EMERGENCY
CITY COUNCIL MEETING
CITY OF WHEAT RIDGE, COLORADO
NOVEMBER 28, 1995
6:00 P.M.
The Emergency City Council Meeting was called to order by Mayor Dan Wilde at 6:00
pm under Section 5.2(b) of the Home Rule Charter Councilmembers present: Teri
Dalbec, Jerry DiTullio, Donald Eafanti, Janelle Shaver, Ken Siler; Tony Solano, and
Jean Fields and Claudia Worth were hooked up electronically from Phoenix, Arizona
Also Present: Wanda Sang, City Clerk; Robert Middaugh, City Administrator; and
Gerald Dahl, City Attorney
The purpose of calling an emergency meeting was for Council to discuss the
resolution lowering the threshold of expenditure of funds by staff to $80000 without
Council approval. The nature of the emergency is that the City must consider
immediate revision or postponement of the resolution in order to conduct day to day
business and financial obligations of the City
Mayor Wilde stated that the resolution as it is presently written will not allow the City
to write any kind of expenditure disbursement check over $800 00 without exclusive
City Council approval. The resolution refers to all expenditures.
Mr Dahl, City Attorney, stated that under City Charter Section 5.2 Special meetings, a
vote shall be taken at the beginning of the meeting as to whether there is in fact an
emergency and the vote of each member of the council shall be individually recorded.
Mrs. Worth stated that they were not notified properly according to the Charter in
writing The FAX sent to the motel was not received. She found out by accident that
there was a special meeting and that an Emergency Meeting was called. It is not an
emergency, and she will vote No
Mrs. Sang, City Clerk, polled Councilmembers present recording the following vote.
Councilmember Dalbec -- No
Councilmember DiTullio -- Yes
Councilmember Eafanti -- Yes
Councilmember Fields -- No
Councilmember Shaver -- No
Councilmember Siler -- Yes
Councilmember Solano -- Yes
Councilmember Worth -- No
Tie vote of four (Yes) and four (No) recorded Mayor Wilde broke the tie by voting
(Yes) Vote of 5-4

Motion by Mr DiTullio to amend Resolution No 909 by changing the amount of
expenditure of funds that must come to the City Council for a majority vote before
such funds may be spent be reduced from $250000 to $1500 00 Motion died for a
lack of a second.
Motion by Mrs Fields to rescind Resolution No. 1497 and reestablish Resolution No
909, paragraph 10 the amount of $2500 00 be changed to $1,00000; seconded Mrs
Worth
Mr Solano asked that the two issues stated in the motion be voted on separately
He stated that Resolution 909 has been in existence since 1984, and the City has
operated under that policy for ten years, and there have been no problems with the
policy
Motion by Mrs Dalbec to amend the original motion and add to paragraph 10 wording
"price quotations and bids" Amendment accepted by original motion maker and
second.
Mr Siler recommended that this policy be brought to a study session and be
thoroughly discussed by old and new councilmembers. By the Council changing the
policy the City doesn't have the ability to pay its bills which is a travesty and is hurting
the City
Mr Middaugh recommended that Council please consider this policy at a study
session because the original policy has been in existence for a very long time and
there have been no problems
Mrs Fields and Mrs. Worth accepted and requested that the motion be divided and
each issue be voted on separately
Mayor Wilde called for a vote on rescinding Resolution No 1497 Vote 8-0, motion
carried.
Mayor Wilde called for a vote on the revisions to Resolution No 909, paragraph 10
changing the amount of $250000 to $1,00000 and adding the wording "price
quotations and bids" Vote 5-3 with Mr Eafanti, Mrs. Solano and Mr Siler voting No ,
motion carried.

Motion by Mr Siler to adjourn, seconded by Mr Solano; carried 8-0
Meeting adjourned at 6.45 pm
