligation If it
is related to a building permit then it would be after ten years null
land void
Discussion followed regarding the hardship it imposes on small bus-
inesses to pay the $10 00 and other it delays the development of
property, the inequities where one party is exempted and another party
is not, consider assessing abutting properties equally, reconstruction
and waived rights of property owners
Consensus was 4-2 to amend Chapter 5, Section 5-45 (el Public
Improvements required, and Chapter 26, Section 2b-e (H) Miscellaneous
Non-Conformities of the Code of Laws for discussion of reconstruction
due to actions beyond the control of the property owner

Discussion of traffic circulation patterns from West 35th
Avenue to WAst 46th Avenue on Wadsworth Boulevard and
adjacent areas (Joint Session with EDARC)
Mayor Wilde thanked the members of EDARC for giving of their time to
attend this joint meeting with Councilmembers
Mr Middaugh explained that some of the things that are happening with
the Wadsworth Corridor have originated in discussions staff has been
having administratively with Safeway Corporation on how to dO site
development that Illtimately spilled out to what is the access point
and how it affects everything else What has been discussed is traffic
signalization on wadsworth Boulevard, and specifically whether or not it
is feasible to havA a traffic sign31 on Wadsworth near the Safeway re-
development and what affect that would have on other signals and other
traffic patterns throughout the whole area
Councilmembers and EDARC discussed future possible development of vacant
property along the corridor and how this would generate additional
trips, possible redevelopment of pockets along the corridor, side street
circulation and the possibilty of additional signal locations, and the
process of applying to the State Highway Department for approval
Consensus was 6-0 to back the Safeway project light at 39th Avenue and
Wadsworth Boulevard
Motion by Mr Edwards to adjourn, seconded by Nr Siler, carried 6-0
Meeting adjourned at 9 00 p m
