HomeMy WebLinkAbout12/22/1997 December 22, 1997 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO 7500 W 29th Avenue, Municipal Building The Regular City Council was called to order by Mayor Cerveny at 7 00 P m Councilmembers present Teri Dalbec, Jerry DiTullio, Lloyd Donnelly, Don Eafanti, Ralph Mancinelli, Janelle Shaver, and Claudia Worth Ken Siler was absent Also present City Clerk, Wanda Sang; City Treasurer, Ron Patera; City Manager, Robert Middaugh; City Attorney, Gerald Dahl; Director of Parks & Recreation, Gary Wardle; Director of Planning, Alan White, staff, and interested citizens APPROVAL OF MINUTES of December 8, 1997 Motion by Mr Eafanti for the approval of the Minutes of December 8, 1997; seconded by Mr DiTullio; carried 7-0 CITIZENS' RIGHTS TO SPEAK Odarka Figlus, 9775 West 36th Avenue, member of the Parks Commission, gave update on the progress of the Recreation Center Curtis Nye, 2901 Depew Street, asked that the City change their nOlse ordinance He was asked by the Police to turn off his Christmas mUSlC because it disturbed a neighbor The complaint has since been withdrawn and Mr Nye can play his music Motion by Mr DiTullio to review our noise ordinance and have staff come back with a recommendation sometime in February on changes if any, seconded by Mrs Worth; carried 7-0 Motion by Mrs Dalbec to add an Agenda Item 6 B An Ordinance on first reading regarding the Civil Service Commission, and to hold an Executive Session at the end of the meeting and adjourn thereafter, seconded by Mr Eafanti, carried 7-0 CITY COUNCIL MINU' ~ 1 December 22, 1997 Page -2- PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1. Council Bill 49 - An Ordinance amending Chapter 26 of the Code of Laws of the City of Wheat Ridge and providing a process for designating and protecting Historic Landmarks within the City Council Bill 49 was introduced on second reading by Mrs Worth, title read by the Clerk; Ordinance No 1102 assigned Motion by Mrs Worth for the approval of Council Bill 49 (Ordinance No 1102); seconded by Mr Eafanti, carried 7-0 Item 2. Council Bill 50 - An Ordinance amending Section 5-124 of the Code of Laws of the City of Wheat Ridge to provide additional grounds for suspension or revocation of contractor licenses Council Bill 50 was introduced by Councilmember Worth on second she also read the title; City Clerk assigned Ordinance No 1103 Motion by Mrs Worth for the approval of Council Bill 50 (Ordinance 1103); seconded by Mr Eafanti; carried 7-0 Item 3. Council Bill 51 - An Ordinance amending Chapter 22 of the Wheat Ridge Code of Laws, concerning Sales and Use Taxes Council Bill DiTullio; he Ordinance No 51 was introduced on second reading by Councilmember also read the title, City Clerk assigned 1104 Motion by Mr DiTullio for the approval of Council Bill 51 (Ordinance 1104) he further moved that it take effect upon passage; seconded by Mrs Shaver, carried 7-0 ORDINANCES ON FIRST READING Item 4. Council Bill 52 - An Ordinance concerning qualification for members of the Election Commission Council Bill 52 was introduced on first reading by Mrs Worth; title read by the Clerk CITY COUNCIL MINU' M ~ December 22, 1997 Page -3- Motion by Mrs Worth that Council Bill 52 be approved on first reading, ordered published, public hearing be set for Monday, January 12, 1998, at 7 00 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded by Mrs Dalbec, carried 7-0 Item 5, Council Bill 53 - An Ordinance vacating a portion of West 44th Place within the City of Wheat Ridge, County of Jefferson, State of Colorado, adjacent to 10911-17 West 44th Place (Case No WV-97-3) Council Bill 53 was introduced on first reading by Mrs Dalbec, title read by the Clerk Motion by Mrs Dalbec that Council Bill 53 be approved on first reading, ordered published, public hearing be set for Monday, January 26, 1998, at 7 00 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication; seconded by Mr Eafanti; carried 7-0 Item 6. Council Bill 54 - An Ordinance vacating a portion of Marshall Street (formerly Illinois Avenue), in the Berkeley Heights Second Filing, within the City of Wheat Ridge, County of Jefferson, State of Colorado (Case No WV-97-4) Council Bill 54 was introduced on first reading by Mr Mancinelli; he also read the title Motion by Mr Mancinelli that Council Bill 54 be approved on first reading, ordered published, public hearing be set for Monday, January 26, 1998, at 7 00 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded by Mr DiTullio; carried 7-0 Item 6. B. Council Bill 55 - An Ordinance amending Section 2-62(b) and Section 19-29~ of the Wheat Ridge Code of Laws, concerning the Civil Service Commission Council Bill 55 was introduced on first reading by Mr DiTullio; title read by the Clerk CITY COUNCIL MINU' S December 22, 1997 Page -4- Motion by Mr DiTullio that Council Bill 55 be approved on first reading, ordered published, public hearing be set for Monday, January 12, 1998, at 7 00 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded by Mrs Dalbec, carried 7-0 DECISIONS. RESOLUTIONS. AND MOTIONS Item 7. Appointment to Park and Recreation Commission from District I Mr DiTullio introduced Item 7 and asked the two applicants to speak Susan Seeds asked that she be appointed; giving time to the Community is important and a privilege to her; she believes in volunteering, has helped plant trees in Panorama Park, weeds flower beds, planted wildflowers in Greenbelt and helped with trash and brush pickup; helped with the Teen Center, put up Christmas decorations and served meals at the Community Center, etc Doris Ibbison asked that she be appointed, feels her past experience on City Council, EDARC, Senior and Community Center Advisory Committees, Richards-Hart Estate Committee, will help her in the future, is exited about the work to be done on the Recreation Center Motion by Mr DiTullio that Susan Seeds be appointed to the District I vacancy on the Parks and Recreation Commission, seconded by Mrs Shaver; carried 5-2 with Mr Eafanti and Mr Donnelly voting no Item 8. Resolution 1643 - requesting Colorado Department of Transportation support for an Interchange Improvement Project at Interstate 70 and Kipling Street Resolution 1643 was introduced by Mr DiTullio; Resolution read by the Clerk Motion by Mr DiTullio for the approval of Resolution 1643; seconded by Mr Eafanti; carried 7-0 CITY COUNCIL MINU" S December 22, 1997 Page -5- Item 9. Approval of Expenditure Items Motion by Mrs Dalbec that the attached purchases be approved in the amounts indicated and that all costs be charged to the account shown on the purchase order report; seconded by Mr Eafanti, carried 7-0 Item 10. ~NSENT AGENDAt A Chain Link Fence Improvements at Panorama & Randall Park Ballfields (RFB #97-40) B . Resolution 1644 - authorizing the Mayor and City Clerk to sign the "Jefferson County Open Space Certification Form Request for payment and certification of use of funds" requesting payment for construction of the Greenbelt Trail Relocation Project . Resolution 1644 - authorizing the Mayor and City Clerk to sign the "Jefferson County Open Space Certification Form Request for payment and certification of use of funds" requesting payment for construction of the soft surface trail in the conservation area south of Clear Creek C Playground Equipment, 37th & Upham Park (RFB #97-39) D Prospect Park Restroom Improvements (RFB #97-41) E Resolution 1646 - authorizing reimbursement from the City of Wheat Ridge's attributable share of the Jefferson County Open Space Fund for Parks and Open Space F Payment to Jefferson County School District for the Prospect Valley Play field Improvement Project, the Prospect Valley Playground and the Wilmore Davis Playground G Demolition of Buildings and Debris Removal (RFB #97-42) H Supplemental appropriation for legal publications I Automated Emergency Notification System (RFP #97-012) CITY COUNCIL MINU' S December 22, 1997 Page -6- J Resolution 1647 - authorizing reimbursement from the City of Wheat Ridge's attributable share of the Jefferson County Open Space Fund for Parks and Open Space Consent Agenda was introduced and read by Mrs Worth She asked to pull 10 C And 10 G Mrs Dalbec asked to pull 10 E And 10 J Motion by Mrs Worth for approval of the Consent Agenda with the exception of 10 C, G , E And J, seconded by Mr Eafanti; carried 7-0 Motion by Mrs Worth to approve C carried 7-0 seconded by Mr DiTullio; Motion by Mrs Dalbec to approve E And J , seconded by Mr Eafanti, carried 7-0 Motion by Mrs Worth to approve G , seconded by Mr Eafanti, carried 7-0 CITY MANAGER'S MATTERS Mr Middaugh briefed Council on a number of contracts that will come before them in the near future regarding the Recreation Center Consensus was 7 in favor to hold a joint meeting with the Parks Commission sometime in January ELECTED OFFICIALS MATTERS Don Eafanti thanked everybody who worked on the Christmas lights for the City Jerry DiTullio had more phone calls about the coyotes near the Davis property and asked the press to publish this to caution people Teri Dalbec asked that Susan Seeds be sworn in tomorrow in the Mayor's Office She has had complaints about fireworks at Everett every Sunday night CITY COUNCIL MINU' S December 22, 1997 Page -7- Motion by Mr DiTullio to hold Executive Session under Section 5 7(B) (1) of the Charter and to adjourn thereafter; seconded by Mrs Shaver; carried 7-0 EXECUTIVE SESSION WAS HELD Meeting adjourned at 9 15 P m I Wanda Sang, City Cl€rk APPROVED BY CITY COUNCIL ON JANUARY 12, 1998 BY A VOTE OF 7 TO o ~ -_"\J ('\-..{ '- ~'-- ..L-" Don Eafanti, eounGil President
