CITY OF WHEAT RIDGE, COLORADO

November 28. 1994
The City Council Meeting was called to order by Mayor
Wilde at 700 pm Councilmembers present: Rae Jean Behm, Don Eafanti, Vance
Edwards, Jean Fields, Ken Siler, Tony Solano, and Claudia Worth Also present: City Clerk,
Wanda Sang; City Administrator, Robert Middaugh, City Attorney, Kathryn Schroeder;
Parliamentarian, Mary Bahde, Director of Public Works, Bob Goebel, staff; and interested
citizens.
APPROVAL OF MINUTES of Special Meeting of November 14, 1994 and Regular Meeting of
November 14, 1994
Motion by Mr Eafanti for the approval of the Minutes of the Special Meeting of November 14,
1994, seconded by Mr Solano, carried 7-0
Motion by Mr Eafanti for the approval of the Minutes of the Regular Meeting of November
14, 1994, seconded by Mr Solano, carried 7-0
CITIZENS' RIGHTS TO SPEAK
Jerry DiTullio, 3250 Newland Street, informed Council and citizens that Wheat Ridge Today
and Tomorrow is sponsoring their annual Christmas lighting contest for cash prizes, entry
forms can be found in the Applewood Transcript and the Jefferson Sentinel, entry forms are
due by December 16
Tom Taylor addressed Mayor and Council breaking their own Rules of Order and Procedure
asked that any reference to censoring 3 Councilmembers be stricken from public record.
Karen Thiessen thanked voters for voting for 36 feet on 38th Avenue, thanked supporters for
all their help; questioned Mayor's conduct.
Teri Dalbec spoke regarding the Wheat Ridge Junior High Building and the many uses it
could have if it were saved Asked that Council appropriate money toward a study to save
the building.

PUBLIC HEARINGS AND ORDINANCES ON SECOND READING
Item 1. Application by Evan Asby for Powderhorn Park Joint Venture for approval of an
amendment to a Planned Industrial Development final developm ent plan located
at 4894 and 4896 Van Gordon Street.
(Case No WZ-94-9)
Item 1 was introduced by Mrs Worth, title read by the Clerk.
Meredith Reckert, Planner II, was sworn in by the Mayor and presented the staff report.
Evan Asby, 8414 W 77th Way, Arvada, applicant, was sworn in by the Mayor and asked for
approval of his application
Robert Vermillion, 632 Gold Rim Road, Boulder, was sworn in and spoke in support of the
application.
Motion by Mrs Worth that Case No WZ-94-9, a request for approval of an amendment to
the Powderhorn Park PID final development plan for property located at 4980-96 Van Gordon
Street, be approved for the following reasons: 1 Staff and Planning Commission
recommend approval 2. The proposal is compatible with adjacent zoning and land use 3
It is consistent with the Comprehensive Plan With the following conditions 1 The outside
storage area be screened from view with a six-foot-high chain link fence with wooden slats
2. All other development parameters of the existing development plan still apply with the
exception of the building height; seconded by Mr Solano, carried 6-1 with Mr Edwards
voting no.
DECISIONS. RESOLUTIONS. AND MOTIONS
Item 2.
Resolution 1436 - authorizing the closure of Wright Court.
Resolution 1436 was introduced by Mrs Behm, title read by the Clerk.
Motion by Mrs Behm for the approval of Resolution 1436, seconded by Mr Edwards, carried

Item 3.
Resolution 1437 - levying General Property Taxes for the Year of 1994 to help
defray the costs of government for the City of Wheat Ridge, Colorado, for the
1995 budget year
Resolution 1437 was introduced by Mr Edwards; title read by the Clerk.
Motion by Mr Edwards for the approval of Resolution 1437, seconded by Mr Solano, carried

Item 4.
Resolution 1438 - reo 52nd Avenue
Resolution 1438 was introduced by Mrs. Worth, title read by the Clerk.
Bunny Gordon, 5190 Tabor Street, asked that the City of Wheat Ridge not pursue widening
W 52nd Avenue
Ken Peck, 10935 W 68th Avenue, Arvada, offered amendm ents to Resolution 1438 and
asked that Council pass this Resolution
Motion by Mrs Worth for the approval of Resolution 1438, seconded by Mr Solano, carried
7-0
Motion by Mr Edwards that we request that the City Administrator and City Attorney continue
to work on the option regarding our portion of right-of-way similar to what we did on 35 th &
Allison, at least have that investigated to understand our options, seconded by Mrs. Worth,
carried 7-0
Item 5.
Architectural services for Police Department addition and renovation.
Motion by Mrs. Fields that the City Administrator be authorized to enter into an agreement for
architectural services with Reck and Associates for the Wheat Ridge Police Department
addition and renovation pursuant to the proposal offered by Mr Reck, dated November 21,
1994, and including standard contractual provisions associated with other Wheat Ridge
contracting agreements, seconded by Mr Solano, carried 7-0
Item 6.
Parliamentarian rule change.
Motion by Mr Solano that language as submitted amending section 43 of the City Council
Rules regarding the designation of a parliam entarian be placed on the December 12 City
Council agenda for formal consideration, seconded by Mrs. Worth, carried 7-0
Item 7.
December meeting changes
Motion by Mrs. Worth that the December 19 Study Session of the City Council be utilized as
an opportunity to meet with the City's State legislative delegation to discuss issues of
concern to the City of Wheat Ridge for the upcoming legislative session. I further move that
the December 26 meeting of the Wheat Ridge City Council be cancelled; seconded by Mr
Solano; carried 7-0

Item 8.
The renaming of Wheat Ridge Park to Albert E. Anderson Park.
Mrs. Worth read an anonymous letter into the record, which praised Mr Anderson and
asked that Wheat Ridge Park be renamed Albert E Anderson Park.
Motion by Mrs Worth that Wheat Ridge Park be renamed Albert E. Anderson Park after the
first Mayor of Wheat Ridge, seconded by Mr Edwards, carried 6-1 with Mr Siler voting no
Mr Siler does not think we should name parks after living people, he has nothing against Mr
Anderson.
CITY ATTORNEY'S MATTERS
Kathryn Schroeder gave update on pending lawsuits.
ELECTED OFFICIALS MATTERS
Jean Fields asked how many committees we have that Councilmembers seNe on and why
we don't get reports from them (Councilmembers updated Mrs. Fields on what committees
they seNe on and stated they would be happy to provide reports)
Tony Solano invited everybody to show up for the holiday lighting ceremony and caroling on
Decem ber 3
Claudia Worth has shopped for the Christmas family and Rae Jean Behm will do the
wrapping.
Vance Edwards is going to the NLC meeting and will give a report when he returns He
moved to adjourn, seconded by Mrs Behm, carried 7-0
