The Regular City Council was called to order by Mayor
Wilde at 7 00 P m Councilmembers present: Rae Jean
Behm, Teri Dalbec, Don Eafanti, Vance Edwards, Jean Fields, Ken Siler, Tony Solano, and
Claudia Worth Also present: City Clerk, Wanda Sang, City Treasurer, Jim Malone, City
Administrator, Robert Middaugh, City Attorney, Gerald Dahl, Parliamentarian, Mary Bahde,
staff; and interested citizens
APPROVAL OF MINUTES of September 25,1995
Motion by Mr Eafanti for approval of the Minutes of September 25, 1995, seconded by Mrs
Fields, carried 8-0
CITIZENS' RIGHTS TO SPEAK
Louise Giardino was present because it is Columbus Day; she recited the oath of
citizenship she took as a young woman, we should all be grateful to live in the U Sand
Colorado especially
Jay Rasplicka read a public statement from the Planning Commission which addressed an
article recently published in the Golden Transcript, which quoted Mr Vance Edwards in
regards to his views of the Wheat Ridge Planning Commission and their position relative to
the impending ballot issue relating to Street Width Designation.
Dan Ladd, District Manager for Wheat Ridge Fire Protection District, invited everybody to
celebrate an Open House on October 14, 1995 at 3880 Upham Street; they are going to
celebrate Fire Prevention Week.
Motion by Mrs Behm to add a new Item 2 to the Agenda to approve a Banner for Fire
Prevention Week; seconded by Mrs Worth, carried 8-0

Bill Peterson addressed the candidates forum held in the City of Wheat Ridge, at which
various candidates did not speak in favor of the mail-in ballot; he totally disagrees with that;
several of his neighbors have told him how happy they are that ballots are being mailed to
them, they enjoy the privilege to take as much time as they like to choose their favorites and
to discuss this with each other He can't understand why anybody running for office would
want a light turnout; he compared the low turnout in Denver, who held a polling place
election, to the high turnout in Jefferson County, who held a mail ballot election
Lisa Rosson, President for Neighbors of a Safer Community, disagreed that the Planning
Commission is not a political group, she encouraged people to vote for the proposed Charter
Amendment after they read it; Neighbors for a Safer Community will provide copies for
anybody who is interested
Ron Selstad is just amazed that at every election City staff, employee organizations, and
now City commissions and most noticeably under this administration, are becoming more
and more involved in politics and actions against political enemies, this is inappropriate and
should be stopped, it should never have been allowed to start. Two weeks ago Mr Wodell
apparently had no time limits imposed as he directed comments against mayoral candidate
Mr Edwards. Were Mr Wodell's comments his own or someone elses? He also addressed
the letter in the Jefferson Sentinel signed by Mrs Wardle, Mrs Middaugh and Mrs. Gidley
He is still bothered about Karen Thiessen being sued by WRAP
Elise Brougham spoke regarding Mr Edward's statement to fire certain City employees if he
is elected, she agrees with his position having worked with Mr Middaugh, Glen Gidley and
Gary Wardle Mr Middaugh lacks professionalism in her opinion, he allowed staff to be
gagged regarding their expertise professional opinion regarding the width of 38th Avenue, he
allowed Vance Edwards to be barred from City Hall, many citizens have become disgusted
with Glen Gidley's interpretation of City zoning laws, Mr Gidley should not present the
applicant's case for them, which he has done for years, it is not unusual when a new
administration takes office, new faces are hired who agree with ethics and philosophy of that
new person.
Karen Thiessen felt that Mr Wodell's statements at the last Council meeting were a careful
set-up between him and Mr Middaugh, she recently attended a CAP meeting and almost fell
out of her chair when somebody complimented the Mayor for 38th Avenue improvements,
don't people realize that 38th Avenue is there in spite of this administration not because of it;
she stated that several members of the Planning Commission are part of WRAP, who is
suing her for speaking up at the Council Meetings, why are people so afraid of the proposed
Charter Amendment?

Motion by Mr Solano to move Item 4 to Item 2 , seconded by Mr Edwards, carried 8-0
LOCAL LIQUOR AUTHORITY MATTERS
Item 1.
Application for a new Tavern Liquor License from DBN, Inc , dba "Pink Cadillac
Saloon", 12100 West 44th Avenue, Wheat Ridge, Colorado
(1-mile radius only)
City Clerk, Wanda Sang, presented the staff report.
Motion by Mr Edwards to set a 1-mile radius and order a survey to establish the needs and
desires of the neighborhood. I further move to set the public hearing date for November 27,
1995 and order the property posted and the public hearing published in the Jefferson
Sentinel, seconded by Mr Siler; carried 8-0
Item 2.
Resolution 1489 - authorizing submittal of a Grant Application and Agreement
for Performance of a Community Development Block Grant Activity to the
Jefferson County Board of Commissioners and requesting approval thereof
Resolution 1489 was introduced by Mr Solano
Mary Kay DeBruyn, representing Jefferson High School, was present and requested $1,200
for a program aimed at "At Risk Youth Intervention Activities" and specifically graffiti
prevention She introduced several students who spoke in favor of this program
Motion by Mr Solano for approval of Resolution 1489; that we initially contact the CDBG
Office, and if the money is not approved, the City pay this out of our General Fund,
seconded by Mr Edwards, carried 8-0
Item 3.
Approval of Banner for Fire Prevention Week.
Motion by Mrs Behm that we allow the Wheat Ridge Fire Department to hang their banner
announcing their Open House on 38th Avenue, seconded by Mr Solano, carried 8-0

ORDINANCES ON FIRST READING
Item 4.
Council Bill 26 - An Ordinance establishing the salary for the elected positions
of Mayor, Members of Council, City Clerk, and City Treasurer, of the City of
Wheat Ridge, during the term of office commencing November 13, 1995,
repealing Ordinance 942, Series of 1993, and remaining in full force and effect
until amended pursuant to Section 3 12 of the Home Rule Charter of the City of
Wheat Ridge
Motion by Mrs Behm that Council Bill 26 be approved on first reading, ordered published,
public hearing be set for Monday, October 23, 1995, at 7'00 p m in City Council Chambers,
Municipal Building, and if approved on second reading, take effect November 13, 1995,
seconded by Mr Eafanti, carried 6-2 with Mr Siler and Mr Edwards voting no
Item 5.
Council Bill 27 - An Ordinance amending the Code of Laws concerning
Disorderly Premises.
Council Bill 27 was introduced on first reading by Mr Solano, who also read the title
Motion by Mr Solano that Council Bill 27 be approved on first reading, ordered published,
public hearing be set for Monday, November 27, 1995 at 700 pm. in City Council
Chambers, Municipal Building, and if approved on second reading, take effect 15 days after
final publication, seconded by Mr Siler; carried 5-3 with Councilmembers Dalbec, Fields, and
Worth voting no
DECISIONS. RESOLUTIONS. AND MOTIONS
Item 6.
Board and Commission Appointments
Motion by Mr Edwards to appoint Norman Clark to the Civil Service Commission from
District IV, seconded by Mrs. Worth, carried 5-3 with Councilmembers Solano, Behm, and
Eafanti voting no
Motion by Mr Siler to appoint Dr. Darrel Norgren to the Animal Control Commission from
District I, seconded by Mr Solano, carried 8-0

Motion by Mr Siler to appoint Pat Garritv to the Election Commission, term to expire 1995,
seconded by Mr Solano
Kim Stewart, 11700 W 46th Avenue, was present to express her interest to serve on the
Election Commission, she has served on boards and commissions in Pueblo in the past; she
would make a commitment, if appointed, to serve to the best of her ability
Mr Siler spoke on behalf of Pat Garrity, by stating that she had lived in Wheat Ridge
approximately 16 years, is a Real Estate Agent, very active in the Chamber of Commerce
and the community
Mrs Worth stated she has known Pat Garrity several years, but Mrs Garrity also serves on
the Governmental Affairs Committee for the Jeffco Realtors, and she did interview the
candidates, or she interviewed me I know, and I'm not sure that, that isn't a conflict of
interest if she is on the Election Commission So I would recommend that she apply for
another commission You can't interview candidates and then supervise an election Some-
how that just doesn't set right.
Mrs. Worth made a substitute motion to appoint Kim Stewart; seconded by Mr Edwards,
failed 4-4 with Councilmembers Dalbec, Worth, Fields and Edwards voting yes
Motion by Mr Siler to appoint Pat Garrity to the Election Commission, seconded by Mr
Eafanti, failed 4-4 with Councilmembers Solano, Eafanti, Behm, and Siler voting yes Mayor
Wilde broke the tie by voting yes Motion carried 5-4
Item 7.

A. Approval of codification expenditure
B Acceptance of right-of-way at 4480 Independence Street.
C Resolution 1490 - amending Intergovernmental Agreement to include the
addition of the City of Golden to become a member of the Table Mountain
Animal Center
Motion by Mr Siler for approval of the Consent Agenda, seconded by Mr Solano Mrs
Dalbec asked that Item C be pulled and voted on separately Motion on A. and B carried 8-
o
Motion by Mrs Dalbec that this be brought before the Animal Control Commission and then
be brought back to Council, seconded by Mrs Worth, carried 8-0

CITY ADMINISTRATOR'S MATTERS
Robert Middaugh distributed Police Department Customer Service Report.
ELECTED OFFICIALS MATTERS
Claudia Worth informed everybody of a concert at the Community Center on October 29
Ken Siler asked that the administration contact a bus company that is parking in the Perkins
parking lot and the cars are parking on Vance Street; neighbors are complaining Residents
should call Code Enforcement if somebody is parking illegally
Dan Wilde stated that the Community Center was very successful in raising funds with their
Italian dinner
Jean Fields asked for job description for boards and commissions, who controls them? Mr
Middaugh replied that they are responsible to and directed by City Council Mrs Fields
suggested we review these job descriptions
Teri Dalbec asked about the Arvada report for Red Rocks, Mr Middaugh stated it is not yet
available as far as he knows
Tony Solano stated he had complaints from residents about transients at Apel-Bacher Park;
wondered if some of the trees and shrubs could be removed there Motion by Mr Solano to
cancel the November 6 Study Session and not to schedule anything for October 30,
seconded by Mr Siler; carried 7-1 with Mr Edwards voting no
Motion by Mrs Behm to hold a budget study session after a short break; seconded by Mrs.
Dalbec, carried 8-0
Motion by Mr Solano to adjourn, seconded by Mrs Behm, carried 8-0
Meeting adjourned at 8 45 p m
