The Regular City Council was called to order by Mayor Wilde at 7 00
P m Councilmembers present Teri Dalbec, Jerry DiTullio, Don
Eafanti, Jean Fields, Janelle Shaver, Ken Siler, Tony Solano, and
Claudia Worth Also present City Clerk, Wanda Sang; City Treasurer,
Jim Malone; City Manager, Robert Middaugh, City Attorney, Gerald
Dahl, Director of Parks & Recreation, Gary Wardle, Director of
Planning, Glen Gidley; Director of Public Works, Bob Goebel; staff,
and interested citizens
APPROVAL OF MINUTES OF April 28, 1997
Motion by Mr Eafanti for the approval of the Minutes of April 28,
1997; seconded by Mrs Worth; carried 8-0
Mayor Wilde read a letter from the Fraternal Order of Police into the
~ record, which requests that the flag at City Hall be flown at half-
staff on May 15, which is Peace Officer Memorial Day, and that the
citizens of Wheat Ridge show their support for law enforcement by
flying a blue ribbon from their cars during National Police Week, May
12 - 17,1997
Mayor Wilde recognized Stevens Elementary School First Place in the
Odyssey of the Mind Contest They will be on their way to Maryland to
compete on the national level
Motion by Mrs Fields to add an Item to the Agenda for discussion and
possible action on parking problems in Wheat Ridge located at 7100 and
7190 West 38th Avenue, as Agenda Item 6 A, seconded by Mr DiTullio,
carried 8-0
Motion by Mrs Dalbec to add an Item to the Agenda, an amendment to
Resolution 1578, which is the Resolution for Boards and Commissions
appointments, and also an appointment that would be allowed if the
Resolution passes This would be Item 6 B, seconded by Mrs Shaver,
carried 6-2 with Mr Siler and Mr DiTullio voting no

Motion by Mrs Dalbec to add discussion on Light Rail that CDOT wants
to do in the area; that this be Item 8 A, seconded by Mrs Worth;
carried 6-2 with Mr Siler and Mr DiTullio voting no

ORDINANCES ON FIRST READING
Item 1.
Council Bill 15 - An Ordinance amending Section 26-31,
concerning off-street parking requirements
Council Bill 15 was introduced on first reading by Mrs Shaver;
read by the Clerk

Motion by Mrs Shaver that Council Bill 15 be approved on first
reading, ordered published, public hearing be set for Monday, June 9,
1997 at 7 00 P m in City Council Chambers, Municipal Building, and if
approved on second reading, take effect 15 days after final
publication; seconded by Mrs Worth; carried 8-0

Item 2.
Consider funding for the Stevens Elementary School Odyssey
of the Mind team
Motion by Mrs Fields that $4,000 be appropriated from the General
Fund fund balance and transferred to Acct No l02-780, to pay a
portion of the expenses of the Stevens Elementary Odyssey of the Mind
team for travel to the World Finals at the University of Maryland from
June 2 through June 8, and that the City's budget be amended
accordingly, seconded by Mr DiTullio, carried 8-0

Findings for Case No WA-96-26 - Medved Autoplex Master Sign
Plan Variance
Motion by Mrs Worth to approve the findings as prepared by the City
Attorney for Case No WA-96-26 Medved Autoplex Master Sign Plan
Variance; seconded by Mr DiTullio,
carried 8-0

Motion by Mrs Fields to direct the City Manager to begin parking
enforcement and towing when needed in the alley and municipal parking
lot located at 7100-7190 West 38th Avenue; seconded by Mr DiTullio;
carried 6-2 with Mrs Shaver and Mrs Dalbec voting no

Motion by Mrs Dalbec to make changes to Resolution 1578, Section 8 ,
seconded by Mrs Worth
Motion by Mr Solano for an amendment to rescind Resolution 1578
entirely; seconded by Mr Siler; carried 5-3 with Councilmembers
Fields, DiTullio, and Eafanti voting no
Motion by Mrs Dalbec to appoint Karin Heine to the Parks and
Recreation Commission and request that she resign from the Animal
Control Commission, seconded by Mrs Worth, carried 7-1 with Mrs
Fields voting no
Item 7.
Resolution 1598 - establishing the Pride of Wheat Ridge
Award
Resolution 1598 was introduced by Mrs Fields, title and summary read
by the Clerk
Motion by Mrs Fields that Resolution 1598 be approved; seconded by
Mr DiTullio
Mr DiTullio moved for an amendment that and Mayor be added after
everywhere it says City Council; seconded by Mr Solano
Mrs Worth asked for a friendly amendment that we add a criteria e
that staff will develop a means of communication to let us know so
that we don't argue in public whether or not somebody should receive
an award This was accepted Amendment carried 8-0
Original Motion as amended carried 8-0
Item 8. A.
Mrs Dalbec explained that this Item was added to the Agenda as a
result of a meeting that she and the Mayor attended with the Colorado
Department of Highways

Item 4.
Bid Award for West 32nd Avenue Reconstruction Project (RFB
#97-06)
Motion by Mr DiTullio that the West 32nd Avenue Reconstruction
Project (RFB #97-06) be awarded to Wycon Construction Company in the
amount of their bid of $1,344 269 00 I further move that a 2%
incentive bonus in the amount of $26,885 00 be established I further
move that a contingency account in the amount of $134,427 00 be
established I further move that the Director of Public Works be
authorized to issue change orders up to the total contract and
contingency amount and that the total cost of this project of
$1,505,581 00 be charged to the Capital Improvement Fund Account No
30-303-845 I further move that the funds be encumbered for the
length of the project which expressly allows the expenditure of funds
in 1998 for this project in accordance with Ordinance 787, 1989
Series; seconded by Mrs Fields
Motion by Mr Siler to add the verbiage that the difference between
the budgeted amount and the bid amount be placed into the Wheat Ridge
Recreation Center fund and that money be used for the proposed
Recreation Center and in the event the Recreation Center is not built,
that this money be returned to the Capital Fund; seconded by Mrs
Dalbec; carried 7-1 with Mr Solano voting no Mr Solano does not
believe we should allocate funds for a Recreation Center that mayor
may not happen and hasn't yet been approved by the voters

Item 5.
City Hall entry way discussion
Motion by Mr DiTullio to postpone this Item to the Study Session on
June 16, 1997; seconded by Mr Solano, carried 6-2 with Mrs Worth and
Mrs Dalbec voting no
Item 6.
Discussion of possible code changes relating to Boards and
Commissions
Motion by Mrs
some changes to
seconded by Mrs
Worth that the City Attorney be directed to bring in
the Boards and Commissions Rules and Regulations,
Shaver; carried 8-0
Item 6. A.
Mrs Fields explained that she had complaints about parking on 38th
Avenue, specifically at 7100-7190 West 38th Avenue She drove over
there and there were 2 trucks parked in the alley behind the 7100-7190
West 38th Avenue properties She could not pass and had to back out
of the alley, where somebody else was coming up behind her and also
had to back out

It was concerning a request by Mr Ruble of CDOT, who has been working
for 2 years to try to put together a sample light rail run in the
Denver area and it is a request that the cities in the Metro Area join
to fund the trial run of two different light rail options, one of them
is the Regio Sprinter and the other would be the Metrolink The Regio
Sprinter would be following the Goldline Commuter Rail; the Metrolink
would run on regular rail line, but they would eventually change that
so it could run faster They are hoping the Regio Sprinter would be
running early in September and it would coincide with the Rockies Game
and the Cities would probably get a share of the tickets
Motion by Mrs Dalbec to indicate to CDOT that there is interest for
this project in the City of Wheat Ridge and that we offer some support
not to exceed $6,000 00 for this sample run of the light rail,
seconded by Mr Solano; carried 7-1 with Mrs Fields voting no
Item 8.
Executive Session under Section 5 7 (b) 1 2 and 3 of the
Charter
Motion by Mr Solano that after Elected Officials Matters we go into
Executive Session under Section 5 7 (b) 1 2 and 3 of the Charter,
seconded by Mrs Shaver; carried 8-0
CITY ATTORNEY'S MATTERS
....
Mr Dahl informed Council that he had found a typo under the Medved
findings and asked that Council reconsider this Item to allow changes
to be made
Motion by Mrs Worth to reconsider Item 3; seconded by Mrs Dalbec;
carried 8-0
Motion by Mrs Worth to approve the findings as prepared by the City
Attorney for Case No WA-96-26 Medved Autoplex Master Sign Plan
Variance with the correction on Page 3, Section 11 a the first
additional be deleted; seconded by Mr Siler, carried 8-0
ELECTED OFFICIALS MATTERS
The upcoming joint session with Council and the Planning Commission on
May 15, 1997 was discussed
