HomeMy WebLinkAbout10/17/1994 OCTOBER 17, 1994 SPECIAL CITY COUNCIL MEETING CITY OF WHEAT RIDGE, COLORADO The City Council Special Meeting was called to order by Mayor Dan Wilde at 5 30 P m Councilmembers present Vance Edwards, Rae Jean Behm, Jean D Fields, Ken Siler, Claudia Worth, Donald Eafanti; Also present City Clerk, Wanda Sang; City Administrator, Robert Middaugh, City Attorney, Kathryn Schroeder The subject to be voted on will be the setting of an election to fill the vacancy in District IV Per the requirements of Section 2 7 of the Wheat Ridge City Charter Mayor Wilde prefaced the Memorandum submitted by Kathryn Schroeder, City Attorney Mrs Schroeder spoke to the memorandum stating it contains two items 1 ) Prerequisites to setting an election date and 2 )Type and Timing of Election She referred to the City Attorney/City Council client privilege and stated the Memorandum can be only released by a majority of the Council and not by individual Council members She addressed the prerequisites to setting an election date stating the problem of setting an election date tonight on the Recall petitions is that the Recall Petitions are not before Council She stated by law the Recall Petitions have to be presented by Mrs Sang with a Certification that stating that the Petitions are sufficient in all respects The City Council does not have the Recall Petitions before them, and until that is done, you cannot set an election date on the recall The second item in the Memorandum deals with the specifics and substantive issue of whether, when and how an election should be set Mr Siler stated that as he understands that no action can be taken tonight, does that mean the petitions cannot be brought forth at some later date and cannot be discussed then? Mrs Schroeder stated there is an obligation on the part of the City Clerk to certify the petitions to the City Council as sufficient if she so finds them, and also Mrs Sang first has to make a finding on the protest brought by Mr Hall She stated the Council can discuss it at the next regular City Council meeting SPECIAL CITY COUNCIL MEETING October 17, 1994 Page -2- Motion by Mr Siler for adjournment; seconded by Mrs Behm, tie vote on the motion 3-3 with Mr Eafanti, Mr Siler and Mrs Behm voting Yes Mayor Wilde broke the tie by voting Yes The motion carried 3-4 Meeting adjourned at 5 45 P m Wanda Sang, City Clerk APPROVED BY CITY COUNCIL NOVEMBER 14, 1994 BY A VOTE OF TO Tony
