STUDY SESSION MINUTES
CITY OF WHEAT RIDGE, COLORADO
7500 W. 29th A venue, Municipal Building
NOVEMBER 20. 1995
The Study Session Meeting was called to order by Mayor
Wilde at 700 pm Councilmembers present: Teri Dalbec, Jerry DiTullio, Don Eafanti, Jean
Fields, Janelle Shaver, Ken Siler, Tony Solano, and Claudia Worth Also present: City
Clerk, Wanda Sang; City Administrator, Robert Middaugh, City Attorney, Gerald Dahl
Item 1.
Discussion of Council Rules
Rule 5.5 Public Hearings. Consensus was 5 in favor that the applicant's presentation come
first; then a brief statement by the staff Consensus was 6 in favor to leave the last sentence
as it is "Time limitations may be imposed upon applicants and opponents" Consensus was
8 in favor to leave out the words there may be Questions bv council of applicant,
opposition, or staff, subiect to Section 2.4 so that the sentence now read: The hearing is
then closed and motion is then in order
Consensus was 5 in favor to change Rule 5.6 Time of Adjournment to read
The City Council shall adjourn a regular meeting upon completion of the entire agenda or at
11 00 pm, whichever occurs first, provided, however, that in the event the entire agenda is
not completed at 11'00 pm, the Council shall either complete action on the agenda item
then under discussion or act pursuant to Rule 91 to suspend the rules to permit completion
of additional agenda items Prior to adjournment, the Council shall act to schedule any
unfinished agenda items for a future meeting in compliance with Chapter V of the Charter, or
to adjourn the meeting to a later date and time certain The meeting may continue later than
11 00 P m for this purpose.
Mrs. Worth asked that Elected Officials' Matters be added to the Study Sessions. Rather
than adding this as a Council Rule, Mayor Wilde will ask if there are any Elected Officials'
Matters at the end of the Study Sessions No consensus was taken on this
Consensus was 8 in favor to have water on the dais and to use a larger coffee pot.
Rule 2.8 Parliamentarian - Consensus was 8 in favor that the first sentence read: "The
Council President shall also function as the Council Parliamentarian" (It will be brought back
at a later meeting that the Council President attend a class for parliamentarians)

Rule 11 Robert's Rules of Order - Consensus was 8 in favor to add the wording "Council
Rules of Order and Procedure take precedence over Robert's Rules of Order
Consensus was 5 in favor to change Rule 3.1 Regular Meetings to hold a Study Session on
the first Monday of each month The third Monday be a floater, to either not hold a meeting,
hold a Study Session, or hold a regular continued meeting.
Item 2.
Discussion of Council Policies.
Consensus was 8 in favor to discuss this at the next Study Session
Item 3.
Update on Petition for Annexation
Consensus was 5 in favor that we tell Carmel properties that we are not interested in the
annexation at this time.
Item 4.
Executive Session under Section 5 7(b)(1 )(A) of the Charter
Motion by Mr Solano to hold Executive Session, seconded by Mr Eafanti; carried 8-0
EXECUTIVE SESSION WAS HELD.
Consensus was 6 in favor that Ken Siler continue to represent the City of Wheat Ridge at
DRCOG for another 2 years.
Consensus was 8 in favor to adjourn the Study Session and convene the Special Meeting.
Study Session adjourned at 11 30 P m

SPECIAL CITY COUNCIL MEETING
CITY OF WHEAT RIDGE, COLORADO

11 30 P.M.
The City Council Special meeting was called to order by Mayor Dan Wilde at 11 30
pm under Section 5.2(a) of the City Charter Councilmembers present: Teri Dalbec
Jerry DiTullio, Donald R. Eafanti, Jean Fields, Janelle Shaver, Ken Siler, Tony
Solano and Claudia Worth Also present: City Clerk, Wanda Sang; City
Administrator, Robert Middaugh, City Attorney, Gerald Dahl, and City Treasurer,
James Malone.
The purpose of the Special Meeting was to vote upon a stipulation for dismissal in the
lawsuit between the City of Wheat Ridge and Dwaine R Richter dba 70 West
Business Center
Motion by Mr Siler that the Stipulation for Settlement and Dismissal in Civil Action
Case No 94 CV 1586, in the District Court, Jefferson County, State of Colorado,
Dwaine R Richter, dba 70 West Business Center, Plaintiff vs. City of Wheat Ridge,
a municipal corporation of the State of Colorado, City Council of the City of Wheat
Ridge, the governing body of the City of Wheat Ridge, Dan Wilde, in his official
capacity as the Mayor of the City of Wheat Ridge, Vance Edwards, Jean D Fields,
Donald R Eafanti, Rae Jean Behm, Ken Siler, Tony Solano, Dennis Hall and Claudia
Worth, in their official capacities as members of the City Council of the City of Wheat
Ridge, Defendants, be approved; seconded by Mrs Dalbec, carried 7-1 with Mr
Solano voting No
Motion by Mr Siler for adjournment; seconded by Mr DiTullio, carried 8-0
Meeting adjourned at 11 40 pm
