HomeMy WebLinkAbout07/24/1995 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO 7500 W 29th Avenue, Municipal Building July 24, 1995 The Regular City Council was called to order by Mayor Wilde at 7 00 P m Councilmembers present Rae Jean Behm, Teri Dalbec, Don Eafanti (voted by telephone from Seattle, WA), Vance Edwards, Jean Fields, Ken Siler, Tony Solano, and Claudia Worth Also present City Clerk, Wanda Sang, City Treasurer, Jim Malone, City Administrator, Robert Middaugh, Parliamentarian, Mary Bahde; Director of Parks & Recreation, Gary Wardle, Director of Planning, Glen Gidley; Chief of Police, Jack Hurst, Director of Public Works, Bob Goebel; staff, and interested citizens APPROVAL OF MINUTES of July 24, 1995 Motion by Mr Siler for the approval of the July corrected, seconded by Mr Solano, carried 7-0 because she had to leave the meeting on July 24, emergency 10, 1995 Minutes as Mrs Behm abstained 1995 due to a medical PROCLAMATIONS AND CEREMONIES Commander, Joe Cassa, presented, on behalf of the Fraternal Order of Police and the Wheat Ridge Police Department, Certificates of Commendation and gifts to Nate Montray, Shawn Montray and Jeremy Neville for their heroic acts of bravery in saving the life of a horseback rider who had fallen from her horse into Clear Creek, west of Prospect Park, Saturday, July 1, 1995 at approximately 4 00 P m Mayor Wilde read and presented the following proclamations 26th Wheat Ridge Carnation Festival - August, 18, 19 & 20, 1995, and featured event will be the Duck Race Sunday, August 20, to benefit Family Tree Duck Month - August 1 - 20 Mayor Wilde presented a plaque to Coach George Stansbury and the Wheat Ridge High School Lacrosse players who won their third State Lacrosse Championship, Division 2 CITY COUNCIL MEETING July 24, 1995 Page -2- Motion by Mrs consideration 8-0 Behm that Agenda Items 7A and 7B be moved for right after Agenda Item 4, seconded Mr Siler; carried CITIZENS' RIGHTS TO SPEAK Mrs Behm read into the record the following She would like to raise a policy question for the City Council to consider At the last City Council meeting the Council passed a Resolution supporting the acquisition of the 60 acre addition to Crown Hill As part of that resolution Council asked that a public process be established to determine the use of the property Unfortunately, I was called away during the discussion of this item for a medical emergency Even though I was unable to vote on the issue I strongly support the acquisition of the 60 acre addition to Crown Hill and a public process to determine how the property should be used I do have a concern, however, that I was unable to raise at the last meeting about one of the uses presented for the use of Crown Hill, and would like the Council to take a position on that use tonight A recreation center has been discussed as a possible use for the addition to Crown Hill I would like to be very clear that I think that a recreation center is needed in our community However, I do not think that Crown Hill is the best site for a recreation center The Council has already heard from many citizens that a recreation center would be opposed on that Crown Hill site Motion by Mrs Behm to remove the Crown Hill addition as a site for a Recreation Center Mr Edwards asked that this be an agenda item motion Mrs Behm withdrew the Motion by Mrs Behm to remove the Crown Hill addition as a site for a recreation center be Agenda Item 4 after Agenda Item 3; seconded Mrs Worth, carried 8-0 Doris Ibbison complimented Council on the purchase of the Crown Hill property; suggested a nine hole golf course on the site Ed Rossillon read a Resolution from Wheat Ridge United Neighborhoods for "National Night Out" on Tuesday, August 1, 1995 Frank Petticrew suggested playing and practice fields for soccer, lacrosse, softball, baseball, midget football and possibly a nine hole golf course for Crown Hill Harry Fleshman also encouraged active use, such as a golf course for Crown Hill CITY COUNCIL MEETING July 24, 1995 Page -3- Geoff Wodell stated that neither Wheat Ridge nor Lakewood would be the final decision makers as to what use would be put on the Crown Hill property; this is up to the entire population of Jefferson County Vance Kolesar explained that there is a lack of practice fields for various sports in the City of Wheat Ridge and asked that Crown Hill be utilized for active use Dr Jack Grosjean asked for active use on the Crown Hill property, had suggested a nine hole golf course at the last meeting, also likes practice fields Arie Baer wants active use at Crown Hill acquisition; he also speaks for Fred Walker, who was here at the last meeting Paulette Gillis Cooper encouraged City Council to make an educated decision as to what the Crown Hill addition would be used for, study what lives there and how it would be affected She thinks Wheat Ridge needs a teen center, she would like to be actively involved in such an endeavor Kristin Bright expressed her appreciation for Don Eafanti and Rae Jean Behm who are representing District III, which is the district she lives in, she loves Crown Hill and wants it used for passive use Alan Bright wants passive use; east end of the park is a food source for many of the animals that live there LOCAL LIQUOR AUTHORITY MATTERS Item 1. Change of Location for Village Liquors, 5305 West 38th Avenue, Wheat Ridge City Clerk, Wanda Sang, presented the staff report Applicants Curtis and Pauline Johnson were present and asked for approval of their application Motion by Mr Siler to approve the Change of Location for Village Liquors from 5305 West 38th Avenue, Unit F, to 5305 West 38th Avenue, Unit D, and authorize the Mayor and City Clerk to sign the Request to Change Location, for the following reasons 1 Applicant has had a Retail Liquor Store license in the Ridge Village Shopping Center since 1984 2 Applicant has had one liquor violation in 1984 and no violations since CITY COUNCIL MEETING July 24, 1995 Page -4- 3 This move constitutes going from Unit F to Unit D and reasonable requirements of the neighborhood and desires of the inhabitants are not affected by this move 4 All applications have been filed and fees paid; seconded by Mrs Behm; carried 8-0 Item 2. Special Events Permit for Carnation Festival Motion by Mrs Behm to approve the Special Events Permit for the Wheat Ridge Carnation Festival Committee, 3596 Ingalls Street, Wheat Ridge, at the location of the Wheat Ridge Carnation Festival, Albert E Anderson Park, at 44th & Field Street in Wheat Ridge, to dispense 3 2% beer on August 18, 1995 from 4 00 P m to 11 00 pm; on August 1'9, 1995 from 12 00 noon to 12 00 midnight, on August 20, 1995 from 12 00 noon to 7 00 P m I further move to authorize the Mayor to sign the Special Events Permit; seconded by Mr Eafanti; carried 8-0 PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 3. Council Bill 20 - An Ordinance amending Section 16-177 of the Wheat Ridge City Code concerning possession of alcohol by minors Council Bill 20 was introduced on second reading by Mr Siler; title read by the Clerk; Ordinance No 1005 assigned Motion by Mr Siler for the approval of Council Bill 20 (Ordinance 1005); seconded by Mrs Worth, carried 8-0 Item 4. Motion re Crown Hill addition Motion by Mrs Behm that the Councils' recommendation is to withdraw the Crown Hill property as a possible site for a recreation center and communicate our policy to the County and the City of Lakewood, seconded by Mrs Fields Mr Solano will vote no until public comment is taken on this subject Mr Siler will also vote no because we shouldn't close any options until Jefferson County holds their public hearings on this Motion carried 6-2 with Mr Siler and Mr Solano voting no ORDINANCES ON FIRST READING Item 5. Council Bill 24 - An ordinance repealing and reenacting Chapter 7 of the Wheat Ridge Code of Laws regarding elections and requirements for candidates Council Bill 24 was introduced on first reading; title read by the Clerk CITY COUNCIL MEETING July 24, 1995 Page -5- Motion by Mr Edwards that Council Bill 24 be approved on first reading, ordered published, public hearing be set for Monday, August 14, 1995 at 7 00 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect upon passage, seconded by Mrs Fields Jerry DiTullio, as a member of the Wheat Ridge Election Committee, thanked all the members of the committee for their input and work on this, he feels this is a fair Ordinance and asked that Council approve this Mrs Worth suggested several grammatical and typographical corrections and asked that under Section 7~24, paragraph (3) be stricken Mr Edwards amended his motion to include Mrs Worth' suggestions and that paragraph (3) be stricken and the subsequent paragraphs be renumbered This was accepted by second Motion carried 8-0 Item 8. A Resolution 1478 - A Resolution to set a hearing on a petition for annexation B Resolution 1479 ~ A Resolution to set a hearing on a petition for annexation Resolutions 1478 and 1479 were introduced by Mr Siler; title read by the Clerk Mr Middaugh explained that Items 5 6 7 8 were all related and that it would not be necessary to make a separate presentation for all of them Resolutions 1478 and 1479 recognize that a petition for annexation is before Council These Resolution set a public hearing date for discussion of the annexation It does not commit Council to annexation, but starts the discussion on the public process Staff is preparing an analysis on the impact of this proposed annexation, which will be provided by the date of the public hearing The ordinances on first reading will begin the process of approving the annexation, if in fact, those ordinances were passed on second reading The last item is an ordinance that establishes land use for the new parcel, this ordinance is quasi-judicial Mr Gidley gave brief presentation as to the location of the parcel, the site is approximately 50 acres; west of I-70, north of 44th Avenue, south of Highway 58; it extends almost to Eldridge Street and is in unincorporated Jefferson County He showed aerial photographs of the area CITY COUNCIL MEETING July 24, 1995 Page -6- If the Resolutions pass, there will be public notices four weeks in a row prior to public hearing, City Clerk is required to publish in the Sentinel four times the matter to be set for public hearing, there is also a specific requirement for notice to Jefferson County and other parties If these Resolutions pass, that process will begin Mr Dahl went over Section 31-12-107 C R S , which explains the process of annexation Motion by Mrs Dalbec to deny the petition because there is no address for the applicant and it does not comply with Sections 31-12-104 and 105 C R S , seconded by Mrs Worth Mr Siler will vote no on the denial because this petition is substantially in compliance; we should go on with this process and listen to public comment Mr Middaugh stated that we do have an address that was submitted by the petitioners Mrs Dalbec and Mrs Worth withdrew their motion Jerry DiTullio requested that Council not approve the petition for annexation, does not approve of the planned apartments and doesn't like that the developers met with some Councilmembers privately Doris Ibbison encouraged Council to proceed with proper hearing and then make the decision George Langdon asked that Council accept the petition and set a public hearing; let's not get boxed in like Lakeside and Glendale, but look toward the future, economical development is critical for our tax base and to keep our property values Alan Bright would like to see this go to a public hearing, wonders how the future of Wheat Ridge will be helped by 750 apartments, residential development does not pay its own way; traffic in this area would be horrendous Ron Zeph, representing Carmel Companies, asked that this be opened up for public hearing so that Carmel Companies can present their plans, he feels that a lot of people in Wheat Ridge will be for this, he invited the people of Wheat Ridge to visit any of their other developments to see the type of quality they do Motion by Mr Siler for the adoption of Resolutions 1478 and 1479 which find that the petitions for annexation of a 25 7 acre parcel and a 28 5 acre parcel are in substantial compliance with State Laws, and which set two public hearings for August 28, 1995 for the purpose of determining whether the proposed annexations comply with Colorado Revised Statutes 31-12-104 and 105, as well as City annexation policies, and to determine if said annexations are in the best interest of the City of Wheat Ridge, seconded by Mrs Behm; carried 7- 1 with Mr Solano voting no CITY COUNCIL MEETING July 24, 1995 Page -7- Item 6. A Council Bill 21 - An Ordinance approvlng the Annexation of certain territory to the City of Wheat Ridge, Colorado B Council Bill 22 - An Ordinance approving the Annexation of certain territory to the City of Wheat Ridge, Colorado Motion by Mrs Worth to postpone Item 6 A August 28 public hearings on the annexation Edwards, carried 7-1 with Mr Solano voting and 6 B petition; no until after the seconded by Mr Item 7. Council Bill 23 - An Ordinance providing for the approval of rezoning from Mineral Conservation (Jefferson County) to Planned Residential Development District on land located at 13500 West 44th Avenue, City of Wheat Ridge, County of Jefferson, State of Colorado (Case No WZ-95-11) (Carmel Companies, Inc for Golden Properties, Ltd ) Motion by Mrs Worth to postpone Item 7 until after the August 28 public hearings on the annexation petition, seconded by Mr Edwards, carried 7-1 with Mr Solano voting no DECISIONS, RESOLUTIONS, AND MOTIONS Item 9. Travel Policy for Elected Officials Motion by Mrs Worth that the travel policy which was enacted for Administrative staff be adopted, as amended, to serve as a travel policy for elected officials and that it be applicable to the recent CML Conference held in June and that the food allowance be increased to up to $50 00 per day; to delete the personal vehicle section; seconded by Mrs Fields; carried 7-1 with Mr Solano voting no Item 10. Motion to appoint Robert Jobin to the Arborist Board from District IV Motion by Mrs Dalbec to appoint Robert Jobin to the Arborist Board to represent District IV; seconded by Mr Edwards; carried 8-0 CITY COUNCIL MEETING July 24, 1995 Page -8- Item 11. CONSENT AGENDA A Authorize Wheat Ridge Carnation Festival to use public right-of-way for the posting of signs and banners B Approve expenditure of funds for boiler repair at Municipal Building C Approve fleet replacements for 1996 D Approve fleet replacements for 1995 E Approve purchase of office furniture for Court Clerk F Approve payment of $6,056 to Jefferson Economic Council G Accept deed for right-of-way purposes Motion by Mr Edwards to approve the Consent Agenda as printed; seconded by Mr Solano; carried 8-0 CITY ADMINISTRATOR'S MATTERS Item 12. C D B G Request for Summit Center Motion by Mr Edwards that we not continue our relationship with Summit Center at this point and that we look at funding for Martensen Elementary playground and bring the information to a meeting as soon as possible; seconded by Mr Edwards; carried 8-0 CITY ATTORNEY'S MATTERS Jerry Dahl asked for Executive Session under Section Charter to advise Council on some pending litigation moved, seconded by Mr Solano; carried 8-0 5 7 of the Mr Edwards so ELECTED OFFICIALS MATTERS Tony Solano thanked Council for their indulgence during his business trips to Atlanta and stated he would be out of town again from August 5 through August 17; he will be available by telephone hook-up Teri Dalbec wants to start and wants in Wheat Ridge great success a public process regarding recreation needs Clear Creek Celebration of the Arts was a CITY COUNCIL MEETING July 24, 1995 Page -9- Claudia Worth is gOlng to walk for La Leehe League and is looking for sponsors, complimented Animal Control Commission on their brochure to watch for wildlife, Clear Creek Celebration for the Arts was a great success Vance Edwards expressed his sympathy on the death of Phyllis Lancaster to her husband Don Lancaster and his family Motion by Mr Solano to adjourn after Executive Session; seconded by Mr Siler; carried 8-0 EXECUTIVE SESSION WAS HELD.
