The Regular City Council was called to order by Mayor Wilde at 7 00 P m Councilmembers
present: Teri Dalbec, Jerry DiTullio, Don Eafanti, Jean Fields, Janelle Shaver, Ken Siler
Tony Solano, and Claudia Worth Also present: City Clerk, Wanda Sang, City Treasurer,
Jim Malone, City Manager, Robert Middaugh, City Attorney, Gerald Dahl, Director of Parks
& Recreation, Gary Wardle, Director of Public Works, Bob Goebel, staff; and interested

APPROVAL OF MINUTES OF July 28,1997
Motion by Mr Eafanti for the approval of the Minutes of July 28, 1997, seconded by Mr
Solano Motion by Mrs Dalbec to include all the Councilrnembers' comments on Item 9;
seconded by Mrs Worth, failed 3-5 with Councilmembers Shaver, Dalbec, and Worth voting
yes Motion carried 6-2 with Mrs Worth and Mrs Dalbec voting no
CITIZENS' RIGHT TO SPEAK
Irving Roach, 4411 Balsam Street, presented petitions 3 or 4 years ago asking that 44th
Avenue be striped to 3 lanes, this has never happened He complained about the speeding
on 44th Avenue and people running red lights
Kate Brannan, 2918 Benton Street, commended Council for putting staggered terms on the
ballot.
Motion by Mr Siler to place an Item 4 A. on the Agenda. Council Bill 39 on first reading
regarding the Pacifica project; seconded by Mr Solano, carried 8-0

Item 1.
Council Bill 25 - An Ordinance amending the Municipal Theft Charge by
increasing the amount taken up to $500 00; repealing all other ordinances in
conflict therewith
Council Bill 25 was introduced on second reading by Mr Solano, title read by the Clerk;
Ordinance No 1086 assigned
Motion by Mr Solano for approval of Council Bill 25 (Ordinance 1086), seconded by Mr
Eafanti, carried 8-0
Item 2.
Council Bill 23 - An Ordinance providing for the approval of rezoning from
Residential- Two to Planned Commercial Development and for approval of an
outline development plan on land located at 3470 Wadsworth Blvd., City of
Wheat Ridge, County of Jefferson, State of Colorado
(Case No WZ-97-8)
Council Bill 23 was introduced on second reading by Mr DiTullio, title and summary read by
the Clerk; Ordinance No 1085 assigned
Patrick Nook, of Nook & Company, architects and planners representing applicant Ronald
Luke, was sworn in by the Mayor and gave brief description of their proposed beauty supply
business This will not be open to the public, only to licensed cosmetologists The entire
frontage of the property will be improved with curb, gutter, sidewalk and landscaping
Jeff Dellen, was sworn in by the Mayor; he is the project manager; explained the
drainage/detention pond and answered Council's questions.
Meredith Reckert, Planner, was sworn in by the Mayor and presented the staff report.
Ron Luke, applicant, was sworn in by the Mayor' he explained that quite a few of his
products are for resale and don't get taxed, he expects 50-60 customers per day; he will be
open from 8'00 a.m to 5'00 p.m
Motion by DiTullio that Council Bill 23 (Ordinance 1085), a request for approval of rezoning
from Residential-Two to Planned Commercial Development and for approval of an outline
development plan on property located at 3470 Wadsworth Blvd. be approved for the following
reasons

1 There are changed conditions in the area which have rendered the property
undevelopable under the existing zoning.
2. This is a commercial zoning which will have minimal impact on the adjacent residential
neighborhood due to use limitations and design parameters on the outline plan
3 Staff and Planning Commission recommend approval
With the following condition. The statement of allowed use be amended to limit use of the
property to this specific proposal, seconded by Mr Solano
Mrs Dalbec stated for the record that she will support this but she is objecting that we have
to require a 25ft right-of-way on Wadsworth, every time we put in a business, we acquire 25
more feet; we have not talked about adding another lane, we have talked about deceleration
lane She also wants something adding regarding lighting so that the neighborhood is taken
into consideration and on the impact of the construction of the deceleration lane along
Wadsworth and keeping traffic out of 35th Avenue
Motion by Mrs Shaver for an amendment to the motion that lighting on the east side be
directed downward, seconded by Mrs Dalbec, failed 5-3 with Councilmembers Shaver,
Worth, and Dalbec voting yes
Original Motion carried 8-0
Motion by Mr DiTullio that the request for approval of a Planned Commercial Development
final development plan for property located at 3470 Wadsworth Blvd be approved for the
following reasons 1 All minimum commercial development standards have been met or
exceeded 2 The proposed building and use is compatible with surrounding uses 3 Staff
and Planning Commission recommend approval With the following condition Drainage and
street plans must be approved by City staff before permits are issued, seconded by Mrs.
Dalbec, carried 8-0
Motion by Mr DiTullio that the request for approval of a consolidation plat for property
located at 3470 Wadsworth Blvd. be approved for the following reasons 1 A plat is part of
the submittal requirements for a Planned Commercial Development final development plan
approval process 2 The plat is required to consolidate two parcels into one parcel 3 All
requirements of the Subdivision Regulations have been met. 4 Staff and Planning
Commission recommend approval, seconded by Mr Solano, carried 8-0

Mr Siler asked that these Items be split out and discussed and voted on separately

Harold Urton has concerns about the density regulations in the multi-family zoning districts,
he is a property owner of six units in Wheat Ridge and has worked very hard to put these
together to have a retirement income, his biggest concern is that if a portion of the property
is destroyed, with this new zoning regulation, you wouldn't be able to rebuild This will also
affect the resale values
Carl Cerveny is concerned over the density requirements, he requested that Council give
notification to any property owner that could be affected; he asked that people that are going
to be grandfathered in be given a permanent exemption in case something happens and they
have to rebuild
Richard Durling spoke in support of the changes recommended by the Comprehensive Plan
Review Committee, disagreed with some of the things the previous speakers said; has a
hard time believing that people didn't know this was going on, he read about it in several
papers, Wheat Ridge does not need more density
Catherine Dunlap stated that the Comprehensive Plan has been developed with the help of
Wheat Ridge residents during several neighborhood meetings, citizens are concerned about
protecting the character of their neighborhoods during redevelopment; increasing the
landscaping and also reducing density; the Comprehensive Plan that has been developed by
the Committee addresses all of these concerns and provides a realistic and equitable
guideline for future development of Wheat Ridge Most of the Ordinances have been
approved by the Planning Commission and she urged Council to approve these Ordinances
and put Wheat Ridge on the right track for the future
Helen Hurlburt asked how the 14 two-unit buildings she lives in will be affected, could they
rebuild exactly how they are in case of a fire?
Jerry Roach also feels that property owners who could be affected by this should be notified
individually; he owns a multi-family building and a vacant lot; questioned how these
ordinances will affect his properties
Nancy Snow, Chairperson of the Comprehensive Plan Committee and she is also on the
Planning Commission, explained that they had four district meetings and one city-wide
meeting and heard over and over again things about density; people are upset because
many of the apartments in this City are too dense, there is no landscaping, no place to play,
no place for seniors to walk; the whole point the law is being changed, is that people in the
future will be conforming; if people don't have to meet new requirements, what is the point?

Lee Wedgwood wondered if Council realized how many duplex owners this will affect;
people have not heard about this meeting, he highly recommended that the owners of multi-
unit properties be given proper notice
Ron Patera, a member of the Comprehensive Plan Review Committee, stated that this is
good, solid legislation, a lot of input was taken in neighborhood meetings, asked that Council
look at this objectively, review it carefully, and pass it as it is
Motion by Mr Siler that Mr Dahl research the City Code to determine if it is necessary to
have a new Ordinance to address single residences on R-2 and R-3 property and allow them
to be rebuilt to their present configuration as an option in case they are destroyed, seconded
by Mr Solano, carried 7-1 with Mrs Worth voting no
Mr Dahl referred to the new version of the Ordinances he had supplied to Council, which is
the version the Planning Commission has recommended. He stated that there are revisions
that will apply to most of the Council Bills. Planning Commission has recommended the
addition of the paragraph Whereas, the citizens of Wheat Ridge have articulated their desire
for reduced residential densities in neighborhood meetings; and in the next to last Whereas,
said recommendations include recommendations on two essential components of residential
density Mrs Dalbec suggested that in the new regulation the words minimum land area be
used. Mr Dahl then addressed the recommended changes to all the Council Bills. They
included the new square footage as recommended by Planning Commission He also
recommended that the language "mandated by the Wheat Ridge Home Rule Charter" be
stricken Planning Commission did not feel that Council Bills 35 and 36 were necessary
Motion by Mrs Dalbec to delay Council Bill 29 until the Comprehensive Plan Committee has
had an opportunity to present to the rest of the community the recommendations they are
making for the whole Comprehensive Plan and its outlook on the City and have more town
meetings and public comment on all other types of design recommendations that they are
going to bring forward for the whole community; seconded by Mr Siler; failed 2-6 with
Councilmembers Dalbec and Siler voting yes
Council Bill 29 An Ordinance amending Section 26 25(IV)(B)(1) of the Wheat Ridge
Code of Laws concerning site development requirements for Planned Residential
Developments
Motion by Mr DiTullio that Council Bill 29 be approved on first reading, ordered published,
public hearing be set for Monday, September 8, 1997 at 7'00 pm in City Council
Chambers, Municipal Building, and if approved on second reading, take effect 15 days after
final publication; seconded by Mr Solano, carried 6-2 with Councilmembers Siler and Dalbec
voting no

Mr Siler voted no because there has not been enough public comment on this entire
process, the Planning Commission has not had enough time to go through this in any detail
Mrs Dalbec voted no because we have enough on our plate with the density regulations and
we don't need this one right now
Council Bill 32 An Ordinance concerning residential density limitations upon two
family dwelling units in the R 2 District
Motion by Mr DiTullio that Council Bill 32 be approved on first reading, ordered published,
public hearing be set for Monday, September 8, 1997 at 7 00 P m in City Council
Chambers, Municipal Building, and if approved on second reading, take effect 15 days after
final publication I further move that all changes that Mr Dahl has presented tonight be
incorporated in the Council Bill*, seconded by Mrs Dalbec; carried 8-0
*Mr Dahl stated that there are two groups of amendments One group is take out the units
per acre and the whereas, which for ease of communion could be amendment group 1,
amendment group 2 is affecting Section 26-7 of the Code, which says if it burns down or is
otherwise destroyed 10 to 50% it has to be rebuilt in full compliance He suggested that on
each of the ordinances a section be added that reads exactly the same which cross
references over to that Section and says but that Section doesn't apply under the following
circumstances. The wording should be as follows The requirements of Section 26-7(0)(2)
shall not apply to require compliance with minimum lot area and/or minimum land area per
unit requirements otherwise applicable to the reconstruction of (insert appropriate dwelling
and district), where such structures and their reconstruction meet all of the following
requirements. (1) the structure was legally in existence on September 8. 1997, (2) the
structure is located on a lot which does not meet the then-applicable minimum lot area
and/or minimum land area per unit requirements for such proposed reconstruction, and (3)
such reconstruction is restricted to replacement of the structure which has been destroyed.
This exemption shall not apply to. (1) new construction where no replacement of a
preexistinq structure takes place, (2) redevelopment of a property where reconstruction of a
structure is only part of such redevelopment, or (3) reconstruction of structures which were
not legally in existence on September 8, 1997 (as distinquished from leqal nonconforming
structures).

Motion by Mr DiTullio that Council Bill 33 be approved on first reading, ordered published,
public hearing be set for Monday, September 8, 1997 at 7 00 P m in City Council
Chambers, Municipal Building, and if approved on second reading, take effect 15 days after
final publication. I further move that amendment one and amendment two be incorporated in
the Council Bill*, seconded by Mrs Dalbec

Motion by Mr DiTullio that Council Bill 34 be approved on first reading, ordered published,
public hearing be set for Monday, September 8, 1997 at 7'00 p m in City Council
Chambers, Municipal Building, and if approved on second reading, take effect 15 days after
final publication. I further move that amendment one be incorporated in the Council Bill*
seconded by Mrs Shaver
Motion by Mr Solano that amendment two be incorporated in the Council Bill*, seconded by
Mr Siler; tied 4-4 with Councilmembers Siler, Eafanti Solano and Dalbec voting yes Mayor

Motion by Mr DiTullio that Council Bill 37 be approved on first reading, ordered published,
public hearing be set for Monday, September 8, 1997 at 700 p.m in City Council Chambers
Municipal Building, and if approved on second reading take effect 15 days after final
publication I further move that amendment one be incorporated in the Council Bill*,
seconded by Mrs Fields, carried 7-1 with Mr Siler voting no

Motion by Mr Solano to reconsider Council Bill 37 because it did not include amendment
two, seconded by Mr Siler; failed 3-5 with Councilmembers Siler, Solano, and Eafanti voting
yes. Mr Solano stated for the record that he did not want to vote in favor of Council Bill 37
without amendment two He only voted yes because he got confused with the Council Bills
being introduced in a different order than presented in the packet.

Item 4. A. Council Bill 39 - An Ordinance providing for the approval of rezoning from
Commercial-One to Planned Industrial Development District and for approval of
an Outline Development Plan on land located at 9500 West 49th Avenue, City
of Wheat Ridge, County of Jefferson, State of Colorado
(Case No WZ-97-10) (Pacifica Holding Company LLC)
Council Bill was introduced on first reading by Mrs Dalbec; title read by the Clerk.
Motion by Mrs Dalbec that Council Bill 39 be approved on first reading, ordered published,
public hearing be set for Monday, September 8, 1997 at 7 00 p.m in City Council
Chambers, Municipal Building, and if approved on second reading, take effect 15 days after
final publication, seconded by Mr Solano, carried 8-0
DECISIONS. RESOLUTIONS. AND MOTIONS
Item 4.
Teen Center Roof Repair Project (RFB #97-26)
Larry Merkl, one of the bidders for the roof repair, was present and answered questions
Motion by Mr Solano that the Teen Center roof repair project be awarded to Larry Merkl
Coatings & Lubricants in the amount of their bid of $18,100 I further move that $6,000 be
transferred from Accl. No 01-602-809 (Other Major Equipment) to Accl. No 01-602-812
(Building Improvements) I further move that $4,000 be transferred from Accl. No 01-602-
774 (Facility Repair and Maintenance) to Accl. No 01-602-812 (Building Improvements) I
further move that $8,100 be transferred from General Fund Balance to Accl. No 01-602-812
(Building Improvements) I further move that the funds be encumbered for the length of the
Project which expressly allows the expenditure of funds in 1998 for this Project in accordance
with Ordinance #787, 1989 Series, seconded by Mrs Dalbec; carried 8-0
Item 5.
1997 Local Streets Improvement Program (RFB #97-27), title read by the Clerk.
Motion by Mr DiTullio that the 1997 Local Streets Program (West 34th Avenue
Reconstruction and Drainage Improvements), (RFB #97-27) be awarded to Pate Construction
in the amount of their bid of $304,08640 Mr DiTullio further moved that a 2% incentive
bonus in the amount of $6,082 00 be established and a contingency account in the amount
of $30,409 00 be established and that $32,89000 be transferred from the Preventative Street
Maintenance, account number 30-303-884 to the Capital Improvement Fund Account Number
30-303-840 for the West 34th Avenue, Webster to Teller project;

Mr DiTullio further moved that the Director of Public Works be authorized to issue change
orders up to the total contract and contingency amount and that the total cost of this project
of $340,577 40 be charged to the Capital Improvement Fund account number 30-303-840
and that the funds be encumbered for the length of the Project which expressly allows the
expenditure of funds in 1998 for this Project in accordance with Ordinance #787 1989
Series, seconded by Mrs Fields carried 8-0
Item 6.
Authorize selection of a facilitator to assist in large animal regulation discussion
within the community
Mr Middaugh explained the request and a discussion with Council followed
Motion by Mr Siler that the City Manager be authorized to engage a professional facilitator to
host up to three community meetings on the subject of large animal regulations to provide
assistance to the Animal Control and Planning Commissions in their consideration of this
item, and that $1,000 be appropriated from the General Fund balance and transferred to
account 106-750 for the facilitator's expenses, and that the budget be amended accordingly;
seconded by Mrs Fields, failed 2-6 with Mr Siler and Mrs Fields voting yes
Item 7.
Approval of Expenditure Items
Motion by Mrs. Worth that the attached purchases be approved in the amounts indicated and
that all costs be charged to the account shown on the purchase order report; seconded by
Mr Solano, carried 7-0 (Mrs Shaver left Council Chamber briefly because she wasn't feeling
well)

Application for development of an in-line skating rink in conjunction with the
skateboard park at Anderson Park.
Resolution 1617 - in support of the Great Outdoor Colorado Grant Application
for development of educational kiosks along the Wheat Ridge Greenbelt.
B. Resolution 1611 - authorizing the Mayor and City Clerk to sign the Joint Use
and Development Agreement with Jefferson County R-1 Schools for the
development of playground improvements at Prospect Valley Elementary
School

Mrs. Worth introduced the Consent Agenda. Mr Siler pulled Item 8 D and Mr DiTullio
pulled Item 8 B
A. Resolution 1616- Amend amount of grant from $25,000 to $70, 000
Motion by Mrs Worth for approval of Resolution 1616 (as amended) and
Resolution 1617, seconded by Mr Solano, carried 8-0
8 Motion by Mr Solano for approval of Resolution 1611, seconded by Mr Siler;
carried 6-2 with Mr DiTullio and Mrs. Fields voting no
C Motion by Mrs Worth that the 1997 Local Streets Program (Vivian St., West 29th Place
and West 30th Place Reconstruction), (RFB #97-28) be awarded to Western Mobile-Denver
in the amount of their bid of $260, 99400 Mrs Worth further moved that a 2% incentive
bonus in the amount of $5,220 00 be established and that a contingency account in the
amount of $26,099 00 be established and that the Director of Public Works be authorized to
issue change orders up to the total contract and contingency amount and that the total cost
of this project of $292,313 00 be charged to the Capital Improvement Fund account number
30-303-840, and that the funds be encumbered for the length of the Project which expressly
allows the expenditure of funds in 1998 for this Project in accordance with Ordinance #787
1989 Series, seconded by Mr Solano, carried 8-0
D Motion by Mr Siler that the notice and call of election for the four adopted and referred
charter amendments be approved as submitted by the City Attorney; seconded by Mr
Solano, carried 6-2 with Mrs Fields and Mrs Dalbec voting no
CITY MANAGER'S MATTERS
Mr Middaugh requested meetings be scheduled on August 27, 1997 and September 4, 1997
for Transportation Plan and Civil Democracy
Motion by Mr Solano that the Civil Democracy meeting be held after the election, seconded
by Mr DiTullio, carried 7-1 with Mr Siler voting no

concerned about the big open pit and that kids might fall in it; there should be some safety

precautions before somebody gets hurt; he asked that somebody talk to them
He asked if they put up a tent at the car dealership if that is legal (Mr Middaugh will look
into this)
Jean Fields asked Mr Middaugh when we can expect to hear something about the pride of
Wheat Ridge award (Mr Middaugh stated it would not happen in the immediate future, he
is buried under work and can't take this on right now) She questioned why citizens were
more informed of the interviewing process for the new Planning Director than she was, feels
this is a lack of communication.
Claudia Worth addressed the pet crematorium in District IV and the problems associated
with it; showed pictures to Council, has a problem with the retention pond at Stevens
Elementary; the pond is full of water, doesn't leech out; she asked Council's permission to
ask the school district to put a fence around this She asked about the modem in the City
Clerk's Office that will tie them into the County for voter information, Mrs Worth stated this
was important to be done before the election
Jerry DiTullio was informed by a member of the former LDR Task Force that a corral size
had been suggested, he wondered if this had somehow been lost during codification and
asked that we check back to find that out; there has been vandalism in Panorama Park;
asked that citizens call if they see anything, asked when basketball court at Stites Park will
be done, asked the last date to put something on the ballot.
Ken Siler also addressed the detention pond at Stevens Elementary; this has been going on
for 8 months, we have a mosquito problem out there, he has a follow-up meeting with the
principal, they want to have this pond for an ecological study, but if they that doesn't go
forward they have indicated that they will fill that pond in and make it just a drainage pond
Janelle Shaver asked for extra copies of the Countywide Transportation Plan and put them
in the lobby for people to look at; asked about the telephone line to the Teen Center
