Mayor Cerveny called the Regular City Council Meeting to order at 7:00 p m Councilmembers
present: Karen Berry, Jerry DiTullio, Dean Gokey, Lena Rotola, Wanda Sang, Larry Schulz,
and Mike Stites Councilor Karen Adams was absent. Also present: City Clerk, Pamela
Anderson, City Manager, Randy Young, City Attorney, Gerald Dahl; Director of Community
Development, Alan White, Director of Public Works, Tim Paranto, staff; and interested citizens
APPROVAL OF MINUTES OF May 24. 2004
Motion by Mr DiTullio for approval the Minutes of May 24, 2004; seconded by Mrs. Sang,
carried 6-0, with Mr. Schulz abstaining
CITIZENS' RIGHT TO SPEAK
Carissa Thyne, representing 4-H and the Jefferson County Fair, came to announce
the Jefferson County Fair on July 30th, July 31st, and August 1st at the Jefferson County
Fairgrounds She invited all to attend.
Ailis Thyne, a member of 4-H introduced 4-H as an organization that teaches life skills
and leadership, and the end results of some of their efforts will be on display at the fair
Taylor Hodge, a 4-H Livestock Council Representative, extended an invitation to attend
the Jeffco Junior Livestock Sale on July 31st at 5'00 p.m. People would have the
opportunity to purchase livestock raised by 4-H members.

Motion by Mr Stites to approve Council Bill 11-2004 (Ordinance 1325), Case No. WZ-
04-01, a request for rezoning from Residential-One to Planned Commercial
Development and approval of an Outline Development Plan for property located at
10135 West 381h Avenue, and shall take effect 15 days after final publication for the
following reasons. -
1 The change in zone will be in conformance with the City of Wheat Ridge
Comprehensive Plan goals, objectives and policies.
2 The proposed use is compatible with the surrounding area.
3 The change of zone will not adversely affect the public health, safety or welfare
With the following condition
1 A note shall be added to the Outline Development Plan that reads. "Tracts A & B
are non-buildable tracts, and may be used as pedestrian walking trails and Open
Space; seconded by Mrs. Sang, carried 7-0.
Final Development Plan
Motion by Mr. Stites to approve Case No. WZ-04-01, a request for approval of a Final
Development Plan for property located at 10135 W. 38th Avenue, for the following
reasons'
1. The requirements of the City's Planned Development Regulations have been
met.
2 The Final Development Plan meets the development standards set forth in the
approved Outline Development Plan for the site, seconded by Mr. DiTullio,
carried 7-0

Motion by Mr. Stites to approve Case No MS-04-02, a request for approval of a Final
Plat for property located at 10135 W. 38th Avenue, for the following reasons:
1. The requirements of the City's Subdivision regulations have been met.
2. All required utility easements are being provided, seconded by Mr DiTullio,
carried 7-0.
3. Adequate infrastructure will be constructed with the development to serve the
proposed use, seconded by Mr DiTullio; carried 7-0

Resolution 14-2004 was introduced by Mrs. Rotola
Motion by Mrs. Rotola to approve Resolution 14-2004, amending the fiscal year 2004
budget to reflect acceptance of the Bureau of Justice Assistance Bulletproof Vest Grant
and adding $8,022.16 into the Police Department Uniforms and Protective Clothing
Account #01-211-700-730; seconded by Mr Schulz; carried 7-0.

CITY A TIORNEY'S MATTERS
City Attorney Gerald Dahl referred to a memorandum he distributed regarding alcoholic
beverage tastings legislation from the state legislature. He asked for direction from
Council on whether they wish to have an ordinance brought forward.
Motion by Mr. DiTullio that the City Attorney draft an ordinance to come forth following
the state law regarding alcoholic beverage tastings; seconded by Mrs Rotola and Mrs.
Sang; carried 7-0.
Mr Dahl explained that CML has found a discrepancy between the dates that the Tabor
elections usually happen, which is the first Tuesday in November, and certain statutory
cities and Home Rule Charters that say the first Tuesday after the first Monday in
November in odd numbered years, which is true in Wheat Ridge. Most of the time that
is the same day. In 2005 and 2011 that date is not the same. If we don't change the
Charter, we will have to hold an election that is not coordinated with the County and will
take place 1 week after the County's election.
Motion by Mrs Sang to direct the City Attorney to draft an ordinance to change our
Charter regarding elections, seconded by Mrs. Rotola, carried 7-0
ELECTED OFFICIALS' MATTERS
Mayor Cerveny warned citizens of telephone scams; don't give out any personal
information unless you initiate the phone call
Mr. Gokey thanked the owner of Master Tech for his ingenuity in improving his
landscaping.
Mrs Sang thanked everybody for participating in their first Monday meetings and stated
that their next meeting will be in October
Mr Stites explained that Mrs. Adams has been out of town for a couple of weeks and if
somebody needs to talk to a Councilmember in that District right away, they should call
him The street dedication for Ed Pinson will be June 22 here at City Hall at 10.30 a m.
He thanked the staff, the City and the applicant tonight for working together on the
property and the trail
Mr Schulz stated that they had a terrific First Monday meeting and Districts III and IV
will also have their next meeting in October He was really impressed with the 4-H'ers
that came in tonight and encouraged everybody to support their sale.

Mrs Berry encouraged everybody to attend the 4-H event and stop by the Jefferson
Conservation District exhibit and say hi.
Mr. DiTullio thanked Randy Young, Joyce Manwaring and Pam Anderson for speaking
at the first Monday meeting.

EXECUTIVE SUMMARY:
The Wheat Ridge C& of Laws does not currently address all new proposed accesses to City streets.
The attached proposed ordinance provides for regulatlon of access to City streets when a proposed
access is not controlled by existing requirements in Chapter 26 of the Code of Laws. The ordinance
also exempts single-family residences, as well as alterations and additions to existing commercially
used structures that will stimulate minor traffic impacts.

ST A TEMENT OF THE ISSUES:
A review of the Wheat Ridge Code of Laws revealed that, while there is dIrection concerning the
construction of street accesses, there may be instances in which there are no requirements for new
street accesses. The proposed ordinance should provide a mechanism to regulate those requests for
street access not currently regulated by the Code of Laws. As directed by City Council, the ordinance
exempts additional regulation of single-family homes and additions or alterations to commercial
property that do not increase projected traffic volumes by 20% of the current traffic into the property.

None.
FINANCIAL IMPACT:
Staff will administer an additional permit system. The financial impact should be minimal, as thcre
will be few requests for new street acccsses.

TITLE.
AN ORDINANCE ENACTING NEW ARTICLE IV OF
CHAPTER 21 OF THE CITY OF WHEAT RIDGE CODE OF
LAWS CONCERNING STREET ACCESS PERMITS
WHEREAS, the City Council of the City of Wheat Ridge has all power and
authority to enact ordinances for the preservation of the public health, safety and
welfare, and
WHEREAS, the City Council also has authority to provide for the laying
out, construction, and regulation of access to and use of public streets within the
City; and
WHEREAS, the City Council deems it necessary to provide procedures
and criteria for application of and design of access to public streets by
developments within the City and those located adjacent to the City which
propose to access and use City streets.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WHEAT RIDGE, COLORADO:
Section 1. A new article IV of Chapter 21 of the Wheat Ridge Code of Laws is
hereby enacted to read as follows'
ARTICLE IV. STREET ACCESS PERMITS
Sec. 21-110. Purpose.
The number, spacing, type and location of vehicular access have a direct
and often significant effect on the capacity, speed and safety of public streets
The director of public works is hereby authorized to regulate vehicular access to
or from any public street within the city to or from property adjoining such street
in order to protect the public health, safety, and welfare, to maintain smooth
traffic flow, to maintain right-of-way drainage, and to protect the functional level of
public streets For the purposes of this article, "street' shall include all public
rights of way within the city which are designed or used for travel by motor
vehicles.

Sec. 221-111. Scope.
This article applies to all developments within the city, as well as those on
property adjacent to the city which propose to rely, in whole or in part, on access
to and/or use of public streets within the city. The requirements of this article
must be satisfied prior to construction of access to or use of any street within the
city which is designed or used for travel by motor vehicles Notwithstanding the
foregoing, the following developments are not subject to the requirements of this
article:
a) Any new street access that is approved as part of any land use
application
b) Street access required for one (1) single-family residence dwelling or one
(1) two-family dwelling
c) Street access required for any new use where the increase in traffic does
not exceed 20% of the traffic generated by the previous use.
Sec. 21-112. Access permit required; procedure.
A permit for each proposed street access must be obtained from the director of
public works. Applications shall be submitted to the director on forms maintained
in the department of public works Applications shall contain, at a minimum
a) Name, address, telephone, telecopy and e-mail address of applicant(s)
b) Streets to which access is requested, including the location of each
proposed access point.
c) Proposed design of access point and connection, including all proposed
improvements, traffic control devices and turning movements.
d) Traffic impact report or study, if required by the director.

Sec. 21-113. Review criteria.
Approval, conditional approval or denial of a street access permit is within the
sole discretion of the public works director. The director shall consider the
following criteria is reaching a decision.
a) Access service to abutting land is subordinate to providing service to
through traffic movements
b) The proposed access creates a safety or operational problem to the street
or street system
c) Whenever possible, residential lots shall not front on arterials (Class 3) or
collectors (Class 4)
d) Access to a freeway, arterial or collector street shall occur only at
locations approved by the director of public works
e) The property has no other access to a public street.

f) The additional access will cause a hardship to an adjacent property or will
negatively impact the street system.
g) The proposed access is in conformance with the requirements or
standards of this Code.
Sec. 21-114. Appeals.
The applicant may appeal conditions of approval or a denial of a street access
permit by filing a written notice of appeal with the City Clerk, listing the reasons
therefor within ten (10) days of issuance of the approval or denial. The city
council shall conduct an administrative appeal hearing, upon ten days notice to
the applicant by telecopy or first class mail. At the hearing, the applicant and the
public works director may present evidence. The council's decision shall be
rendered within fifteen days after the conclusion of the hearing, shall be final and
subject to review in the district court pursuant to Rule 106, CRCP
Sec. 21-115. Requirements.
The requirements of this section are necessary to ensure that all City streets will
continue to function at the level present prior to construction of the new access
a) Any request for access may require the party requesting the access to
construct such improvements to the street system which will mitigate the
negative impact of the access on the capacity, speed or safety of the
street system.
b) A traffic study shall accompany all requests for access onto arterial and
collector streets unless waived by the public works director
Section 2. Safety Clause The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare
of the public and that this Ordinance is necessary for the preservation of health
and safety and for the protection of public convenience and welfare The City
Council further determines that the Ordinance bears a rational relation to the
proper legislative object sought to be attained
Section 3. Severability; ConflictinQ Ordinances Repealed If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses
shall not be affected thereby All other ordinances or parts of ordinances in
conflict with the provisions of this ordinance are hereby repealed
Section 4. Effective Date This Ordinance shall take effect fifteen days after
final publication, as provided by Section 5 11 of the Charter.

EXECUTIVE SUMMARY:
Section 21-3 of the Wheat Ridge Code of Laws provides that the establishment or a change ofa street
width will require a process which allows the adjacent properties the opportunity to revIew the plan
and offer input related to any impacts associated with the proposed street widths prior to City Council
approval of the new street width. The 2004 Major Street Improvement Project includes reconstructing
Carr Street, from 46th A venue to 1-70 South Frontage Road, as well as 46th A venue from Carr Street to
Estes Street. The new design of Carr Street will provide a more consistent street section, with
standard four-foot sidewalks. To remain within the streeet right-of-way, the pavement on Carr Street
will be reduced by approximately three feet. Two neighborhood meetings have been held to discuss
the project, and specIfically, the street width change. All notification requirements of the Wheat Ridge
Code of Laws have been met. The project is currently in the bidding process.

STATEMENT OF THE ISSUES:
The 2004 Capital Improvement Program budget includes the design of a street reconstruction project
in the Clearvale Subdivision, which is located between 46th A venue and 1-70 for Carr Street to Estes
Street. The budget also provides funding for the first of three anticipated phases of construction for
this project. To properly design the improvement of Carr Street to current sidewalk standards within
the av....:!able nght of way, changes will be required in the current street width. The entire Carr Street
segment, from Carr Street to the 1-70 South Frontage Road, is proposed to change from 34 feet in
width to 31 feet wide.
The street width designation process includes pubhc notification and a public hearing. Published
notices were enacted on June 3, 2004 The process allows property owners to review the proposed
plan and submit a protest petition if they choose to do so. The City Council will make the final
decision regarding the petition., if applicable.

FINANCIAL IMPACT:
The 2004 Major Street Improvement project is included in the approved 2004 CIP budget. Carr Street
Improvements are proposed in this year's project and are included In the budget amount of
$650,000.00. The current design requires a change of street width. If the new street widths are not
approved, the project must be redefined.
RECOMMENDED MOTION:
"I move that street widths be established for Carr Street, from 46th A venue to 1-70 South Frontage
Road to 27 feet as recommended by the Public Works Department."

Alcoholic Beverage Tastings: HB 1021 (2004)
The General Assembly has enacted HB 1021, effective July 1 The bill is
primarily known for lowering the level of legal intoxication from 0.10 to 0.08 BAC.
However, the bill also provides for "tastings" of alcohol beverages in licensed retail
liquor stores, by local option of the City. The purpose of this memorandum is to
describe what choices are available to you in making this decision.

Most important, unless the City adopts an ordinance allowing tastings, they may
not occur at all. The statute places certain limits on how tastings can be conducted
· Only on licensed premises by a licensee or licensee's employee that has
competed a server/seller training program approved by the Department of
Revenue
· Samples = 1 oz of wine/malt liquor or 0 5 oz of spirituous liquor; no more
than 4 samples to the same person.
· No more than 5 hours per day between 11 a.m. and 7 p.m. and no more
than any four of six days of the week, Monday - Saturday, not to exceed
104 days/year
If the City chooses to allow tastings, it may further restrict the number of
tastings per year per license, the days on which tastings may occur, and the
number of hours of tasting may last. Instead of setting up a general system, the
City may also choose to simply penn it tastings on a case-by-case basis.

If the City chooses to allow tastings, the statute makes clear that:
· Opt-in ordinance may further restrict statutory limits on number of tastings
per year per licensee, days on which tastings may occur, and the number
of hours a tasting may last.
· Local Licensing Authority may establish its own application procedure and
reasonable fee
· Local Licensing Authority can reject application if applicant cannot
establish ability to comply with the law or will create a public safety risk to
the neighborhood
· Licensee will accept full liability for violations of liquor code, regardless if
they occur by an "employee, agent, or otherwise; and "licensee shall be
subject to the same revocation, suspension, and enforcement provisions"
as would normally apply.

TITLE:
AN ORDINANCE PERMITTING ALCOHOL BEVERAGE
TASTINGS
WHEREAS, the Colorado General Assembly has enacted C RS 12-47-301(10),
permitting alcohol beverage tastings on the premises of a retail liquor store licensee or
liquor-licensed drugstore licensee by the adult patron of the licensee, by local option
only; and
WHEREAS, the City Council has authority pursuant to C RS. 12-47-301(10)(a)
to permit alcohol beverage tastings, and
WHEREAS, the Council has determined that alcohol beverage tastings may be
allowed within the City, subject to the limitations contained herein
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITYOF WHEAT RIDGE, COLORADO:
The Wheat Ridge Code of Laws is hereby amended by the addition of a
new section 11-56, to read
Sec. 11-56 Alcohol beverage tastings
(a) Subject to the limitations of this section, alcohol beverage tastings are permitted
within the City. For the purposes of this section "tastings" means the sampling of malt,
vinous, or spirituous liquors that may occur on the premises of a retail liquor store
licensee or liquor-licensed drugstore licensee by adult patrons of the licensee pursuant
to the provisions of this section and Section 12-47-301 (10), C.RS
(b) A retail liquor store or liquor-licensed drugstore licensee who wishes to conduct
tastings may submit an application or application renewal for that purpose to the Liquor
Licensing Authority The applicant for a tastings permit shall state on the application the
days and times that tastings will occur The applicant shall give at least 24 hours' prior
notice to the Police Department of any deviations in the tastings schedule as set forth in
the application. The Liquor Licensing Authority may reject the application if the
applicant fails to establish that he or she is able to conduct tastings without violating the
provisions of this section, Section 12-47-310(10), CRS, or creating a public safety risk to
the neighborhood. The :"'iquor Licensing Authority shall establish its own application
procedure and shall charge a reasonable application fee. The Liquor Licensing

Authority may delegate review and decision on the application to its clerk or
administrative official.
(c) Tastings shall be subject to the following limitations
1 Tastings shall be conducted only by a person who has completed a server
training program that meets the standards established by the liquor
enforcement division in the department of revenue and who is either a retail
liquor store licensee or a liquor-licensed drugstore licensee, or an employee
of a licensee, and only on a licensee's licensed premises.
2. The alcohol used in tastings shall be purchased through a licensed
wholesaler, licensed brewpub, or winery licensed pursuant to Section 12-47-
403 CRS
3. The size of an individual alcohol sample shall not exceed one ounce of malt
or vinous liquor or one-half ounce of spirituous liquor.
4 Tastings shall not exceed a total of five hours in duration per day, which need
not be consecutive
5.
Tastings shall be conducted only during the operating hours in which the
licensee on whose premises the tastings occur is permitted to sell alcoholic
beverages, and in no case earlier than 11 a.m. or later than 7 p.m.

6 The licensee shall prohibit patrons from leaving the licensed premises with an
unconsumed sample.
7. The licensee shall promptly remove all open and unconsumed alcohol
beverage samples form the licensed premises or shall destroy the samples
immediately following the completion of the tasting.
8 The licensee shall not serve a person who is under twenty-one years of age
or who is visibly intoxicated.
9. The licensee shall not serve more than four individual samples to a patron
during a tasting
10 Alcohol samples shall be in open containers and shall be provided to a patron
free of charge.
11 Tastings may occur on no more than four of the six days from a Monday to
the following Saturday, not to exceed one hundred four days per year

12. No manufacturer of spirituous or vinous liquors shall induce a licensee
through free goods or financial or in-kind assistance to favor the
manufacturer's products being sampled at a tasting. The licensee shall bear
the financial and all other responsibility for a tasting.
13 A violation of a limitation specified in this section, Section 12-47-301(10) CRS
or Section 12-47-801 (CRS) by a retail liquor store or liquor licensed drug
licensee, whether by his or her employees, agents, or otherwise, shall be the
responsibility of the retail liquor store or liquor-licensed drugstore licensee
who is conducting the tasting
14 A retail liquor store or liquor-licensed drugstore licensee conducting a tasting
shall be subject to the same revocation, suspension, and enforcement
provisions as otherwise apply to the licensee.
Section 1.Safety Clause. The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the City
of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public
and that this Ordinance is necessary for the preservation of health and safety and for
the protection of public convenience and welfare. The City Council further determines
that the Ordinance bears a rational relation to the proper legislative object sought to be
attained.
Section 2. Severability: Conflictina Ordinances Repealed If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses shall
not be affected thereby All other ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed
Section 3. Effective Date. This Ordinance shall take effect fifteen days after
final publication, as provided by Section 5 11 of the Charter.

I attach a May 11, 2004 memorandum from Geoff Wilson, General Counsel for the
Colorado Municipal League. The memo identifies a discrepancy between the TABOR
Amendment (Colo Const.Art X Sec. 20), regarding the required date for TABOR election (first
Tuesday in November in odd-numbered years) as compared to various municipal home rule
Charters, including the Wheat Ridge Charter, at S 2.2 (first Tuesday after the first Monday)
In 2005 and 2011, the TABOR date and the Charter date are one week apart. Because
Jefferson County will run the county-coordinated election on the TABOR date, Wheat Ridge
would have to run its separate municipal election one week later, in compliance with Sec. 2.2 of
the Charter To do this will involve extra expense, voter confusion, and, likely, a much smaller
voter turnout, assuming the City could even obtain voting machines from the County so soon
after the TABOR election.
I recommend that Council direct me to prepare and bring forward a charter amendment,
changing the regular municipal election date to the first Tuesday in November in odd-numbered
years The ballot question would make clear that the amendment is to schedule the City
election to coincide with the coordinated election conducted by the County The question would
be voted on at the November 2004 general election.
I will raise this issue during City Attorney's matters at the June 14 Council meeting

WHEREAS, Section 16 8(b) of the Charter permits the City Council to initiate
charter amendments, and
WHEREAS, the Council wishes to place before the voters at the November,
2004 general election a ballot measure to amend Charter Section 2.2 concerning the
scheduling of municipal elections.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, AS FOLLOWS:
Section 1. Pursuant to Charter Section 16 8(b), the following proposed
amendment to the Wheat Ridge Home Rule Charter is hereby submitted to the voters
of the City for their consideration at the general election to be held on November 2,
2004
Amend Section 2.2 of the Charter as follows:
Sec. 2.2 Municipal elections.
A general municipal election shall be held on the first
Tuesday after the first Monday in November of 1979, and
every two (2) years thereafter Any special municipal
election may be called by resolution or ordinance of the city
council at least sixty (60) days in advance of such election
The resolution or ordinance calling a special municipal
election shall set forth the purpose or purposes of such
election. Polling places for all municipal elections shall be
open from 7:00 a.m. to 7 00 p.m. on election day.
Section 2. Ballot Question. The ballot question for the proposed Charter

and that this Ordinance is necessary for the preservation of health and safety and for
the protection of public convenience and welfare. The City Council further determines
that the Ordinance bears a rational relation to the proper legislative object sought to be
attained.
Section 4 Severabilitv. If any clause, sentence, paragraph, or part of this
Ordinance or application thereof to any person or circumstances shall for any reason be
judged by a court of competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this Ordinance or its application to other persons
or circumstances.
Section 5 Effective Date. This Ordinance shall take effect fifteen days after final
publication, as provided by Section 5 11 of the Charter

EXECUTIVE SUMMARY:
A grant application was submitted to the Colorado State Parks Trails Program. Great Outdoors
Colorado (GOCO) funds the Colorado State Parks Trails Program. The Parks and Recreation
Department has received notice of a grant award in the amount of $44, 1 00 for the reconstruction of
Clear Creek Trail. As part of the GOCO process and the issuance of a contract a resolution from the
City of Wheat Ridge is required.
City Council awarded the contract for the Clear Creek trail reconstruction project on April 12, 2004
and Amendment #1 to the contract on Apn126, 2004. The project was completed in May of2004.
COMMISSIONIBOARD RECOMMENDATION:

STATEMENT OF THE ISSUES:
The funds awarded from this grant will be placed in the Open Space fund and will be used for the
expenses already incurred as part of the project as well as for the reseeding required along the sides of
the newly constructed trail. This reseeding will occur in the fall of2004.
ALTERNATIVES CONSIDERED:
Do not accept the grant award in the amount of $44, 100.
FINANCIAL IMPACT:
Grant funding in the amount of $44,100 will be added to the Open Space Fund account 32-520-00-
539.

Section 1. The City of Wheat RIdge hereby authonzes the Mayor and City Clerk to sign

SectIOn 14.2 of the Home Rule Charter ofthe City of Wheat Ridge proVides express authority to enter

Intergovernmental Agreement (IGA) between the City of Wheat Ridge and the City and County of
Denver was approved by City Council on March 22, 2004 for the Denver Area Urban Area Secunty
Imtiative. Authonzation for the Mayor and City Clerk to sign the IGA was also approved on March
22,2004 A Resolution is an admmlstratlve record reqUirement for approval of the IGA.
As the Council is aware, the CIty of Wheat RIdge has been very active in the development of the
Urban Area Secunty Initiative (UASl) SInce late summer of 2003.
The 2003 and 2004 grant budgets have been approved, and funding IS begmning to occur. The City of
Wheat RIdge has been approved to receive a SignIficant portIOn ofthe 2003 Grant A ward to be used to
replace the current emergency radio system used by the police and Wheat Ridge Fire Department.
That replacement program is underway at this time. A fimsh date is not known at thIS time. The total
award IS approxImately $1.5 mIlhon dollars for the commumcations replacement process in Wheat
Ridge
The IGA, as approved on March 22, 2004, provides m part for the following:
A. Allows for the Denver Urban Area to procure fundmg and assistance for developing enhanced
preparedness, mItigatIOn, response and recovery to/from terrorist related actIvIty and attacks
that use or threaten thp use of chemical, bIOlogical, radIOlOgical nuclear and explOSIve deVices.
B. Establishes a mechanism and structure for the Denver Urban Area to meet the federal
reqmrements necessary to develop plans, prionties, and budgets related to grant fund mg.
C. Defines the "urban area" for purposes of the grant.
D. Defines the roles and responsibllitles of participants including the level of partiCIpation by
each entity.
E. Sets the term ofthe agreement commencing on January 1, 2004 and termmatmg on December
31,2008.

ST A TEMENT OF THE ISSUES:
As explaIned in the March 22, 2004 Council Action Form, there are a few issues to be considered.
Overall participatIOn in this program is pOSItive and beneficial. However, the time commItment on the
part of representatives to UASI can be considerable and demanding. The City is committed to a four
year program, that could evolve into a program beyond the grant cycles for contmued and future
cooperative effort.

None.
FINANCIAL IMPACT:
The finanical Impact IS generally positIve. Some "in-kind" service costs are being absorbed by the
City, but most direct costs for thIS program are covered by the grant Itself.

Dear Ms_ Fryer;
On May 24th you attended the Wheat Ridge City Council meeting to voice your concerns over
..J enforcement of the City's sign code, specifically enforcement of the off premises sign provision.
You provided to Council a letter citing several sections of the code which you beheved would
offer you the opportunity for an off premises sign. This letter is written in response to your
letter.
While we appreciate the situation you have in attempting to rent your apartments on Holland
_--- -' Street, adding a section to the code to permit off premises signs IS not favored by a majority of
Council at this time, nor is staff supportive of such a change.
Section 26-709 C 1 and 2 do indeed allow signs in residential zone districts. This provision
allows the owner of an apartment building, for example, to put up a sign with the name of the
apartment building on it. This section does not contain a provision that allows these signs on
property other than that on which the building is situated. This section does not supersede the
prohibition of off premises signs contaIned in Section 26-707 D.
Section 26-709 K contains regulations for semipublic signs. A semipublic sign is defined as "a
sign giving information as to church, educational institutions or service club locations." A sign
advertising units for rent at your apartment building does not qualify as a semipublic sign. The
entirety of thiS section does not apply to your situation.
Lastly, Section 26-71 () sets out the requirements for a master sign plan. A master sign plan is
authOrIzed for planned developments or for business centers or office complexes with multiple
bUildIngs or uses. The intent IS to create a unified and integrated sign system for the center or
complex and is not intended for single buildings. This section does not apply to your apartment
building.
_' \ The CIty's sign code is not unique In prohibiting off premises signs; many other cities do not
~ allow them. The City has established this regulation in an effort to reduce the potential visual
clutter created by signs located on every corner. Locating off premises signs only with

landowner permission does not provide enough of a safeguard to prevent off premises signs from
getting out of hand.
- The current sign code does not contain any provisions allowing an off premises sign in your
situation, nor are there likely to be any amendments proposed to allow such signs.

ADP/SIS has given back to the community in many ways.
Pennington Elementary School
In 2001, a reading program was started with our neighborhood school, pennington
Elementary ADP/SIS employees visit classrooms twice a week during lunch hours to
volunteer with reading, writing or math tutorial sessions in grades K - 6 To date,
employees have contributed over 1,800 hours of time to this effort
Our company has also sponsored an essay contest at the school for three consecutive years.
In 2004, sixty 5th and 6th graders submitted essays on the topic \"What are Your Goals for
Success?" Gift certificates in various amounts from Walden Books & More were given to the
top essay winners in the classes that participated.
These efforts have made a solid impact on students attending the school. In the spring of
2004 their standardized test reading scores went up. We believe that student scores have
increased on standardized tests, in part because of the reading program and students'
motivation to do well with outside volunteers.
In a speech given by Colorado Congressman Bob Beauprez on 11/21/2003, the Pennington
Elementary School was cLnmended for their academic progress and changes that are fostering
excellence among staff and students.
ADP/SIS has also donated retired PCs from the company, office supplies and books, large

white boards, and holds a school supplies drive in August. ADP/SIS has applied for a grant
from the Jared pollis Foundation for 60 desktop PCs to be given to individual students
this coming fall. Students must apply for a PC and will earn the PC after completing a
training session on use The training is being provided by White Ridge High School
students and will be coordinated by staff from ADP/SIS.
Students and faculty alike have enthusiastically received the support and partnering from
our company, and our associates enjoy making these contributions.
United Way Drive
Employees participate in the ADP United Way Campaign that runs each fall Last year
payroll donations for the Wheat Ridge offices totaled $8,301.00. The United Way
organization brings together health and social service agencies, government, business,
schools and other leaders to help with such issues as homelessness, childcare,
strengthening families and increasing independence for our elderly neighbors.
Blood Drives
Every four months, Bonfils Bloodmobile is on site to take and receive blood donations from
employees About 30 - 40 pints of blood are usually donated at each session. Recently,
ADP/SIS extended the program to neighboring businesses who supported the event by allowing
their employees to take time from their workday and make this important contribution.
ADP/SIS has partnered with Bonfils for more than five years, with more frequent activity
in the past four years
Bright Beginnings Golf Tournament
This will be the eighth year that ADP/SIS has served as the major tournament sponsor for
this agency's annual fund raising event. To date, over a half million dollars has been
raised. Bright Beginnings is a local agency that promotes the healthy development of
Colorado children during the critical first three years of life. Over 10,000 newborns in
the state are served, and many services are offered to families and children beyond the
age of three.
Starlight Children's Foundation
ADP/SIS employees have donated their time to complete wiring for this agency's computer
systems and telephone systems. Various communication equipment and software has also been
donated to the agency. The Starlight Children's Foundation is a~ international non-profit
organization that provides services for seriously ill children and their families. Working
through more than 1,000 hospitals, they provide both in-hospital and outpatient programs
and services.
Jeffco Action Center Food Drive
We collect non-perishables food items to support local families and shelters during the
summer and fall seasons We have supported this program for five years.
Marine Corp Toys for Tots Program
We collect new toys during the holiday season to support the Marine Corp's program of toy
donation to underprivileged children in the metro area. We have supported this program for
five years, also.
Bike to Work Day
To contribute to our environment and stay physically fit, nearly 30 employees are
participating in the second year of the Bike to Work Day event. Employees will ride over
675 miles that day and ADP/SIS will host a breakfast for participants once they arrive!
